    THAT, noting with grave concern the presence of Ugandan securityforces, first in Migingo Island and, secondly, in Kacheliba in West Pokot

    District, areas that form part of the Sovereign Republic of Kenya, an act

    that is against provisions of international law; this House registers itsstrong opposition to and disapproval of this act of aggression by the

    Government of Uganda, and resolves that the Ugandan security forces

    leave Kenyan soil with immediate effect, and that the Government of

    Uganda unconditionally commits itself to respecting the territorialboundaries between Kenya and Uganda, and further, that this House

    urges His Excellency the President and Commander-in-Chief of the

    Armed Forces of the Republic of Kenya to use all the resources and

    options at his disposal to reclaim Kenyan land in accordance with the

    Constitution of Kenya.

    House resolves that the Government lifts the restriction under the

    Retirement Benefits Act in respect of occupational schemes to enable a

    member leaving employment after three years of membership to beentitled thereupon to a refund of his or her contributions together withinvestments income accrued thereon and payment of the employers

    contribution together with the investment income accrued thereon and for

    matters incidental thereto and connected therewith.

    21.THAT this House adopts the Report of the joint committee on Finance,

    Planning and Trade and the Budget Committee on the discrepancies in the

    Supplementary Estimates for the Financial 2008/2009 laid on the Table of

    the House on Wednesday, 13th May, 2009.

    THAT, being aware of the serious problem of squatters and landlessness

    in Kenya today, and lack of a clear policy and legal framework to dealwith the same, considering the efforts made by the Government so far in

    settling some squatters on various farms in certain parts of the country

    without a clear criteria or structures to guide the process, appreciating the

    need to establish a fund to facilitate a continuous squatter settlementprocess with proper structures and criteria for identification of genuine

    squatters countrywide and suitable land for acquisition and settlement in

    an open, transparent and consultative manner; this House urges the

    Government to establish a fund under the Government Financial

    Management Act, (No.5 of 2004), to be known as the Squat ters

    Settlement Fund for the purposes of continuous squatter settlement, and

    for matters incidental thereto and connected therewith.

    have continuously taken up most of the opportunities in prestigious

    national learning institutions and secured the most marketable courses inuniversities as a result of high quality education facilities; concerned that

    public schools lack requisite facilities and manpower to guarantee quality

    education for children; appreciating the need to improve education forchildren from poor backgrounds in order to achieve equity; this House

    urges the Government to increase the budgetary allocation to public

    primary and secondary schools for enhanced quality education.

    THAT, aware that in the recruiting of officers into the disciplined forces,the following heights requirements apply:-

    Armed forces - 5 feet 3 inches for both men and women, regular police - 5

    feet 9 inches for policemen and 5 feet 3 inches for policewomen and in theAdministration Police, 5 feet 8 inches for men and 5 feet and 3 inches for

    women; and concerned that this requirement is discriminative and is not

    within any legal framework; this House urges the Government to dispense

    THAT, aware that northern Kenya and other arid lands face perennialdrought of a cyclic nature; mindful that this occasions severe negative

    economic, 2 June 17, 2009(A) social and environmental effects; noting

    that currently responses to drought are reactive due to lack of proactive

    measures; concerned that the country lacks a legal framework designed to

    mitigate these problems; this House urges the Government to establish a

    Drought Management Authority responsible for drought preparedness and

    response, including forecasting, impact assessment and management

    policy, drought preparedness and mitigation.

    THAT, noting the past and continued marginalization of Northern Kenya,

    aware that because of the prolonged neglect, the entire region has laggedbehind in development compared to other parts of Kenya; cognizant of the

    fact that the inhabitants of the region are taxpayers with equal human and

    legal rights like other Kenyans, entitled to all the services provided by theGovernment, including adequate security and infrastructural facilities such

    as road network to open up the region, appreciating the efforts of the

    Grand Coalition Government in establishing the Ministry for Development

    of Northern Kenya and Other Arid Lands as a strategy to address thesehistorical imbalances, this House resolves that the Deputy Prime Minister

    and Minister for Finance increases budgetary allocation to the Ministry of

    Northern Kenya and other Arid Lands to at least 15 per cent per annum forthe next decade in line with the Governments positive approach towards

    the development and transformation of this region.

    electricity to its citizens and encourage establishment of cottage industries

    through lower electricity costs; cognizant that the western part of Kenya isendowed with rivers such as the Nzoia, Yala, Arror, Weim Wei, Moiben,

    Chepkaitit, Kaptetit and others; this House urges the Government to

    establish small hydro-power generation plants on these rivers tosupplement the supply of electricity to the national grid.
