3 Consideration and adoption of amendments to mandatory instruments Amendments to SOLAS – Enter into force 1 January 2014 Chapter II-1, Regulation 8-1 System capabilities after a flooding casualty on passenger ships Existing regulation is replaced. Applies to passenger ships with a length of 120 meters and above with three or more main vertical fire zones. With regards to SRtP (safe return to port) an on-board stability computer is required, or shore-based support for the purpose of providing operational information to the Master after a flooding casualty, Chapter III, Regulation 20 Operational readiness, maintenance and inspections A new subparagraph 11.4 has been added regarding operational testing of the release systems for free-fall lifeboats. All parties concerned are encouraged to implement the new subparagraph 11.4 to Regulation 20 at the earliest possible opportunity. Chapter V, Regulation 14 Ship’s manning Existing text has been re-written with reference to IMO guidance requiring that the manning shall be established following a transparent procedure. Chapter VI, Regulation 5-2 Prohibition of the blending of bulk liquid cargoes and production processes during sea voyages This new regulation describes the prohibit blending of bulk liquid cargoes on-board during sea voyages. However, this prohibition does not apply to the blending of products for the use in the search and exploitation of seabed mineral resources (e.g. oil and gas). Chapter VII, Regulation 4 Documents Existing paragraphs 1 and 2 have been re-written specifying which documents shall be available to parties involved when carrying dangerous goods in packaged form. Chapter XI-1, Regulation 2 Enhanced surveys This regulation has been amended with updated reference to IMO Resolution A.1049(27) (2011 ESP Code) Amendments to HSC 2000 Code – Enter into force 1 January 2014 In Chapter 14 Radiocommunications, paragraph 14.15.10 has been updated stating that annual survey of EPIRBs shall be within the survey window. Amendments to FSS Code – Enter into force 1 January 2014 A new Chapter 6 Fixed foam fire-extinguishing systems for machinery spaces, cargo spaces, vehicle spaces, ro-ro spaces and special category spaces has replaced the existing chapter. Chapter 8 Automatic sprinkler, fire detection and fire alarm systems has been amended with a description of where a dry pipe system or pre-action systems is permitted to be fitted. Amendments to IMDG Code – Enter into force 1 January 2014 The whole IMDG Code with the annexes is updated with regards to uniformed terms, typographic and grammatical matters, in addition to updated information of dangerous goods. The amended IMDG Code may apply on a voluntary basis from 1 January 2013. Amendment to the International Convention on Load Lines, 1966 and the Protocol of 1988 Details regarding Winter Seasonal Zone off the southern tip of Africa have been included in captioned IMO instruments.

Amendments to SOLAS – Appendix - Certificates All SOLAS safety certificates and records of equipment are to be amended with updated references to appropriate IMO instruments. The Record of equipment for passenger ship safety (Form P) has been amended with new entries for lifejackets. The new entries regarding lifejackets will be as follows; total number of lifejackets, in addition to numbers of adult, child and infant lifejackets. Also, new entry regarding number of life-rafts served by MES will be amended. 4 Measures to enhance maritime security The Committee, recognizing that shipping companies may find it difficult to identify reliable, professional private providers of armed security, approved guidelines as described below to assist ship operators and ship masters on the use of privately contracted armed security personnel (PMSC) on board ships to provide additional protection against acts of piracy and armed robbery. The guidelines cover PMSC professional certification, including the recommendation that companies should seek certification with relevant national and international private maritime security service standards once these are in place. The guidelines also cover (PMSC) company requirements, including the recommendation that PMSCs should establish procedures to provide maritime security services to ship owners and ship operators and comply with all relevant legal requirements, and they provide advice on management, including recommendations on selection, vetting and training of team personnel. Finally, the guidelines include information on deployment, addressing the PMSC’s role in ensuring efficient and successful deployment, including communicating with the ship owner or operator and making recommendations on management of firearms and ammunition from embarkation to disembarkation and use of force. The Committee wants PMSCs to recognize that laws governing the use of force may differ over time and location. The applicable national law, including any criminal laws, for an incident on a ship from which armed guards will be operating will be principally that of the flag state. However, the Committee also noted that PMSCs might be subject to laws and regulations of coastal, port and other states. The Committee requested the International Standardization Organization (ISO) to develop international standards for PMSCs. The Committee approved the following MSC circulars: − MSC.1/Circ.1443 Interim guidance to private maritime security companies providing privately

contracted armed security personnel on board ships in the high risk area − MSC.1/Circ.1405/Rev.2 Revised interim guidance to shipowners, ship operators, and shipmasters

on the use of privately contracted armed security personnel on board ships in the high risk area − MSC.1/Circ.1444 Interim guidance for flag states on measures to prevent and mitigate Somalia-

based piracy.

5 Goal-based new ship construction standards A Working Group on GBS and FSA discussed: − further development of the risk based approach to goal based standards (GBS/Safety Level

Approach), and; − development of generic IMO Guidelines on approval of risk-based ship design

(based on MSC 86/5/3 prepared in the SAFEDOR project). It was agreed to bring both topics forward. At MSC 91 there will be a working group dealing with GBS/SLA and until MSC 92 there will be work done in a correspondence group on preparing guidelines for approval of risk based design.

6 LRIT-related matters The Committee adopted resolution MSC.330(90) on Amendments to the Revised performance standards and functional requirements for the long-range identification and tracking of ships and resolution MSC.331(90) on Amendments to resolution MSC.298(87) on establishment of a distribution facility.

The Committee furthermore approved the amendments to LRIT Technical documentation (parts I and II, respectively), including the additional draft amendments to be implemented during a future modification testing phase of the LRIT system, and requested the Secretariat to issue updated circulars as MSC.1/Circ.1259/Rev.5 and MSC.1/Circ.1294/Rev.3. The Committee also approved amendments to MSC.1/Circ.1376 on Continuity of service plan for the LRIT system and requested the Secretariat to issue an updated circular as MSC.1/Circ.1376/Rev.1 and approved COMSAR.1/Circ.54 on Audits of LRIT Data Centres and of the International LRIT Data Exchange conducted by the LRIT Coordinator. Furthermore the Committee approved MSC/Circ.1412 on Principles and guidelines relating to the review and audit of the performance of LRIT Data Centres and of the International LRIT Data Exchange. 8 Radiocommunications and search and rescue The Committee approved five circulars: − COMSAR.1/Circ.50/Rev.1 on Distress priority Communications for RCC from shore-to-ship via

Inmarsat − A new MSC circular on the Revised Questionnaire on Shore-based Facilities for the Global Maritime

Distress and Safety System (GMDSS) − A new MSC circular on Basic Safety Guidance for yacht races or Oceanic voyages by non-regulated

craft − A revised MSC circular on the Revised Guidelines on annual testing of 406 MHz satellite EPIRBs − SAR.7/Circ.10 on the List of documents and publications which should be held by a MRCC. The Committee also approved the draft amendments to the IAMSAR Manual for inclusion in the 2013 edition of the IAMSAR Manual. 9 Ship design and equipment The Committee approved the following circulars: − A new MSC circular on Unified interpretation of SOLAS regulations II-1/28 and II-1/29 concerning

means of going astern and steering gears − A new MSC circular on Guidelines for passenger ship tenders − A new MSC circular on Guidelines for the design and installation of a visible element to the general

emergency alarm on passenger ships − A new MSC circular on Guidelines for the standardization of lifeboat control arrangements − A new MSC circular on Guidelines on exemptions for crude oil tankers solely engaged in the

carriage of cargoes and cargo handling operations not causing corrosion − A new MSC circular on Unified interpretations of the Code of Safety for Special Purpose Ships, 2008

(2008 SPS Code) concerning the expression "certified on or after 13 May 2008"; near coastal voyages; determining the bilge pump numeral in accordance with SOLAS regulation II-1/35-1; general SOLAS requirements relating to passenger ships; safe return to port; "formal safety assessment"; and concerning the application of SOLAS chapter V.

− A new MSC circular on Awareness of counterfeit and substandard life-saving appliances − A new MSC circular on Early implementation of the amendments to SOLAS regulation III/20.11.2, in

conjunction with the adoption of amendments to SOLAS regulation III/20.11.2 − A new MSC circular on Unified Interpretation to paragraph 1.2.2.6 of the LSA Code concerning

lifeboat exterior colour − A new MSC circular on Unified interpretation of SOLAS regulation II-1/48.3 concerning protection

against flooding − A new MSC circular on Unified interpretation of SOLAS regulations II-1/29.3 and 29.4 concerning

steering gear − MSC circular on Unified interpretation of SOLAS regulation II-1/3-5 concerning asbestos.

The Committee further agreed that viewing the results of evaluations of existing lifeboat release and retrieval systems contained in the new GISIS module should be open to the public. With regard to amalgamation of MSC.1/Circ.1206/Rev.1 and MSC.1/Circ.1277 into a new mandatory instrument, the Committee agreed to limit the scope of the new instrument to lifeboat, rescue boats, fast rescue boats, launching appliances and release gears for those boats and liferafts.

10 Safety of navigation The Committee adopted several new and amended Traffic Separation Schemes, and other routing measures than traffic separation, in accordance with resolution A.858(20). The Committee also adopted Resolution MSC.333(90) – Adoption of revised performance standards for shipborne voyage data recorders (VDRs). The Committee did not approve the draft revised text of SOLAS regulation V/22 intended for adoption at MSC 91, but sent it back to NAV for further consideration because it was still considered to contain vague expressions. Furthermore the Committee approved new MSC circulars on Unified Interpretations of COLREG 1972, as amended, on Pilot transfer arrangements and on the clarification of SOLAS regulations V/19.2.3.4 and V/19.2.9.2. The Committee adopted Resolution MSC.334(90) – Adoption of amendments to the performance standards for devices to measure and indicate speed and distance (resolution MSC.96(72)) 11 Fire protection The Committee approved the following circulars: − MSC.1/Circ.1430 Revised Guidelines for the design and approval of fixed water-based fire-fighting

systems for ro-ro spaces and special category spaces − MSC.1/Circ.1431 Guidelines for the approval of helicopter facility foam fire-fighting appliances − MSC.1/Circ.1432 Revised Guidelines for the maintenance and inspection of fire protection systems

and appliances − MSC.1/Circ.1433 Unified Interpretation of SOLAS regulation II-2/10.6.4 and chapter 9 of the FSS

Code − MSC.1/Circ.1434 Unified interpretations of SOLAS chapter II-2 − MSC.1/Circ.1435 Unified interpretations of the FTP Code − MSC.1/Circ.1436 Amendments to the unified interpretations of SOLAS chapter II-2, the FSS Code,

the FTP Code and related fire test procedures (MSC/Circ.1120) − MSC.1/Circ.1437 Amendments to the Interim explanatory notes for the assessment of passenger

ship systems' capabilities after a fire or flooding casualty (MSC.1/Circ.1369). 12 Dangerous goods, solid cargoes and containers The Committee approved the following circulars: − A new MSC circular on Interim measures for early implementation of the draft amendments (02-13)

to the IMSBC code expected to be adopted at MSC 92 regarding the safe transportation of solid bulk cargoes, and section 4 on Assessment of acceptability of consignments for safe shipment

− A new MSC circular on Amendments to the Emergency Response Procedures for Ships carrying Dangerous Goods (EmS Guide)

− A new MSC circular on Conversion table (record of amendments) for part 7 requirements concerning transport operations

− A new MSC circular on Illustrations of segregation of cargo transport units on board containerships and ro-ro ships

− A new MSC circular on Inspection programmes for cargo transport units carrying dangerous goods. The Committee endorsed the approval of DSC.1/Circ.66 on Carriage of iron ore fines that may liquefy.

13 Stability, load lines and fishing vessel safety The Committee adopted resolution MSC.335(90)) on Amendments to the Guidelines for the design and construction of offshore supply vessels, 2006 (2006 OSV Guidelines) (resolution MSC.235(82)). The Committee also approved LL.3/Circ.208 on Unified interpretations of the 1966 LL Convention and the 1988 LL Protocol, as modified by resolution MSC.143(77); concerning the application of Load Lines requirements to guard rails. At its last meeting the Committee approved the draft Agreement on the Implementation of the 1993 Protocol relating to the 1977 Torremolinos Convention on the Safety of Fishing Vessels as the basic document for consideration by the Diplomatic Conference to be held in Cape Town, South Africa, from 9 to 11 October 2012, for the adoption of the Agreement. At this meeting the Committee requested the Secretariat to prepare a document containing the outcome of the discussions on the draft Agreement at this session, for submission to the 2012 Cape Town Diplomatic Conference.

19 Formal safety assessment A number of amendments to the Guidelines for Formal Safety Assessment (FSA) for use in the IMO rule-making process were agreed, the most important being the acceptance criteria for prevention of oil spills. It was also agreed to include the procedures for FSA review in the FSA Guidelines. The ‘Guidance on the use of human element analysing process (HEAP) and Formal Safety Assessment (FSA) in the IMO rule-making’ will therefore be repealed. The FSA on Crude oil tankers from the SAFEDOR project will now be reviewed, together with a submission by Japan, and so will also another SAFEDOR FSA study on sea transport of dangerous goods. The FSA review will take place 3 days prior to MSC 91. 20 Piracy and armed robbery against ships See agenda item 4 above. 21 General cargo ship safety An action plan was prepared for dealing with the recommendations in the IACS's FSA study on General Cargo Ship Safety (MSC 88/19/2, MSC 88/INF.6 and MSC 88/INF.8). This involves the following subcommittees: NAV, FSI, STW, FP, DSC and DE, with target completion in 2013. 22 Implementation of instruments and related matters The committee agreed with the IACS UI (unified interpretation) on a clarification of SOLAS Chapter V, Regulation 23 – Pilot transfer and a Corr.1 to MSC.1/Circ. 1375 will be issued regarding installation date of pilot transfer equipment and arrangements. Previous wording “replaced” has now been exchanged with “newly added”. 24 Application of the Committee's Guidelines The Committee agreed to add a new Annex 6 to the Committees' Guidelines on the organization and method of their work, containing a Checklist for Identifying Administrative Requirements and Burdens which should be used when preparing the analysis of implications required of submissions of proposals for inclusion of unplanned outputs. 25 Work programme The Committee added the following new work programmes of the sub-committees, with target completion date in brackets, as follows: BLG Amendments to the provisions of SOLAS chapter II-2 relating to the secondary means of

venting cargo tanks (After 2014) COMSAR Review and modernize the Global Maritime Distress and Safety System (GMDSS) (2017) DE Requirement for hoist winches to be tested following any maintenance, repair or

modification work which might affect the safe working operation of accommodation ladders (MSC.1/Circ.1331) (2013-2014)

DE Clarification of SOLAS requirements for steering gear trials (regulation II-1/29) (After

2014) DE Amendments to the Guidelines for vessels with dynamic positioning (DP) systems

(MSC/Circ.645) (After 2014) FP Life safety performance criteria for alternative design and arrangements for fire safety

offshore units (MOUs) (2013) A proposal by Ukraine to include a new chapter in SOLAS dedicated to piracy did not gain sufficient support. 27 Passenger ship safety The in response to the request of the Secretary-General, in light of the loss of the Costa Concordia, the Committee agreed to a new MSC circular on Recommended interim measures for passenger ship companies to enhance the safety of passenger ships covering:

− lifejackets on board passenger ships, except for ro-ro passenger ships; − emergency instructions for passengers; − passenger muster policy; − access of personnel to the navigating bridge; and − voyage planning.

Furthermore the Committee adopted a new MSC resolution on Measures aimed at enhancing the safety of passenger ships. The Committee also agreed to a draft action plan for the long-term work on passenger ship safety bearing in mind that structural and equipment issues should not be considered until the final report of the investigation into the loss of the Costa Concordia has been submitted to the Organization.
