Introduction [for SULEV (PZEV)only]

Certain 2014 328i models are certified toCalifornia’s stringent Super Ultra Low EmissionVehicle (SULEV) standards and also qualify as aPartial Zero Emission Vehicle (PZEV) under theCalifornia Air Resources Board Zero EmissionVehicle program. In addition to very low tailpipeand zero-evaporative emissions, this PZEVcertification includes a unique warranty when thevehicle is registered in California and certainother states, as indicated in the SULEV (PZEV)section beginning on page 39. SULEV (PZEV)models registered in Delaware, Oregon,Pennsylvania andWashington are covered by theCalifornia Emission Warranty beginning onpage 26.

The emission certification standard can beverified on the Vehicle Emission ControlInformation label located in the enginecompartment. A representative label is shownbelow; the SULEV (PZEV) certification is statedafter the word “California.”

BMWUltimate Service™

BMWUltimate Service leads the industry inproviding owners with incredible value and peaceof mind. This service includes:� The BMWMaintenance Program: No cost

factory-recommended maintenance for4 years/50,000 miles from the originalin-service date, whichever comes first.

� BMWRoadside Assistance: No-cost 24/7on-the-road assistance for 4 years/unlimitedmiles from the original in-service date. Alsoincludes trip-interruption benefits as well astrip routing services.

� NewVehicle LimitedWarranty: Limitedcoverage for defects in materials andworkmanship for 4 years/50,000 miles fromthe original in-service date, whichever comesfirst. Repairs will only be made at authorizedBMW centers using Original BMW Parts.

Special Notes on the BMWAdvanced Diesel Engine� At ambient temperatures below approximately

32ºF, starting the engine of the 328d and 535dmay be delayed for a few seconds while theautomatic fuel preheating system is active. Anindicator lamp in the instrument cluster willilluminate during this time. The engine willstart only after the indicator lamp goes out.

Automatic fuel preheating indicator lamp� Engine breaking-in: Prior to driving the first

approximately 1,250 miles, do not exceed anengine speed of 3,500 rpm; avoid full-throttleacceleration, and using the “kick-down”function of the transmission. After thismileage, engine speeds can be graduallyincreased.

� The BMWAdvanced Diesel engine isdesigned to run only on Ultra LowSulfurDiesel (ULSD).This fuel designation containsa maximum of 15 parts per million (ppm) ofsulfur. Service stations which dispense thisfuel will have their pumps marked with thisinformation (or similar):

� A Cetane rating of 51 or higher isrecommended for use in BMWAdvancedDiesel Vehicle.

� The use of biodiesel fuel is acceptable as longas the content is no higher than 5% (B5) whichmeets ASTM D6751 specification. If abiodiesel rated higher than B5 (such as B10 orB20) is pumped into the vehicle, damage tothe fuel system components may occur.

� If gasoline, B10 or higher biodiesel, or anyother improper fuel (i.e., low-sulfur diesel) ispumped into your diesel vehicle: at the firstnotion of the mistake, stop pumping and donot start the vehicle, not even to move it awayfrom the filling pump. Serious engine damagecan occur! Contact your authorized BMWcenter or Roadside Assistance immediately.

� The BMW 328d and 535d are equipped with amisfueling system which is intended toprevent gasoline from being pumped into thetank. Most automotive diesel fuel nozzles willbe of the recommended diameter (24 mm).When inserted into the fuel-filler neck, the fuelnozzle simultaneously presses two safety tabslocated inside the fuel-filler neck; this will allowthe fuel nozzle to be fully inserted for refueling.

A gasoline fuel nozzle diameter is smaller (21 mm)than an automotive diesel fuel nozzle. If a gasolinefuel nozzle is inserted into the fuel-filler neck ofyour diesel vehicle, the smaller diameter fuel nozzlewill not be able to simultaneously press the twosafety tabs; this will prevent the fuel nozzle frombeing fully inserted into the fuel-filler neck.� To allow emergency filling of diesel fuel in

locations using a commercial (truck) size dieselfuel filler nozzle which is larger than the nozzlefor passenger cars, and/or for filling stationswhich dispense diesel fuel from a non-conforming sized nozzle, a diesel misfuelingbypass adapter is included in your car.

� The BMW diesel engine oil is different than oilused for BMW gasoline engines. Use only“low-ash” fully synthetic oils meeting BMW’slong-life rating LL04 (API rating CF). One suchoil is Castrol’s SLX Professional OE SAE5W-30 (Castrol #06070). This oil is alsoavailable at authorized BMWCenters underBMW part number 07 51 0 037 195. There is areference label located in the enginecompartment with this part number.

� The 328d and 535d are equipped with atraditional dipstick located in the enginecompartment (item #1 shown for 328d;location similar for the 535d).

To check the engine oil level:

1. Park the vehicle on a level surface with theengine at operating temperature (i.e., afterdriving continuously for at least 7 miles).

2. Turn the engine off.

3. Wait at least approximately 5 minutes.

4. Pull the dipstick out and wipe dry with alint-free cloth, paper towel or similar item.

5. Carefully push the dipstick fully into the tube,then pull out again.

6. The oil level must be between the two marks.

� The quantity of oil between the two marks isapproximately 1 quart.

� The 328d and 535d are equipped withSelective Catalyst Reduction (SCR)technology. Diesel Exhaust Fluid (DEF) isinjected into the exhaust system to helpreduce the emissions of nitrogen oxides (NOx).DEF is designed to last until your next oil

change before it needs to be refilled. However,depending on your vehicle needs, you can runout of DEF before you reach the interval. Theinstrument cluster warning lamp will warn youbefore DEF is depleted, starting atapproximately 1,000 miles.

Refill DEF indicator lamp (yellow)Note: If you continue to drive until the mileagereaches 0, a new warning will appear (NO STARTIN – – – MILES).Once this warning appears,youwill only be able to restart the engine onemore time if this is donewithin 3minutes oflast shutting it off. Beyond this time interval,the enginewill not restart until DEF is refilled!

EmptyDEF indicator lamp (red)DEF is available from your nearest authorizedBMWService Center. Or, refer to your vehicleOwner’s Manual for refilling DEF yourself.� An additional warning lamp in the instrument

cluster may illuminate if the diesel particulatefilter requires service.

The BMWMaintenance Program

The BMWMaintenance Program is a benefitdesigned to help reduce the cost of ownership.This program has been devised with thefollowing objectives: to maximize vehicle safety,reliability, and resale value by minimizingbreakdowns resulting from wear, and minimizingcost and inconvenience by computingmaintenance intervals based upon the specificmanner in which each individual vehicle is driven.

A 2014 3, 5 and 7 Series vehicle purchased froman authorized BMW center in the United States(including Puerto Rico) is covered by the BMWMaintenance Program for 48 months or50,000 miles, whichever occurs first. Coveragebegins on the date of first retail sale or the date

the vehicle is first placed into service as a salesdemonstrator, Aftersales Mobility Program (AMP)Vehicle or BMWGroup company vehicle,whichever is earlier.

Any authorized BMW center in the United States(including Puerto Rico) will perform thescheduled and/or additional maintenanceservices on your vehicle at no expense to you solong as your vehicle qualifies for coverage underthe BMWMaintenance Program.

Coverage

The BMWMaintenance Program covers allfactory recommended maintenance, asdetermined by the Condition Based Service(CBS) system. Additional specific items thatneed replacement due to normal wear and tear,and that are not covered by the original NewVehicle Limited Warranty - such as brake pads,brake rotors, and wiper blade inserts - areincluded, provided wear and tear exceeds BMWwear limits. Any applicable adjustments requireddue to normal operating conditions are alsoincluded. See pages 8-10 of this booklet foradditional information.

Exclusions from coverage include the following:� Items reimbursable under your New Vehicle

Limited Warranty� Gasoline and diesel fuel� Gasoline and diesel fuel additive� Diesel glow plugs� Diesel particulate filter� Windshield washer additive (except when in

conjunction with scheduled maintenance)� Tires, wheel alignment, tire balance and

rotation� Parking brake shoes/linings� Reset Tire Pressure Monitor� Wear and tear of soft trim items, such as:

seats, carpets, moldings, headliner, doorpanels and all chrome trim

� Damage, including consequential, whichresults from negligence, improper operation ofthe vehicle, wear and tear or deterioration dueto driving habits or conditions, improper repair,environmental influences, flood, accident or

fire damage, road salt corrosion, alteration,installation of non-genuine BMW accessories,or use of improper, poor quality orcontaminated fuel

� Altered or unreadable Vehicle IdentificationNumber (VIN) or odometer irregularities orvehicles where the true mileage cannot bedetermined

� Maintenance or repair after the vehicle isdeemed a total loss

� Maintenance or repairs performed by otherthan an authorized BMW center within theUnited States (including Puerto Rico)

� “Topping off” low fluids (e.g., engine oil,antifreeze, washer fluid, etc.) except whendone in conjunction with a scheduledmaintenance or other required maintenancework (as outlined in the customizedmaintenance checklist printout) that isperformed during an applicable MaintenanceProgram period

� Vehicles used in competitive events� Oil changes performed outside the

recommended maintenance intervals asindicated by the Condition Based Service

� DEF refills performed outside therecommended maintenance intervals asindicated by the Service Interval Display (328dand 535d only)

Maintenance UpgradeOption

Please contact your authorized BMW center forinformation regarding the purchase of optionalMaintenance Program Upgrades. Eligibility andcoverage exclusions may apply.

Intervals

Time intervals should be followed using themaintenance intervals as indicated by the BMWCondition Based Service.

Maintenance intervals on motor vehicles haveconventionally been specified based uponaccumulated mileage. However, drivingconditions have a major influence on routinemaintenance requirements; distance traveled is

A vehicledriven for 50,000 miles of short trips in the citywith numerous cold starts, prolonged periods ofidling, stop-and-go driving, and high enginespeeds during acceleration requires morefrequent maintenance intervals than a vehicledriven for 50,000 miles for long distances at lowengine speeds primarily at operatingtemperature.

The advanced technologies at BMW have led tothe development of the unique BMWConditionBased Service (CBS) system which computesthe actual optimummaintenance requirementsbased not only upon the accumulated mileage,but taking into account important factors such ashigh or low engine speeds, short or long tripdriving.

Condition Based Service (CBS)

CBS is a further development of the ServiceInterval Indicator System.

The remaining times for selected maintenancetasks as well as any legally prescribed dates aredisplayed to you individually:� Engine oil� Brakes - front and rear separately� Brake fluid� Vehicle check� Required State Inspection(s)

CBS thus determines the current and futuremaintenance requirements. This data can also beread from the vehicle key by your BMWServiceAdvisor and used to propose the optimum scopeof maintenance.

Disconnecting the battery during periods oflong-term storage will interrupt the

calculation of time-based services. BMWrecommends that you have all items requiringtime-based maintenance, such as brake fluid andpossibly also the engine oil and microfilter,brought up to date by your authorized BMWcenter. Also see the section on battery care onpage 11 of this Booklet.

2014 3 Series Sports Wagons built prior to July2013 utilized a different CBS “connected serviceitem” interval as detailed on page 11.

The completion of certain subsequentmaintenance items or services, as required toproperly maintain your vehicle, will be specifiedat intervals computed by the BMWConditionBased Service system as follows:� Oil Service: Engine oil should be changed with

the engine at operating temperature.

All 2014 model year 3 (except 328d see below), 5(except 535d see below) and 7 Series vehiclesare factory-filled with BMWHigh PerformanceSynthetic oils. We recommend BMWHighPerformance 5W-30 Synthetic Oil (BMW partnumber 07 51 0 017 866) for regular scheduledengine oil changes.

The 2014 model year 328d and 535d arefactory-filled with a different BMWHighPerformance Synthetic oil than on gasolineengines. We recommend BMWHighPerformance 5W-30 Diesel Synthetic Oil (BMWpart number 07 51 0 037 195) for regularscheduled engine oil changes.

BMW recommends that you check your engineoil level whenever you add fuel to your vehicle.For information on checking your engine oil level,refer to your vehicle’s Owner’s Manual.

If you need to add oil between oil changes andBMWHigh Performance Synthetic Oil isunavailable, for the purpose of topping up theengine oil level only, BMW recommends use ofone of the below-listed synthetic oils:

If you are unable to obtain a recommendedsynthetic oil from the list above, for the purposeof topping up the engine oil level only, use only asynthetic oil with an API rating of SM or higher.

QualityCertification I

For a detailed list of items inspected, refer to theQuality Certification I form provided to the Ownerat time of delivery. A copy of the form is on file atthe selling authorized BMW center.

Fuel Quality – Gasoline (gasolineengines only)

Only use fuels advertised to have adequatedetergency and low alcohol (such as ethanol)content. Please refer to your owner’s manual forimportant information on the fuel recommendedfor use in your vehicle. Use of fuels withinsufficient detergent and/or excess alcohol cancause driveability problems that necessitatecleaning intake valves and fuel injection valves,and, when applicable, adjusting the engine idle.

We suggest having this work performed by yourauthorized BMW center, perhaps while regularmaintenance is performed. Your authorized BMWcenter can also recommend a gasoline additivethat will provide sufficient detergency. Thisrecommended unscheduled maintenance whichmay be necessitated by use of inappropriatefuels is not required in order to maintain theemission warranty. It also is not covered by yourvehicle’s warranty because no defect in materialor workmanship or component failure is involved.

If your car is driven only for short distances of lessthan 10 miles over a prolonged period of time,without an occasional drive at highway speeds, theengine’s charging system will not maintain thebattery. Insufficient use of the vehicle could resultin short term starting problems and, in the longterm, could damage the battery.

In case the car is not operated for several weeks,it is advisable to:� consider using a proper trickle charger,

following the charger manufacturer’sinstructions, to maintain the battery’s state ofcharge; or

� consult your authorized BMW center regardingbattery removal. Once removed, the batterymust be charged and stored in a cool, dryplace where it can be protected from freezing.If the battery will be stored for over 3 months, itmust be recharged every 3 months, or else itwill become damaged and useless.

Please consult with your authorized BMW centerfor further guidance and information.

*For the ActiveHybrid 3, ActiveHybrid 5 andActiveHybrid 7 the information above refers tothe 12 volt service battery and not the high-voltage battery.

Corrosion Protection

Extensive corrosion protection measuresimplemented by BMW nowmake it possible tooffer a 12-year unlimited mileage anti-corrosionwarranty against rust perforation on your vehicleprovided that the vehicle is properly maintained.

Information on proper maintenance is available inthis Booklet and your vehicle’s Owner’s Manual.

The major degree of corrosion protection is dueto the electrophoretic dip painting process whichcathodically deposits paint particles on all bodyparts, attracting paint particles into the minutestcavities or seams. Body parts are designed toprovide optimum corrosion protection.

During manufacture, metal exterior body partsreceive an additional corrosion protection coat.Hood, trunk, doors and other body parts arecoated with PVC and sealed from the outside.

All floor panels receive a resilient coating of PVCfor maximum protection against damage due tostones, etc.

Corrosion protection materials tested over manyyears are applied to the surfaces of cavities andto the entire underside of the vehicle during andafter assembly.

For additional information on the 12-yearunlimited mileage anti-corrosion warranty seethe Warranty Section of this Booklet (page 22).

Restoring corrosion protection

Please take care that anti-corrosion material isreplaced when your car is repaired after body orchassis damage.

BMWwill not accept any liability for repair of,or damage caused by, any parts andaccessories not approved byBMW.

Underbodymaintenance

The underbody has to be cleaned at least once ayear, in Spring, with plain water in order toremove mud, chemical sediments and otherdeposits. If those materials are not removed,corrosion (rust) will occur on metal components.

Your BMW authorized center can do thisanti-corrosion service for you.

Do not apply additional undercoating orrust-proofing on or near the exhaust

manifold, exhaust pipes, catalytic converter or heatshields. During driving, the substance used forundercoating could overheat and cause a fire.

If we areunable to contact one of your party, the messagerelay service will document the information, andwill make reasonable efforts to deliver themessage to the message recipient.

Personal Trip Routing. Leave the planning tous. Simply give one of our Roadside Assistanceservice representatives a call, and we will provideyou with a detailed, easy to read, computerizedtrip itinerary and companion map package.Please allow up to two weeks to process yourrequest.

Dispatch Service

A service provider will be dispatched to the siteof your disabled vehicle.

On-Site Assistance

On-site service for vehicle disablements such asflat tires, dead batteries, and out of fuelconditions is provided up to a maximum of$100.00 per incident by BMWRoadsideAssistance.

The cost for parts and fuel, when used on-site,are the responsibility of the owner/driver. TheNew Vehicle Limited Warranty does not cover anyof the above on-site services.

Lock-Out

Your BMW is equipped with an advanced entrysystem, which cannot be bypassed by traditionallocksmith methods without significant damage toyour vehicle. However, in the event that you find

yourself locked out, a simple telephone call toRoadside Assistance will help you get back onthe road. A representative will help you findtransportation or arrange towing service to thenearest authorized BMW center. Related towingcosts will be compensated up to $100.00 perincident. You, or the person driving your vehicle,are responsible for any expenses related toreplacement keys.

Towing Service

In the event of a mechanical breakdown normallycovered under the New Vehicle Limited Warranty,your vehicle will be transported (at no cost) to thenearest authorized BMW center. Your vehicle isalso covered in the event of an accident orcollision.

If a breakdown occurs after normal businesshours, your vehicle will be transported to a securelocation and transported to the nearestauthorized BMW center on the next businessday.

If you request that the vehicle be taken to alocation other than the nearest authorized BMWcenter, any additional expense will be yourresponsibility.

However, you may request (at no cost) to betaken to a different authorized BMW center aslong as it is within 50 additional miles of the“nearest” authorized BMW center.

Towing requests for vehicles disabled because ofcasualty, fire, act of God, or violation of law(federal, state or local) are provided at theexpense of the owner/driver.

If it is necessary for you to have your vehicletowed through your own arrangements, youmust contact BMWRoadside Assistance forprior authorization and instructions on claimprocedures. All claims must be submitted withinsixty (60) days of the disablement or occurrence,accompanied by the original receipts. Claimsreceived after that time period may bedishonored and are subject to the full discretionof BMWRoadside Assistance. If BMWRoadsideAssistance is not contacted for “prior”authorization, the maximum coverage for towingis $100.00.

Sign-and-Drive

Typically, if you are within the terms of yourwarranty, the services you receive under theBMWRoadside Assistance program will notrequire payment. In most cases, you will simplysign a receipt from the provider of services.

Trip Interruption Benefits

Trip interruption benefits are provided formechanical breakdowns as follows:� Breakdowns that are warranty related, and;� Must occur in excess of 100 miles from the

driver’s primary residence, and;� Repairs cannot be completed during normal

business hours on the same day ofbreakdown.

Reimbursements will be made for meals, lodging,car rentals, and alternate transportation to bringthe driver and the BMW automobile togetherafter the vehicle has been repaired by anauthorized BMW center. Original receipts mustaccompany all reimbursement requests.

Trip interruption coverage is limited to $1,000.00per incident, for a maximum of five days perincident.

NewVehicle LimitedWarranty—2014Models (Valid Only in theU.S.A. including Puerto Rico)

Warrantor

BMW of North America, LLC (BMWNA) warrantsduring the Warranty Period the 2014 U.S.-specification BMW vehicles distributed byBMWNA or sold through the BMWNA EuropeanDelivery Program against defects in materials orworkmanship to the first retail purchaser, andeach subsequent purchaser.

WarrantyBegins

Coverage begins on the date of first retail sale orthe date the vehicle is first placed into service asa sales demonstrator, Aftersales MobilityProgram (AMP) Vehicle or company vehicle,whichever is earlier.

Warranty Period

The warranty period is 48 months or50,000 miles, whichever occurs first, except foras noted below.

WarrantyCoverage

To obtain warranty service coverage, the vehiclemust be brought, upon discovery of a defect inmaterial or workmanship, to the workshop of anyauthorized BMW center in the United States(including Puerto Rico), during normal businesshours.

The authorized BMW center will, without chargefor parts or labor, either repair or replace thedefective part(s) using new or authorizedremanufactured parts. The decision whether torepair or replace said part(s) is solely theprerogative of BMWNA. Parts for whichreplacements are made become the property ofBMWNA. In all cases, a reasonable time must beallowed for warranty repairs to be completedafter the vehicle is received by the authorizedBMW center.

Warranty repairs do not constitute an extensionof the original limited warranty period for thevehicle or a part thereof.

All maintenance services must be performed tokeep your warranty coverage valid. It is theowner’s responsibility to maintain the vehicle asindicated by the vehicle’s Condition BasedService (CBS) display and/or as outlined in theMaintenance Service Summary section of thisbooklet. Prior to performing service or repairwork under warranty, when necessary, the ownermust present to the authorized BMW centerproof that the periodic maintenance serviceswere performed at the required intervals. Therepair invoices/receipts for the completion ofrequired maintenances services should beretained for this purpose.

SafetyBeltWarranty - Kansas

Safety belts are covered under the BMWNewVehicle Limited Warranty for defects in materialor workmanship for a period of 10 years,unlimited mileage from the date of purchase. Inorder to be eligible for this coverage, the vehiclemust be a new car retailed in the State of Kansasand the repair performed by an authorized BMWcenter in Kansas.

Other Items

Wheel alignment, balancing and wiper bladeinserts are covered up to the first 2,000 miles onthe vehicle.

Itemswhich are subject to wear and tear ordeterioration due to driving habits orconditions, such as brake pads/linings, brakediscs, clutch disc, pressure plate, filters,upholstery, trim and chrome items, paintfinish, drive belts, glass, and similar items,are specifically limited to defects inmaterialorworkmanship.

What is not covered:

Remote control transmitter battery replacement.

Damage, including consequential, which resultsfrom negligence, improper operation of thevehicle, improper repair, lack of or impropermaintenance, environmental influences, flood,accident or fire damage, road salt corrosion, oruse of improper or contaminated fuel.

Damage to the engine, transmission or anyrelated component caused by improper shiftingof the transmission.

Maintenance services and parts when replacedduring maintenance such as spark plugs(gasoline engines only), lubricants, fluids, enginetune-up parts, replacement of filters, coolant,and refrigerant.

Failure to maintain the vehicle properly inaccordance with the instructions in the Owner’sManual or the Service section of this Statement,that results in the failure of any part of the vehicle.

Modification of the vehicle or installation of anyperformance accessories or componentsattached to the vehicle which alters the originalengineering and/or operating specifications orwhich result in damage to the other originalcomponents, electrical interference, electricalshort, radio static, water leaks and wind noise.

Tires are warranted by their respectivemanufacturer. See the Tire Warranty Statementon page 39.

Driving over rough or damaged road surfaces,as well as debris, curbs and other obstaclescan cause serious damage towheels, tiresand suspension parts. In accordance with the defect warrantyprovisions of section 207(b) of the Clean Air Act,BMWNA warrants to the first retail purchaser,and each subsequent purchaser, that the car (a)was designed, built and equipped so as toconform, at the time of sale, with all regulationsof the U.S. Environmental Protection Agencyapplicable at the time of manufacture and (b) isfree from defects in materials and workmanshipwhich would cause it to fail to conform withapplicable regulations for a period of 2 years or24,000 miles, whichever occurs first, except forspecific emission control components (as listedon page 26), for which the warranty period is8 years or 80,000 miles, whichever occurs first.

Coverage begins on the date of first retail sale orthe date the vehicle is first placed into service asa sales demonstrator, Aftersales MobilityProgram (AMP) Vehicle or company vehicle,whichever is earlier.

Warranty claims must be made as soon asreasonably possible after a defect is discovered.To make a claim, the car must be brought to anyauthorized BMW center during normal businesshours.

The authorized BMW center will, without chargefor parts or labor (including diagnosis), eitherrepair or replace the defective part, if any. Thedecision whether to repair or replace said parts issolely the prerogative of BMWNA and must beexpected to correct the failure of the warrantedpart. Parts for which replacements are madebecome the property of BMWNA. In all cases, areasonable time must be allowed for warrantyrepairs to be completed after the car is receivedby the authorized BMW center.

It is the owner’s responsibility to have allscheduled inspection and maintenance servicesperformed (at the owner’s expense), asprescribed in the maintenance schedule for theBMW Emission Control System. Service intervalsare computed by the onboard BMWConditionBased Service system and displayed on theinstrument panel. The instructions for propermaintenance and use can be found in theOwner’s Manual. It is strongly recommended thatany replacement parts used for maintenance,repair or replacement of emission controlsystems be certified BMWService Parts or BMWAuthorized Remanufactured Parts. Withoutinvalidating this warranty, the owner may elect tohave maintenance, repair or replacement of theemission control systems performed by anyautomotive repair establishment, or elect to useparts other than certified BMWService Parts.However, the cost of such service or parts will notbe covered under this warranty, except inemergency situations. In an emergency situation,where an authorized BMW center or a warrantyreplacement part is not reasonably available(within 30 days), repairs may be performed at anyavailable service establishment using anyequivalent part. BMWNA will reimburse theowner for such emergency repairs (includinglabor, parts and diagnosis not to exceedBMWNA rates for labor, parts, and diagnosis insaid area) that are covered under this warranty.Replaced parts and paid invoices must bepresented at an authorized BMW center as acondition of reimbursement for emergencyrepairs not performed by an authorized BMWcenter.

The use of replacement parts, which are not ofequivalent quality, may impair the effectivenessof the emission control system. If other thancertified BMWService Parts or AuthorizedRemanufactured Parts are used for maintenance,repair or replacement of components affectingemission control, the owner should obtain

assurances that such parts are warranted by theirmanufacturer to be equivalent to genuine BMWparts in performance and durability. BMWNAassumes no liability under this warranty withrespect to parts other than genuine BMW parts.

However, the use of non-genuine BMWreplacement parts or non-EPA certified partsdoes not invalidate the warranty on othercomponents, unless non-genuine BMW parts ornon-EPA certified parts cause damage towarranted parts.

What is not covered

This warranty does not cover malfunctionscaused by any of the following: accident, flood,misuse, improper adjustment, modification,alteration, tampering, disconnection, improper orinadequate maintenance. For gasoline engines,the use of leaded fuel or fuels containing morethan 10% ethanol, or other oxygenates with morethan 2.8% oxygen by weight (i.e., more than 15%MTBE or more than 3%methanol plus anequivalent amount of co-solvent). For dieselengines, the use of diesel fuel other than what isrequired as outlined on page 2 and in theOwner’s Manual or the accidental use ofgasoline.

The replacement of maintenance parts, such asspark plugs (gasoline engines only), filters andsimilar items used in required maintenanceservices, the repair or replacement ofmaintenance parts beyond the first requiredinspection/maintenance, or if the part has beenreplaced earlier for reasons other than it beingdefective.

The car or any part of the car, unless a failurecauses the car to fail to conform to applicableemission regulations.

Any car on which the odometer has beenreplaced or altered and the true mileage cannotbe determined.

The car, if the Vehicle Identification Number (VIN)is altered or cannot be read, or if the car has beendeclared a total loss or sold for salvage purposes.

Federal Emissions PerformanceWarranty (Valid Only in the U.S.A.including Puerto Rico)

In those states and jurisdictions that haveestablished periodic vehicle emissions tests toencourage proper vehicle maintenance andrequire the car to pass an emissions testapproved by the U.S. Environmental ProtectionAgency and:

1. The car was distributed by BMW of NorthAmerica, LLC (BMWNA), or sold through theBMWNA European Delivery Program; and

2. The car has been maintained and operated inaccordance with the instructions for propermaintenance and use set forth in the Owner’sManual supplied with the car; and

3. The car fails to conform to the applicableemissions standards of the EPA as judged byan EPA approved emissions test; and

4. The failure to conform results or will result inthe owner of the car having to bear a penaltyor other sanction (including the denial of theright to use the car) under local state orfederal law if the non-conformity is notremedied within a specified period of time.

Then, in accordance with the provisions ofsection 207(b) of the Clean Air Act, BMWNAwarrants that if the car is eligible for coverageunder this warranty, any non-conformities in thecar, which cause it to fail an EPA-approvedemissions test will, without charge for parts orlabor (including diagnosis), be adjusted, repaired,or replaced, at the option of BMWNA to properspecifications, in order to make the car complywith applicable emissions standards. Thedecision whether to adjust, repair or replace partsis solely the prerogative of BMWNA and mustreasonably be expected to correct the failure ofthe warranted part.

Coverage begins on the date of first retail sale orthe date the vehicle is first placed into service asa sales demonstrator, Aftersales MobilityProgram (AMP) Vehicle or company vehicle,whichever is earlier. This warranty continues for aperiod of 2 years or 24,000 miles, whicheveroccurs first, except for specific emissions controlcomponents (as listed on page 26), for which thewarranty period is 8 years or 80,000 miles,whichever occurs first.

This warranty is made subject to the terms andconditions that apply to the Emission ControlSystemWarranty and the New Vehicle LimitedWarranty.

Warranty repairs do not constitute an extensionof the original limited warranty period for thevehicle or a part thereof.

No claim under this warranty will be denied on thebasis of use of a properly installed EPA certifiedemission part for maintenance and repair.

A vehicle manufacturer may deny an emissionperformance warranty claim on the basis of anuncertified replacement part used in themaintenance or repair of a vehicle only if the vehiclemanufacturer presents evidence that theuncertified replacement part is either defective inmaterials or workmanship or not equivalent from anemission standpoint to the original equipment part.

Maintenance, replacement, or repair ofemission control devices and systemsmaybeperformed by any automotive repairestablishment or individual using anycertified part.

Immediately after the car has failed an EPAapproved emission short test, your claim can bemade at any authorized BMW center. Theauthorized BMW center will honor or deny yourclaim within the time period specified by local orstate laws (not to exceed 30 days), to avoidfurther penalties or sanctions. If the claim isdenied, the authorized BMW center will notifyyou in writing of the reason(s). The authorizedBMW center is required by law to honor the claimif notice of denial is not received by the ownerwithin the specified time period.

To obtain service under this warranty, the vehiclemust be brought, upon failure of a Smog Checktest or upon discovery of the defect, to theworkshop of any authorized BMW center, duringnormal business hours. The authorized BMWcenter will honor or deny your claim within30 days. If the claim is denied, the authorizedBMW center will notify you in writing of thereason(s). The authorized BMW center isrequired by law to honor the claim if notice is notgiven to the owner within 30 days.

The authorized BMW center will, without chargefor parts or labor (including diagnosis), eitheradjust, repair or replace the defective part andother parts affected by the failure of thewarranted part, if any. If your vehicle failed theCalifornia Smog Check test or an EPA approvedshort test, then BMWNA will repair your vehicleso that it will pass this test. Items that requirescheduled replacement are warranted up to thereplacement interval specified in the Servicesection of this Statement. BMWNAmay repair apart in lieu of replacing it when performingwarranty repairs. Parts for which replacementsare made become the property of BMWNA. If your California registered vehicle is between 7and 8 years old and has been driven less than80,000 miles, then your vehicle is eligible foradditional warranty coverage under the FederalEmissions Warranty.

A repair performed as the result of a Smog Checktest failure due to a defect in a part, which iswarranted for 7 years/70,000 miles (8 years or100,000 miles for certain models), is covered.

It is strongly recommended that any replacementparts used for maintenance, repair orreplacement of emission control systems begenuine BMWService Parts or BMWAuthorizedRemanufactured Parts. Without invalidating thiswarranty, the owner may elect to havemaintenance, repair or replacement of theemission control systems performed by anyautomotive repair establishment, or elect to useparts other than BMWAuthorizedRemanufactured or genuine BMWService Parts.However, the cost of such service or parts will notbe covered under this warranty, except inemergency situations. In an emergency situation,where an authorized BMW center is notreasonably available or a warranty replacementpart is not available within 30 days, repairs maybe performed at any available serviceestablishment or by any individual using anyreplacement part.

A repair not completed within 30 daysconstitutes an emergency. BMWNA willreimburse the owner for such emergency repairs(including labor, parts and diagnosis not toexceed BMW suggested retail price for allwarranted parts replaced and labor chargesbased on the manufacturer’s recommended timeallowance for the warranty repair and thegeographically appropriate hourly labor rate) thatare covered under this warranty. Replaced partsand paid invoices must be presented to anauthorized BMW center as a condition of

reimbursement for emergency repairs notperformed by an authorized BMW center.

If other thangenuine BMWService Parts or AuthorizedRemanufactured Parts are used for maintenance,repair or replacement of components affectingemission control, the owner should obtainassurances that such parts are warranted by theirmanufacturer to be equivalent to genuine BMWparts in performance and durability. BMWNAassumes no liability under this warranty withrespect to parts other than genuine BMW parts.

However, the use of non-genuine BMWreplacement parts does not invalidate thewarranty on other components, unlessnon-genuine BMW parts cause damage towarranted parts.

What is not covered

This warranty does not cover malfunctionscaused by any of the following: accident, flood,misuse, modification, alteration, tampering,disconnection, improper or inadequatemaintenance, except if performed by anauthorized BMW center doing warranty repairwork, use of leaded fuel or fuel other than asspecified in the Owner’s Manual.

The replacement of maintenance parts, such asspark plugs (gasoline engines only), filters andsimilar items used in required maintenanceservices or the repair or replacement ofmaintenance parts beyond the first replacementinterval.

Any car on which the odometer has beenreplaced or altered and the true mileage cannotbe determined.

The car, if the Vehicle Identification Number (VIN)is altered or cannot be determined, or if the carhas been declared a total loss or sold for salvagepurposes.

Certain 2014 328i models are certified toCalifornia’s stringent Super Ultra Low EmissionVehicle (SULEV) standards and also qualify as aPartial Zero Emission Vehicle (PZEV) under theCalifornia Air Resources Board Zero EmissionVehicle program. In addition to very low tailpipeand zero-evaporative emissions, this PZEVcertification includes a unique warranty when thevehicle is registered in California, Connecticut,Maine, Maryland, Massachusetts, New Jersey,NewYork, Rhode Island or Vermont. The SULEV(PZEV) models registered in Delaware, Oregon,Pennsylvania andWashington are covered by theCalifornia Emissions Warranty; this coverage isdescribed beginning on page 26.

The California Air Resources Board and BMW ofNorth America, LLC (BMWNA) are pleased toexplain the emission control system warranty onyour 2014 vehicle. In California, new motorvehicles must be designed, built and equipped tomeet the State’s stringent anti-smog standards.BMWNAmust warrant the emission controlsystem on your vehicle for the periods of timelisted below provided there has been no abuse,neglect or improper maintenance of your vehicle.

*The California Emissions Control SystemLimited Warranty SULEV (PZEV) applies to all2014 U.S.-specification BMWSULEV (PZEV)vehicles registered in California, Connecticut,Maine, Maryland, Massachusetts, New Jersey,NewYork, Rhode Island or Vermont. Owner’sWarrantyResponsibilities:– As the vehicle owner, you are responsible forthe performance of the required maintenancelisted in your Owner’s Manual. BMWNArecommends that you retain all receiptscovering maintenance on your vehicle, butBMWNA cannot deny warranty solely for thelack of receipts or for your failure to ensure theperformance of all scheduled maintenance.

– You are responsible for presenting your vehicleto an authorized BMW center as soon as aproblem exists. The warranty repairs should becompleted in a reasonable amount of time, notto exceed 30 days.

California Emission ControlSystem LimitedWarrantySULEV(PZEV)*

This warranty applies to California certifiedvehicles distributed by BMW of North America(BMWNA) or sold through the BMWNAEuropean Delivery Program, registered andoperated primarily in California.

*The California Emissions Control SystemLimited Warranty SULEV (PZEV) applies to all2014 U.S.-specification BMWSULEV (PZEV)vehicles registered in California, Connecticut,Maine, Maryland, Massachusetts, New Jersey,NewYork, Rhode Island or Vermont.

BMWNA warrants to the original purchaser andeach subsequent owner that the vehicle is:

a. designed, built and equipped so as toconform with the applicable California AirResources Board emission standards.

b. free from defects in materials andworkmanship which cause any part that canaffect emissions to fail to conform withapplicable requirements or to fail a CaliforniaSmog Check test or EPA approved short testfor a period of 15 years or 150,000 miles,whichever occurs first.

c. free from defects in materials andworkmanship in emission related parts for aperiod of 15 years or 150,000 miles,whichever occurs first.

Coverage begins on the date of first retail sale orthe date the vehicle is first placed into service asa sales demonstrator, Aftersales MobilityProgram (AMP) Vehicle or company vehicle,whichever is earlier.

To obtain service under this warranty, the vehiclemust be brought, upon failure of a Smog Check testor upon discovery of the defect, to the workshop ofany authorized BMW center, during normalbusiness hours. The authorized BMW center willhonor or deny your claim within 30 days. If the claimis denied, the authorized BMW center will notify youin writing of the reason(s). The authorized BMWcenter is required by law to honor the claim if noticeis not given to the owner within 30 days.

The authorized BMW center will, without chargefor parts or labor (including diagnosis), eitheradjust, repair or replace the defective part andother parts affected by the failure of thewarranted part, if any. If your vehicle failed theCalifornia Smog Check test or an EPA approvedshort test, then BMWNA will repair your vehicleso that it will pass this test. Items that requirescheduled replacement are warranted up to thereplacement interval specified in the Servicesection of this Statement. BMWNAmay repair apart in lieu of replacing it when performingwarranty repairs. Parts for which replacementsare made become the property of BMWNA.

A repair performed as the result of a Smog Checktest failure due to a defect in a part, which iswarranted for 15 years/150,000 miles, is covered.

Warranty repairs do not constitute an extensionof the original limited warranty period for thevehicle or a part thereof.

In all cases, a reasonable time, not to exceed30 days, must be allowed for a warranty repair tobe completed, after the car is received by theauthorized BMW center.

It is the owner’s responsibility to have all requiredmaintenance services performed (at the owner’sexpense), as prescribed in the maintenanceschedule for the BMW Emission Control System.Service intervals are computed by the ConditionBased Service system and displayed on theinstrument panel.

However, BMWNA will not deny your warrantyrepair claims solely because you do not havemaintenance records or you did not perform therequired maintenance unless BMWNAdemonstrates that such lack of requiredmaintenance is a direct cause of the emissioncontrol system failure. The instructions forrequired maintenance and use can be found inthe Owner’s Manual and in the Service section ofthis Statement.

It is strongly recommended that any replacementparts used for maintenance, repair orreplacement of emission control systems begenuine BMWService Parts or BMWAuthorizedRemanufactured Parts. Without invalidating thiswarranty, the owner may elect to havemaintenance, repair or replacement of theemission control systems performed by any

automotive repair establishment, or elect to useparts other than BMWAuthorizedRemanufactured or genuine BMWService Parts.However, the cost of such service or parts will notbe covered under this warranty, except inemergency situations. In an emergency situation,where an authorized BMW center is notreasonably available or a warranty replacementpart is not available within 30 days, repairs maybe performed at any available serviceestablishment or by any individual using anyreplacement part.

A repair not completed within 30 daysconstitutes an emergency. BMWNA willreimburse the owner for such emergency repairs(including labor, parts and diagnosis not toexceed BMW suggested retail price for allwarranted parts replaced and labor chargesbased on the manufacturer’s recommended timeallowance for the warranty repair and thegeographically appropriate hourly labor rate) thatare covered under this warranty. Replaced partsand paid invoices must be presented to anauthorized BMW center as a condition ofreimbursement for emergency repairs notperformed by an authorized BMW center.

The use of replacement parts, which are not ofequivalent quality, may impair the effectivenessof emission control systems. If other thangenuine BMWService Parts or AuthorizedRemanufactured Parts are used for maintenance,repair or replacement of components affectingemission control, the owner should obtainassurances that such parts are warranted by theirmanufacturer to be equivalent to genuine BMWparts in performance and durability. BMWNAassumes no liability under this warranty withrespect to parts other than genuine BMW parts.

What is not covered

This warranty does not cover malfunctionscaused by any of the following: accident, flood,misuse, modification, alteration, tampering,disconnection, improper or inadequate

maintenance, except if performed by anauthorized BMW center doing warranty repairwork, use of leaded fuel or fuel other than asspecified in the Owner’s Manual.

The replacement of maintenance parts, such asspark plugs, filters and similar items used inrequired maintenance services or the repair orreplacement of maintenance parts beyond thefirst replacement interval.

Any car on which the odometer has beenreplaced or altered and the true mileage cannotbe determined.

The car, if the Vehicle Identification Number (VIN)is altered or cannot be determined, or if the carhas been declared a total loss or sold for salvagepurposes.

General

The warranty gives you specific legal rights, andyou may also have other rights which vary fromstate to state.
