GENERAL PARTICULARS

I. Nature of Contract : Contract for Supply of Housekeeping and Allied for the NCB Unit at NCB Bhavan, Old Bombay Road, Near Gachibowli, Hyderabad - 500104

II. Last Date For Submission of E-Bids & Time : E-Bids to be uploaded on or before the time schedule of the E-tender.

IV. Earnest Money of Rs.50,000/- in the form of Demand Draft issue from any Nationalized bank and drawn in favour of National Council for Cement and Building Materials to be physically submitted one day before closing of the E-tender. The scan copy of the EMD is also be uploaded in the portal.

V. If the decision on etender is delayed beyond 30 days from the last date of receiving of bids, the bidder may ask their EMD held with NCCBM. However, in place of a Bid security, NCCBM requires from Bidders to sign a Bid securing declaration (as per Annexure-V) accepting that if they withdraw or modify their Bids during the period of validity, or if they are awarded the contract and they fail to sign the contract, or to submit a performance security before the deadline defined in the request for bids document, they will be suspended for a period of 1 year from being to submit Bids for contracts/supply with NCCBM.

VI. Period of Contract: One year and extendable on yearly basis at sole discretion of

NCB at the existing terms and conditions.

VII. Validity of Price Bid (Annexure-1): Price Bid should remain open for acceptance for a period of four months from the date of opening of tenders.

VIII. The tenderer should have quote his service charge in such a way that gross service

charge in Rupees per billing month should be more than the amount of Income Tax to be recovered from total payment from such monthly bill which is aggregate of Wages (Fixed), EPF (Fixed), ESI (fixed), Service Charge (as quoted) and GST (as applicable). It may be noted that the rate of Income tax will be computed @2% of the total payment i.e. at the highest applicable rates irrespective of the status of the tenderer as an individual/contractor/firm/trust. The service charge has to be quoted on the sum which comes out after adding minimum wages.

IX. Any cutting / correction / overwriting should be authenticated by authorized signatory and then only uploaded to the portal.




Schedule I

NATIONAL COUNCIL FOR CEMENT AND BUILDING MATERIALS NCB Bhavan, Near Gachibowli

1 DEFINITIONS

a) NCB means National Council for Cement And Building Materials

b) Agency means the Agency engaged for providing services to NCB

2 SCOPE OF CONTRACT

2.1 National Council for Cement and Building Materials is situated at NCB Bhavan, Old

Bombay Road, Near Gachibowli, Hyderabad – 500104, TS.

2.2 NCB desires to deploy certain services / manpower for short-term projects /

assignments – namely Technical Personnel, Computer Operators, Laboratory

Assistants, Casual Labours, Housekeeping staff etc at our unit NCB Bhavan, Old

Bombay Road, Near Gachibowli, Hyderabad – 500104, TS. – during the period of

12 months commencing from the date of this agreement and the Agency has

offered and agreed to provide the said services/manpower in conformity with the

provisions of the agreement.

2.3 The registered office or branch office of the bidder should be located in Hyderabad.

The bidder is required to submit the proof of its office address along with telephone

number as per details to be provided in Schedule II.

2.4 Without prejudice to the other responsibilities of the Agency as mentioned in this

document, the Agency shall in particular render the following services and shall

make all arrangements incidental thereto.

i) The Agency shall provide casual labour at the rates fixed under Minimum

Wages Act of the Regional Labour Commissioner (Central).

In addition to the above rates, NCB will pay PF @ 13.00% (PF @ 12% +

Admn charges @ 0.50% + 0.50%), ESI @ 4.00%, GST as presently

applicable (IGST=18%) and Service Charges only. The tenderers are required

to quote the service charge separately for each category of manpower.

ii) The agency must have two years of experience in the relevant field having

sufficient manpower resources on their pay roll. Bidder should have annual

turnover of over Rs.80 Lakhs (Rupees Eighty Lakhs only) in each previous two

financial years (2017-18 and 2018-19).




iii) For outstation duty they will be paid TA/DA per day as per agreed rates for

each person, in addition to the above rates.

iv) Security Deposit – At the time of entering into a formal contract for the

execution of works, the Agency shall deposit, a Security of Rs.6,00,000/-

(Rs. Six Lakhs only) or equivalent to one month salary bill whichever is higher

with the NCB. The security deposit shall be in the form of FDR / CDR or Bank

Draft in favour of the National Council for Cement and Building Materials,

Hyderabad (TS). The deposit thus made by the Agency shall be held as a

Security for the due and proper performance and completion of this contract

subject to these condition:

All compensations, or other sums of money payable by the Agency may be

deducted from or paid by the sale of a sufficient part of his security deposit, or

from the interest arising therefrom or from any sums which may be due

whatsoever and in the event of his security deposit being reduced by reason

of any such deductions or sale as aforesaid, the Agency shall within 10 days

make good the same, or bank draft payable to the Director General NCB. The

deposit, if any, will be released to the Agency, when the contract is completed.

v) Within 7 days of the receipt of intimation from NCB on the acceptance of the

tender, the Agency shall be bound to execute and implement the contract by

signing an agreement on the stamped paper of the requisite value. In any

case once NCB communicates its acceptance of the tender to the Agency, it

shall constitute a binding agreement between the Agency and NCB whether a

formal contract is or is not subsequently entered into or is delayed for any

reason whatsoever. Failure to comply with the aforesaid will lead to

cancellation of the contract by NCB and forfeiture of earnest money deposit.

vi) The Agency shall submit his bill for the preceding month by 2nd day of the

month and the payment shall be made on production of PF, ESI and Service

Tax deposit challans of previous month duly authenticated by the competent

authority. Contribution towards ESI and PF shall be made online and a copy of

the online generated challan towards proof of payment will be submitted to

NCB.

vii) The Agency shall maintain a separate PF code/ESI code for each person and

shall extend all benefits to the persons employed by him under the contract.




viii) The Agency will ensure registration with PF authorities for online submission

/deposit of PF contribution in respect of manpower deployed by him at NCB,

premises within 30 days of the award of manpower supply contract.

ix) The Agency shall register his firm under the Contract Labour (R&A) Act 1970

at his risk and cost and shall abide by all the legislations applicable to the

contract. The Agency shall abide by all the provisions and Legislations cited in

the Act and obtain proper license under the Law for supply of manpower.

x) The Agency shall maintain all the necessary records and registers relating to

appointments, attendance, wages etc and shall produce the same every

month to the authorized representative of NCB and labour department of the

State Government as and when asked for by them.

xi) The Agency will maintain all registers, returns as required including

attendance and wages register under Contract Labour (R&A) Act 1970.

xii) The personnel deployed shall be the sole responsibility of the Agency and

NCB shall not bear any liability whatsoever with regard to them and no person

employed by him under this contract shall claim employment with NCB.

xiii) That the Agency also agrees that Welfare and Safety of his manpower shall

be entirely his responsibility and he shall make necessary compensation in

case of any injury is caused to any of his employee in the course of

performance of job or accident or mis-happening. NCB in no way shall be

liable to disburse any payment on these accounts.

xiv) That the Agency shall not normally deploy any personnel on duty for more

than 8 hours in a day except in emergent circumstances and in no case

exceeds 12 hours on a particular day. Such deployment shall be made with

the prior approval of NCB.

xv) That the contract is on principal-to-principal basis and would not be transferred

or assigned by the Agency without the written consent of NCB.

xvi) That the person employed by the Agency and deployed in the NCB shall not

indulge in any activity prejudicial to NCB. This is without prejudice to the right

of the NCB to turnout such persons from the premises of NCB without any

notice or terminate the contract of the Agency without notice of liability on the

part of NCB.




xvii) That the Agency shall comply with all the instructions issued from time to time

by the duly nominated representative of NCB and shall obtain his prior

approval before effecting any changes in the conditions/clauses set out herein.

xviii) That no residential or living accommodation whatsoever shall be provided by

NCB to any of the personnel deployed by the Agency in any of the unit of

NCB.

xix) That in case there is any loss to NCB as a result of theft, pilferage, act of

dishonestly or connivance/inefficiency/negligence by any of the person

deployed by the Agency in NCB, the Agency shall be liable to compensate

NCB to the extent of loss in full by recovery from any payment due. In case

the loss is more than the dues, then the same shall be paid by the Agency

separately within 30 days of the demand made by NCB. The decision of NCB

authorities about the quantum of loss incurred shall be final and binding on the

Agency. However, this will be without prejudice to the other rights available to

NCB to take appropriate action.

xx) That in case of absence from duty by any person(s), proportional wages shall

be deducted from the wage bill of the concerned absentee.

xxi) That the payment of wages to the persons employed/deployed by the Agency

shall be made in the presence of the authorized representative of NCB by 7th

of following month.

xxii) That if at any point of time NCB finds that payment made to the persons

deployed by the Agency is less than the minimum wages, NCB shall have the

right to make the payment of such sum which has been paid less and recover

the same from the Agency’s bill or dues.

xxiii) That except where otherwise provided in the agreement all questions and

disputes relating to the meaning of any of the clauses of this agreement and

as to the quality of the performance or as to any other question, claim, right,

matter or thing whatsoever, in any way, arising out of or relating to the

agreement of the execution or failure to execute the same whether arising

during the progress of the agreement or after the completion or abandonment

thereof shall be referred to the sole arbitration of the person appointed solely

by the Director General, National Council for Cement and Building Materials.

Arbitrator to whom the matter is originally referred being unable to act for any

reason, the Director General NCB shall be entitled to appoint another




Arbitrator and the said new arbitrator shall proceed with the reference from the

stage at which it was left by his predecessor. It is also a term of this

agreement that no person(s) other than a person appointed by the Director

General NCB as aforesaid should act as an arbitrator. The reference to the

arbitration can be made only after the completion of the work under this

agreement on expiry of the final period of this agreement and before accepting

payment in full & final settlement. The award of the arbitrator shall be final and

binding on all the parties of this agreement. Subject, as aforesaid, the

provisions of the Arbitration and Conciliation ACT 1996, or statutory

modification or enactment thereof and the rules made thereunder and for the

time being in force shall apply to the arbitration proceedings under these

clauses.

All disputes are subject to jurisdiction of Civil Courts in Hyderabad.

xxiv) That any reference to the word ‘NCB’ mentioned in this agreement shall mean

any duly authorized representative of National Council for Cement and

Building Materials or any other person nominated by the Director General.

2.5 The tentative requirement of manpower at NCB-Hyderabad is in the following

Categories of Manpower indicating their qualification against each category:

The persons to be deployed shall be of good moral character and not discharged

or dismissed employees, arising out of disciplinary proceedings or otherwise from

any service before.




2.6 There will be no increase in the rates during the currency of the contract for any

reasons whatsoever except when there are statutory revisions made by RLC

Central.

2.7 In case any additional manpower assistance is required, the Agency shall provide

the same at proportionate additional cost.

2.8 It shall be the responsibility of the Agency to maintain the required strength on all

days. However, in case the Agency fails to maintain the minimum strength agreed

to, deduction on proportionate basis shall be made. If the Agency on any day fails

to provide a minimum of 50% of the agreed manpower, he shall reimburse to the

NCB 50% of the minimum wages for that day in respect of the absentees.

2.9 The Agency shall obtain police verification report/clearance. The Agency shall also

issue photo identity cards of its personnel deployed at the NCB.

2.10 The Agency shall maintain an observation register with the respective Security

Officer/Assistant Security Officer of the premises and it shall be the responsibility of

the Agency to attend to the observations recorded therein within three days to the

satisfaction of the NCB.

2.11 The contract shall be valid for a period of one year and extendable on yearly basis

at sole discretion of NCB at the existing terms and conditions. The contract can,

however, be terminated by either party at any time by giving three months’ written

notice to the other party without assigning any reason and without any liability

whatsoever. However the liability of any party arising under any clauses of the

contract shall not be prejudiced.

2.12 In case of quit and/or termination of this contract from either side, the full and final

account of the Agency will be settled subject to his clearing wages, P.F. etc to his

employee in the presence of the authorized representative of NCB, to his each and

every employee engaged for NCB.

2.13 The Agency should deploy a supervisor at his own cost on all working days to

supervise the payment of wages, maintaining of Records/Register and for

Manpower Assistance.

2.14 The Agency at his cost will provide and maintain a first-aid box at a place where it

could be readily accessible during all working hours under the responsibility of his

Supervisor and if during the course of performing the duties any person working

under this contract gets injured or passes away, NCB shall not be responsible for

any compensation and it shall be the sole responsibility of the Agency to pay

compensation, if any.
