APPEAL

Donation to the Building fund of the Association

The Executive Committee of K P&T PA is overwhelmed by the response it hasbeen receiving from several Members for the appeal made by the Association fordonation to the building fund. The names of the Donors are given in this issue of thejournal.

K P&T PA reiterates its appeal and earnestly requests other Members and Wellwishers to donate liberally to the building fund to facilitate commencement of theconstruction work of the proposed annex to Pensioners’ Bhavan. Most of the Banksand Post Offices have paid the revised pension as also the arrears on 31st August 2016.Arrears of pension have also been paid to the Pensioners retired with less than 33 yearsof service, who got substantial amount of arrears (in lakhs in most of the cases) asa consequence of delinking of 33 years of service for full pension with retrospective effectfrom1-1- 2006, in addition to the arrears in terms of 7th CPC recommendations. K P&TPAhopes that there will be a good response from the Members of the Association, Subscribersto the Journal Pensioners’ Champion and Well Wishers.

Names of those who donate Rs.50,000/- and above will be engraved on granitestone to be embedded in the front wall near the main door of the new building andof those who donate Rs. 10000 /- and above but less than Rs.50000/-, on the boardsprovided in the main hall

Minutes of the meeting held on 22.08.2016under the Chairmanship of Addl.CGA withall the Heads of CPPCs/GovernmentBusiness Divisions of Authorised Banks toreview the status of implementation of 7thCPC pension revision and other issues.

A meeting with all the Heads of CPPCs/Govt. Business Divisions to review the statusof implementation of 7th CPC revision andother issues was held on 22.08.2016 at PFMSConference Hall, 4th Floor, Shivaji StadiumAnnexe, New Delhi under the Chairmanship ofAddl.CGA. A list of participants is enclosed atAnnexure-I.

Following agenda items were discussed.

I) Status of implementation of 7th CPCPension Revision

1) Readiness of the Banks for timely andcorrect revision of pension and paymentof arrears by 31st Aug 2016:- As per DPPWOM dated 4th August, 2016 all the PensionDisbursing Banks have to complete the taskrelated with 7th CPC pension revisions andpayments of arrears by 31st August, 2016.Banks were also instructed vide OM No. CPAO/IT & Tech/Revision (7th CPC)/ 19.Vol-IlI/2015-16/ 109 dated 11th August 2016 from CPAOinstructing them to complete the task by 31StAugust 2016 and report the revision throughe-scrolls. In the meeting, instructions werereiterated to ensure payment of revised pensionalong with arrears to all pre-2016 Pensionersby 31.08.2016. All Banks expressed theircommitment for payment of revised pensionalong with arrears to Pensioners by 31.08.2016.However, the State Bank of India mentionedthat it was targeting the date of 8th September,2016 to complete the process on which boththe Addl. CGA and CC (P) instructed that thetarget date of 31.08.2016 is non- negotiable

Status of Implementation of 7th CPC Pension Revision and other issues:Minutes of the Meeting CPAO & CPPC

(GoI, Ministry of Finance, New Delhi letter No. CPAO/IT&Tech/Revision (7th CPC)/19. Vol-III/2016-l7/124 dated 30th August, 2016)

and they should use all their resources tocomplete the payment of revised pension alongwith arrears by 31.08.2016. Since payment ofpension presently being drawn bythe Pensioners/Family Pensioners under 6thCPC will provide basis for revision under 7thCPC, correctness of pension under 7th CPCrevisions would depend upon the accuracy ofthe revisions effected by the Banks under 6thCPC. Internal Audit of CPAO has pointed outin many cases mismatches between thepension authorized by the CPAO and thepension paid by the Banks vide letter dated22nd July 2016 to Banks. In these cases,Banks were either making overpayments orunderpayments to the Pensioners. If notcorrected, these discrepancies in the paymentwould percolate to the 7lh CPC revisions alsowhich may lead to the Pensioners’ grievancesand Court Cases. Therefore, Banks wereadvised to comply with the audit observationswhile revising such cases as per 7th CPCwithout breaching the deadline of 31st August,2016.

2) Strategy of Banks to deal with pendingcases of revision under 6th CPC: - It wasdiscussed that there were possibilities whereRevision Authorities had been sent by theCPAO but Banks had not yet acted uponthese Authorities pertaining to the pensionrevisions under DP&PW O.M. dated 30.07.2015and 06.04.2016. Further, other revisions under6th CPC pending with Departments may alsobe received by the Banks later after effectingrevisions under 7th CPC by them based on theexisting pension.

To deal with these pending cases under6th CPC, Banks were advised to make suitablestrategy and provision in their software to revisethese cases under 6th CPC at a later date too

and provisions for further required adjustmentsfor 7th CPC revisions may also be made.

3) Monitoring of implementation of 7th CPCby CPPCs/GBDs: As Banks have to effect7th CPC revisions along with payment of arrearsby 31st August, 2016, close monitoring ofimplementation of the same was required. Forthis purpose, Banks were advised to constitutea group of officials who may keep a closewatch on the status of implementation on dailybasis.

This group may deal with the issuesrelated with manpower, software, infrastructureand availability of records to ensure that correctrevisions are done and arrear payments aremade by 31st August, 2016. Banks were alsoadvised to strengthen their Internal Monitoringand Control System for timely and correctpayment of pension and revisions.

4) Reporting of revised cases to CPAO byBanks: The objective of government is toensure timely and correct revision of pensionunder 7th CPC. It becomes necessary forCPAO to monitor the same. Therefore, afterpaying the revised pension and arrears, Bankswere advised to flag the revised cases in theFormat -A of the e-scrolls to be submitted toCPAO so that revised cases may be identifiedat CPAO. To enable the Banks for flagging ofsuch cases, necessary modifications havebeen made in the Format-A of e-Scroll bychanging the heading of column 18 to“Applicable Pay Commission’. Under thiscolumn, banks have to fill “7” for the caseswhich have been revised under 7th CPC bythem. Further banks were advised toincorporate in the column 27 of the Format ine-scroll titled “Pay Commission”, 7th CPC andsend it along with Format-A.

Banks sought certain clarifications onthe 7th CPC revisions and the clarifications ofCPAO have been put on CPAO website on24th August 2016. A copy of the same is atAnnexure-II.

II) Other Issues

a) Furnishing the details/records ofpending revision of Pre-2006 pensioncases: Despite all efforts of PAOs and CPAO,still 4,857 (1.13%) cases as on 22nd August2016 pertaining to Civil Ministries/ Departmentswere pending for revision as per 6th CPCrecommendations. In these cases, details ofPensioners required for revision are neitheravailable with CPAO nor with PAO/Ministry/Department. Since Banks are paying pensionto these Pensioners, they were advised toforward the details of such Pensioners/FamilyPensioners to CPAO for immediate revision ofpension. In those cases where Banks are nothaving requisite details of these Pensioners,they were supposed to contact the Pensionerson the contact details available with them underKYC norms and get the details.

b) Delay in commencement of familypension to spouse on death of Pensioners:It has been reported by the Pensioners andPensioners' Associations that there is inordinatedelay in start of pension in favour of spouseafter the death of Pensioners. Ideally thereshould not be any delay in the start of familypension in favour of the spouse of deceasedPensioners because family pension in favourof spouse is co-authorized in the original PPOof Pensioners itself through joint bank accounts.The family pension must be started immediatelyafter submission of death certificate of thePensioners. It is essential for CPAO to monitorsuch types of cases; however, it becomesdifficult because the date of death of Pensioneris not known to CPAO. Though, provision ofreporting of date of death of Pensioners isavailable in the Format ‘F’ of the e-scroll.However, Banks are not providing thisinformation to CPAO. Therefore, Banks wereadvised to take necessary steps in this regardto ensure timely payment of family pension inthe event of death of Pensioners and reportthe same to the CPAO through Format-F ofe-Scroll.

c) Automatic Restoration of Commutationof pension and payment of AdditionalPension: The commuted portion of pensionmust be restored after 15 years from the dateof payment of commutation automatically.Similarly, on attaining the age of 80 years,additional pension to the Pensioners shouldalso be paid automatically. It was mentionedto the Banks that it has been noticed that inmany cases timely restoration of CVP andpayment of additional pension are not done bythe Banks resulting into sufferings to thePensioners. These issues are reported by thePensioners and Pensioners' Associations tothe government time and again. In the recentSCOVA meeting also these issues were raisedon which Secretary (P&PW) expressed hisdeep concern and desired that CPAO shouldtake monthly report on it from the Banks. Toensure timely restoration of CVP and paymentof additional pension on attaining the age of80 years, Banks were advised to makenecessary provisions in their software forflagging of such cases and regular monitoringthereof so that Pensioner may not feel harassedon these grounds.

d) Use of CPAO website to respond on theaction taken on Pensioners’grievances: Banks were informed that CPAOhas developed web responsive Pensioner’sservice on its website www.cpao.nic.in for theregistration and tracking of grievancesregistered by the Pensioners. Facility to forwardbank related grievances and taking onlineresponse thereof has been developed. For thispurpose login IDs have been created for everyhead of CPPC and necessary instructions(along with login id and password) have alreadybeen circulated by CPAO for the use of thisservice by the Banks. To monitor the disposalof grievances by the Banks, separate loginIDs have also been created for the officers ofGovernment Accounting/Business Divisions.However, it is noticed that Banks have notstarted using this facility for taking action onthe grievances of Pensioners forwarded online

through this system. They were advised touse this facility immediately.

Further, Banks were also advised tohave separate website for CPPCs which shouldbe able to redress Pensioners grievances tooas per para 9.2 of CPPC guidelines issued byCPAO.

e) Readiness of SFTP for implementationof digitally signed pension revisionauthorities: After the implementation ofpaperless movement of digitally signed revisionauthorities for SBI, PNB, Canara Bank andBank of Baroda, other 25 Banks were instructedthrough CPAO OM dated 28.01.2016 to getready with their SFTP server so that w.e.f.16.02.2016 this project might be implementedin all the Banks. Accordingly, all the bankswere requested to provide Server fingerprintfor SFTP, Useer name of SFTP and Passwordfor the SF TP to the CPAO. However, 7 Banksi.e. Bank of India, Central Bank of India, IndianOverseas Bank, Oriental Bank of Commerce,State Bank of Travancore, United CommercialBank and Syndicate Bank were still to providethese details. Consequently, this project wasyet to be implemented with these Banks. These7 Banks were advised to complete allformalities in this regard without further delayso that the digitally signed pension revisionauthorities may be implemented with themalso.

f) Status of Aadhaar Seeding: CC (P)appreciated the overall seeding of Aadhaar bythe Banks which was more than 75% of thetotal civil Pensioners. Further, quoting thereference of DP&PW letter dated10.08.2016addressed to CMDs of all Pension DisbursingBanks, he advised the Banks to complete theAadhaar seeding for remaining Pensioners alsowhile revising the pension under 7th CPC.

g) Delay in receipt of Scrolls fromBanks: Though Banks are required to send e-scrolls to CPAO either on the same day or bynext day, but delay ranging from 1 day to 68days has been observed. Banks were advised

to ensure that e-scrolls are timely sent toCPAO.

h) Timely credit of revisions of pensioneffected consequent to OMs dated-30thJuly, 2015 and 6th April 2016 respectivelyof DP&PW: Instances have been reportedwhere the revision of pension already sent by

The undersigned is directed to say that the pension of the Government servantsappointed on or after 1.1.2004 is regulated by the new Defined Contribution Pension System(known as National Pension System), notified by the Ministry of Finance (Department ofEconomic Affairs) vide their O.M. No. 5/7/2003-ECB & PR dated 22.12.2003. Orders wereissued for payment of Gratuity on provisional basis in respect of employees covered under National Pension System on their retirement from Government service on invalidation ordeath in service, vide this Department’s O.M. No. 38/41/2006-P&PW(A) dated 5.5.2009.

2. The issue of grant of Gratuity in respect of Government employees covered by the NationalPension System has been under consideration of the Government. It has been decided thatthe Government employees covered by National Pension System shall be eligible for benefitof ‘Retirement Gratuity and Death Gratuity’ on the same terms and conditions, as areapplicable to Employees covered by Central Civil Service (Pension) Rule,1972.

3. These Orders issue with the concurrence of Ministry of Finance, Department of Expenditure,vide their .D. Note No. 1(4)/EV/2006-II dated 29.07.2016.

4. In their application to the persons belonging to the India Audit and Accounts Department,these Orders issue after consultation with Comptroller and Auditor General of India.

5. These Orders will be applicable to those Central Civil Government Employees who joinedGovernment Service on or after 1.1.2004 and are covered by National Pension System andwill take effect from the same date i.e. 1.1.2004.

The undersigned is directed to say thatthe pension of Penioners/Family pensionerswho were drawing pension/family pension ason 1.1.2006 under the CCS(EOP) Rules wererevised in accordance with Department ofPension & Pensioners' Welfare O.M. No. 38/37/2008-P&PW(A) dated 1.9.2008. Instructionswere issued vide this Department OM of evennumber dated 30th September, 2010 forextension of benefits of modified parity to pastPensioners for revision of disability pension/family pension covered under CCS(EOP)Rules.

2. Subsequently, orders were issued vide thisDepartment's OM No. 38/37/2008 P&PW(A)dated 28.1.2013 and 30.7.2015 for furtherstepping up of normal pension/family pensionto 50%/30% of the sum of minimum pay in thePay Band and Grade Pay corresponding to thepre-revised Pay Scales from which thePensioner had retired as arrived at withreference to the fitment table annexed to theMinistry of Finance. Department of ExpenditureOM No. 1.1.2008. IC dated 30th August 2008with efect from 1.1.2006. These benefits werealso extended to pre-2006 Disability Pensioner/family Pensioner covered under the CentralCivil Services (Extraordinary Pension) rulesvide this Department's OM of even numberdated 20.11.2014 and 29th April 2016respectively. As per para III(a), IV(a) and paraV(a) of this Department's OM of even numberdated 20th November 2014. The serviceelement of disability pension of pre-2006Diability Pensioners was linked to qualifyingservice for earning full pension.

3. In the case of pre-2006 Pensioners receivingpension under CCS(Pension) Rules, 1972.Orders have been issued vide this Department'sOM No. 38/37/2008-P&PW(A) dated 6.4.2016.

that the revised consolidated pension of pre-2006 Pensioners shall not be lower than 50%of the minimum of the Pay in the Pay Bandand the Grade Pay (wherever applicable)corresponding to the pre-revised Pay Scale asper the fitment table without pro-rata reductionof pension even if they had qualifying serviceof less than 33 years at the time of retirement.

4. This provision would be equally applicablefor computing service element of reviseddisability pension being drawn by the pre-2006Disability Pensioners. Accordingly, theprovision linking the service element ofdisability pension under para III(a), IV(a) andV(a) of this Department's OM of even numberdated 20th November 2014 stands deleted.The arrears of revised disability pension wouldbe payable with effect from 1.1.2006.

5. All Ministries/Departments are requested tobring the contents of these Orders to the noticeof Controller of Accounts/Pay and AccountsOfficers and Attached and Subordinate Officesunder them for revising the pension of all thosepre-2006 Disability Pensioners who hadrendered less than 33 years of qualifying serviceat the time of retirement/boarding out in themanner as indicated above on top priority.Revised Pension Payment Orders (PPOs) inall these cases may also be issuedimmediately.

6. All other terms and conditions in the OMNo. 45/22/97-P&PW(F) dated 3.2.2000 and OMNo. 45/3/2008 P&PW(F) dated 30.9.2010.20.11.2014 and 29.4.2016 shall remainunchanged.

7. This issues with the concurrence of theMinistry of Finance, Department of Expenditure,vide their I.D. Note No. 1(5)/EV/2012 dated5.7.2016.

The revised pay structure, asrecommended by the 7th CPC, was giveneffect as on 01.01.2016 as per theGovernment’s Notification. The DearnessAllowance, which was computed at 125% ( i.e125.75 fraction of 0.75 being ignored),got merged with Pay as on that date. The 7thCPC has not indicated as to what base figureof AICPI (IW) the Revised Wages will relateto hereafter wards. As you are aware, theactual DA that was due as on 01.01.2016 was125.75. It is only due to the practice of ignoring

fraction; the DA was determined at 125%. Nodoubt, the said practice had not been impactingvery much except for the postponement of thebenefit by six months. It is, therefore,necessary that, Revised Wages are related toa base index figure equivalent to actualDearness Allowance percentage of 125 thatstands merged as on 01.01.2016. This is moreso due to the fact that there is no possibilityof the ignored fraction of 0.75 being reckonedfor any computation in future.

We, therefore, request that, 12 monthlyaverage, which stood at 261.33 as on31.12.2015, may be taken at 260.46, whichwould provide the exact percentage of DA at125. The future percentage increase in DA inother words may be computed with the basefigure of 260.46. The next instalment of DA,which has become due as on 1.07.2016 ifcomputed on the above basis of 260.46, shall

work out to 3.28%. On ignoring the faction, theDA with effect from 01.07.2016 shall be 3%.We, request you to kindly take the above intoaccount and issue orders for grant of 3% DAw.e.f. 01.07.2016.

The decision of extension of CGHSFacility to retired BSNL employees wasconveyed vide letter No.4-12(11)/2012-PATdated 420-2-2014.The letter also mentionedthat BSNL employees who opt for CGHS wouldhave to pay the requisite fee to CGHS asapplicable to Government retirees. The facilitywas not being extended to BSNL employeesdue to different Pay Scales applicable to BSNLemployees. Now, CGHS Authorities haverequested DoT to indicate equivalent BasicPay and Grade Pay as per the Central PayScales on the Pension Payment Order (PPO)which will facilitate evaluation of subscriptionand room rent of the Beneficiary. Retiredemployees intending to avail CGHS facilitymay approach DoT and get the equivalentBasic Pay and Grade Pay indicated on theirPPOs for availing CGHS Facility.

Modifying the liability of BSNL towards the payment of pensionarybenefits to the retired employees

GoI, Ministry of Communications, Department of TelecommunicationsO.M. No 40-13/2013-Pen (T) Dated 20-07-2016

As stipulated in rule 37-A of CCS(Pension) Rules, 1972, the pensionary benefitsin the case of BSNL shall be paid by theGovernment, and the Government shall specifythe arrangement and manner including the rateof pensionary contribution to be made by BSNLand the manner in which financial liabilities onthis account shall be met. As per sub-rule 24of the said Rule, the arrangement thus workedout shall be applicable to the existingPensioners and to the Employees who aredeemed to have retired from Government2. The instructions with regard to the financialliability on this account were issued vide DoT’sletter no 1-45/2003-B dated 15-06-2006.Subsequently, the matter of modifying thePension liability of BSNL towards the paymentof pensionary benefits including family pensionto the retired employees has been consideredby the Government, and the following hasbeen decided.

(a) The pension liability in respect ofemployees of DOT/DTS/DTO who retired priorto 01.10.2000 is solely borne by Governmentof India and the BSNL will have no liability inrespect of these Employees.

(b) The liability towards pensionarybenefits including family pension to the BSNLemployees (excepting those recruited after1-10-2000), as per sub-Rule 22 of Rule 37-Aof CCS (Pension) Rules, 1972, lies with theGovernment of India.

The condition that the annual pensionliability of the Government shall not exceed60% of the annual receipts to Governmentfrom the items specified in the O M dated15-06-21006, is hereby rescinded.

(c) BSNL will continue to dischargepension liability by way of pension contributionin accordance with FR 116.

40th AGB Meeting of the Associationwas held at Hotel Kamat Yatri Nivas,Gandhinagar, Bengaluru, on August 24th, 2016.Shri S S Ramanatha Rao, President of theAssociation presided. A minute’s silence wasobserved in memory of the members departedduring the preceding year. The Assn was theRecipient of ‘SPVatta’ Trophy and cash rewardof Rs 5000/- awarded by Bharat PensionersSamaj, New Delhi, for ‘its outstandingperformance in 2014’; and the trophy was ondisplay at the dais.

The President in his welcome speechmentioned that late visionary Sri C L Rao, aDefence civilian pensioner, founded thisAssociation in his house in 1974 with a handfulof Members. He remembered this visionarywith great respect. He also mentioned aboutthe office accommodation provided to theAssociationn by Shri Tirumalai a Member, whooffered a portion of his house at Vyalikaval( present address) on a meagre rent. Mentioningabout the recognition of the Assn by the Govt.and sanction of Grant-in-aid, he praised thecontributions of former President lateShri M N Doraiswamy and former SecretaryShri S Gurudas. Then, the President referredto the 7CPC. When the 7CPC Team headedby Justice Sri Mathur came to Bangalore onAugust 24, 2014, to hear the views ofpensioners and others, Shri Ramanatha Raoled a team of 11 Pensioners Representativesand all of them presented their views. Herequested the Members to donate liberally tothe Assn from the 7th CPC arrears – a minimumamount of Rs 1000.

Secretary of the Assn Shri AshokKololgi read out the Minutes of the last year’sAGM held on 11 Aug 2015. It was acceptedby members by voice vote. He then read outSecretary’s report for the year 2015-16& placedit for adoption. He informed that the Membershipof the Assn has increased to 1122. Hementioned that Aadhaar card seeding withpension accounts in Banks. He said that theOROP still eluded full satisfaction among theDefence pensioners. He referred toimprovement in CSD facilities for Defencecivilian pensioners and family pensioners. Hewas happy that the Journals of the BPS NewDelhi, and sister organisations like theKarnataka P&T PA were airing the views in thePD. He emphasised that the Members mustensure that the Assn has the telephone numbersand e-mail IDs of all the Members, for quickcommunication. The Report was adopted bythe House.

Treasurer Shri K S Menon presentedthe Income & Expenditure Statement for2015-16 & Budget for the year 2016-17, It wasaccepted after a few queries from the members.

Members who had crossed 75 years ofage during the year were honoured as ‘elites’.21 Members present were felicitated with ashawl, a memento and rose-bud each.

Shri Krishna Rao while addressing thegathering spoke in detail about the 7th CPC.He emphasised that compared to themultiplication factor of 2.57, recommended bythe Commission and accepted by the Govt,Option-1 formula had better advantage, Hesaid that it was possible to get the details ofthe pensioners from the service records, thoughold, to rule in favour of Option-1. He averredthat it should be possible to get the relevantdetails from other records like Pay Bills etc.ifservice records are not available forimplementation of Option-1.ShriRadhakrishnaspoke about the short-falls of 7th CPC, andsaid that the struggle is still on for Option I.He was however vocal that the Govt andparticularly the DoP&PW were not in favour ofimplementation of Option-1recommended bythe 7th CPC. Shri SadashivaRao maintainedthe role of Adviser and Patron, and said thatall Pensioners should make joint account inBanks for easy transfer of pension and shouldgive nominations for arrears. He said that allshould maintain good health and gave a fewtips like: Walking daily, Taking medicines asper Doctor’s advice regularly; Readingnewspapers and books.

The Sixth Annual General Body meetingof Karnataka IA & AD Pensioners’ Associationwas held on 10th September 2016 atRangamandira Eastern Quadrangle O/o TheAccountant General (A&E), Bangalore. Themeeting commenced at 10.30 AM.

Nearly 250 Members attended themeeting. The AGM completed the adoption ofAnnual Report, Accounts and Amendments to

Memorandum of Association and Rules andRegulations of the Association. There were nonominations for elections to ExecutiveCommittee. General Body unanimously decideto re-nominate the existing CommitteeMembers for the Executive Committee for theyears 2016-17 and 2017-18. Newly nominatedExecutive Committee Members later met andunanimously elected Shri HV Manjunath asPresident and S Radhakrishna as Secretary.

The meeting was converted in to opensession at 12noon. The open session wasinaugurated by Shri R Naresh IA&AS,Accountant General, O/o Accountant General(A&E) Bengaluru. After invocation by BVManjunath and lighting of lamp by the ChiefGuest and other Dignitaries which includedShri K O Manjunath, Sr. DAG (ADMIN) andMuralidhar K S, DAG(GE) of O/o AG(A&E).The Secretary in his brief report stated thatAssociation which started with 110 memberson 31st March 2010 has grown in strength andon 31st July 2016 strength of membership is973. He mentioned that the Associationconducted Sports Fest on 12 June 2016 to itsMembers, their spouses and grandchildren

He also mentioned that Association istaking up many charitable and social activitiesfor the welfare of Society. 23 Senior Membersabove 80 years were honoured in the OpenSession. Inaugurating the ‘Open Session’ ChiefGuest appreciated the good work being doneby the Association to the Society and to welfareof its Members. He assured all help to theAssociation. There was a festive mood and itlooked like a family get together.

It was a pleasure for everyone to meettheir old friends and colleagues and recollectthe pleasant past and discuss their presentactivities. Recreation Club hall was a hub ofactivities in their days and Members wereremembering their activities in club as players,artists and spectators.

The AGM concluded at 1.30 PM withNational Anthem.
