    by weight in homogenous materials for

    ln sub rule (3) of ru le 13 i t is speci f ied that the sub rule (L) of ru le 13 shal l not apply tocomponents of electrical and electronic equipment manufactured or placed in the

    market six years before the date of commencement of these rules. These rules are

    appl icable to the electr ical and electronic equipment speci f ied in schedule l . The

    applications l isted in schedule l l shall be exempted from provisions of sub-rule (1) ofrule l_3. This does not mean that schedule l l is exempted from e-waste (Managementand Handling) Rules, 2011. putting the onus of re-cycling of electronics wastes (e-wastes) on the producers, the rules make the e-waste producers l iable for recyclingand reducing e-waste in the country. The rules cover discarded lr and telecoms

    equipment and consumer electrical goods and encompass the concept of Extended

    producers, Responsibil i ty or the 'polluter Pays Principle' which as applicable in relation

    of e-wastes, makes the producers to take responsibil i ty for the disposal of end-of-l ife

    products. personal Computer manufacturers, mobile handset makers and the white

    goods makers wil l be required to come up with e-waste collection centers or introduce,take back, systems. These rules wil l apply to every producer, and bulk consumer

    involved in manufacture, sales, purchase and processing of electronic equipment or

    components.

    2. According to the 20L1 Census around 32.60/o of the households in Kerala

    have both land l ine and mobi le phone connect iv i ty, whi le the nat ional average is only

    !!.70/o. Kerala has 20.40/o computer connectivity, as against national average of

    Lg.|o/o. e -wastes are fast becoming a major solid waste stream in the State. Amongthem Compact Fluorescent Lamps (cFL) and Fluorescent Tube Lights (FTL) engagespecial attention and disposal tactics due to the mercury contained in them' The

    following types of wastes are generated from the fluorescent lamp sector:

    (i) Glass Waste (with & without mercury)(i i) Waste PhosPhor Powder.( i i i ) Waste mercury ( in l iquid and vapour phase) '(iv) Waste electronic and plastic components'compact Fluorescent Lamps (cFL) and Fluorescent Tube Lights (FTL) due to itsmercury content pose health risk if handled carelessly, as mercury may enter l iving

    systems causing irreversible damages and may even prove to be fatal ' The cPCB

    guidelines specify that the waste generated at the manufacturers end shall be stored

  • and treated/recycled either in a recycling unit at the production site or any authorizedLamp Recycling Unit and all hazardous waste thereof shall be sent to Treatment,Storage and Disposal Facil ity (TSDF) set up as per the Hazardous Wastes(Management & Transboundary) Rules 2008. Mercury emissions are strictly controlledduring the manufacturing stage of CFL&FTL and stringent measures should be followedby units at the time of disposal of hazardous wastes containing mercury. At presentfused CFLs /FTLs are posing a diff icult situation to manage by local bodies since it isbeing dumped in to municipal sol id waste dumping si tes very carelessly by the publ icand is endanger ing publ ic heal th. This s i tuat ion has warranted the Government toevolve a proper procedure to collect fused CFLs/FTLs and dispose them of scientif icallyand safely. The way forward for consumers would be turning in old mercury lamps ofall types particularly conventional Fluorescent Tube Lights and CFLs to ensure propertransport and disposal avail ing the service of the Ministry of Environment authorizedagencies for collection and storage of e-wastes, avoiding situations creating directcontact of broken CFLs and FTLs by users and others.

    3. Since Kerala doesn't have an e-waste disposal plant,.the waste goes into theunorganized market for crude dismantling, recovery and reuse.This create several occupational health hazards. As the State's consumption patternincreases, scientif ic management of e-waste becomes very crit ical. The problem of e-waste has been growing rapidly in the State and the end users especially offices andresidents are facing practical diff icult ies in disposing of them in an environmentallysound manner.

    4. ln the matter of safe collection, storage, transportation and scientif ic disposalof the e-wastes generated in the State, Government issue the following orders forstrict and urgent compliance by all concerned:

    Producers of e-wastes shall be responsible for collection, transportation anddisposal in the prescribed manner, of all e-wastes generated by them o1bought back by them from consumers under the 'Extended ProducerResponsibil i ty' either directly or through authorized agents. The e-wastesthus collected shall be delivered to authorized recyclers by the producersthemselves, under appropriate arrangements.

    ,EPR' or dispose it through local collection mechanisms if any arranged for

    by Local self Government lnstitutions, in the manner ordered in para 4'(v)

    below.

    (iir) The state Pollution control Board shall take steps to get the firms

    d i s m a n t l i n g o r r e c y c l i n g w i t h i n t h e S t a t e t o b e r e g i s t e r e d a n d t o h a v econsents for operation and scientific disposal of the

    e-wastes collected'

    (iv) The Board, Department of Environment & Climate Change and Kera|a State

    council for science Technology & Environment shall include management

  • 5(vi) Space may be arranged near local markets or landed properties owned byLSGls, from where the wastes can be collected and stored at a centralcollection point for each LSGI, to be taken delivery of by the accreditedstate level agencies for collection and transportation and disposal or tocollect and transport to centralized disposal facil i t ies. The question ofpayment of some monetary incentives to those who collect incomegenerating e-wastes from house holds, by the state level agencies to beengaged can also be considered, for which the LSGIs providing space forcentralized storage may negotiate with such agencies.

    (vii) Some recyclers extend the facil i ty of entering into agreement withcorporate and Government organizations to collect, transport and disposeof e-wastes. They may also give incentive for the types of e-wastes whichwill provide them income on reprocessing. Each category may havedifferent rate depending on its recyclable value. Usually the following e-wastes are eligible for payment by registered recyclers/authorizedcollection agents.
