Sec,9-1.Codeadopted.There is hereby adopted for the purpose of establishing rules and regulations for theconstruction,alteration, removalandmaintenanceofelectricwiringandapparatus, includingpermitsandpenalties, thatcertainelectriccodeknownas theNationalElectricalCodeof theAmerican Insurance Association, being particularly the 1975 edition thereof and the wholethereof, save and except such portions as are hereinafter deleted,modified, or amended, ofwhichnotlessthanthree(3)copieshavebeenandnowarefiledintheofficeoftheclerkandthesameareherebyadoptedandincorporatedasfullyas ifsetoutat lengthherein,andtheprovisionsthereofshallbecontrolling intheconstruction,alteration,maintenanceorremovalofallelectricwiringandapparatuswithinthecorporatelimitsofthetown.Secs.9-2—9-17.Reserved.
ARTICLEII
ADMINISTRATIONANDENFORCEMENT
Sec.9-18.Electricalinspector—Officecreated;appointment.There is hereby created the office of electrical inspector, who shall be appointed by the
mayor,subjecttotheconfirmationoftheboardofaldermen.
Sec.9-19.Same—QualificationsThe electrical inspector shall be of good moral character, shall be versed in the approvedmethods of electrical construction for safety of life and property and the National ElectricalCode.
Sec.9-20.Same—CompensationTheelectrical inspectorshall receivesuchcompensationasthemayorandboardofaldermenmaydecide
Sec.9-21.Same—Duties,powersgenerally.
(a) The electrical inspector shall have theduty and is herebyauthorized, empoweredanddirectedtoregulateanddeterminetheplacingofelectricwiresorotherappliancesforelectriclights,heatorpower in the town,and tocauseall suchwires,appliancesorapparatus tobeplaced,constructedandguardedasnottocausefiresoraccidents,endangeringlifeorproperty,andtocooperatewiththefiremarshal.
(b) Itshallbethedutyoftheelectricalinspectortoenforceallprovisionsofthischapter; and he is hereby granted the authority to enter all buildings in the town in theperformanceofhisdutiesbetweenthehoursof8:00a.m.and5:00p.m.daily,exceptthat inemergenciesandwithinthelimitsofreason,hemayenterbuildingsforsuchpurposesatotherthanthedesignatedhours.(c)Itshallbethedutyoftheelectricalinspectortoinspectand/ortestallelectricalworkandequipment or apparatus for compliance with the code adopted by section 9-1.Wheneverelectric wiring, appliances or apparatus shall be defective or hazardous through impropermanufactureor improperor insufficient insulationorforanyotherreason,heshallatoncecausetheremovalofsuchdefectattheexpenseoftheownersofsuchwiring,applianceorapparatus.(d)Uponfailuretocomplywiththischapter,thetownelectricianshallhaveauthority,after
duenotice,tocutoffelectriccurrentinthelocalityconcerned.
Sec.9-22.Same—AuthorityastoenforcementandinterpretationofelectricalcodeAll electrical construction, allmaterials, appliances,motors, heatingdevices, andapparatususedinconnectionwithelectricalworkandtheoperationofallelectricalapparatuswithinthe
townshallconformtotherulesandrequirementsoftheNationalElectricalCodewhenworkisperformedor equipment and apparatus installed; however, the necessity, good service andresultsoftenrequirelargersizesofwire,morebranchcircuits,andbettertypesofequipmentthattheminimumwhich isspecified intheNationalElectricalCode.Therefore,theelectricalinspectorsupervisingtheenforcementofsuchcodewillhavetheresponsibilityandauthorityfor making interpretations of the rules, for deciding upon the approval of equipment,materialsconstruction,andforgrantingthespecialpermissioncontemplatedinanumberofthe rules; and theelectrical inspector,wherenecessary, shall follow the codeprocedure forsecuringofficialinterpretationsofthecode.
Sec.9-23.Inspection;issuanceofcertificateofinspectionUponthecompletionofthewiring,installationoralterationofanybuildingorstructurefor
light,heat,power,applianceorapparatusshallbethedutyofthepersonhavingdirectchargeof such to notify the electrical inspector,who shall, as early as possible, inspect suchwiring,installation,applianceandapparatus;and if installed,alteredandconstructed in compliancewith the permit and in accordancewith the requirements of this chapter, he shall execute acertificate of satisfactory inspection,which shall contain the date of such inspection and theresult of his examination; but no such certificate shall be issued unless such electric wiring,motors, heating devices, appliances and apparatus are in strict accord with the rules andrequirements and the spirit of this chapter, nor shall current be turned on such installation,equipment,appliance,motor,heatingdeviceorapparatusuntil such certificate is issued.Theamountoffeeorchargetobemadeforsuchinspectionsandcertificateshallbetwodollarsandfiftycents($2.50)perinspectionandtwenty-fivecents($0.25)percircuit.
ARTICLEIII.LICENSESANDPERMITS
Sec.9-35.Electricalcontractor'slicense—RequiredAnypersondesiringtoengageinthebusinessofelectricalconstructionoroftheinstallationofwiringandapparatusforelectriclights,appliances,heatingorpowerinthetownshall,beforedoingso,obtainalicensetherefor.
Sec.9-36.Same—Fee.The fee for the license required by section 9-35 shall be ten dollars ($10.00) per year,whichshallbepaidintothetowntreasurybeforesuchlicenseshallbecomeeffective.
Sec.9-37.Same—Qualificationforlicense.Nolicenserequiredbysection9-35shallbeissueduntilthepartyapplyingforsamehasgivensatisfactoryevidence to the townelectricianofhisability todoelectricalwork inasafeandsatisfactorymanner.
Sec.9-38.Same—Bondrequired.
Everypersondoingelectricalbusinessinthetownshallexecuteanddelivertothetownabondwithasuretybondingcompanyinthesumoffivehundreddollars($500.00)toindemnifythe
town or any citizen for any damage caused by the failure of such person doing theelectricalworktocomplystrictlywiththeprovisionsofthischapter.
Sec.9-39.Individualpermits.Any individual desiring toperformhis ownelectricalworkpersonally shall not be required tomakethebondorobtainthelicenserequiredbythisarticle,butshallberequiredtoobtaintheregular permit for thatparticular job. Suchworkdonebyan individualmustbedonebyhimpersonally on his own particular job and not be away of performing a service to the publicgenerally.
Sec.9-40.Workpermit—Required.No installation, alteration or removal shall be made in or of the wiring of any building orstructure for light, heatorpower, or increase in the loadof energy carriedby suchwiresorequipment,norshallanybuildingorstructurebewiredforelectric lights,appliances,motors,apparatusorheatingdevicesnoralterationsmadetheretowithoutawrittenpermit thereforbeingfirstobtainedfromthetownlicense-issuingclerkbythepersonhavingdirectchargeofsuchinstallation,alterationorremoval.Sec.9-41.Same—Prerequisite’stoissuance.NopermitrequiredbySection9-40forinstallationoralterationofanywiring,heatingdevices,motors,appliancesandapparatusshallbeissueduntilthelicenserequiredbysection9-35hasbeenobtainedandthebondrequiredbysection9-38hasbeenpaidSec.9-42.Refusalofpermits,revocationoflicensesforchapterviolations.Anypersonwhoshall fail to correctanydefect inhisworkorwho fails tomeet the requiredstandards after having been given notice of the unfit condition by the electrical inspector,withinareasonabletime,shallberefusedanyotherpermituntilsuchdefecthasbeencorrectedand shall be subject to revocation of license for continual defective work, or either, uponconviction for violation of the provisions of this chapterBE IT FURTHER ORDAINED, by the Mayor and Alderman of the Town of Church Point,Louisiana, that any provisions or items of the Ordinance or the application thereof if heldinvalid,suchinvalidityshallnotaffectotherprovisions,items,orapplications,andtothisend,the provisions of this Ordinance are hereby declared severable.BE IT FURTHER RESOLVED that all ordinances or resolutions or parts thereof in conflictherewithandherebyrepealed.

DIVISION2.TREEBOARD
Sec.14.5-31.Established.
There is hereby created and established a tree board for the town which shall consist of three (3) members, citizens and residents of this town, who shall be appointed by the mayor with the approval of the council. (Ord.of8-4-98,§ 3)
Sec. 14.5-32. Terms of members.
The term of the three (3) persons to be appointed by the mayor shall be three (3) years except that the term of two (2) of the members of the first board shall be for two (2) years. In the event that a vacancy shall occur during the term of any member, his successor shall be appointed for the unexpired portion of the term. (Ord.of8-4-98,§ 4)
Sec. 14.5-33. Compensation.
Members of the board shall serve without compensation. (Ord. of 8-4-98, § 5)
Sec. 14.5-34. Duties and responsibilities. Itshallbetheresponsibilityoftheboardtostudy,investigate,counselanddevelopand/orupdateannuallyandadministerawrittenplanforthecare,preservation,pruning,planting,replanting,removalordispositionoftreesandshrubsinparks,alongstreetsandinotherpublicareas.Suchplanwillbepresentedannuallytothetowncouncilandupontheiracceptanceandapprovalshallconstitutetheofficialcomprehensivetowntreeplan.Theboard,whenrequestedbythetowncouncil,shallconsider,investigate,makefindings,reportandrecommenduponanyspecialmatterorquestioncomingwithinthescopeofitswork.
(a) Theboardshalldevelopandmaintainalistofdesirabletreesforplantingalongstreetsinthethree(3)sizeclassesbased onmatureheight:small(under20feet),medium(20to40feet),andlarge(over40feet).Listsoftreesnotsuitableforplantingshallalsobecreatedbythe board.
Sec. 14.5-35. Organization.
The board shall choose its own officers, make its own rules and regulations and keep a journal of its proceedings. A majority of the members shall be a quorum for the transaction of business. Sec. 14.5-36. Council's right to review board actions and decisions; appeals.
The town council shall have the right to review the conduct, acts and decisions of the tree board. Any person may appeal from any ruling or order of the tree board to the town council who may hear the matter and make final decisions.
Sec.14.5-46.Toppingunlawful.
Itshallbeunlawful asanormalpracticeforanyperson,firmorcitydepartmenttotopanystreettreeparktreeorothertreeonpublicproperty.Toppingisdefinedas theseverecuttingbackoflimbstostubslargerthanthree(3) inchesin diameter within the tree's crown to sucha degree soas toremove thenorm.alcanopy anddisfigurethetree.Treesseverelydamagedbystormsorothercauses,orcertaintreesunderutilitywiresorotherobstructionswherethepruningpracticesareimpracticalmaybeexemptedbyadeterminationofthetreeboard.
Sec.14.5-51.Treeservicebusiness,licenserequired; exceptions.
It shall be unlawful for any person or firm to engage in the business or occupation of pruning, treating, or removing street or park trees within the town without first applying for a procuring a license. The license fee shall be twenty-five dollars ($25.00) annually, in advance; provided, however, that no license shall be required of any public service company including electric utilities and their agents and contractors or town employees doing such work in the pursuit of their public service endeavors. ARTICLEII INSURANCELICENSETAX
Sec.15-16.Levied.
There is hereby imposed and levied an annual license tax on any insurer engaged in thebusinessofissuinganyformofinsurancepolicyorcontract,whichmaynoworhereafterbesubject to thepaymentofany license tax for statepurposes,all as it is authorizedbysection 1076 of Title 22 of the Louisiana Revised Statutes of 1950 on risks located in thismunicipalityasfollows:
(1) Life,accident,orhealthinsurers.Onanyinsurerengagedinthebusinessofissuinglifeoraccidentorhealthinsurancepolicies,otherthanprogramsofbenefitsauthorizedorprovidedpursuant to theprovisionsofParts Iand IIofChapter12of 'title42of theLouisianaRevisedStatutes of 1950, or other forms of contracts or obligations covering such risks, or issuingendowmentorannuitypolicies,orcontracts,orothersimilar formsofcontractobligations inconsideration of the payment of a premium or other consideration for the issuance of suchpolicies,contractsorobligationswhethersuchinsurerbyoperatinginthisstateorthroughanagentorotherrepresen-tative,orotherwise:
a. Tendollars($10.00)ongrossannualpremiumsuptotwothousanddollars($2,000.00)andanadditional license thereafterof seventydollars ($70.00)oneach ten thousanddollars($10,000.00),orfractionthereof,ofgrossannualpremiumsinexcessoftwothousanddollars($2,000.00);
b. Themaximumlicenseofsuchbusinesses,payabletothismunicipalitybyone(1)insurer,shallnotexceedtwenty-onethousanddollars($21,000.00).
(2) Fire,marine, transportation,etc., insurers.Onany in-surer,engage in thebusinessofissuing policies, contracts or other forms of obligations covering the risk of fire, marine,transportation, surety, :fidelity, indemnity, guar- anty, worker's compensation, employers'liability, prop- erty damage, live stock, vehicle, automatic sprinkler, whosoever in this state,whether such insurer is operating in this state through agents or other representative orotherwise,notmorethanthefollowing:
a. 1stClass:Whenthegrossreceiptsarenotmorethantwothousanddollars($2,000.00),thelicenseshallbefortydollars($40.00);
b. 2ndClass:Whenthegrossreceiptsaremorethantwothousanddollars($2,000.00),andnotmorethanfourthousanddollars($4,000.00),thelicenseshallbesixtydollars($60.00);
c. 3rdClass:Whenthegrossreceiptsaremorethanfourthousanddollars($4,000.00),andnotmorethatsixthousanddollars($6,000.00),thelicenseshallbeeightydollars($80.00);
d. 4th Class: When the gross receipts exceed six thou- sand dollars ($6,000.00), theadditional license there- after shall be seventydollars ($70.00) foreach ten thousanddollars($10,000.00),orfractionthereof,inexcessofsixthousanddollars($6,000.00);
e. Themaximumlicensetaxonsuchbusinesses,pay-abletothismunicipalitybyaninsurershall not exceed themaximum limit of nine thousanddollars ($9,000.00), asprovided forbyL.R.S.22:1076,abovereferredto;
f. Provided,thatplateglassandsteamboilerinspec-tioninsurersshallpayonlyone-thirdof the ratesprovided insubsection (2);andprovided further, that theamountso fixed if thepayershallfileaswornstatementwiththeannualreportrequiredby
L.R.S.Title22,Chapter1,PartXXIII,showingthatatleastone-sixthofthetotaladmittedassetsof the payer, less assets in an amount equal to the reserves on its policies issued in foreigncountries inwhich it is authorized todobusinessandwhichcountries requirean investmentthereinasaconditionofdoingbusiness,isvestedandmaintained,eitherinbondsofthestate,or in bonds ofmunicipal, school, road or levee district, or other political subdivisions of this
stateorinmortgagesonpropertylocatedinthisstate,orinrealpropertyinthisstatewhichshallberequisitefortheconvenientaccommodationofthetransactionofitsownbusiness,orinpolicyloans,orotherloanstoresidentsofthisstate,ortocorporationsorganizedunderthelaws of this state and domiciled in this state, or in stock of homestead building or loanassociationsorganizedunderthelawsofthisstate,totheextentsuchstockisguar-anteedorinsured by the Federal Deposit Insurance Corporation or other federal state agency.(b)Alllicensetaxes leviedhereinshallbedueandpayableonJanuary1ofeachyearandallunpaidlicensetaxesshallbecomedelinquentonJune1.Apenaltyoffive(5)percentpermonthshallbeaddedtotheamountoftaxdueandpayabletothismunicipalityalongwiththetaxdue.Theamountof anymonetarypenalty assessedpursuant to this section shall notbe greater thantwenty-five (25) percent of the total amount of the tax due. The collection of delinquentaccountsshallbeenforcedinaccordancewithL.R.S.22:1076and47:1601.

DIVISION2.PARKINGMETERS
Sec.16-45.Definitions.
For the purpose of this division, the following terms shall have the following meaningsrespectivelyascribedtotheminthissection:
Operatorshallmeanandincludeeverypersonwhoshalloperate,driveorbeincontrolofanyvehicleuponanystreet.
Park shallmean the standingof any vehicle,whetheroccupiedornot, uponany street for aperiodoftimegreaterthanisreasonablynecessaryfortheloadingorunloadingofpersonsormaterials.
Street shall mean and include any public street, avenue, road, boulevard, highway or otherpublicplacelocatedinthetownandestablishedfortheuseofvehicles.
Vehicle shallmeanand includeanydevice in,uponorbywhichanypersonorproperty isormaybetransporteduponahighway.Abicycleormotorbicycleshallbetermedavehicle.
Sec.16-46.Establishmentofzones.
(a) Themayorisherebyauthorizedanddirectedtoestablishzonestobeknownasparkingmeterzonesuponsuchstreetsofthetownasheshallselect,withtheapprovaloftheboardofaldermen, for the location of such zones and to cause parking meters to be installed andparkingmeter spaces tobedesignatedasprovided in this division. Themayor, from time totime,withtheapprovaloftheboardofaldermen,mayaddto,change,orabandonsuchparkingzones. In selecting, changing, or abandon• ing such parkingmeter zones themayor shall beguided and governed by location, amount of traffic, the demand for parking space, thecongestionoftraffic,theuseofthestreetandallothertrafficconditionswhichmaybeexistent.Theparkingmetersprovidedforinthisdivisionshallcontrolparkingonlybetweenthehoursof8:00a.m.and5:00p.m.onalldaysexceptSundays,andlegalholidays,andonproclamationofthemayor.OnSaturdaysthedesignatedhoursshallbefrom8:00a.m.to8:00p.m.Whensuchparkingmetersarenotcontrollingparkingasinthissectionprovided,vehiclesmaybeparkedwithoutinsertinganycoininsuchmeter,buttheparkinglinesadjacenttosuchmetersshallbeadheredtoinsuchparkinginthesamemannerasisrequiredduringothertimes.
Sec.16-47.Installationandmaintenance.
Themayorisdirectedtoprovidefortheinstallation,regulation,control,operationanduseoftheparkingmetersprovidedforinthisdivisionandtomaintainau.chmetersingoodworkablecondition. Themayor further is authorized andempowered to enter into contracts for suchpartsandmaintenanceof suchparkingmetersasmaybenecessary tomaintain the same ingoodoperatingcondition,andtopayforsuchpartsandmaintenanceexclusivelyfromthereceipts, funds and revenues received from the operation of such parkingmeters. Sec.16-48.Placement;legend.
Allparkingmetersinstalledintheparkingmeterzones,establishedas providedin section16-46shallbeplacedupon the curb immediately adjacent to the individualparkingspacesdescribedinsection16-49ofthisdivision.·Eachparkingmetershall be placedorset in sucha mannerastoshowordisplaybyasignalthattheparkingspaceadjacenttosuchmeterisorisnotlegallyinuse.Eachparkingmetershallbeinstalledandsettodisplayuponthedepositofaonecent($0.01)coinorafivecent($0.05)coinoftheUnitedStates therein a signal indicating legal parking for theperiodof timeallowed forsuch respective amount,andshallcontinuetooperatefromthetimeofthedepositofsuchcointhereinuntiltheexpirationofthetimeallottedforsuchrespectivecoin.Eachmeteralsoshallbesoarrangedthatupontheexpirationofsuchallottedtimeitwillindicat
byamechanical operation and the exhibit of a propersignal that the lawfulparkingperiodhasexpired.(Ord.No.

Sec.16-49.Defacingdamagingmetersprohibited.
It shall be unlawful for any person to deface, injure, tamperwith, open orwillfully break,destroy or impair the usefulness of any parkingmeter installed under the provisions of thisdivision.(Ord.No.177,§11,4-2-63)
Sec.16-50.Markingofspaces;mannerofparking.
(a) Themayor is instructed tohave linesormarkingspaintedorplacedupon thecurborstreet adjacent to each parkingmeter for the purpose of designating the parking space forwhichsuchmeter is tobeused,andeachvehicleparkedalongsideofornext toanyparkingmetershallparkwithinthelinesormarkingssoestablished.Itshallbeunlawfulandaviolationof thisdivisiontoparkanyvehicleacrossanysuch lineormarkingorto parkany vehicle insuchapositionthat thesame shall not be entirely withintheareasodesignatedbysuchlinesormarkings.
(b) Whenaparking space inanyparkingmeter zone isparallelwith theadjacent curborsidewalk,anyvehicleparkedinsuchparkingspaceshallbeparkedsothatthe
· foremost part of such vehicle shall be alongside of and next to the parkingmeter.Whenaparkingspaceinanyparkingmeterzoneisdiagonaltothecurborsidewalkanyvehicleparkedinsuchparkingspaceshallbeparkedwiththeforemostpartofsuchvehicledirectedatandnexttosuchmeter.(Ord.No.177,§§5,6,4-2-63)

(a)When any vehicle shall be parked in any space alongside of or next towhich a parkingmeterislocatedinaccordancewiththeprovisionsofthisdivision,theoperatorofsuchvehicle,uponentering theparking space, shall immediatelydepositor cause tobedeposited in suchparkingmetera fivecent ($0.05)coinof theUnitedStates,oraonecent ($0.01)coinof theUnitedStatesincasesuchparkingmeterismadetoacceptsuchonecent($0.01)coin,andatonceshallputsuchmeterintooperationasthereondirected.Theparkingspacemaythenbelawfullyoccupiedbysuchvehicleduringtheperiodoftimewhichhasbeenprescribedfortheamountdeposited.Ifsuchvehicleshallremainparkedinanysuchparkingspacebeyondtheparking time limit allotted for each coin inserted in such meter, the parking meter shalldisplayasignorsignalshowingillegalparking,andsuchvehicleshallbeconsideredasparkedovertimeandbeyondtheperiodoflegalparkingtime.
(b)Theinsertionofafivecent($0.05)coinoftheUnitedStatesintoanyparkingmetershallallowtheoccupancybyavehicleoftheparkingspaceinconjunctiontherewithduringtheperiodofparkingtimewhichhasbeenprescribedbyordinanceforthepartofthestreetinwhichsuchparkingspaceislocated.Theinsertionofaonecent($0.01)coinoftheUnitedStatesintoanymeterconstructedtoacceptsuchcoinshallentitlethevehicletobeparkedintheparkingspaceadjacenttosuchmeterforaperiodoftwelve(12)minutes.Themetersinthetownshallbesoadjustedthattheyindicatetheelapsingofsuchtimes.(Ord.No.177,§§7,8,4-2..S3)
Sec.16-52.Overtimeparkingdeclaredunlawful.
(a) Itshallbeunlawful foranyperson or operator tocause,allow,permitorsufferanyvehicletobeparkedovertimeorbeyondtheperiodforwhichthecoinhehas insertedintheparkingmeterentitlesthevehicletooccupysuchparkingspace.
(b) It shall be unlawful for any person or operator to permit a vehicle to remain in anyparkingspaceadjacent toanyparkingmeter,while themeter isdisplayingasignal indicatingthatthevehicleoccupyingsuchparkingspacehasalreadybeenparkedbeyondtheperiodforwhichthecoin·insertedinsuchmeterentitlesittoremaininsaidparkingspace.(Ord.No.177,§9.4-2-63)
Sec.16-53.Useofslugsprohibited.
Itshallbeunlawfultodepositorcausetobedepositedinanyparkingmeteranyslug,deviceorthingwhatsoeverotherthanafivecent($0.05)oraonecent($0.01)coinoftheUnitedStates.(Ord.No.177,§10,4-2-63)
Sec.16-54.Parkingmeterfund.

Sec.16-55.Violationnotices;penalties.
(a) Each police officer shall attach to every vehicle parking in violation of any of theprovisionsofthisdivisionanoticethatsuchvehiclehasbeensoillegallyparkedandinstructtheoperatortoreportatthepolicedepartmentofthetowninregardtosuchviolation.

ARTICLEIV.ABANDONEDVEHICLES
Sec. 16-67. Abandonment prohibited.
Itshallbeunlawfulforanypersontoabandonany motorvehicleonanystreet,alleyorotherpublicgroundsofthetown.(Ord.No.130,§ 1,9-6-60)
Sec. 16-68. Notice to owner to remove.
When the chief of police or the street commissioner has reason to believe that a motor vehicle has been abandoned on a public street, alley, or any other public grounds, such official shall give written notice to the owner of such vehicle that such vehicle shall be removed from the public street, alley or other public grounds, within five (5) days from service of such notice. Such notice shall be either personally served upon the owner of such motor vehicle or mailed to such owner by registered mail, return receipt requested, and shall give a reasonable description of the motor vehicle, including its license number, if any, and its location and shall be dated and signed by the official. In the event that the owner of such vehicle is unknown and the identity of such owner cannot be determined by reasonable inquiry, then, and in that event, the above-mentioned notice shall be posted on the inside of the windshield or in some other prominent place on such vehicle, and such posting shall constitute service upon the owner of such vehicle. Sec.16-69.Vehiclesremainingafternoticetoconsti-tuteabandonedvehicle.
Anymotorvehicleremainingonanypublicstreet,alleyoranyotherpublicgroundofthetownforfive(5) days after notice, as provided for in section16-68, shall be and constitute an abandoned motorvehicle.(Ord.No.130,§ 2,9-6-60)
Sec.16-70.Removalafternotice.
After the lapse of the period provided for insection 16-69, the chief of police or the streetcommissioner, as the casemay be, shall removesuch vehicle from the public street, alley or anyotherpublic groundsofthetownandshallplacesuch vehicle in the town dump, or in any otherplace,atthediscretionofsuchofficial,whereinsuchvehicleshallremainforaperiodofthirty(30)days:If
such vehicle is not claimed by the owner thereofwithinsuchthirty(30)daysperiodandallcostsandchargespaid,thetownmaydisposeofsuchvehicleby sale as provided in section 16-71 to defray allexpenses of the town in so removing and storingsuchvehicle.(Ord.No.130,§ 4,9-6-60)
Sec.16-71.Saleofunredeemedimpoundedvehicles.
Whenever any motor vehicle belonging to aknownor unknownpersonhasbeen seizedor isotherwise held by the town for illegal parking,stationing or abandoning of such motor vehicleonthepublicstreetsandwaysofthetownandthe same has not been claimed for a period ofthirty
(30) days or more, then the motor vehicleshallbeconsideredashavingbeenabandonedtothe town and the town may dispose of suchmotorvehicleandcollectthecostsandchargesofremoving and storing such vehicle in thefollowingmanner:
(1) After the thirty (30) days period haselapsed,thetownshallsenda registeredorcertifiedletter,returnreceiptrequested,tothelast-knownownerofthevehicleathislast-known address informing him thatthe town is holding such vehicle and willsellthevehicletothehighestbidderunlesstheowner,onor before the dateof sale,claimsthevehicleandpaystothetownallcostsandchargesimposedbythetownfortheremovalanddetentionofthevehicle.Acopyofsuchlettershallalsobesenttoanypersonorfirmknowntobetheholderofamortgageonsuchvehicle.
(2) Beforethesaleofanysuchvehicles,thetownshall have them appraised by a competentappraiser and shall publish a notice of theproposed sale of such vehicles in the officialjournalofthetownnot less
thanthree(3) timeswithinaten (10) dayperiodprior
to the date of the sale. The published noticeshallcontainacompletelistofthevehiclestobe sold, thedateandplaceof such sale, andnotification that said vehicles will be soldeither individually or in tototothehighestbidder therefor, all in the discretion of thetown.
(3) All funds received from the sale of a motorvehicle under the provisions hereof shall be setasideandplacedinaseparateaccountestablishedthereforbythetown.If,withinoneyearfollowingthe date of the sale, the owner or lienholder ofanyofsuchvehiclesshallpresentsufficient prooftothe townofhisownershipor lien,theowneror lienholder shall be entitled to the amountreceived for his individual vehicle less his proratashareofthecostsandexpensesofthesale,aswellasallchargesandcostsdueandowingforremovalandstorageofthevehicle.Anyfundsnotclaimedwithinoneyearfollowingthedateofsaleshall be deposited to the general fund of thetown.
AmendmentofChapter16,Sec.16-71toreadasfollows:
Sec.16-71.Saleorotherdisposalofjunkedmotorvehicles.
Anyjunkedmotorvehicleasdefinedinthischaptermayberemovedanddisposedofafternoticeofnotlessthan5dayseitherplacedonthevehicleitselforgiventotheowner,ifknown.AnyjunkedmotorvehiclewhichremainsonthepublicwayorprivatepropertyafternoticegivenasprovidedhereinshallbeconsideredaspublicpropertyandshallbedisposedofbytheChurchPointPoliceDepartment.Saiddepartmentisherebygivenauthoritytodisposeofsuchjunkedmotorvehiclesbyanyofthefollowingmeans,towit:
(1) CauseSaidmotorvehicletobedeliveredtoasalvageorscrapfacilityandsurrenderedasscraptoanysuchfacilitywillingtoacceptsame.
(2) Negotiatewithanytowingcompanyorcompaniesanagreementoragreementswherebythetowingcompanyorcompaniesshallremove
thevehicleinconsiderationofthecompanyreceivinganysalvagevaluewhichmaybeobtainedtherefrom.
(3) Otherwisedisposeofsaidvehicleinthemostcosteffectivemeanspossible,includingpaymentofreasonablefeestoanythirdpartywillingtoacceptsame,ifnopartyiswillingtoeitherpayforsameoracceptsameforsalvagevehicle.

PURPOSEANDINTENT
THE MAYOR AND THE CHURCH POINT TOWN COUNCIL HEREBY MAKES ITKNOWN THAT IT IS THE RESPONSIBILITY OF ALL CITIZENS OF THE TOWN OFCHURCH POINT TO DISPOSE OF THEIR OWN JUNKED ITEM OR ITEMS ANDJUNKEDVEHICLESANDTOABATEALLNUISANCES.THETOWNOFCHURCHPOINTWILLNOTBERESPONSIBLEFORDISPOSINGOFANYJUNKEDITEMSASDEFINEDINTHEDEFINITIONSSECTIONTHATFOLLOWSOFSUCHORJUNKEDVEHICLESASDEFINEDINTHEDEFINITIONSSECTIONTHATFOLLOWS.
THE TOWN OF CHURCH POINT HEREBY GIVE FORMAL NOTICE THAT ALLPROPERTIES LOCATED WITHIN THE CORPORATE LIMITS OF THE TOWN OFCHURCHPOINTMUSTBEMAINTAINEDINASAFEANDSANITARYCONDITION
Pursuanttotheauthorityconferredby33:4876andanysubsequentamendmentsthereto, the Town of church Point hereby recognizes the power granted tomunicipalities to regulate and prohibit storing of (1) Junk or junked items (2)junkedmotorvehicles.
Pursuant to the authority conferred by R.S. 33:5062 and any subsequentamendments thereto, the Town of Church Point hereby recognizes the powergrantedtomunicipalitiesrequiringthatprivatepropertybemaintainedinasafeandsanitarycondition,andproviding for thecutting,destructionor removalofnoxiousweedsorgrassorotherdeleterious,unhealthfulornoxiousgrowthsatcosttothepropertyowner.
TheChurchPointTowncouncil,aftercarefulconsideration,hasdeterminedthatregulatingthelocationandstorageofjunkeditemsandjunkedmotorvehiclesonpublicandprivateproperty isnecessary inorder toprotect thebest interestofthepublicandtoprovide for thesafetyofallof thecitizensof thecityandthesurroundingarea.The Town Council, after careful consideration, has determined that thestorageofsuchmotorvehiclesisundulyexpensiveforthetownandaccountsfor a vast majority of the costs involved in the disposal of junked motorvehicles.The town of Church Point hereby adopts, in part, the 2012 InternationalPropertyMaintenanceonlytotheextentoftheprovisionsusedherein.
PARTONE—ADMINISTRATIONANDENFORCEMENT
General.Thedepartmentofpropertymaintenanceinspectionisherebycreatedandtheexecutiveofficialinchargethereofshallbeknownasthecodeofficial.
Appointment.Thecodeofficialshallbeappointedbythechiefappointingauthorityofthejurisdiction.
Deputies.Inaccordancewiththeprescribedproceduresofthisjurisdictionandwiththeconcurrenceoftheappointingauthority,thecodeofficialshallhavetheauthoritytoappointadeputy(s).Suchemployeesshallhavepowersasdelegatedbythecodeofficial.
Liability.Thecodeofficialoremployeechargedwiththeenforcementofthiscode,whileactingforthejurisdiction,ingoodfaithandwithoutmaliceinthedischargeofthedutiesrequiredbythiscodeorotherpertinentlaworordinance,shallnottherebyberenderedliablepersonally,andisherebyrelievedfromallpersonal
liabilityforanydamageaccruingtopersonsorpropertyasaresultofanactorbyreasonofanactoromissioninthedischargeofofficialduties.Anysuitinstitutedagainstanyofficeroremployeebecauseofanactperformedbythatofficeroremployeeinthelawfuldischargeofdutiesandundertheprovisionsofthiscodeshallbedefendedbythelegalrepresentativeofthejurisdictionuntilthefinalterminationoftheproceedings.Thecodeofficialoranysubordinateshallnotbeliableforcostsinanaction,suitorproceedingthatisinstitutedinpursuanceoftheprovisionsofthiscode.
Owner.Theownerof thepremisesshallmeantheperson listedastheowneroftheprivatepropertyinquestionaccordingtothecurrentTownpropertytaxrolls,andhis/heraddressshallbethelastaddressshownonsaidrolls.
Occupant. The occupant of the premises shall mean anyone residing on theprivatepropertyinquestion.
PARTTWO--DUTIESANDPOWERSOFTHENUISANCEOFFICIAL
General.Thecodeofficialisherebyauthorizedanddirectedtoenforcetheprovisionsofthiscode.Thecodeofficialshallhavetheauthoritytorenderinterpretationsofthiscodeandtoadoptpoliciesandproceduresinordertoclarifytheapplicationofitsprovisions.Suchinterpretations,policiesandproceduresshallbeincompliancewiththeintentandpurposeofthiscode.Suchpoliciesandproceduresshallnothavetheeffectofwaivingrequirementsspecificallyprovidedforinthiscode.
Inspections.Thecodeofficialshallmakealloftherequiredinspections,orshallacceptreportsofinspectionbyapprovedagenciesorindividuals.Allreportsofsuchinspectionsshallbeinwritingandbecertifiedbyaresponsibleofficerofsuchapprovedagencyorbytheresponsibleindividual.Thecodeofficialisauthorizedtoengagesuchexpertopinionasdeemednecessarytoreportuponunusualtechnicalissuesthatarise,subjecttotheapprovaloftheappointingauthority.
Rightofentry.Whereitisnecessarytomakeaninspectiontoenforcetheprovisionsofthiscode,orwheneverthecodeofficialhasreasonablecausetobelievethatthereexistsinastructureoruponapremisesaconditioninviolationofthiscode,thecodeofficialisauthorizedtoenterthestructureorpremisesatreasonabletimestoinspectorperformthedutiesimposedbythiscode,providedthatifsuchstructureorpremisesisoccupiedthecodeofficialshallpresent
credentialstotheoccupantandrequestentry.Ifsuchstructureorpremisesisunoccupied,thecodeofficialshallfirstmakeareasonableefforttolocatetheownerorotherpersonhavingchargeorcontrolofthestructureorpremisesandrequestentry.Ifentryisrefused,thecodeofficialshallhaverecoursetotheremediesprovidedbylawtosecureentry.
Identification.Thecodeofficialshallcarryproperidentificationwheninspectingstructuresorpremisesintheperformanceofdutiesunderthiscode.
Noticesandorders.Thecodeofficialshallissueallnecessarynoticesororderstoensurecompliancewiththiscodeasappliestothisordinance.
Departmentrecords.Thecodeofficialshallkeepofficialrecordsofallbusinessandactivitiesofthedepartmentspecifiedintheprovisionsofthiscode.Suchrecordsshallberetainedintheofficialrecordsfortheperiodrequiredforretentionofpublicrecords.
PARTTHREE--NUISANCES
Sanitation.Allexteriorpropertyandpremisesshallbemaintainedinaclean,safeandsanitarycondition.Theoccupantshallkeepthatpartoftheexteriorpropertywhichsuchoccupantoccupiesorcontrolsinacleanandsanitarycondition.
Gradinganddrainage.Allpremisesshallbegradedandmaintainedtopreventtheerosionofsoilandtopreventtheaccumulationofstagnantwaterthereon,orwithinanystructurelocatedthereon.
Exception:Approvedretentionareasandreservoirs.
Sidewalksanddriveways.Allsidewalks,walkways,stairs,driveways,parkingspacesandsimilarareasshallbekeptinaproperstateofrepair,andmaintainedfreefromhazardousconditions.
Weeds.Allpremisesandexteriorpropertyshallbemaintainedfreefromweedsorplantgrowthinexcessof12inches.Allnoxiousweedsshallbeprohibited.Weedsshallbedefinedasallgrasses,annualplantsandvegetation,otherthantreesorshrubsprovided;however,thistermshallnotincludecultivatedflowersandgardens.
Rodentharborage.Allstructuresandexteriorpropertyshallbekeptfreefromrodentharborageandinfestation.Whererodentsarefound,theyshallbepromptlyexterminatedbyapprovedprocesseswhichwillnotbeinjuriousto
humanhealth.Afterpestelimination,properprecautionsshallbetakentoeliminaterodentharborageandpreventrein-festation.
Exhaustvents.Pipes,ducts,conductors,fansorblowersshallnotdischargegases,steam,vapor,hotair,grease,smoke,odorsorothergaseousorparticulatewastesdirectlyuponabuttingoradjacentpublicorprivatepropertyorthatofanothertenant.
Accessorystructures.Allaccessorystructures,includingdetachedgarages,fencesandwalls,shallbemaintainedstructurallysoundandingoodrepair.
Motorvehicles. Exceptasprovided for inother regulations,no inoperativeorunlicensedmotorvehicleshallbeparked,keptorstoredonanypremises,andnovehicleshallatanytimebeinastateofmajordisassembly,disrepair,orintheprocessof being strippedordismantled. Paintingof vehicles is prohibitedunlessconductedinsideanapprovedspraybooth.Junked vehicles: The term "junk, wrecked or used automobiles or motorvehicles" as used herein shall mean any motor vehicle which is totallyinoperable and left unattended on any portion of any occupied lot, neutralground, streetor sidewalk,and is sodamagedordismantledas tobea totalloss or is lawfully inoperable on public streets under the provisions of thevarious statutes and ordinances applicable in this jurisdiction as a result ofsignificantdamage,decayordestruction.Theterm"totalloss"shallmeanthatthe cost to repair a damaged or dismantled motor vehicle exceeds the junkvalueofsaidvehicle,asdeterminedbyanyrecognizednationalappraisalbook.Exception: Any antique motor vehicle retained by the owner for antiquecollection purposes, rather than for salvage or transportation. (such vehiclemust be at least 25 years old and the owner will have 60 days to start therestoration work on any antique motor vehicle), parts from antique vehiclesmaintained on private property that are being used for restoration purposes,anymotorvehicle storedonprivatepropertyas thepropertyofamemberofthearmed forcesof theUnitedStateswho isonactivedutyassignment, anymotor vehiclewhich is storedundera carportor inagarage;The fact thatamotor vehicle is being storedorotherwisemaintained for spareparts for therepair of any other motor vehicle, or motor vehicles, shall not exempt suchvehicle from being determined to be a junked motor vehicle if it otherwisemeetsanyoftheconditionssetforthinthisdefinition.
Exception:Avehicleofanytypeispermittedtoundergomajoroverhaul,includingbodywork,providedthatsuchworkisperformedinsideastructureorsimilarlyenclosedareadesignedandapprovedforsuchpurposes.
Defacementofproperty.Nopersonshallwillfullyorwantonlydamage,mutilateordefaceanyexteriorsurfaceofanystructureorbuildingonanyprivateorpublicpropertybyplacingthereonanymarking,carvingorgraffiti.
Itshallbetheresponsibilityoftheownertorestoresaidsurfacetoanapprovedstateofmaintenanceandrepair.
Accumulationofrubbishorgarbage.Allexteriorpropertyandpremises,andtheinteriorofeverystructure,shallbefreefromanyaccumulationofrubbishorgarbage.
Disposalofrubbish.Everyoccupantofastructureshalldisposeofallrubbishinacleanandsanitarymannerbyplacingsuchrubbishinapprovedcontainers.
Rubbishstoragefacilities.Theownerofeveryoccupiedpremisesshallsupplyapprovedcoveredcontainersforrubbish,andtheownerofthepremisesshallberesponsiblefortheremovalofrubbish.
Refrigerators.Refrigeratorsandsimilarequipmentnotinoperationshallnotbediscarded,abandonedorstoredonpremiseswithoutfirstremovingthedoors.
Disposalofgarbage.Everyoccupantofastructureshalldisposeofgarbageinacleanandsanitarymannerbyplacingsuchgarbageinanapprovedgarbagedisposalfacilityorapprovedgarbagecontainers.
Garbagefacilities.Theownerofeverydwellingshallsupplyoneofthefollowing:anapprovedmechanicalfoodwastegrinderineachdwellingunit;anapprovedincineratorunitinthestructureavailabletotheoccupantsineachdwellingunit;oranapprovedleakproof,covered,outsidegarbagecontainer.
Containers.Theoperatorofeveryestablishmentproducinggarbageshallprovide,andatalltimescausetobeutilized,approvedleakproofcontainersprovidedwithclose-fitting
coversforthestorageofsuchmaterialsuntilremovedfromthepremisesfordisposal.
Junked items other than junked vehicles means Any used electrical applianceand/or parts thereof, including, but not limited to, a washingmachine, clothesdryer,refrigerator,orfreezer.Machineryand/orequipmentorpartsthereofotherthan junkedmotor vehicles and unused electrical appliances which, by reasondeterioration through rusting, rotting, or otherwise, have been inoperativeand/orunusableforthepurposeforwhichtheywereintended.
Construction Debris- including but not limited to steel, glass, brick, concrete,asphaltmaterial,pipe,gypsum,wallboard,and lumber fromtheconstructionor
destructionofastructureaspartofaconstructionordemolitionprojectorfromtherenovationofastructureand/or landscaping,and includingrocks,soils, treeremains, trees, and other vegetative matter that normally results from landclearing, landscaping and development operations for a construction project.Clean cardboard, paper, plastic, wood, andmetal scraps from any constructionand/or landscape project. Non-construction and demolition debriswood scraps,other non-hazardous wastes that are generated at construction or demolitionprojects,providedsuchamountsareconsistentwithbestmanagementpracticesof the industry and used or discarded materials resulting from construction,remodeling,repair,ordemolitionoperationsonanypavement,house,commercialbuilding,orotherstructureandsuchothermaterialsasmayberemovedduringthenormalcleanupprocessofsuchconstruction,remodeling,repair,ordemolitionoperations.
Town---“Town”istheTownofCHURCHPOINT,amunicipalcorporationorganized
underthelawsoftheStateofLouisiana.
SECTIONFOUR--NOTICESANDORDERS
Noticetopersonresponsible.Wheneverthecodeofficialdeterminesthattherehasbeenaviolationofthisordinanceorhasgroundstobelievethataviolationhasoccurred,noticeshallbegiveninthemannerprescribedhereintothepersonresponsiblefortheviolationasspecifiedinthiscode.
Form.Suchnoticeshallbeinaccordancewithallofthefollowing:
1. Beinwriting
2. Includeastatementoftheviolationorviolationsandwhythenoticeisbeingissued.
3. Includeacorrectionorderallowing10businessdaystobringtheallegednuisanceviolationintocompliancewiththeprovisionsofthisordinance.
Methodofservice.Suchnoticeshallbedeemedtobeproperlyservedifacopythereofisdeliveredinanyofthreewaysasfollows:
1. Deliveredpersonallybyplacingsuchnoticeviaasticker,decalorthelikeonthejunkedvehicleoronthedoorofthehome,buildingorpropertywheresuchnuisanceviolationhasoccurred
2. Sentbycertifiedorfirst-classmailaddressedtothelastknownaddress;
3. Attachsuchtothefrontdooroftheresidenceinquestion
Anyorderornoticesrequiredtobeservedonanoccupantofthepremisesshallbeconsideredservedbymailingthesametotheoccupantatthephysicaladdressoftheprivatepropertyorbyattachingthesametothefrontdooroftheresidenceinquestion
Inthosecaseswhereserviceofnoticesorordersistobemadebymailing,serviceis complete upon the mailing and shall be proved by the certificate of theindividualmailingsuchnoticeororder.
Asanalternativetotheforegoingmannerofservice,noticesandordersmaybeservedasprovidedintheLouisianaCodeofProcedure.
Unauthorizedtampering.Signs,tagsorsealspostedoraffixedbythecodeofficialshallnotbemutilated,destroyedortamperedwith,orremovedwithoutauthorizationfromthecodeofficial.
Penalties.Seeviolationssection
Transferofownership.Itshallbeunlawfulfortheownerofanydwellingunitorstructurewhohasreceivedacomplianceorderoruponwhomanoticeofviolationhasbeenservedtosell,transfer,mortgage,leaseorotherwisedisposeofsuchdwellingunitorstructuretoanotheruntiltheprovisionsofthecomplianceorderornoticeofviolationhavebeencompliedwith,oruntilsuchownershallfirstfurnishthegrantee,transferee,mortgageeorlesseeatruecopyofanycomplianceorderornoticeofviolationissuedbythecodeofficialandshallfurnishtothecodeofficialasignedandnotarizedstatementfromthegrantee,transferee,mortgageeorlessee,acknowledgingthereceiptofsuchcomplianceorderornoticeofviolationandfullyacceptingtheresponsibilitywithoutcondition
formakingthecorrectionsorrepairsrequiredbysuchcomplianceorderornoticeofviolation.
Uponfailureoftheowneroragenthavingchargeofapropertytocutanddestroyweedswithinten(10)daysafterserviceofanoticeofviolationshallbesubjecttoprosecution in accordance with the penalties section made part hereof. Uponfailuretocomplywiththenoticeofviolation,anydulyauthorizedemployeeofthejurisdiction or contractor hired by the jurisdiction shall be authorized to enterupon theproperty in violationand cut anddestroy theweedsgrowing thereon,andthecostsofsuchremovalshallbepaidbytheowneroragentresponsibleforthe property. In the exercise of the authority herein granted, the governingauthoritymayprovide for the removal of suchabandoned junk vehicles by themunicipalityforthecollectionofthecostofremoval,nottoexceedtwohundreddollars (not including private towing company fees), from the owner of thematerialand,amongotherthings,mayrequire,butnotbywayoflimitation,thatany vacant lot or portion of any occupied lot used for the storage of junk, asherein defined, shall be surrounded or enclosed by a board fence or otherenclosure.
SECTIONFIVE-ENCLOSUREREQUIRED.
Noperson,firmorcorporationshallstoreorofferforsaleanyironorsteel junk,junked motor vehicles, including parts and accessories thereof, or wreck ordismantlesaiditemsforcommercialpurposesonanyprivatepropertythatisnotproperly enclosed on all boundary lines with a substantial fence not less thanseven (7) feet nor more than ten (10) feet high or completely screening saidenclosedareafrompublicview.Suchareasorparcelsofland,orpremises,shallbeenclosedwithasolid,nontransparentwallor fence,exceptingforentrancesandexits.Chain-linkedfencingispermissibleifappropriateslatsareinsertedintothewiremeshtomakethefencingnontransparent.Theprovisionsofthesectionshallnot apply to a private property uponwhich the aforestated activities are beingconductedat theeffectivedateof thisordinance,butshallapply tosaidprivateproperty after any period of six (6) consecutive months during which theaforedescribedactivitiesarenotconducted.
SECTIONSIX-SEVERABILITY
In the event any section, part or portion of this ordinance shall be foundunconstitutional,orotherwiseunenforceable,theremainingportionshallbevalidandoffullforceandeffect.
SECTIONSEVEN--REPEALOFCONFLICTINGORDINANCES.
All ordinances and laws or parts of ordinances and laws not specifically notedabovewhichareinconflictwiththisordinanceareherebyrepealed.
SECTIONTWELVE--VIOLATIONS
Unlawfulacts.Itshallbeunlawfulforaperson,firmorcorporationtobeinconflictwithorinviolationofanyoftheprovisionsofthisordinance.
Noticeofviolation.Thecodeofficialshallserveanoticeofviolation.
Prosecutionofviolation.Anyperson failing tocomplywithanoticeofviolationwithin10daysofthenoticebeingservedbyandinaccordancewiththisordinanceshallbegivenacitationandsummoned toappearbefore theMagistrateof theChurch PointMayors Court. Any person violating any of the provisions of thisordinanceshallbeguiltyofamisdemeanor,anduponconvictionshallbesubjecttoafineofnotmorethantwohundreddollars($200.00)perdayforeverydayinviolation thereof; each separate day of violation shall constitute a separateoffenseandtheviolationshallbedeemedastrictliabilityoffense.Ifthenoticeofviolation is not complied with, the code official shall institute the appropriateproceedingat lawor in equity to restrain, correctorabate suchviolation,or torequiretheremovalorterminationoftheunlawfuloccupancyofthestructureinviolationoftheprovisionsofthiscodeoroftheorderordirectionmadepursuantthereto. Any action taken by the authority having jurisdiction on such premises
shallbechargedagainst therealestateuponwhichthestructure is locatedandshallbealienplaceduponsuchrealestate.
Violationpenalties.Anypersonwhoshallviolateaprovisionofthiscode,orfailtocomplytherewith,orwithanyoftherequirementsthereof,shallbeprosecutedwithinthelimitsprovidedbystateorlocallaws.Eachdaythataviolationcontinuesafterduenoticehasbeenservedshallbedeemedaseparateoffense.
Abatementofviolation.Theimpositionofthepenaltieshereinprescribedshallnotprecludethelegalofficerofthejurisdictionfrominstitutingappropriateactiontorestrain,correctorabateaviolation,ortopreventillegaloccupancyofabuilding,structureorpremises,ortostopanillegalact,conduct,businessorutilizationofthebuilding,structureorpremises
