Our Responsibilities
LicensingWe regulate the following activities so that they do not endanger human health or harm the environment:• waste facilities (e.g. landfills, incinerators, waste transfer
stations);• large scale industrial activities (e.g. pharmaceutical, cement
manufacturing, power plants);• intensive agriculture (e.g. pigs, poultry);• the contained use and controlled release of Genetically
Modified Organisms (GMOs);• sources of ionising radiation (e.g. x-ray and radiotherapy
equipment, industrial sources);• large petrol storage facilities;• waste water discharges;• dumping at sea activities.
National Environmental Enforcement• Conducting an annual programme of audits and inspections of
EPA licensed facilities.• Overseeing local authorities’ environmental protection
responsibilities.• Supervising the supply of drinking water by public water
suppliers.• Working with local authorities and other agencies to tackle
environmental crime by co-ordinating a national enforcement network, targeting offenders and overseeing remediation.
• Enforcing Regulations such as Waste Electrical and Electronic Equipment (WEEE), Restriction of Hazardous Substances (RoHS) and substances that deplete the ozone layer.
• Prosecuting those who flout environmental law and damage the environment.
Water Management• Monitoring and reporting on the quality of rivers, lakes,
transitional and coastal waters of Ireland and groundwaters; measuring water levels and river flows.
• National coordination and oversight of the Water Framework Directive.
• Monitoring and reporting on Bathing Water Quality.
Monitoring, Analysing and Reporting on the Environment• Monitoring air quality and implementing the EU Clean Air for
Europe (CAFÉ) Directive.• Independent reporting to inform decision making by national
and local government (e.g. periodic reporting on the State of Ireland’s Environment and Indicator Reports).
Regulating Ireland’s Greenhouse Gas Emissions• Preparing Ireland’s greenhouse gas inventories and projections.• Implementing the Emissions Trading Directive, for over 100 of
the largest producers of carbon dioxide in Ireland.
Environmental Research and Development• Funding environmental research to identify pressures, inform
policy and provide solutions in the areas of climate, water and sustainability.
Strategic Environmental Assessment• Assessing the impact of proposed plans and programmes on the
Irish environment (e.g. major development plans).
Radiological Protection• Monitoring radiation levels, assessing exposure of people in
Ireland to ionising radiation.• Assisting in developing national plans for emergencies arising
from nuclear accidents.• Monitoring developments abroad relating to nuclear
installations and radiological safety.• Providing, or overseeing the provision of, specialist radiation
protection services.
Guidance, Accessible Information and Education• Providing advice and guidance to industry and the public on
environmental and radiological protection topics.• Providing timely and easily accessible environmental
information to encourage public participation in environmental decision-making (e.g. My Local Environment, Radon Maps).
• Advising Government on matters relating to radiological safety and emergency response.
• Developing a National Hazardous Waste Management Plan to prevent and manage hazardous waste.
Awareness Raising and Behavioural Change• Generating greater environmental awareness and influencing
positive behavioural change by supporting businesses, communities and householders to become more resource efficient.
• Promoting radon testing in homes and workplaces and encouraging remediation where necessary.

Key Findings of 2016 Domestic Waste Water Treatment (DWWT) Inspections*

1. Introduction
The aim of the National Inspection Plan is to protect human health and water from pollution
caused by domestic waste water treatment systems (DWWTS) (also known as septic tank
systems). This is done through inspections, education and awareness.

The National Inspection Plan 2015-2017 requires local authorities to undertake a minimum
of 1,000 national inspections of domestic waste water treatment systems (DWWTS) each
year. A greater proportion of inspections are required in areas with a higher contamination
risk, the focus being on risk to public health and protecting water resources. Local
authorities can do more inspections than required if they deem them necessary.
The EPA is responsible for the development of the National Inspection Plan and to co-
ordinate and report on the implementation of the plan. Further information on the National

This report covers the period from 1st January to 31st December 2016. Links to previous

2. Inspections
An inspection of a domestic waste water treatment system (DWWTS) is undertaken by the
local authority to determine whether it is fit for purpose and/or it poses a risk to human
health or the environment. If a septic tank system fails an inspection an advisory notice is
issued to the homeowner by the local authority. This specifies what is wrong and what
needs to be fixed.
2.1 Inspection findings
Forty-nine percent of septic tank systems failed inspection in 2016, 45% failed in 2015.
Operation and maintenance and the lack of desludging continue to be the main reasons that
septic tank systems fail.

2.2 Local authority inspections
In 2016 the local authorities exceeded the minimum number of target inspections (1,000)
required by the EPA; see Table 2.
Eighty-six percent of local authorities met or exceeded their minimum number of target
inspections.
• Wexford County Council exceeded their minimum target by 62 inspections.
• Mayo County Council exceeded theirs by 28 inspections. (Additional inspections
were required to address their 2015 inspection shortfall).
Some local authorities failed to undertake their minimum number of required inspections;
see Table 2.
• Sligo County Council had the highest shortfall as they failed to carry out any of their
allocated 26 inspections.

• Both Cavan and Longford County Councils addressed their 2016 shortfalls with
additional inspections in 2017.
• Donegal County Council made up their 2015 inspection shortfall in 2016.
Due to the size of their shortfall the EPA issued a direction to Sligo County Council to ensure
any shortfalls were addressed by the end of 2017. Warning letters were issued to other local
authorities who failed to reach their minimum target numbers.

2.3 Reasons for failures
The main reasons systems failed are shown in Figure 2. Most inspection failures (53%) were
due to operation and maintenance (nuisance odours, systems not fit for purpose) and
desludging issues. Desludging is a minimum maintenance requirement and is relatively
inexpensive to undertake. There is a grant scheme available to home owners, administered
by the Department of Housing, Planning and Local Government, for the upgrade of their
domestic waste water treatment systems but this does not cover maintenance or
desludging.
Twenty nine percent of sites failed due to risk to human health or the environment (noise,
odour, effects on water, soil, plants or animals). In terms of effects on human health and
water quality issues, unlicensed discharges, leakages and surface ponding are very important
and must be addressed by the homeowner.

2.4 Private wells
There are approximately 170,000 private drinking water wells in Ireland (Focus on Private
Water supplies; EPA). Private wells are susceptible to contamination especially from on-site
septic tank systems. In 2016, 27% (299) of all inspections were undertaken on sites with
private wells and 51% of these inspections failed. Figure 3 shows the percentage failures of
sites inspected. Desludging and operation and maintenance accounted for the majority of
failures.
It is important that homeowners are made aware, through engagement and education, that
proper septic tanks maintenance can significantly reduce potential harmful contamination
of their drinking water supply.

2.5 Group water schemes
Group water schemes are privately owned and managed drinking water supplies. In 2016
there were 865 group water schemes in Ireland. Group water schemes can be broken down
into;
• “Public” Group Water Schemes (PuGWS). These are schemes that usually take their
drinking water from the larger public water supplies but are managed by a local
community group.
• “Private” Group Water Schemes (PrGWS). Water is privately sourced, treated and
distributed to members of that scheme.
In 2016, 210 domestic waste water systems were inspected in areas that receive their
drinking water from group water schemes. Of those inspected 47% failed inspections. Figure
4 shows the breakdown of failures. Operational and maintenance and desludging again
accounted for the greatest number of failures (54%).

The EPA has provided grant funding to the National Federation of Group Water Schemes
(NFGWS) for the roll out of a pilot septic tank de-sludging awareness programme for houses
within group water scheme catchment areas. This project is due for completion shortly.

2.6 Site selection
The National Inspection Plan 2015-2017 specifies that sites should be selected for inspection
based on risk. The plan specifies eight risks categories, low to very high, for sites inside and
outside areas of special interest (ASI). Local authorities are required to undertake more
inspections in areas of special interest and high risk. This explains why some local authorities
have a higher number of inspections compared with others. Figure 5 compares actual risk
based inspections against the requirements of the National Inspection Plan. Risk based
inspections are broken down per county in Table A2 in the appendices.

At a national level Figure 5 shows that the number of inspections undertaken per risk zone
equates to the requirements of the National Inspection Plan. However, on a regional basis
some county councils failed to allocate their inspections appropriately across the different
risk zones, (see Appendix A, Table A2). Local authorities should continue to ensure that the
site selection criteria set out in the National Inspection Plan are adhered to.
The National Inspection Plan also states that priority should be given to unregistered sites.
In 2016 there were 251 site inspections undertaken on unregistered sites. This represents
23% of the total number of inspections, compared with 20% in 2015.

3. Enforcement
Advisory notices are issued by local authorities where failures are identified. Advisory notices
outline the measures to be taken by the homeowner.
3.1 Advisory notices
In 2016, 544 advisory notices were issued which is an 11.5% increase from 2015. Between 2013
and 2016 there were 1,748 advisory notices issued. As of September 2017, 473 of these notices
were still open, 451 are open beyond their remedial date. Summaries are shown in Tables 3 and
4.

The onus is on local authorities to allocate appropriate resources and to take appropriate
measures, such as continued engagement, re-inspections or prosecutions to ensure compliance
and that advisory notices are closed out as quickly as possible.
3.2 Prosecutions
The local authority can prosecute a homeowner if they fail to comply with an advisory notice.
From inspections undertaken 2016, there is currently, (September 2017), one pending prosecution
open against a homeowner, (see Appendix A, Table A.1).

4. Engagement strategy
4.1 Engagement
Operation, maintenance and desludging issues continue to be the main reasons for failures. In
most cases, homeowners can easily rectify these issues once they are made aware of how to solve
them. This highlights the importance and the need for continual effective and targeted
engagement and education.
The National Engagement Strategy Working Group developed a public engagement programme.
The working group comprises of;
• Representatives from six local authorities;
• The Health Service Executive (HSE);
• The Department of Housing, Planning, Community and Local Government (DHPCLG);
• The Local Authority Water and Communities Office (LAWCO);
• The City and County Management Association (CCMA);
• The National Federation of Group Water Schemes (NFGWS); and
• The EPA.
In 2016 the working group developed three new leaflets and these are being distributed by local
authorities. (See Appendix B for links to further documentation on septic tanks).

In November 2016, the Working Group held a national inspection plan workshop for local
authorities to discuss issues in relation to site inspections and engagement.

4.2 Awareness raising activities
The increase in operation and maintenance and desludging failures indicates that all stakeholders
must continue to be proactive in raising awareness around issues relating to domestic waste water
treatment plants especially operation maintenance and desludging. Listed below are some
examples of proactive engagement used by local authorities;
• Advisory stands at agricultural summer shows and festivals providing information on
maintenance of septic tanks;
• Information leaflets distributed in GP practices and medical centres waiting rooms;
• Pop up posters placed in county libraries;
• Advice to desludge the septic tank given to homeowners prior to inspection;
• Pre-inspections of systems to identify issues before the main inspection;
• Distribution of information leaflets to homeowners in bathing water catchment areas to
reduce pollution in bathing areas.
4.3 Complaints and queries
In 2016 the EPA received five complaints relating to septic tank issues. Three complaints were
resolved, two are active and are currently being dealt with by the EPA.
The EPA’s queries office received 312 queries relating to septic tank issues (queries mainly related
to Code of Practice, Water Services Amendment Act and Wastewater Treatment Manuals) which
represents 13% of total of queries received from the public.

5. Current and future developments
The River Basin Management Plan 2018-2021 under the Water Framework Directive (WFD)
is due to be finalised by the Minister for Housing Planning and Local Government soon. The
EPA in conjunction with the local authorities, Inland Fisheries Ireland and other bodies have
been assessing the significant pressures which have an impact on water bodies (rivers, lakes,
estuaries water bodies or groundwater bodies) to support the development of the
plan. The EPA is also currently preparing the 2018 -2021 National Inspection Plan. The
revised Inspection Plan will incorporate the findings of this assessment and will ensure
inspections are targeted in areas affected by domestic waste water treatment systems.
In 2016 the EPA published Research 161 – Assessment of disposal options for treated waste
water from single houses in low permeability subsoils, (see Appendix B). Following the
findings of this report it is proposed to revise the Code of Practice Wastewater Treatment
and Disposal Systems Serving Single houses, (see Appendix B).
As in 2015 all local authorities are encouraged to develop a list of permitted contractors in
their areas and to make it easily accessible on their websites to assist those interested in de-
sludging their septic tanks.

6. Recommendations
• All stakeholders should continue to make a concerted effort to provide appropriate and targeted information to consumers in maintaining and desludging their septic tank systems.
• Local authorities should continue being proactive with homeowners such as undertaking pre-inspections and issuing pre-inspection advice to homeowners to desludge the tank.
• Local authorities should develop a list of permitted waste collection contractors in their area and make it available on their websites to assist people who want to desludge their domestic waste water systems (DWWTS).
Engagement
• Local authorities who failed to reach their minimum inspection targets in 2016 must correct this shortfall with additional inspections in 2017 and must comply with any directions issued by the EPA.
• Local authorities must ensure that inspections are allocated appropriately across the different risk zones.
• Local authorities must prioritise the inspection of unregistered sites.
• Where private drinking water wells are on sites with DWWTS, home owners must maintain their DWWTS to ensure contamination of their drinking water well is minimised.
Inspections
• Local authorities should ensure that appropriate actions such as continued engagement, re-inspections and prosecutions are used to close out notices, especially older ones.
• Local authorities should prioritise the enforcement of those notices where system failures pose a risk to human health and the environment.

Táimid tiomanta do dhaoine agus don chomhshaol a chosaint ó éifeachtaí díobhálacha na radaíochta agus an truaillithe.
Is féidir obair na Gníomhaireachta a roinnt ina trí phríomhréimse:
Rialú: Déanaimid córais éifeachtacha rialaithe agus comhlíonta comhshaoil a chur i bhfeidhm chun torthaí maithe comhshaoil a sholáthar agus chun díriú orthu siúd nach gcloíonn leis na córais sin.
Eolas: Soláthraímid sonraí, faisnéis agus measúnú comhshaoil atá ar ardchaighdeán, spriocdhírithe agus tráthúil chun bonn eolais a chur faoin gcinnteoireacht ar gach leibhéal.
Tacaíocht: Bímid ag saothrú i gcomhar le grúpaí eile chun tacú le comhshaol atá glan, táirgiúil agus cosanta go maith, agus le hiompar a chuirfidh le comhshaol inbhuanaithe.

Measúnacht Straitéiseach Timpeallachta• Measúnacht a dhéanamh ar thionchar pleananna agus clár beartaithe
ar an gcomhshaol in Éirinn (m.sh. mórphleananna forbartha).
