TOR MM Forum Since the inaugural National MM Forum on 28 February 2011 the forum has continued to evolve since then with provincial forums also convening in most provinces. MMs have reflected extensively on the forum and made proposals for refinement.

MMs unanimously recognised the importance of the MM Forum and reaffirmed its existence and continued convening by SALGA.

It was also agreed that all Provinces should organise Provincial Forums and to keep the forums functional

It was further agreed on a need for an institute that would amongst others, deal with labour issues affecting MMs.

Provinces will nominate two people to serve on a steering committee to work on the formation of the proposed institute.

Refined Terms of Reference have been presented to Provincial MM Forums.

Provincial MM Forums have been established in 8 provinces and preparations are being made for the 9th one.

DCOG has drafted regulations to give effect to the Systems Amendment Act. NT has also drafted minimum competence regulations. On 1 January 2013 the regulations came into effect

The NMMF raised concerns on the MSA Amendment regulations and requested SALGA to make inputs on the matter and also to find out if indeed the regulations were necessary, given the complications wrt implementation. The NMMF requested that SALGA should continue to represent the interests of Local Government on the matter.

It was indicated that the matter also receive attention at the MINMEC meeting as an input from the NMMF. It was further agreed that the MMs be kept updated on the matter.

Regulations on appointment and conditions of service of senior managers was published for public comment on 7 March 2013.

SALGA consulted municipalities and developed a submission on the regulations, in addition to having had technical engagements with the Dept at various stages.

It is hoped that final version will take cognisance of the SALGA comments and provide appropriate guidance on the implementation of the Systems Amendment Act.

The matter is on the agenda of NMMF of 29 April 2013

Impacts of ESKOM Electricity Distribution on Municipalities.

SALGA met ESKOM on 28 May 2013 to address numerous issues raised by municipalities.

The MM Forum noted Eskom proposal for the Multi Year Price Dispensation was also discussed.

SALGA and ESKOM have agreed to facilitate SDAs. A task team has been established to determine the contents, structuring and positioning of the agreement

SALGA partnering with Statssa initiated a partnership on a local data programme (Municipal Barometer)

This aims to improve baseline data for improved planning & oversight. The 2011 census results launched have been packaged to provide ward level data.

The presentation by the SG was noted. It was agreed that the MMs could download the presentation and the statistics from the STATSSA website for information and further usage in the municipal administrative process.

Statssa have been engaging various provincial offices regarding provincial statistics.

Statssa is working with SALGA to enable continuous dissemination of municipal data through partnering on the Municipal Barometer.

The Municipal Barometer is on the agenda of the MM Forum on 30 April 2013

Municipal Finance Matters

The AG presented preliminary audit outcomes to SALGA in Feb & March

Preliminary results are a mixture of opinions for municipalities and municipal entities.

159 municipalities and entities have obtained unqualified opinions while, 179 have not.

One of the key challenges is non-compliance with laws and regulations. In the same token municipalities have raised concerns wrt cost of compliance and financial and capacity implications due to increased GRAP and other reporting requirements

In October 2012 SALGA engaged 75 municipalities who have persistently underperformed. Pledges were made by concerned municipalities which need to be closely monitored and support must be provided where required.

A SALGA has developed a support programme that involves the deployment of a SALGA team to assist at least 15 municipalities with hands-on support

Minimum Competence Reg’s

NT Min Competence regulations came into effect on 1 Jan 2013 The effect is that employees not in possession of the required qualifications may not be legally employed in municipalities.

The MM Forum of 30 & 31 Oct 2013 requested SALGA to present concerns at MinMec.

Many municipalities haven’t received feedback from NT on applications for extension for employees who are in process of obtaining the necessary applications The first court application in this regard has been brought and all interested parties are awaiting the outcome of the matter. The non-compliance with the regulations by employees in municipalities will negatively impact on the audit outcomes for the 2012/2013 financial year.

SALGA engaged the Minister CoGTA at MinMec in November 2012 and commitment made to facilitate engagement between SALGA, CoGTA, NT,

Public Admin Bill:

The Dept of Public Administration intends to have the Bill finalised by June 2013, leaving very little time for consultation

Due to the evolution of local government as a sector since 2007 when an initial LG position was taken as well as the fact that the collective bargaining role of SALGA will be seriously affected by the Bill, it is proposed that SALGA reconsider its position

SALGA has been invited to participate in Nedlac where the matter was raised

A new SALGA consultation with members be embarked upon to ensure that the SALGA position is in accordance with the view of its members.

National Treasury Circulars

National Treasury has over the last couple of years issued a number of circulars to municipalities. The said circulars covers a wide range of matters

In some instances municipalities do not agree with the contents of the circulars.

The impact of such circulars and its continued development is causing serious challenges for the sector as well as the fact that the AG and others apply it strictly when it is not a binding instrument

It is proposed that SALGA

develops a formal position paper regarding NT circulars and that based on such a position engage NT and AG to agree on the status of the circulars and how they shall be managed
