The Committee made note of the fact that neither the owner, responsible party or their designated agent requested a hearing, for 811 Vernon Street, within ten (10) days from the notification of the initial certification of blight and nor did the owner, responsible party or their designated agent file an appeal with the Court of Common Pleas pertain-ing to the certification of blight 811 Vernon Street.

Please be advised that the Blighted Property Review Committee has certified to the Redevelopment Authority that the property is blighted. The Blighted Property Review Committee had also requested concurrence by the Planning Commission that the property is blighted.

OPINION

This matter has come before the Court on Defendant Eric Shaw’s motion for summary judgment, in which he asserts that Plaintiffs have failed to produce sufficient evidence to support a prima facie case of negligence against him. Plaintiffs deny the Defendant’s contention. Each party has submitted a brief in support of their respective positions, and the Court heard oral argument following the call of the Argument List on September 23, 2014. For the reasons set forth below, we find that summary judgment is proper in favor of Defendant Eric Shaw at this time.

I. FActuAL BAckgrOuND

The following is a brief summary of the facts relevant to our decision in this matter, viewed in the light most favorable to Plaintiffs as the non-moving party: Defendant Eric Shaw (Shaw) is the owner and landlord of certain real property located at 115 State Street, Portland, Northampton County, Pennsylvania. One of his tenants at the property was, at all relevant times, Steven Nitschke. Mr. Nitschke’s paramour is Defendant Kerri Bun-nelle (Bunnelle), who would often stay with Mr. Nitschke, and was in fact a part-time resident at the property though she was not on the lease. Bunnelle was, at all relevant times, the owner of a 70-pound white German Shepherd Dog known as Athena. Bunnelle knew Athena to roughhouse with other dogs on her parents’ farm in New York.

On August 20, 2012, in the afternoon hours, Plaintiff Nancy Knott was in her back yard when her attention was brought to the sound of dogs barking elsewhere on her property. She walked to her side yard, where she

observed her dog and Athena engaged in a fight. Athena had broken away from Bunnelle and come into the Knotts’ yard. As she attempted to break up the fight, Mrs. Knott fell to the ground and injured her right knee, which required surgery, in addition to sustaining various other bruises and lac-erations.

In their Complaint, Plaintiffs allege that Shaw was negligent for permitting a dangerous animal on his property, and for otherwise failing to keep third persons safe from Athena. Shaw denies these allegations, claim-ing he had no such duty, and contends that summary judgment must be granted in his favor.

II. StANDArD OF LAw—SummAry JuDgmeNt

In ruling upon a motion for summary judgment, we are asked to consider whether there remain any genuine issues of material fact for de-termination by a trier of fact. Where there are not, we may enter summary judgment upon finding that the moving party is entitled to judgment as a matter of law. Pa. R.C.P. 1035.2. More specifically, summary judgment may be entered in favor of the moving party when a “party who will bear the burden of proof at trial has failed to produce evidence of facts essential to [his or her] cause of action [which] would require the issues [to] be submitted to a jury.” Jones v. Southeast Pennsylvania transportation Au-thority, 565 Pa. 211, 216, 772 A.2d 435, 438 (2001).

Importantly, when ruling upon a motion for summary judgment, we must view the facts in the light most favorable to the non-moving party. Boring v. erie Insurance group, 434 Pa. Super. 40, 641 A.2d 1189 (1994). It is the moving party that bears the burden of proving that no genuine is-sues of material fact remain. Laich v. Bracey, 776 A.2d 1022 (Pa. Commw. 2001). Importantly, a party’s right to summary judgment in its favor must be clear before the court may enter same. marks v. tasman, 527 Pa. 132, 589 A.2d 205 (1991). Furthermore, any “doubts as to the existence of a genuine issue of a material fact are to be resolved against the granting of the summary judgment.” Shoats v. commissioner, Pennsylvania Department of corrections, 139 Pa. Commonwealth Ct. 607, 614, 591 A.2d 326, 330 (1991). Mindful of this standard, we find that summary judgment is proper in this case, for the reasons set forth below.

III. DIScuSSION

In order to succeed on a claim of negligence, there are four well-known elements which a plaintiff must prove: (a) the existence of a le-gally recognized duty on the part of the defendant; (b) a breach of that duty; (c) a causal connection between the breach and the plaintiff’s injury; and (d) injury to the plaintiff. See Jones v. Levin, 940 A.2d 451 (Pa. Super. 2007). It is the first of these elements upon which Shaw’s motion for sum-mary judgment focuses. In his motion, Shaw contends that Plaintiffs have

failed to produce sufficient evidence to support a finding that he had any duty with respect to the dog at issue. We agree.

Pennsylvania law provides that a landlord may be held liable to third persons for injuries caused by a tenant’s animal “if the landlord has knowl-edge of a dangerous animal on the rented premises and if the landlord enjoyed the right to control or remove the animal by retaking the premises.” rosenberry v. evans, 48 A.3d 1255, 1258 (Pa. Super. 2012), citing Palermo v. Nails, 334 Pa. Super. 544, 483 A.2d 871 (1984). Critical to our analysis in this case, the landlord must have had actual knowledge of the animal’s dangerous propensities. underwood ex rel. underwood v. wind, 954 A.2d 1199 (Pa. Super. 2008). Constructive knowledge is insufficient to hold a landlord liable. Id.

We agree that summary judgment in favor of Shaw is appropriate at this time, as Plaintiffs have failed to present any evidence which would suggest that Shaw had any actual knowledge of any dangerous propensity Athena may have had. Plaintiffs contend that Shaw should have known of Athena’s dangerousness due to her large size, and point to Shaw’s own deposition testimony in which he agrees that he would have concerns about a large dog on his property that is known to roughly play with other dogs or people. (Shaw Dep. 6/3/14, pp. 31-32.) However, as stated above, con-structive knowledge is not the requirement of our law—the defendant must have had actual knowledge of a dangerous propensity. Plaintiffs have pointed to no record evidence which would suggest that Shaw had such knowledge with respect to Athena.

In reaching our decision here, we are cognizant of the rule which prohibits the entry of summary judgment in reliance upon the moving party’s own testimony. Bremmer v. Protected Home mutual Life Insurance company, 436 Pa. 494, 260 A.2d 785 (1970). See also, Borough of Nanty-glo v. American Surety co. of New york, 309 Pa. 236, 163 A. 523 (1932). Accordingly, we must impart that our decision is based not upon Shaw’s deposition testimony in which he disclaims knowledge of any dangerous propensity that Athena may have had—though that does play some role—but that our decision turns upon the deposition testimony of the other par-ties, including that of co-defendant Kerri Bunnelle, in which every indica-tion is that Shaw had no knowledge of any dangerous propensity Athena may have had. “An exception to the [Nanty-Glo] rule has been recognized where the moving party relies upon the uncontradicted testimony of an-other party, even a co-defendant, who is an adverse party and equally liable to the plaintiff.” rosenberry, supra at 1259, citing Askew by Askew v. Zeller, 361 Pa. Super. 35, 521 A.2d 459 (1987).

In her deposition testimony, Defendant Bunnelle testified that Athena was never involved in any kind of attack, and that while Athena was known to engage in roughhousing only with other dogs on her parents’ farm in New York, she did not engage in that type of play with humans,

and that she was in fact very submissive to humans. (Bunnelle Dep., 6/3/14, pp. 18-22.) Bunnelle also testified that Shaw had occasion to meet her dog approximately five times over the course of nearly two years, and that she was not aware of any complaints about Athena to either herself or Shaw over the course of that time, excepting the incident at issue. Id. at pp. 19-21, 41. There is nothing in Bunnelle’s testimony which would suggest that Shaw ever observed Athena at play with another dog, or that he was aware of how she might play with other dogs. When Shaw inquired of Bunnelle as to Athena’s disposition, he was told that she was “friendly.” Id. at p. 41. The depositions of the Plaintiffs, in turn, contain no evidence which would suggest any actual knowledge on Shaw’s part of a dangerous propensity on Athena’s part. Likewise, there is no other evidence of record from which one could reasonably infer same. Given this finding, we do not reach the question of whether there is any evidence that Athena actually had a dan-gerous propensity.

As in rosenberry, the record in this case lacks “any evidence of complaints brought to the Landlord’s attention, warning signs, prior attacks or any of the types of circumstances that have been generally held to con-stitute knowledge of a dog’s dangerous or vicious propensities.” rosen-berry, supra at 1264. Accordingly, we must conclude, as did the Superior Court in that case, that the entry of summary judgment is proper in Shaw’s favor in this case, as Plaintiffs have failed to produce sufficient evidence from which a jury could infer that Shaw had a duty to protect third persons from the dog Athena.

Judgment is hereby ENTERED in favor of Defendant Eric Shaw and against Plaintiffs with respect to all of the claims raised by Plaintiffs against Defendant Eric Shaw in their Third Amended Complaint.

with respect to Plaintiff’s alleged failure to plead sufficient facts to support a breach of contract claim, as the Complaint set forth a cause of action based upon an account stated, and averred sufficient facts in support thereof. However, the Court sustained a preliminary objection with respect to Pa. R.C.P. 1019(i), as Plaintiff had failed to attach documentation to the Complaint which supported its averment that it was the assignee of the right to collect on Defendant’s allegedly past due credit card account. While the documents attached to the Complaint il-lustrated that Plaintiff was the assignee of the right to collect credit card accounts previously owned by HSBC, nothing in those documents made any reference to an account of the De-fendant.

OPINION

This matter is before the Court on Defendant’s preliminary objections to Plaintiff’s Complaint. In its Complaint, Plaintiff asserts a cause of action upon an account stated, based upon Defendant’s alleged failure to make payments due on a credit card account. In her preliminary objections, De-fendant asserts that Plaintiff has violated Pennsylvania Rule of Civil Pro-cedure 1019(i) by failing to attach to its pleading copies of writings upon which its claims are based, and also that Plaintiff’s claims are legally insuf-ficient.

I. FActuAL AND PrOceDurAL BAckgrOuND

In its Complaint, Plaintiff alleges, inter alia, the following facts: Defendant Linda M. Haas was the user of an HSBC Visa consumer credit card; that she used that credit card over a period of time while making monthly payments upon receipt of monthly billing statements; and that she ceased making payments on the credit card account, which had an outstand-ing balance as of May 15, 2011. Plaintiff also alleges in its pleading that it is the successor in interest to HSBC with respect to the right to collect the debt on Defendant’s credit card account.

This matter was initially brought before Magisterial District Judge Douglas Schlegel, who entered judgment in favor of Defendant. Plaintiff thereafter filed an appeal, and filed its Complaint in the Northampton

County Court of Common Pleas on September 8, 2014. Defendant filed preliminary objections thereto on September 23, 2014. Said objections were assigned to the Honorable Paula A. Roscioli for decision from the Novem-ber 10, 2014 Argument List. The Court heard oral arguments on that date, and both parties have submitted briefs in support of their respective posi-tions. The Court having reviewed the record before us, as well as the ap-plicable law, the matter is now ready for disposition. For the reasons set forth below, we shall sustain Defendant’s preliminary objections in part, and overrule them in part.

II. DIScuSSION

In her first preliminary objection, Defendant argues that Plaintiff’s Complaint violates the requirements of Pa. R.C.P. 1019(i), which requires that when a claim is based upon a writing, a copy of the writing must be attached to the pleading unless it is inaccessible to the pleader, in which case the reason therefor must be stated, together with the substance of the writing. In this preliminary objection, Defendant first argues in part that Plaintiff has failed to comply with Pa. R.C.P. 1019(i) in that it failed to attach sufficient documentation to its pleading to illustrate that it is in fact the successor in interest to HSBC, the alleged issuer of the credit card ac-count at issue, with respect to the right to collect the alleged debt on said account. Having reviewed the documentation attached to the Complaint, we agree with Defendant’s evaluation of same.

Paragraphs 9 and 10 of the Complaint state as follows: On or about April 5, 2011, HSBC sold this account to

CACH, LLC. A true and correct copy of the bill of sale is at-tached hereto and marked Exhibit B.

On or about June 28, 2013, plaintiff acquired the account from CACH, LLC. A true and correct copy of the bill of sale is attached hereto and marked Exhibit C.Attached to the Complaint are the two exhibits that Plaintiff claims

reflect the assignment of Defendant’s credit card account to Plaintiff. Ex-hibit B is a document titled “Assignment and Bill of Sale,” signed by David Nauman, vice president of HSBC Receivables Acquisition Company I, HSBC Receivables Acquisition Corporation (USA) III, HSBC Receivables Acquisition Corporation (USA) IV, on June 29, 2011, and states in pertinent part:

HSBC Receivables Acquisition Company I, HSBC Re-ceivables Acquisition Corporation (USA) III, HSBC Receiv-ables Acquisition Corporation (USA) IV (hereinafter collec-tively called ‘Seller’) has entered into a Purchase and Sale Agreement as of April 5, 2011 (‘Agreement’) for the sale of Near Prime Fresh Charged Off Receivables described in Para-graph 1 therein to CACH, LLC (hereinafter called ‘Purchaser’), upon the terms and conditions set forth in that Agreement.

Now therefore, for good and valuable consideration, Seller hereby sells, assigns, and transfers to Purchaser, its suc-cessors and assigns, all of Seller’s rights, title, and interest in each and every one of the Near Prime Fresh Charged Off Re-ceivables described in the Agreement and in Exhibit A attached hereto.

Notably, neither the “Agreement” nor the “Exhibit A” referenced in Ex-hibit B is attached to the Complaint.

The second document attached to the Complaint that Plaintiff alleges evidences the assignment of Defendant’s account is Exhibit C, another “Assignment and Bill of Sale,” dated June 28, 2013, that provides as fol-lows:

CACH, LLC (‘Seller’) has entered into a Purchase Agree-ment (‘Agreement’) dated June 28, 2013, as amended by the Closing Statement dated June 28, 2013, for the sale of Accounts described in Exhibit A thereof, to Velocity Investments, LLC (‘Buyer’) upon the terms and conditions set forth in that Agree-ment.

Now therefore, for good and valuable consideration, Seller hereby sells, assigns and transfers to Buyer all of Seller’s rights, title and interest in each and every one of the Accounts described in Exhibit A to the Agreement.

Again, the referenced “Exhibit A” is not attached to the Complaint. Taking these documents together as a whole, we cannot conclude that

they reflect an assignment of a right to collect the debt alleged in the case. The “Assignment and Bill of Sale” dated June 29, 2011 and attached as Exhibit B merely illustrates that some accounts owned by HSBC Receiv-ables Acquisition Company I, HSBC Receivables Acquisition Corporation (USA) III, HSBC Receivables Acquisition Corporation (USA) IV were sold to CACH, LLC. There is no evidence whatsoever that would tend to show that Defendant’s credit card account was among those sold in that transaction. Likewise, the “Assignment and Bill of Sale” dated June 28, 2013 merely illustrates that some accounts owned by CACH, LLC were sold to Velocity Investments, LLC. There is again no evidence whatsoever that would tend to show that Defendant’s credit card account was among those sold in that transaction. Accordingly, we cannot accept these docu-ments in satisfaction of the requirements of Pa. R.C.P. 1019(i), which Rule requires that Plaintiff attach to its Complaint the documentation upon which its claim of ownership is based. See Atlantic credit & Finance, Inc. v. giuliana, 829 A.2d 340 (Pa. Super. 2003). For this reason, Defendant’s preliminary objection on this point must be sustained. We shall, however, grant Plaintiff an opportunity to plead again with the appropriate documen-tation of the alleged assignment.

The next part of Defendant’s objection on the basis of Plaintiff’s al-leged failure to comply with Pa. R.C.P. 1019(i) is her contention that Plaintiff has failed to attach a copy of the cardholder agreement upon which its claims are based. We find that we must overrule this objection, as it is clear from a plain reading of the Complaint that Plaintiff is not raising its claims under a breach of contract theory, and accordingly there is no contract upon which it is basing its claims. To the contrary, Plaintiff’s claims are brought upon an account stated, and, for the reasons set forth below, we believe that Plaintiff has properly pleaded such a claim.

In order to properly plead a claim upon an account stated, a plaintiff must plead facts that, if proven, would show: (1) there has been a running account, (2) a balance remains due, (3) the account has been rendered upon the defendant, and (4) the defendant has assented to the account. See e.g., citibank (South Dakota), N.A. v. Ambrose, 13 D. & C.5th 402 (Adams Cty. 2010). A defendant’s assent to the account can be found where the defendant had for many months made payments on account of the billing statement or retained the statement without payment. Donahue v. city of Philadelphia, 157 Pa. Super. 124, 129, 41 A.2d 879, 881 (1945). In this case, we find that Plaintiff has pleaded sufficient facts in support of each of these elements. Plaintiff has pleaded that Defendant made purchases and payments over a course of time, that she received monthly account statements reflecting her account activity, that Defendant made monthly payments after receipt of those monthly statements, that she received the statements without objec-tion, and that a balance remains due on the account that Defendant has failed to pay. Furthermore, a copy of the most recent statement is attached to the Complaint. These facts averred by Plaintiff are sufficient to plead each of the elements described above. While more will be required to Plaintiff to prove its claim, such documentation is a matter of proof and not pleading. For this reason, we find that we must deny Defendant’s demurrer to Plaintiff’s claim upon an account stated.

WHEREFORE, we enter the following:

AND NOW, this 14th day of November 2014, upon consideration of Defendant’s preliminary objections to the Plaintiff’s complaint, it is hereby ORDERED that Defendant’s preliminary objections on the grounds of Plaintiff’s alleged failure to comply with Pa.R.C.P. 1019(i) are SUSTAINED IN PART and OVERRULED IN PART, as set forth in the proceeding [sic] Opinion. Plaintiff is granted leave to file an amended pleading within twenty (20) days of the date of this Order. In the event that Plaintiff fails to file an amended pleading within the time allowed, its claims shall be dismissed, without prejudice. Defendant’s demurrer to the Complaint is OVERRULED.
