Case 15/31 between Gabriel Resources Limited and 5

I would like first few points, the first 7
point again and again thanking Court Reporters for 8
their Transcript, thanking our Secretary for the 9
Report on the time. The time is, indeed, an issue. 10
As we decided yesterday, we have started now at 8:30 11
already. We'll also start tomorrow morning at 8:30, 12
so already an hour gain. We are ready to work this 13
evening until at 6:30 and we still have reserve time 14
tomorrow afternoon in order--no need to do that. We 15

the examination will be conducted. I will ask you one 3
or two questions, then direct and cross and redirect. 4

a Deloitte Professor of Management at the Wharton 16
School of Business at the University of Pennsylvania-- 17

Pennsylvania, where I've been on the standing faculty 1
for 21 years. 2
Throughout that time, my research, my 3
teaching, my consulting focuses on the materiality, 4
the financial importance of a firm's relationships 5
with its external stakeholders, political, civil 6
society, community members, trying to demonstrate that 7
maintaining a strong relationship with these 8
stakeholders is beneficial to the organizational 9
purpose of the enterprise. This is sometimes referred 10
to as the "Social License to Operate." 11
In addition to extensive publications across 12
a wide array of academic journals, I've also consulted 13
with leading extractive companies and companies in 14
multiple industries in helping them advance their 15
internal processes to win and obtain the Social 16
License. 17
In terms of the statement, the statement was 18
drafted by myself, with consultation with counsel. 19
They provided some stylistic and other feedback, but I 20
had the final word as to the contents of the 21
manuscript--of the statement. 22

Can you, in a few words, start by introducing 9
yourself. And then the second question, just sort of 10
warming up--if I may say so--in introducing, tell us 11
how the process--what is the process that has been 12
followed for the preparation of your Report. 13
Please. 14
THE WITNESS: Okay. My name is Robert 15
Boutilier. I was born in Canada, but I live in Mexico 16
now. And my educational background is in psychology. 17
I'm a social psychologist, although my publications 18
now are more in management science and applied 19
sociology. I did marketing research and public 20
opinion polling for 20 years in Canada. 21
I was vice president of a national opinion 22

polling company in Toronto. Around 1999 I began doing 1
stakeholder research in the mining industry and 2
developed a stakeholder approach and methodology which 3
has evolved into an approach for measuring the Social 4
License. 5
I now do consulting with mostly mining 6
companies and some infrastructure and energy companies 7
around the world, Africa, Latin America, Australasia, 8
North America. And I published four books on the 9
stakeholder relations and the Social License, a dozen 10
academic articles and chapters, and about--over 60 11
conference presentations, mostly on stakeholder 12
relations, the Social License, and a view on 13
corruption as well. 14
The process of writing this Report. I was 15
contacted by counsel for the Claimant. They asked me 16
if I would be interested in contributing to my 17
expertise in this case. I acknowledged that Dr. Ian 18
Thomson is a co-author of mine, and we worked to--the 19
first thing that happened was I reviewed a great deal 20
of material on the case that was available and then 21
tried to organize it into something that would tell 22

the story of what level of Social License the Project 1
had. 2
And I wrote drafts of the Report, and counsel 3
commented on them. And then I re-wrote them and added 4
additional information and had the final editorial 5
control. 6
PRESIDENT TERCIER: Okay. What was the role 7
played by Mr. Ian Thomson? 8
THE WITNESS: I had no contact with him on 9
this. We know that we are each involved in this case. 10
We have both signed confidentiality agreements. And 11
so, we look forward to the final publication of this 12
case so that we can talk about it. 13

on. One important and difficult question, it is a 4
question of the dates for the second session. 5
You remember that it had been agreed between 6
the Parties that--before I was the Chairman--that it 7
was necessary to have two weeks and that it appeared 8
that it was simply not possible. And I think now we 9
have the demonstration that it would not have been 10
possible to have 13 more witnesses and experts 11
enjoying these two weeks. 12
So, the problem is, of course, as you can 13
imagine, to find dates available and, if possible, not 14
too late. And the Members of the Arbitral Tribunal 15
have tried, first, to find dates. And the first 16
proposal we made was the week of the 13th of July. 17
Unfortunately, this is not possible for 18
Claimant because of the availability of your experts, 19
I was told. 20
Okay. So, we went back and we have 21
proposals. The earliest--but it is with a 22

caveat--would be the week of the 10th of February. 1
Would it be possible for you? Of course, you 2
don't know because you have to look at the--but if you 3
can check. But there is one caveat. It should be in 4
Paris because--I don't want to give the reasons, but 5
it should be in Paris. 6
The next would be the 17th of August. The 7
next would be the 24th of August, the week, of course. 8
And the last, 28th of September. 9
We are, of course, conscious that it is 10
extremely--it is too long, but it is due to the 11
situation--to the circumstances as it occurred. 12
Now, I would be grateful if you could see on 13
your side which dates would be--would be possible for 14
you. And I have to add, the 28th of September has 15
still a question mark. The 28th of September with a 16
question mark. 17
MR. POLÁŠEK: Mr. President, just for 18
clarification, because the previously communicated 19
earliest dates were in July of this year, are these 20
dates for the next year, 2020, or are we talking about 21
2021? 22

I'm semi-retired, supposedly, independent consultant. 22

I was born and educated in the United Kingdom. I hold 1
a Bachelor's degree and a doctorate degree from the 2
University of London Imperial College. I have 48-plus 3
years' experience in the mining industry having worked 4
in various capacities. For the first 20-plus years 5
essentially as a technical and Management side of the 6
mining business, and mostly in mineral exploration, 7
and for the last 20-plus years essentially as a social 8
specialist and consulting, providing advice and 9
assistance to companies, to banks, to governments, to 10
communities, to non-governmental organizations, fairly 11
broad experience mostly working out with junior mining 12
companies, one way or another, mostly at the 13
exploration level, but also with operating mines and 14
with development Projects and that, I think, sort of 15
sums me up right now. I do have more information 16
which I will move through as quickly as I can. 17

we will not be able to complete tonight. So, we can 9
go as long as you--you can take it as long as you 10
wish, and we will need to resume tomorrow. 11
DR. HEISKANEN: Then it may be better to 12
break now. I understand it's going to go on for 13
another hour. But we have a very short day foreseen 14
for tomorrow, 2 hours 45 minutes. So, if we add an 15
hour to that, it's still going to be a short day, and 16
we would finish early afternoon. 17

think it's important for you to know the time that 5
will be at your disposal tomorrow to avoid any lengthy 6
discussion tomorrow. So, I would like to discuss it 7
shortly with my co-arbitrators. 8
Sorry. I wanted to do that. So, you 9
are--you have not to stay here. You are--but you know 10
that you are under testimony and that you have not the 11
right to have any conduct with representatives. Okay. 12

PRESIDENT TERCIER: Each party had allocated 14
34 hours and 45 minutes. That is what was in PO 26, 15
and 5 hours for the Tribunal. 16
Starting with the Tribunal, the Tribunal has 17
used over the 5 hours, 5 hours and 25 minutes. But I 18
consider it's a good sign. 19
Secondly, we cannot--if we have decided and 20
agreed that we should finish tomorrow, we cannot 21
allocate you the full time we had in mind. So, we 22

have to reduce it. And assuming we can work tomorrow 1
during eight hours, what is already quite a long day, 2
keeping half an hour for not only the Tribunal but 3
also some other things, we have 7 hours and 30 4
minutes. 5
That means that we would reduce the time at 6
your disposal for each of you, total time allocated, 7
theoretically, at the very beginning, by 1 hour and 45 8
minutes. 9
That concretely means that Claimant will have 10
33 hours. You have used 28 hours and half an hour. 11
It means that Claimant still has 4 hours and half an 12
hour. 13
On the other side, Respondent, 33 hours, 14
minus around 30 hours that you have used. It means 15
that you have left 3 hours. 16
So, I recall for tomorrow, you would have 17
4 hours and half an hour--and 30 minutes, and 18
Respondent would have 3 hours at disposal. 19
We are aware that there will be a 20
presentation on Respondent's side. And here we have 21
the time, 20 minutes and 20 minutes. Then we will 22

have the cross, and by--both done by Claimants. And 1
then the redirect, that could be--written 10 minutes 2
and 5 minutes. 3
But that is the calculation that we have 4
discussed. 5

DR. HEISKANEN: Yes. Likewise, we agree with 10
the allocation. 11
Just to flag. We were going to raise this 12
tomorrow morning, but we can do it now. Dr. Stoica 13
would need 30 minutes instead of 20 minutes for his 14
presentation. So, that is one comment. 15
And given that the Respondent has 3 hours 16
left, we reserve the right to extend the redirect a 17
bit more than the 10 and 5 minutes that are envisaged. 18
We may not need it, but we will certainly be 19
within the time allocated to the Respondent. 20
