Mr. Galante thanked the Police committee members and the administrator for putting together the contracts. Communications: None Brief remarks on the Agenda from members of the Public: Deborah DiMicelli, 20 Winding Way: Asked about different issues with older residents that have mobility issues and if there is any committee that reviews planning for increased access to all buildings, especially medical buildings. Mayor Neff and Mr. Holzapfel replied that their resolutions approving commercial

improvements include a provision that they need to be ADA compliant. Deborah DiMicelli also stated the sidewalk by the post office is not in good shape and it is difficult for older people to get into the library without automatic doors. Carmen Grant, 216 Winding Way South: Asked why the sidewalk on Silverside Ave doesn’t extend to the train station. Mayor Neff replied that NJ Transit would need to put a pedestrian crossing gate there and they don’t have the funds for it. It may be time to look at this again. It will be part of our sidewalk discussion. Mrs. Jungfer: The engineer said that we don’t want to direct people to that intersection, as it is very unsafe and there is no traffic control there to safely cross people. Lori Markoff, 83 Laurel Drive: Asked what the sidewalk project is. Mayor Neff gave a brief description. REPORTS OF COUNCILMEMBERS: BUDGET AND INSURANCE: (IT and Cyber Security, Board of Health, Two River Water Reclamation Authority, Municipal Court) Mr. McNally stated the Board of Health meeting is tomorrow night at 7 pm. POLICE AND EMERGENCY PREPAREDNESS: (Open Space, Capital Projects and Emergency Planning) Mr. Galante stated that it is EMS Week and to make sure to like them on Facebook. Our police department had an information session at RBR on school security that was well attended. PUBLIC WORKS AND INFRASTRUCTURE (Shade Tree, Recreation, and Business and Professional Association) Mr. Smith stated with regard to recreation, sign-ups for summer camp, and summer and fall sports registration is going on now. There is a Shade Tree Commission meeting this Thursday at 8 pm. SHARED SERVICES, GRANTS AND LEGISLATIVE ISSUES: (Traffic Safety and Parker Homestead Liaison) Mr. Healy absent. Mayor Neff stated the Parker Homestead had a very busy weekend with a Cub Scout campout sleepover and the Two River Ramble. PLANNING AND TELECOMMUNICATIONS: (COAH Litigation, Planning Board and Environmental Commission)

Mr. Holzapfel stated the Environmental Commission will be meeting Wednesday, May 22nd at 7 pm. Planning Board will meet Thursday, June 6th at 7 pm. Mr. Holzapfel stated on the COAH front, the compliance hearing is scheduled for Thursday for our affordable housing plan. PERSONNEL AND PUBLIC RELATIONS: (Red Bank Regional and Little Silver Schools, Library Trustees, and Borough Charitable Events) Mrs. Thygeson stated the Little Silver Charitable Foundation had a very successful Taste of Little Silver event. RBR: Had Relay for Life on Friday night and the Ridge Road Run on Sunday, which made over $65,000 and goes towards mental health initiatives. Markham Place: Last Wednesday the Boro had 85 8th graders participate in Student Government Day. MAYOR’S REPORT (FRAMES and Two River Council of Mayors): Mayor Neff reported he mentioned Corinne Thygeson as the liaison for Little Silver Business and Professional Association. We are going to reconnect with the Eastern Monmouth Chamber of Commerce. We will be meeting with Freeholder director Tom Arnone on Wednesday about dredging the Parker Homestead pond. Mayor Neff also wants to see if the county will help us dredge some streams that run from the pond and swamp the nature trails. Mayor Neff attended the ceremony celebrating the 150th anniversary of Embury Methodist Church on Sunday. The Board of Health will be putting out information on mosquitos and sun protection in the newsletter. Mayor Neff wanted to thank Bruce Hanson for voluntarily fixing the wiring in the Woman’s Club for the sound system. Other Reports: None Old Business: None New Business:

RESOLUTION

WHEREAS, gun violence in our schools and elsewhere is an issue that requires attention by our

state and federal lawmakers; and

WHEREAS, Little Silver has previously called on lawmakers to address this problem, which

has resulted in more than 11,000 gun-related homicides per year in the past few years; and

WHEREAS, towns like Little Silver spend countless hours and resources addressing gun

violence in schools, devoting police and other personnel to the task of training and drilling to

respond to “active shooter” incidents; and

WHEREAS, Little Silver members of Moms Demand Action for Gun Sense in America have

called on local towns to support efforts to combat gun violence across the country; and

WHEREAS, a national coalition of organizations has designated June 7, 2019 as the 5th

National

Gun Violence Awareness Day; and

WHEREAS, in support of that effort, the governing body of Little Silver encourages all of its

citizens to supports its efforts to help keep guns out of the wrong hands, to encourage responsible

gun ownership, and to help keep our children safe;

NOW THEREFORE BE IT RESOLVED that the Mayor and Council of the Borough of Little

Silver hereby declare June 7, 2019 to be Gun Violence Awareness Day, encouraging all of its

citizens to wear orange in order to raise awareness of the issue, and to honor the lives of victims

RESOLUTION ADOPTING AN AFFRIMATIVE MARKETING PLAN FOR THE BOROUGH OF LITTLE SILVER WHEREAS, in accordance with applicable Council on Affordable Housing (“COAH”) regulations and the New Jersey Uniform Housing Affordability Controls (“UHAC”) N.J.A.C. 5:80-26.1,et seq., the Borough of Little Silver is required to adopt by resolution an Affirmative Marketing Plan to ensure that all affordable housing units created, including those created by rehabilitation are affirmatively marketed to very low, low and moderate income households, particularly those living and/or working within Housing Region 4, the Housing Region encompassing the Borough of Little Silver; and NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Council of the Borough of Little Silver, County of Monmouth, State of New Jersey, do hereby adopt the following Affirmative Marketing Plan:

Affirmative Marketing Plan

A. All affordable housing units in the Borough of Little Silver shall be marketed in accordance with the provisions herein unless otherwise provided in N.J.A.C. 5:93-1, et seq.

B. This Affirmative Marketing Plan shall apply to all developments that contain or will contain low

and moderate-income units, including those that are part of the Borough’s prior round Fair Share Plan and its current Fair Share Plan and those that may be constructed in future developments not yet anticipated by the Fair Share Plan.

C. The Affirmative Marketing Plan shall be implemented by an Administrative Agent designated by

and/or under contract to the Borough of Little Silver. All the costs of advertising and affirmatively marketing affordable housing units shall be borne by the developers/sellers/owners of the affordable unit(s).

D. In implementing the Affirmative Marketing Plan, the Administrative Agent, acting on behalf of

the Borough, shall undertake all the following strategies: 1. Publication of one advertisement in a newspaper of general circulation within the housing

region. 2. Broadcast of one advertisement by a radio or television station broadcasting throughout the

housing region. 3. At least one additional regional marketing strategy using one of the other sources listed

below.

E. The Affirmative Marketing Plan is a regional marketing strategy designed to attract buyers and/or renters of all majority and minority groups, regardless of race, creed, color, national origin, ancestry, marital or familial status, gender, affectional or sexual orientation, disability, age or number of children to housing units which are being marketed by a developer or sponsor of affordable housing. The Affirmative Marketing Plan is also intended to target those potentially eligible persons who are least likely to apply for affordable units in that region. It is a continuing program that directs all marketing activities toward Housing Region 4 in which the Borough is located and covers the entire period of deed restriction for each restricted housing unit.

F. The Affirmative Marketing Plan is a continuing program intended to be followed throughout the

entire period of restrictions and shall meet the following requirements:

1. All newspaper articles, announcements and requests for applications for very low, low, and moderate-income units shall appear in the Trenton Times, the Asbury Park Press, the Messenger-Press, and The Coast Star.

2. The primary marketing shall take the form of at least one press release and a paid display

advertisement in the above newspaper during the first week of the marketing program. Additional advertising and publicity shall be on an "as needed" basis. The developer/owner shall disseminate all public service announcements and pay for display advertisements. The developer/owner shall provide proof of publication to the Administrative Agent. All press releases and advertisements shall be approved in advance by the Borough’s Administrative Agent.

3. The advertisement shall include a description of the:

i. Street address(es) of the units; ii. Directions to the units;

iii. Range of prices for the units; iv. Number of bedrooms in the affordable units (bedroom mix); v. Maximum income permitted to qualify for the units;

vi. Location of applications; vii. Business hours when interested households may obtain an application;

viii. Application fees, if any; ix. Number of units currently available; and x. Anticipated dates of availability.

4. Newspaper advertisements, announcements and information on where to request applications for very low, low, and moderate-income housing shall appear in at least three locally oriented weekly newspapers within the region, one of which shall be circulated primarily within Monmouth County and the other two of which shall be circulated primarily outside of Monmouth County but within the housing region.

5. Advertisements will be broadcast on the following regional cable television station: 25

WNYE-TV New York City Dept. of Info Technology & Telecommunications.

6. Applications shall be mailed by the Administrative Agent to the prospective applications upon request. Locations of applications, brochures, and flyers to affirmatively market the program are listed below, and will also be made available on the Borough’s website. Also, information on how to apply shall be made available at the developer’s sales/rental office and shall be mailed or emailed to prospective applicants upon request. When on-line preliminary applications are utilized, if prospective applicants do not have internet access they will be given a phone number to call the Administrative Agent, who will then enter all pre-application information online during the phone call.

7. The Administrative Agent shall develop, maintain and regularly update a list of community

contact person(s) and/or organizations(s) in Mercer, Monmouth, and Ocean Counties that will aid in the affirmative marketing program with particular emphasis on contacts that will

reach out to groups that are least likely to apply for housing within the region, including major regional employers.

i. Quarterly informational flyers shall be sent to each of the following agencies with a

request for publication in their journals and for circulation among their members:

Mercer County Association of Realtors

Monmouth Ocean Regional Realtors

Ocean County Board of Realtors

ii. Quarterly informational circulars shall be sent to the administrators of each of the following agencies in the counties of and requests to post same shall be sent to the administrators of each of the following agencies within the counties of Mercer, Monmouth, and Ocean:

Welfare or Social Service Board

Rental Assistance Office (local office of DCA)

Offices on Aging or Division of Senior Services

Housing Authority

Community Action Agencies

Community Development Departments

iii. Quarterly informational circulars shall be sent to the chief personnel administrators of all the major employers within the region as listed below in accordance with the Region 4 Affirmative Marketing Plan.

8. A random selection method to select occupants of very low, low and moderate-income housing will be used by the Administrative Agent in conformance with N.J.A.C. 5:80-26.16(l). The Affirmative Marketing Plan shall provide a regional preference for all households that live and/or work in Housing Region 4 comprised of Mercer, Monmouth, and Ocean Counties.

9. The Administrative Agent shall administer the Affirmative Marketing Plan. The

Administrative Agent has the responsibility to income qualify very low, low and moderate income households; to place income eligible households in very low, low and moderate income units upon initial occupancy; to provide for the initial occupancy of very low, low and moderate income units with income qualified households; to continue to qualify households for re-occupancy of units as they become vacant during the period of affordability controls; to assist with outreach to very low, low and moderate income households; and to enforce the terms of the deed restriction and mortgage loan as per N.J.A.C. 5:80-26.1, et seq.

10. Whenever appropriate, the Administrative Agent shall provide or direct qualified very low,

low and moderate-income applicants to counseling services on subjects such as budgeting, credit issues, mortgage qualifications, rental lease requirements and landlord/tenant law and shall develop, maintain and update a list of entities and lenders willing and able to perform such services.

11. All developers/owners of very low, low and moderate-income housing units shall be required to undertake and pay the costs of the marketing of the affordable units in their respective developments, subject to the direction and supervision of the Administrative Agent. The implementation of the Affirmative Marketing Plan for a development that includes affordable housing shall commence at least 120 days before the issuance of either a temporary or permanent certificate of occupancy. The implementation of the Affirmative Marketing Plan shall continue until all very low, low and moderate-income housing units are initially occupied and for as long as affordable units exist that remain deed restricted and for which the occupancy or re-occupancy of units continues to be necessary. Please note that in addition to complying with this Borough-wide Affirmative Marketing Plan that the Administrative Agent shall also review and approve a separate Affirmative Marketing Plan for every new affordable development in Little Silver that is subject to N.J.A.C. 5:80-26.1 et seq. That document shall be completed by the owner/developer and will be compliant with the Borough’s Affirmative Marketing Plan as presented herein, and incorporate development specific details and permitted options, all subject to the Administrative Agent’s review and approval. The development specific affirmative marketing plans will use the standard form for Region 4, which is attached hereto as Appendix I.

12. The Administrative Agent shall provide the Municipal Housing Liaison with the information

required to comply with monitoring and reporting requirements pursuant to N.J.A.C. 5:80-26-1, et seq. and the Order granting the Borough a Final Judgment of Compliance and Repose.

BE IT FURTHER RESOLVED that the appropriate Borough officials and professionals are

authorized to take all actions required to implement the terms of this Resolution. BE IT FURTHER RESOLVED that this Resolution shall take effect pursuant to law.

WHEREAS, Mrs. Trufolo’s mortgage company, Select Portfolio Servicing, Inc. also paid the

second quarter taxes causing on overpayment necessitating a refund; and

WHEREAS, the Borough of Little Silver established a Length of Service Award Program

(LOSAP) per Ordinance #559-03 in order to reward volunteer members of the Little Silver Fire

Department and Little Silver Emergency Medical Services for their loyal, diligent and devoted

services to the residents of the Borough of Little Silver; and

WHEREAS, Lincoln National Life Insurance Company and Lincoln Financial Group, is the

provider for the Borough of Little Silver’s Length of Service Award Program Deferred Plan and

its eligible volunteers as provided for in its Length of Service Award Program Plan Document,

Plan Identifier: 01-LOSAP-LINCOLN-101700; and

WHEREAS, the list of 2018 LOSAP qualifiers has been reviewed by the Borough’s LOSAP

coordinators for the Little Silver Fire Department and the Little Silver Emergency Medical

Services and submitted to the Administrator/Clerk for payment processing to Lincoln Financial

Advisors; and

NOW, THEREFORE, BE IT RESOLVED the Borough of Little Silver’s contribution for the

2018 LOSAP program qualifiers is a total of $62,100.00 (50 qualifiers at $1,242 per qualifier)

WHEREAS, the Borough of Little Silver did heretofore award a bid on October 17, 2017 to Thor

Construction Group for various improvements to softball fields in the Borough of Little Silver in

an amount of $205,387.00; and

WHEREAS, the Mayor and Council of the Borough of Little Silver amended said agreement

with Change Order #1 in the sum of $17,012.00; and

WHEREAS, the Mayor and Council of the Borough of Little Silver amended said agreement

with Change Order #2 in the sum of $9,570.35; and

WHEREAS, the Mayor and Council of the Borough of Little Silver wish to further amend said

agreement in accordance with the attached Change Order # 3 in the amount of $1,682.70; and

WHEREAS, the Change Orders falls within the legal limit established pursuant to N.J.A.C.

5:31-4.2; and

WHEREAS, adequate funding for this purchase is contained in Monmouth County Open Space

Grant and the Open Space Trust Account.
