VALUABLE TONIC AND REMEDIAL AOENT, INIrt'lRsKl) AND RKCOMMENIKl BY THE KNTIRK MEDICAL FilA'1 V. Of all nieliciiial pieparatUms that have he. it put tipnii the liiurkel in leceut years, the e.xtract of nutlt h:xs proved itself one of the most valuable as a tonic or remedial teverage. It has received the anquiilitieii recognition uud support of phy- sicians, and is freely prescribed by them in nmny cutses, especially where tli. nervous or physical systems have been impaired by disease or over-vor- k. Tne house if "DAVID NICHOLSON," of this city, has recently introduced a pure malt extract of high character, made at their request and under their suggestions by Mr. Adnlphus lit. sell, and which is popularly known as "NICH-OlON- 's LlQl'l D BREAD," from its life-givin- g anil healih-restori- n propertie. A saoiple siib-nittie- d to Dr. K, I. James was made the subj.-c- t ol a chemical analysis bvtiim. ami the result ot his invetii;atioiis are g.ve:i in the appended cer- tificate: T. I oi'ls, April 2 , 1SS4. "W. K. Cil'LT K. Esi., Nutioiiul Druggist Iar Sir: Having submitti'd the Nicholson mult ex- tract to examination, us requested, I take pleasure in reporting tiint I find it M 6e all that the pro-p.ietor- s claim for it. The results, as shown in the following Kiim:uurj-- , are necessarily only approxi- mate, but are sufficiently accurate for ail practical purposes. "The specimens submitted consisted of an eflVrve?cing tluid, dark brown by direct and of a deep ruby color by transmitted light, resembling in general appearance and behavior a very supe- rior article of porter. Its" taste was, howeyer, much milder and more pieusgpt than porter, be- ing somewhat sweeter than beer, the sweetness masked and covered by a very pleasant bitter, derived evidently from hops. The specific gravity of a sample fresh f um the bottle is 1.022 plus. Amount of extractive matter in 50 cubic centi- metres of the fluid is 3.!it grammes, or about 8 per cent. Amount of alcohol, per cent, is 2. SI plus. The extractive matter is apparently identical with the "e.xtractiuu mallis" of Trommer, or of the German Pharmacopoeia. It consists almost en- tirely of malt sugar, dextrine, being free from fatty acids, etc. The fluid contains a very large amount of diastase, as shown by the fact that it easily liquefies an equal bulk of gelatinous starch. This fact, its low percentage of alcohoi, its effer- vescence, its delightful taste and odor, all combine to recommend Nicholson's malt extract as being a most nourishing beverage, and the best article of the sort that has ever come under my exami- nation. LIQUID BREAD.AN A BsoLUTKL V 1'URK KXTRACT OF

MALT.

VALUABLE TONIC AND REMEDIALAOENT,

INIrt'lRsKl) AND RKCOMMENIKl BY THEKNTIRK MEDICAL FilA'1 V.

Of all nieliciiial pieparatUms that have he. it puttipnii the liiurkel in leceut years, the e.xtract ofnutlt h:xs proved itself one of the most valuableas a tonic or remedial teverage. It has receivedthe anquiilitieii recognition uud support of phy-sicians, and is freely prescribed by them in nmnycutses, especially where tli. nervous or physicalsystems have been impaired by disease or over-vor- k.

Tne house if "DAVID NICHOLSON,"of this city, has recently introduced a pure maltextract of high character, made at their requestand under their suggestions by Mr. Adnlphuslit. sell, and which is popularly known as "NICH-OlON- 's

LlQl'l D BREAD," from its life-givin- g

anil healih-restori- n propertie. A saoiple siib-nittie- d

to Dr. K, I. James was made the subj.-c- t

ol a chemical analysis bvtiim. ami the result othis invetii;atioiis are g.ve:i in the appended cer-tificate:

T. I oi'ls, April 2 , 1SS4."W. K. Cil'LT K. Esi., Nutioiiul Druggist IarSir: Having submitti'd the Nicholson mult ex-

tract to examination, us requested, I take pleasurein reporting tiint I find it M 6e all that the pro-p.ietor- s

claim for it. The results, as shown in thefollowing Kiim:uurj-- , are necessarily only approxi-mate, but are sufficiently accurate for ail practicalpurposes.

"The specimens submitted consisted of aneflVrve?cing tluid, dark brown by direct and of adeep ruby color by transmitted light, resemblingin general appearance and behavior a very supe-rior article of porter. Its" taste was, howeyer, much milder and more pieusgpt than porter, be-ing somewhat sweeter than beer, the sweetnessmasked and covered by a very pleasant bitter, derived evidently from hops. The specific gravityof a sample fresh f um the bottle is 1.022 plus.Amount of extractive matter in 50 cubic centi-metres of the fluid is 3.!it grammes, or about 8 percent. Amount of alcohol, per cent, is 2. SI plus. The extractive matter is apparently identical withthe "e.xtractiuu mallis" of Trommer, or of theGerman Pharmacopoeia. It consists almost en-tirely of malt sugar, dextrine, being free fromfatty acids, etc. The fluid contains a very largeamount of diastase, as shown by the fact that iteasily liquefies an equal bulk of gelatinous starch. This fact, its low percentage of alcohoi, its effer-vescence, its delightful taste and odor, all combineto recommend Nicholson's malt extract as beinga most nourishing beverage, and the best articleof the sort that has ever come under my exami-nation. Respectfully,

"FRANK L. JAMES, Ph. D., M. D."

AND NOTES, ETC.

An abandonment of goods at sea doesnot divest the owner of his property inthem. (24 Pick., 25.) By finding ves-

sels or other chattels ujon the ocean, thetinders do nut Income the owners. Theprojerty remains as lx fore, subject only"to the right of salvage. This right ismerely a lien, or right to retain thegoods till the salvage be paid. (1 M. &

S., 140; 24 Pick., 25.) But propertysunk in a steamboat, and unclaimed for

twenty-thre- e years, was held to beclearly derelict. (12 La. Ann., 745.)

Protest in maratime law is a writing, attested by a Justice of the Peace, aNotary Public, or a Consul, made andverified by the master of a vessel, statingthe severity of a voyage by which a shiphas suffered, and showing that it was notowing to the neglect or misconduct of

the master. (See Marsh. Ins., 715; 1

Wash.,C. C, 145, 23S; 1 Pet.-- , C. C,110; 1 Pall., C, 10; S W. & S, 144.) Theprotest is not, in general, evidence for themaster of the vessel or his owners, in theEnglish or American Courts, yet it isoften proper evidence against them.(Abb. Ship., 405.)

Usages of .merchants', commmonlycalled the law merchant, is the generallody of commercial usages in matters re-

lating to commerce. Blackstone calls itthe custom of merchants, and ranks itunder the head of the particular customsof England, which go to make up thegreat body of the common law. (1 Bl.

Com., 75.) Since, however, its characteris not local, nor its obligation confined toa particular district, it cannot with pro-

priety be considered a custom in thetechnical sense. (1 Steph. Com., 54.) Itis a system of law which does not restexclusively on the positive institutionsor local customs of any particular country, but consists of certain principles ofequity and usages of trade which generalconvenience and a common sense ofjustice have established, to regulate thedealings of merchants in all the commercial countries of the civilized world. (3Kent., 2.)

These usages, being general and extensive, nartake of the character of

rules and principles of law, not of matters of fact, as do usages, which are special. They constitute a part of the gen-

eral law of the land, and being a part ofthat law, their existence cannot beproved by witnesses, but the judges arebound to take notice of them ex officio,(Winch., 24.), and this application itnot confined to merchants, but extendsto all persons concerned in any mercantile transaction. (See BeamesLex Mercatoria, Kediviva, Caines, Lex Merca- -

toria Americana, Comyns Dig. Merchant(D.); Cbitty Com. Law ; Parsons, Mari.lj i'dtefeto'an unconditionalwritten order from one jerson to another,

tain sum of money therein named.(Byles on Bills, 1 ; and authorities.) Anoien (that is, unsealed) letter addressedby one person to another directing him,in effect, to pay, absolutely and at allevents, a certain sum of money thereinnamed to a third person, or to any otherto whom that third jterson may order itto be paid, or it may be payable tobearer or to the drawer himself. (1

Dan. Neg. Inst., 20.) A bill of exchangemay be negotiable or non-negotiab- le. Iinegotiable, it may be transferred eitherbefore or after acceptance. The ersonmaking the bill, called the drawer, is saidto draw ii)Kii the erson to whom itis directed, and undertakes impliedly topay the amount with certain costs if herefuse to comply with the command. The drawee is not liable on the bill tillafter acceptance, and then becomesliable as principal to the extent of theterms of the acceptance; while t.'iedrawer lecomes liable to the payeeand indorsees conditionally upon thefailure of the acceptor to pay. Theliabilities between indorsers and in-

dorsees arc subject to the same rulesas those of indorsers and indorseeson promissory notes. Kegulaily, the drawee is the jerson to beco neacceptor, but other parties ma' accept, under special circumstances.

A foreign bill of exchange is one 'ofwhich ihe drawer and drawee are resi-

dents of countries foreign to each other.An. inland bill is one of which the

drawer and drawee are residents of thesame State or country. (25 Miss., 143).As to whether a bill is considered asforeign or inland when made partly inone place and partly in another, seeTanut, 520; Gow., 50; 1 M.& S., 87.

The distinction letween inland andforeign bills becomes important withreference to the question whether protestand notice are to le given in case of nun-acceptanc- e.

FRIDAY November 13th.

' SOME POINTS OF PUBLIC POLICY.

The electors of the Kingdom need not

be informed that they will soon s called

upon to exercise a great trust. This hasbeen told them time and again, andthey are fully conscious of the fact them-'cAlve- ii

Wft refrain therefore from fol- -

lowing the example of our Oppositionfriend and questioning the intelligence of

the voters by impressing upon themtheir duty in the coining election. We

take it for granted that every man will

do his duty, and that the choice made by

them will be for the public good. There are some points, however, upon

which it might " be well to make sug-

gestions, not by way of advice or instruc-

tion, but to lead to thought and refleo. tion. And first of all comes the question

of labor and immigration. This countryis practically unoccupied industrially. Itis quite true that sugar planting has at-

tained to large proportions, but the areaof land in sugar, or which can possibly

-- ' be applied to the cultivation of sugarcane, is limited in proportion to the

; whole body ot territory in these Islands.. all TneansT" anrwe 'would 'recommend

nothing that could tend, even in remotedegree, to injure that interest.

' ,But there are interests outside nd ina' measure indepeiuUiv of sugar, thatshouk considered in this connection,

"and that may be. promoted materially byjegislation; The uplands of this country,

. "where neither sugar nor rice can be; profitably raised, may be made to pro-

duce an v Infinite variety of products.Cattle are now raised upon the pasturage

--of the country, but without an accessionof population to create local consump-

tion the limit of meat production must. soon bo reached. Cattle ranges willbecome overstocked, the quality of beef

; will deteriorate, and stock le killedfor their hides and horns, the mostwasteful of all industrial conditions. Butat this time there is nothing else to fallback upon. We liave sugar and ricein the lowlands where abundant wateris available, and cattle on a thousandhills, roaming at pleasure, and yieldingno adequate return to the owners of theland.

Encouragement should be given tomen of limited capital to come to thiscountry and engage in agricultural pur-

suits. Every reasonable inducementshould be offered to immigrants cominghere with sufficient money to take upland and make homes. They will soonfind out what the land is fit to produce, although this is a oint upon which theyshould Ix? guided by the experience of

others in the country. At all events, itis ono of those points upon wluch thelegislature might very profitably takeaction, by appropriating a sulficient sumfor an experimental farm. Failing this, however, an effort should be made tocollect reliable information regarding thecapabilities and diversities of soil for theinformation of intending settlers.

A' great deal, of course, would depen dupon the character of the Legislaturewhen this broad question of colonizationcame to be considered ; but we think theelectorate is to be trusted with theselection of men capable to ileal with it.The present set of population is to switchoff from the old grooves into new amiunfamiliar tracks, and we think everyone who has been identified with thegrowth and development of the countryfor a number of years would regret anyradical change in this direction. Thisis inevitable, however, unless other industrial, moral and economic forces arebrought into play.

In addition to the question of popula-tion and labor, there is the important oneof 'harbor improvements and a free port,

"lleeent developments in the commercial; ontlook point to this as a necessity if

Honolulu is to keep pace with the chang-ing conditions of trade and travel. This port has practically become theterminus of the Australian mail line, aswell as that of the Oceanic line. It willnaturally attract shipping from otherDointa : and as the Panama canal is cer--

tain to ba built, now that FreneU prestige j

oouies were nanaca over lo the professorsof the university, and at the last meeting !

of the medical society the results of theautopsy were discussed. Dr. Limanstated with reference to the current notion j

that in cases of persons struck by light- - j

ning under a tree, aa impression of thetree with its branches, eta. was to be i

found on the body, that in one of thecases under consideration such figurescould be traced with the aid of the imagi-nation; but that "palm leaves" on deadbodies were common, and were the e'Jectof the pressure produced by the clothiug. With reference to the second corpse Prof.I.eyden called attention to a rupture inthe heart, which showed that lightningwas capable of literally tearing livingorgttns in he same way as houses or trees.

George Paulet came to the Islands in I

1844, Kanoa was sent to !

Lahaina to fetch the King Kamehamehathe Third, who was staying at that place. His son, the present Governor of Kauai, was one that accompanied him. TheKoyal party returned to Honolulu byway of the Pali, having landed on the j

other side of this island. The deceased j

A luiiux Hawaiian Knravor.A young Hawaiian, Henry Grube, a

ward of Captain Marchant's, has justcompleted a very handsome piece of en-

graving. On a kukui nut he has en-

graved a picture of His Majesty theKing, with a crown on the head. Aroundthe crown is the incription, "KalakauaI, King of Hawaii." The work is clever-ly executed, and shows decided talent. The tools used for this work were madeby Grube himself. The engraved nuthas been on exhibition in King Bros.'art store, but was taken away yesterday. It will be presented to His Majesty theKing by Mr. Jaeger for Grube, as abirthday present. The exceptional talentdisplayed by this young Hawaiian sug-

gests the idea that he should be sent toEurope by the Government, or by pri-

vate individuals who take a pride in theadvancement of the native race, to ob-

tain artistic training. This is a casewhich manifestly suggests such a course. On the Pacific Coast, and in other partsof America, young jeople of either sexwho display exceptional talent aresent to Europe to have theirqualities in music or art perfected, and a similar course might with advan-tage be adopted in the case of youngGrube. It would add lustre to the Ha-

waiian race if one of its members should

'A special "meeting - --sfr .he above Association was held at 11 o'clock yesterdaymorning at His Majesty's boathouse. Aletter was read from the Myrtle BoatClub, asking to be ed in the As-

sociation. The request was unanimouslygranted. The Kapiolani Club, which re-

signed at the same time as the Myrtles, was given further opportunity to with-draw their letter of resignation, so thatthey might participate in those racesonly oien to members of the Associa-tion. A resolution was passed that theminutes of the meeting which caused thewithdrawal of certain boat clubs be ex-

punged from the records of the Associa-tion. This action of the Associationshows that there was no ill-feeli- ng in thematter. The Begatta Committee re-

ported progress to the meeting, whichthen adjourned.

lt may be an interesting piece of localnews to state that Colonel Spreckels hascontributed a second thousand dollars tothe Kapiolani Home fund. His originalsubscription of 1,000 was paid before leav-ing for San Francisco, when he was inHonolulu early this year; and upon learn-ing that there might probably be some dif-lieul- ty

in raising the requisite amount, hepromptly wrote authorizing the payment

f an additional sum of $1,000, which hasbeen done.

ability of the voters to make a suitableselection of representatives with capacityto deal with these and other questions asthey arise. We lelieve in the wisdomof the eople as a rule, and think a ma-jority is much less likely to err than aminority, more especially if the minorityshould chance to le the rump of a oncepotent, but now broken and routed party, like the so-call- ed "Independent Opp-osition"! the Hawaiian Kingdom.

THE REGATTA.

We congratulate the lovers of aquaticsport upon the happy termination of avery unpleasant and unnecessary diff-iculty among the boat clubs regarding theapproacning regatta. me .uynie uiunapplied for readmission to the HawaiianRowing and Yachting Association, hav-ing reconsidered' its act of withdrawalfrom that organization ; anil its requestwas received and assented to in a spiritof friendly conciliation which reflectscredit upon all concerned. Not onlywere the Myrtles reinstated, but all ref-

erence to their withdrawal from the Asso-ciation was expunged from the minutes,as well as the resolution which led to it.There is therefore no room for cavil orcriticism. The public who subscribetheir money to provide suitable trophiesshould le content, and we doubt notthere will le sulficient funds placed inthe hands of the Committee to insure thefinancial success of the regatta, now thatthe oarsmen agree to do their lest inmanly rivalry iqon that occasion. TheMyrtles have achieved 1 turels in thepast; it is the wish and hope of theirfriends that they may again lear off thepalm, but as their task will le more diffi-

cult this year than formerly, shouldthey prove the victors, their added hon-ors will Imj all the greater.

There is no bad feeling or unworthyjealousy among the boating clubs, andwe therefore deprecate the attempt, byour evening contemiorary, to create dis-

union and foment distrust. From thevery first the "Bulletin" misrepre-sented the Association, and if it were notwillfully blind it would perceive, from theaction taken by the Myrtle Club itself, that its position is untenable. Therewas no necessity whatever for pushingmatters to an extreme,' and such wouldnever ha 3 happened if the Club hadnot somehow drifted under the influenceof a single mind, which in this particu-lar was of an impracticable character. Not only has the Myrtle Club been rein-stated in the Association, but an oppor-tunity has been afforded the Kapio-laj- ii

Chibto .tv.lfflsiijer- its ac tion , andthe Association. Of course we .Jvenoting ; to say regarding the business

grievance of our contemporary, but wefancy it has only itself to blame for whathas occurred. We do not, however, anticipate any very serious result fromit. The regatta will come off all thesame, and it will be as well attended, weather iermitting, whether the regattaprogamme be advertised in our eveningcontemporary or not. We trust, however, that there will be an end of systematic mischief making in this matter
