1. EXECUTIVE SUMMARY

BACKGROUND

The Government of India through Ministry of Shipping, Road Transport and Highways (MOSRT&H) entrusted

National Highways Authority of India (NHAI) with the responsibility of improving the quality highways of national

importance through NHDP in different phases. N.H.-27 was included in NHDP-Phase-II and was constructed on

BOT (Annuity) basis. The National Highways Development Project (NHDP) is a major initiative for capacity

enhancement of the highways in qualitative and quantitative terms. This project which has been implemented

recently aimed at developing Palanpur-Swaroopganj section of NH-27 located in the states of Gujarat and

Rajasthan to four lane divided carriageway including strengthening of the existing two lanes.

In order to provide smooth travel and a better level of service to the users of highway vehicular traffic, it was

decided to augment the capacity of the Palanpur–Swaroopganj section of NH-27 from Km. 601+000 in

Banaskantha district in the state of Gujarat to Km 677+000 in Sirohi district of Rajasthan state by widening the

existing 2 lanes to 4 lane divided carriageway, including strengthening of the existing 2-lanes on Build, Operate

and Transfer (Annuity) basis.

The scope of the project includes Design, Engineering, Construction, Development, Finance, Operation and

Maintenance from Km. 601.000 (Palanpur) to Km. 677.000 (Swaroopganj) of NH-27 in the states of Gujarat and

Rajasthan.

Project road starts from Palanpur which is an educational hub of Banaskantha District, during the rule of Jhalori

Nawabs, Palanpur became well known for Gujarati Gazals and Poetry. Dairy. Textile, Diamond polishing and

Marble are major industry of Palanpur. Banas Dairy is one of the largest dairy in the state. The diamond

polishing and evaluation industry across India and across and abroad is dominated by Palanpur Jain Diaspora.

The Project road starts at Km. 601+000 at Palanpur and passes through major town like Iqbalgadh, Amirgadh,

Abu Road and ends at Km. 677+000 at Swaroopganj.

M/s Larson & Tubro Interstate Road Corridor Limited is the Concessionaire and the Independent Consultant of

O & M is M/s. MSV International, Inc. Gaurgaoun. M/s Larson & Tubro Interstate Road Corridor Limited has

engaged M/s. Larson & Tubro Limited –ECC Division as their EPC contractor. The project has been completed

on 24th March, 2009 and the project highway has been placed in commercial operation with effect from 24th

March, 2009.

Status of Main carriageway including paved shoulder and service road:

(i) General cleaning: Concessionaire had been instructed to increase the manpower for regular cleaning

work till date Concessionaire not taken any action to increase the manpower.

(ii) Drain : Despite of repeated reminders lined drain is not completely cleaned. The covers of drain is also damaged at large number of locations. Now the Concessionaire has done the cleaning work at few locations and also told that planning to cast the drain covers is being done.

(iii) Kerb Painting: The kerb painting is generally ok all along the Project Highway, wherever notified has been completed by Concessionaire.

(iv) Pot Holes: The surface of main carriageway is generally ok, there is not pot hole in the stretch. Wherever

developed during monsoon have been attended immediately.

(v) Median Plantation: During monsoon all Median plantation gaps as planned has been completed by

Concessionaire all along the Project Highways. Few gaps again developed which already notified and asked to make the compliances.

(vi) Avenue Plantation: Avenue plantation in Gujarat section is good but in Rajasthan section Avenue plantation is not up to mark. During ongoing rainy season IE had requested the Concessionaire to plan minimum 2000 plants in Rajasthan section. Concessionaire agreed to do plantation in Rajasthan section accordingly 2000 plants has been planted in this raining season.

(vii) Pedestrian Guard rail: Wherever pedestrian guard rail has been provided is being in good condition by

the Concessionaire but few notified gaps Concessionaire has been asked to maintain/repair.

(viii) Pavement Marking : At present Concessionaire is not having in-house facility to do the pavement marking as and when required. Now Concessionaire has mobilized the pavement marking vender and pavement marking is in progress.

(ix) Street Lighting: Street lighting provided at VUP, flyover and on service road has been maintained as per the provision of Contract Agreement.

(x) Road Side shoulders : Few rain cut and drop-off on side shoulder has been notified to the Concessionaire which is in progress. Concessionaire has been asked to complete at the earliest.

(xi) Road side furniture : Road side furniture like sinages, MBCB, hazard marker, Emergency calling number sign boards etc. has been provided. Concessionaire is attending the missing/damaged sign boards as per IE’s inspection report but not attending on time.

Service Road along Project Highway : (i) General cleaning: Concessionaire is attending the cleaning work on service road but frequency is not

maintained because of shortage of manpower and improper supervision at site. Concessionaire had assured that by end of September 2016 they will resolve the manpower issue and will maintain the frequency but till now no action has been taken.

(ii) Pavement Marking : At few locations on service road pavement marking is peeled out which is already

notified to the Concessionaire. Now the Concessionaire has mobilized the vendor and pavement marking is in progress at notified locations.

(iii) Street lighting : Wherever lighting on service road is provided is maintained in good/working condition by Concessionaire.

(iv) Road Surface : Surface of service road all along the Project highway is generally good/satisfactory.

Flyover and Vehicular/Pedestrian under Passes: (a) Flyover: (i) General cleaning below flyover : Concessionaire is cleaning the road surface below flyover but

frequency is not maintained as per approved calendar. (ii) Flyover expansion joints : Condition of expansion joints is good but cleaning frequency of expansion

joints is not maintained due to shortage of manpower and improper supervision at site.

(iii) Drainage spouts : All the spouts and cross drain is cleaned and maintained as required. However at few locations frequency is not maintained.

(b) Vehicular Under Passes: (i) General cleaning below flyover : Concessionaire is cleaning the road surface below flyover but

frequency is not maintained as per approved calendar. (ii) Flyover expansion joints : condition of expansion joints is good but cleaning frequency of expansion

joints is not maintained due to shortage of manpower and improper supervision at site.

1.2.2.1 Critical obligations and constraints of Concessionaire as per contract.

1. Improvement – This includes improvement in the existing assets as per requirement of this agreement

and safety audit if any in consultation with IC.

2. Road Maintenance –This includes routine maintenance, major maintenance, periodic preventive

maintenance, disaster maintenance and inspections.

3. Traffic management – Incident management; enforcement of regulations together with the relevant

authorities, hazard response ; information gathering and dissemination, road patrols and surveillance.

4. Safety – Accident prevention; after care; user behavior; education; enforcement; data collection and

analysis.

5. Facility Management – including periodic inspections, routine maintenance, rehabilitation and expansion

planning.

6. Road property management –Management of access, encroachment and ribbon development.

7. General responsibilities – including budgeting compliance with legal and accounting requirements and

public relations.

8. Planning of Operations and Maintenance Centre – including the basic planning comment on the detail

design and design co-ordination.

9. Maintaining public relations unit to interface with and attend to suggestion from users of the highway, the

media, Govt. agencies and other external agencies.

1.2.2.2 Critical obligations of Authority as per Contract

1. Enable access to the site, free Encumbrances, in accordance with this Agreement.

2. Permit peaceful use of the site by the Concessionaire as license under and in accordance with the

provisions of this Agreement without any let or hindrance from NHAI or persons claiming through or

under it;

3. Make reasonable endeavors in not allowing or placement of barriers by Government of Gujarat and

Rajasthan or any Governmental Agency on the Project Highway except on account of any law and order.

4. Enter into state support Agreement with the Concessionaire and the Government of Gujarat and

Rajasthan.

5. Assist the Concessionaire in obtaining police assistance from government of Gujarat and Rajasthan

against payment of prescribed costs and charges, if any, for traffic regulation, patrolling and provision of

security on the highway.

6. Observe and comply with its obligations set forth in this Agreement.

7. Take all necessary steps towards accomplishment of acquisition of additional land. NHAI shall bear the

cost of additional land.

8. Coordinate with Government of Guajarat and Rajasthan authorities for completing the legal requirements

and maintaining law and order during removal of encroachment by the Concessionaire.

9. Bear all expenses as per the demand note raised by the concerned government or other concerned

agencies in respect of shifting of all types of utility services, environmental clearance, tree cutting,

compensatory afforestation and rehabilitation and reselltlement. However responsibility for shifting

approval etc. rests with the Concessionaire.

1.2.2.3 Critical obligations of IE as per contract

Maintenance shall include cleaning, replacement of equipment /consumables, roadside faculties, horticulture

maintenance and repairs to equipment, pavements, bridges, structures, HTMS and other civil works.

Maintenance shall not include the extension of any existing pavements, bridges, structures and other civil

works unless part of Project highway.

1. Review work plan and schedules of various operation and maintenance activities.

2. Review operation and maintenance manual prepared by the Concessionaire.

3. Review the performance of operation and maintenance (O&M) activities including equipment , service,

operation and safety, toll plazas and fees collection system (only for BOT project) landscaping,

environmental issues and way side amenities.

4. To mediate and assist in resolving disputes between NHAI and Concessionaire during O&M stage.

5. Initiate necessary action to undertake maintenance obligations of the Concessionaire at risk and cost of

the Concessionaire in the event of his failure to carry out O&M.

6. Undertake audit of the traffic using the Project Highway at least once a month.

7. Review and inspect the Project highway at least once a month during the O&M period and issue an

Inspection report of such inspections.

8. Review the accident record on the project highway and suggest remedial measures.

2.3 HIGHWAY TRAFFIC MANAGEMENT SYSTEM (HTMS) The project Highway has been provided HTMS to collect information about traffic and incident management as listed below. 1. Emergency communication system : Emergency communication system in the form of call boxes (ECS’s) is installed at the spacing of 2 km. on either side of the highway for both direction of travel and connected to the control centre through the transmission system of optical fiber cable and copper cables with suitable interfacing control centers is located at toll plaza so that any user making emergency call from ECB’s can be provided the assistance of Ambulance, crane and highway patrol unit to callers locations. 2. Mobile Communication system : Mobile communication system is provided on Ambulances, cranes and patrolling vehicles for faciliting speedy communications even when they are on move. 3. Variable Message Sign system : Variable message sign is provided at 6 locations to guide and forewarm the users absent the traffic and weather conditions on highways. These messages are varied from control centres based on the data received though servillance system. 4. Meteorological Data System : Meteorological data system is provided at 100 locations to provide weather information on temperature, wind speed, humidity and visibility. 5. Automatic Traffic Counter-cum-classifier System : Automatic traffic counter cum classifier is installed at two locations for traffic data collection and monitoring. 6. CCTV Surveillance System : For the close circuit TV surveillance, video cameras is installed at following major junctions and two mid sections for visual information collection and distance surveillance system.

Video camera has been installed at all major intersection as per concession agreement for visual information collection and distance surveillance system. Traffic management shall be undertaken during scheduled and unscheduled maintenance activities and also during any Emergency. The Concessionaire has to attend to safety of the road users as well as the workers simultaneously throughout the concession period. It are a vital activity during unforeseen and/or emergency situations or administrative reasons. Concessionaire has provided following resources for Highway traffic management as per Concession Agreement.

Traffic management will be called for during unscheduled activities such as • Emergency situation arising on account of (a) force majeure (b) Accident/incident of the project highway. • Special repairs required on account of failure of an element of the Project Highway. • Default of the concessionaire with respect to an operational activity on the project highway.

Work program schedule shall be prepared such that diversion roads for the main traffic are minimized, and all the times minimum 8.75 m carriageway on each side and service road is available and utilized to the maximum extent possible. Measures shall be taken that the traffic is guided from closed lane onto the operating lane without its conflict with the traffic from the opposite direction. in case of unscheduled activities mentioned above, an emergency traffic management for the affected reach of the highway shall be prepared and implemented in consultation with the IC immediately. This emergency traffic management plan shall take into account the various requirements spelt out in the CA as well as in this schedule. Adequate safety during night time shall be ensured by providing mobile emergency lighting units with electrically flashing/illuminated warning signs important locations finalized in consultation with IC. Traffic management plan shall be based on the following operational parameters.(1) The existing divided carriageways & service road shall be utilized to the maximum extent possible.(2) At major intersections all traffic turning movements will be allowed at MOST of the times.(3) All short and long term temporary road diversions shall be proposed for approval of IC.(4)Adequate advance warning and information signs shall be incorporated in the traffic management plan in accordance with IRC/MORTH standards and specifications. Traffic management for widening of existing minor bridges/culverts shall be carried out without diversion of traffic. Construction of missing stretches of service road shall be carried out without any conflict with traffic on existing carriageway and service roads. Lane closure involves traffic management in the affected reach of the highway and shall be time bound activity and O_M Manual has to incorporate it accordingly. For the safety of construction workers as well as the traffic, a physical separation of 1.5 m between work area and the highway traffic shall be maintained.
