The list of participants is given at Annexure-I. 2. After welcoming the participants to the meeting called at short notice, Union Secretary (Mines) invited their attention to pending cases of Action taken on decision of previous CCEC meetings held on 22 nd Apr-15, 3 rd Mar-15, 19 th Jan-15 & 18 th Sep-14. He reminded that the following issues discussed in the previous CCEC meetings, remained unattended: a) States were requested in the meeting on Effective use of Space Technology held on 18.09.2014 along with CCEC meeting (Para 7 of the minutes of that meeting), to identify a few areas of endemic illegal mining (which may be other than the regular leased area) and convey the information it on to NRSC, so that regular monitoring of the same could take place b) Updated action taken report on Shah Commission Reports on Illegal mining from concerned State Governments of Goa, Jharkhand and Odisha were sought in the CCEC meeting held on 18.09.2014 (Para 18 of the minutes of that meeting); such ATR’s are still awaited. c) The issue of Geo-chemical mapping of the entire country was flagged in the CCEC meeting on 18.09.2014 (Para 4 of the minutes of that meeting). and Union Secretary (Mines) had stressed the need for close coordination. These should be deliberated in the SGPB (State Geological Programming Board) for efficient resource utilization. The action taken in this regard by the States needs to be intimated on priority. d) He further stated that in the CCEC meeting held on 13.3.2015 in Vijyan Bhawan, the extension of lease period as per Section 8A(5) & 6 of the Ordinance was discussed (Para 4 of the minutes of that meeting). It was urged that the States should expedite implementation. The status of extension of leases done along with reasons and timeline for left over extension of the leases, were to be furnished. It may be done at the earliest.

Minutes of the Coordination Cum Empowered Committee (CCEC) meeting

held on June 05, 2015 at Shastri Bhawan, New Delhi,

chaired by Union Secretary (Mines), Dr. Anup K Pujari (Minutes 4 pages and Annexures 10 pages)

The meeting Co-ordination Cum Empowered Committee (CCEC) meeting was

held under the chairmanship of Union Secretary (Mines), Dr. Anup K Pujari on 5th June,

2015 in Aluminium Room, Shastri Bhawan, New Delhi. The list of participants is given

at Annexure-I.

2. After welcoming the participants to the meeting called at short notice, Union

Secretary (Mines) invited their attention to pending cases of Action taken on decision

of previous CCEC meetings held on 22nd Apr-15, 3rd Mar-15, 19th Jan-15 & 18th Sep-14.

He reminded that the following issues discussed in the previous CCEC meetings,

remained unattended:

a) States were requested in the meeting on Effective use of Space Technology held

on 18.09.2014 along with CCEC meeting (Para 7 of the minutes of that meeting),

to identify a few areas of endemic illegal mining (which may be other than the

regular leased area) and convey the information it on to NRSC, so that regular

monitoring of the same could take place

b) Updated action taken report on Shah Commission Reports on Illegal mining from

concerned State Governments of Goa, Jharkhand and Odisha were sought in the

CCEC meeting held on 18.09.2014 (Para 18 of the minutes of that meeting); such

ATR’s are still awaited.

c) The issue of Geo-chemical mapping of the entire country was flagged in the

CCEC meeting on 18.09.2014 (Para 4 of the minutes of that meeting). and Union

Secretary (Mines) had stressed the need for close coordination. These should be

e) In the same meeting (Para 5 of the minutes of that meeting), all States

Governments were requested to furnish list of non-working mines, segregated

mineral wise and statutory clearance wise (with respect to FC/EC etc.) with their

present status. The main reasons for requesting this with the State Governments

was/is to take up this matter with concerned authorities by Ministry of Mines.

However none of the States has given the list of this. Further, they were

requested to provide list of all such mining lease cases where the prior approval

has already been granted but the mining lease still not executed.

f) He further referred to the meeting held on 13.3.2015 (Para 7 of the minutes of

that meeting), wherein notification dated 10/2/2015 of 31 Minerals as ‘minor’

minerals had been discussed. All State Governments were requested to provide

their comments through Action Taken Report (ATR) along with their existing

capabilities for taking over the entire regulation of those minerals. It may be

done at the earliest.

3. Union Secretary (Mines) discussed about the judgement of Punjab and Haryana

High Court in regard to the requirement of approval of Central Government for

reserving ‘minor’ minerals under Section 17A(2). The judgement was elaborated by

Union Economic Advisor (Mines), Shri Sudhaker Shukla, that it inter alia states that “the

statement made on behalf of the respondents that the HSIIDC would not commence the

mining operations without complying with the provisions of Section 17A (2) of the

MMDR Act, 1957, namely obtaining the approval of the Central Government and issuing

the notification in the official gazette is accepted. There shall be no order as to costs”.

Union Secretary (Mines) asked various State Governments regarding the process

followed for reserving area under Section 17A(2) for major and minor minerals.

Whether they obtain the previous approval of Central Government before reserving

area under this Section or not? He asked them to convey their viewers view on this in

the light of the referred court judgment.

4. Union Secretary (Mines) informed that the Mineral Auction Rules (MAR) and

Mineral (Evidence of Mineral Contents) Rules have already been notified and the

Model Tender Document and Model MDPA have also been uploaded on the new

website of the Ministry of Mines

(http://mines.gov.in/writereaddata/UploadFile/Model%20Tender%20Document.pdf)

for facilitating the State Governments to initiate the mineral auction of the identified

blocks, at the earliest. Now the State Governments are requested to inform the dates

for starting the auctioning of identified mineral blocks. He also requested the State

Government representatives to fill up the response sheet provided to them at the

beginning of the meeting, about the status of Blocks identified for notification for

Auction and the status of setting up/ notifying DMFs in the districts The summary of

responses of the State Government have been compiled in Annexure-II.

5. Union Joint Secretary, Dr. Niranjan Kumar Singh informed that 166 Geological

Reports (GRs) explored by GSI have already been given to the State Governments free

of cost, to assist them in further identification of blocks for auction. State wise break

up of these 166 GRs may be seen at Annexure-III.

6. Thereafter, CMD/MECL, Dr. Gopal Dhawan, made a presentation on the

exploration data availability with MECL for sharing them with the States about their

capability for assisting the Sates in exploration of further blocks for putting them for

auction. He distributed the executive summary of the 57 GRs are available for 13

states and the State Governments can procure them from MECL. This presentation has

been given in Annexure-IV.

7. After the presentation by CMD, MECL, the Union Secretary (Mines) requested

the representative of the various State Governments to check whether the GRs

provided by MECL are still awaited for auction or have been allotted already. The

representatives of Karnataka and Jharkhand appreciated the work done by MECL in

terms of quality and time taken.

8. Representative of Odisha sought guidance for fixation of the reserve price.

Representative of Andhra Pradesh informed that the reserve price of 35 % has been

stipulated by the Supreme Court for auction of the Category C mines. It was advised

that fixation of reserve price/floor price is for the State Government to decide.

9. Thereafter, representative of State Governments of Andhra Pradesh, Karnataka

and Gujarat requested to include their Mineral Development Corporations as the

notified agency under Section 4(1) for exploration. The Union Secretary (Mines) asked

them to send the formal request at the earliest to this Ministry.

10. The representative of Goa raised the provision of area for dumping in the

existing mining leases and asked for the provision of legislative framework for

resolution of this problem. Union Joint Secretary (Mines), Shri Arun Kumar elaborated

the problem with regard to this requirement of dumps being non-contiguous and being

non-mineralised. There was detailed discussion in the matter and it was requested

that some solution needs to be found.

11. The representative of Telangana highlighted the issue in regard to the court

cases challenging the applicability of provisions of MMDR Amendment Act, 2015 on

the earlier applications and subsequent judgments / interim judgments on them and

requested the Union Mines Ministry to intervene in the matter.

12. Union Secretary (Mines) emphasized the urgency of initiating the auction

processes by the State Governments. He further mentioned that the State

Governments should not see mining sector only from point view of revenue generation

rather States should approach the sector for its coordinated development and mineral

conservation. Union Secretary (Mines) urged the representatives of State

Governments to adopt a punctual and professional approach and ensure value

addition in everything they plan to do.
