The 370th Meeting of Registration Committee (RC) was held under the Chairmanship of Dr. J.S.

Sandhu, Deputy Director General (Crops Science) & Chairman of RC on 15.10.2016 at 11:30 hrs in

1 Confirmation of minutes of the 369th meeting of the Registration Committee

The minutes of the 369th meeting were confirmed with the following corrections:-

1. Agenda item no. 6.10 wherein Butachlor 4% GR may be recorded as Butachlor

5% GR.

2. It was observed that under Agenda Item No. 7.11 of M/s HPM Chemicals &

Fertilizers Limited for Tebuconazole Technical and Agenda Item No. 7.12 of M/s

Ambey Labs Pvt. Ltd. for Diafenthiuron Technical were proposed for

rejection/change of category of application as their samples have failed in CIL

4.1 List under section 9(3) Export applications

The Agenda was deliberated & it was decided that all the cases stand approved as per

Annexure 4.1.1 and 4.1.4 of agenda.

The Committee further decided that the applicants of import for export category shall be

subjected to the decision taken by the Committee in its 357th meeting.

4.2 Consideration of an application of M/s HPM Chemical & Fertilizers Ltd., for grant

of registration for indigenous manufacture of Buprimate Technical 94.5% w/w min.

under section 9(3).

Approved with minor amendment in the label and leaflets.

5.0 9(3B) Cases

6.0 9(3) CASES

6.1 Consideration of application of M/s Rajhans Fertilizers Ltd., Indore for grant of

registration for import of Chlorpropham Technical 98% min. (w/w) from a new

source u/s 9(3).

The application of M/s Rajhans Fertilizers Ltd. (RFL) was considered by the

RC during 360th meeting held on 11.12.2015 vide Agenda Item No. 2.2, for registration of

import of Chlorpropham Technical 98% min. (w/w) from a new source and the

registration was approved u/s 9(3B) as against the application which was under section

9(3) of the Insecticides Act, 1968. Consequently, the Crop Care Federation of India

(CCFI) and M/s UPL Ltd. (UPL) filed a Writ Petition (C) No. 306 of 2016 against Union

of India and the Ministry of Agriculture and Farmers Welfare (respondent No. 1 and 2

respectively), Registration Committee (respondent No. 3) and M/s Rajhans Fertilizer Ltd.

(RFL) (Respondent No. 4) in the Hon’ble High Court of Delhi. Subsequently, the

Hon’ble High Court of Delhi by order dated 13.01.2016 in the matter directed “The Writ

Petition to be treated as a revision petition U/s 11 of the Act, to be disposed of within a

period of 3 months, after giving an opportunity of hearing to the petitioner as also the

respondent No. 4”.

Accordingly, the Revisional Authority u/s 11 of the Act in its order dated

15.06.2016 directed the RC as under:

(i) The resolution 2.2 of 360th meeting to the extent that it accords approval of

registration to M/s RFL u/s 9(3B) of the Insecticides Act, 1968 will not be

given effect to.

(ii) The RC will consider the M/s RFL application afresh taking all facts raised in

this revision, and decide the matter through a well reasoned order in three

months.

In the Revision Petition Order of dated 15.06.2016 the following issues were

raised:

a) Verification of source of import of the pesticide in Germany viz., M/s Schirm

GmbH, Germany.

The petitioners contended in the W.P. that RC has failed to have the source of

import of the pesticides in Germany with M/s Schirm GmbH, Germany verified

from the Designated National Authority (DNA) of the country. The RC noted the

facts that communications were sent to the concerned DNA in Germany to verify

the status of registration/manufacturing of Chlorpropham in that country. The

scanned copy of production license for synthesis of CIPC from the concerned

competent authority (a provincial government in Germany) was sent through an

email to the DNA, Germany as well as the Indian Embassy in Germany for

verification. The DNA, Germany informed vide email dated 13.05.2014 that “the

Federal Office of the Consumer Protection and Food Safety (BVL) is the

Competent Authority for the authorization of plant protection products. The

evaluation of the technical active substance is part of the authorization procedure

of a particular plant protection product. It should be noted that the BVL does not

approve manufacturing plants”. The DNA also informed that “as already stated in

the communication of 10th September, 2013, the BVL has knowledge of the

mentioned source of Chlorpropham which is part of an application for mutual

recognition in Germany. The respective plant product is approved in the United

Kingdom but not yet in Germany”. RC further noted the fact brought to its

knowledge during deliberation that in a communication dated 09.08.2016 related

to verification of source for a product other than Chlorpropham Technical

informed that “The Federal Office of Consumer Protection and Food Safety

(BVL) is the competent authority for the authorization of plant protection products

in Germany. The evaluation of the technical active substance is part of the

authorization procedure. However, active substances for none authorized plant

protection products can also be manufactured and traded like other chemicals,

which then must be in compliance with the German chemicals law. Therefore it is

not necessary to permit or authorize manufactures or sources of plant protection

products in Germany. The federal states of Germany are responsible for the

approval of manufacturing plant with respect to emission control”.

Further, the Indian Embassy in Germany verified that M/s Schirm GmbH,

Germany, has the approval of the authority to synthesis Chlorpropham (CIPC) in

the factory located as Geschwister-Scholl-Str. 127, D-39218 Schonebck,

Germany.

In view of the confirmation by the DNA, Germany as quoted above that the

Federal State of Germany are responsible for the approval of the manufacturing

plant with respect to emission control and that active substances for

non-authorized plant protection products (in Germany) can also be manufactured

and traded like other chemicals, which then must be in compliance with the

German chemicals law besides, the authentication of the production license for

synthesis of CIPC of M/s Schirm GmbH, Germany, by the Indian Embassy in

Germany, RC was convinced about the source of Chlorpropham Technical (CIPC)

in Germany, as claimed by the applicant.

A letter dated 13th October, 2016 from CCFI along with a copy of the letter dated

30.09.2016 from Imperial Supply Chain Solutions purported to be signed by Mr.

Dirk Unterstenhofer, COO Schirm GmbH Director Contract Manufacturing & Dr.

Frauke Richter, Site Manager Schonebeck received through DAC&FW

mentioning that the source M/s Schirm GmbH, Germany has withdrawn the

consent to supply Chlorpropham Technical to M/s RFL was also deliberated by

the RC and it was observed that the supply of technical grade material from the

source to the registrant is a commercial aspect which is outside the scope

mandated to the RC u/s 9 of Insecticides Act, 1968 and such verifications from the

source is not the part of registration process.

b) Non submission of consecutive years data on Bio-efficacy by the applicant.

c) Bio-efficacy studies carried out without standard check for comparison with

the already registered product.

The issues related to Bio-efficacy raised in the Revision Petition were also

deliberated in detail. Members agreed to consider the request of the applicant to

accept the data on Bio-efficacy with a gap of one year, in view of the facts that

data was generated under the controlled environmental conditions i.e 10 + 1oC

temperature with 90 + 5% relative humidity and hence the different season data

has no relevance. The RC further observed that the data on Bio-effectiveness of

Chlorpropham 50% HN (made from the Chlorpropham Technical 98% min w/w,

imported from M/s Schirm GmbH, Germany) @ 18 gm a.i./MT is effective in

reducing the sprouting percentage in Potato in cold storage, under controlled

environmental conditions and comparison was made with untreated control

treatment. Applicant has also requested to waive-off the requirement of

comparative study with already registered formulation stating that the standard

check of already registered formulation was not available in the market, in their

correspondence and also stated that they have informed the first registrant of the

product to supply their registered formulation. The RC discussed and deliberated

the issue and was of the view that data on Bio-effectiveness is satisfactory as

comparison has been made with untreated control.

d) Residue data generated/analyzed without “X” and “2X” dosages, from two

seasons.

The committee also perused the data on residue of Chlorpropham in Potato, in

cold storage, under controlled environmental conditions and found that the data

was generated as per the protocol for residue studies in Gaitonde Committee

Report i.e. “to carry out the residue studies, there should be at least two treatment

dosages, a recommended dose and other one higher than recommended. It would

be however desirable to have three treatment dosages, wherein one should be

double of recommended dosage”; and RC guidelines for residue data requirement

for registration for TI new source, i.e. “two years/seasons data on residue in plant

(herein, Potato in cold storage under controlled environmental conditions) on

representative crop of each group on which pesticide is approved”. Members

observed that in all the residue studies the residues of Chlorpropham were

reported less than 8 ppm even at the initial sampling stage (two days after

application) which reduces further with storage time up to 60 days, at all the tested

dosages at all the locations, whereas MRL for Chlorpropham has been fixed 50

ppm in Potato in India based on the data submitted by the first applicant of the

product. RC agreed that residue data is satisfactory as per the guidelines.

e) Bio-efficacy data generated using sample which had passed its shelf life.

The issue pertaining to data generation within the shelf-life, also has been

deliberated, in the light of import of sample (third time) of 4 kg Chlorpropham

Technical 98% min (w/w) supported with documents like notarized copy of invoice

dated 9th October, 2011 issued from supplier along with certificate of origin from

manufacturer; and shipper declaration for dangerous goods from manufacturer

dated 17th October, 2011 and RC observed that Bio-efficacy data of 2013 was

generated within the shelf life of the product.

f) Forged/fabricated documents submitted by RFL.

g) Illicit sale of Chlorpropham formulation by RFL.

h) Illegal import of Chlorpropham by RFL.

The RC observed that the issues related to forged/fabricated documents and illicit

sale & illegal import of Chlorpropham by M/s RFL are being dealt separately,

independently of registration process.

In view of the perusal of all relevant documents of the case by the RC as available

on records and on the basis of discussions and scientific deliberations, the RC was of the

considered view that the data/information submitted by the applicant from Chemistry,

Bio-efficacy, Toxicity and Packaging disciplines can be considered as satisfactory and

deserves the acceptance for the approval of registration u/s 9(3) of the Insecticides Act,

1968 subject to minor amendments in Label and leaflets. RC also recommended that the

decision may also be apprised to the Hon’ble Revisional Authority.

6.2 Consideration of an application of M/s UPL Ltd., Mumbai for grant of registration

for indigenous manufacture of Carbendazim 1.92% + (w/w) + Mancozeb 10.08%

(w/w) GR u/s 9(3).

The agenda was deliberated and approved for control of Blast and Sheath blight diseases in Paddy

crop, subject to MRL fixation from FSSAI.

6.3 Consideration of an application of M/s Dhanuka Agritech Ltd., New Delhi for grant

of registration for import of Flusizalole Technical (95% min. w/w) from a new source

under section 9(3).

The committee deliberated the agenda and approved the same from source of import as M/s.

Anhui Huaxing Chemical Industry Co. Ltd., No. 6, Hongfeng road, Hefei, P. R. China, PC

230088 . The source is valid up to December, 18, 2018.

6.4 Consideration of an application of M/s Bharat Insecticides Ltd., New Delhi for grant

of registration for indigenous manufacture of Bifenthrin 8.0% SC (w/w) [TIM vs

FIT] u/s 9(3).

The agenda was deliberated and approved.

7.0 9(4) TIM Cases

8.0 ENDORSEMENT CASES

8.1 M/s Indofil Industires Ltd., Mumbai has submitted an application for the label

expansion Mancozeb 75% WG against Scab, Pre-mature leaf fall, Alternaria leaf

spot/Blight sooty blotch of Apple.

The agenda was deliberated and approved for label expansion against Scab, Pre-mature

leaf fall, Alternaria leaf spot/Blight sooty blotch of apple.

8.2 M/s BASF India Ltd., Mumbai has submitted an application for the label expansion

Fluxapyroxad 250 g/l + Pyraclostobin 250 g/l SC.

The agenda was deliberated and approved subject to fixation of MRL for the label

expansion against premature leaf fall and alterneria leaf spot disease in apple crop.

8.3 Request from M/s BASF India Ltd., Mumbai for the endorsement for the bulk sale

of formulation to co-distributors for repacking and sale for Metiram 70% WG

The agenda was deliberated and approved.

8.4 Request from M/s BASF India Ltd., Mumbai for the endorsement for the bulk sale

of formulation to co-distributors for repacking and sale for Boscalid 25.2 % +

Pyraclostrobin 12.8% WG.

The agenda was deliberated and approved.

9.0 MISCELLANEOUS ITEMS

9.1 Consideration of application for import permits for Boric Acid and other substances

for non-insecticidal use.

Committee deliberated the Agenda & approved as per Annexure - 9.1.1.

9.2 Consideration of application for enhancement of shelf life under section 9(4).

Committee deliberated the Agenda & approved as per Annexure – 9.2.1

9.3 Consideration of the request of Secretariat of CIB&RC to delete the name of one

source of import of Boric Acid which is inadvertently mentioned in the decision of

366th and 367th Registration Committee meeting.

Committee deliberated the Agenda & approved.

9.4 Inclusion of requirement for allergy/sensitization study and deletion of acute oral

mice study from Toxicity data requirement

The agenda was deliberated and in view of the fact that the matter has already been earlier

agreed in principal by RC it was decided for keeping the toxicity data requirement for

registration of pesticides in India and for global harmonization the inclusion of

requirement for Allergy/Sensitization study and deletion of acute oral mice study from

toxicity data requirement.

10.0 Online filling of application for registration under different categories

10.1 Consideration of application u/s 9(4) FIM category received only by complete On-

line system.

The Agenda was deliberated in detail & all the complete cases were approved as proposed in

Annexure – 10.1.1 of the agenda.

11.1 Any other item with the Permission of Chair

11.1 Request from M/s Punjab Agri and Export Corporation Ltd.(PAECL), regarding

import of Wax laden with pesticides Imazilyl and Thiabendazol for coating of

Kinnow fruit for export purposes.

The matter was deliberated and it was observed that none of the above product is

recommended on kinnow fruit whereas Imazilyl is not even registered for use in India as

such. Hence, it was decided that M/s PAECL may be advised to submit an application to

the Secretariat of CIB&RC for registration of the above product as per guidelines. M/s

PAECL may also be advised to take up the matter with FSSAI for use of wax coating

(containing pesticide) over the kinnow fruit. In the meantime, Chairman desired that

ADG (PP) may explore the possibility for immediate alternatives to curb the fungal

growth on kinnow fruit during transit so as to facilitate export of kinnow fruit from India.

11.2 Requirement of Consent letter for Neem, Tricontanol and Sulphur under section

9(4) formulation “Me Too” category.

RC was informed that there have been several representations to grant relaxation for

requirement of Consent Letter by the formulators for registration u/s 9(4) Me Too for the

above products claiming that there are no registered technical manufacturers/producers of

these products. The Committee deliberated the issue & decided as Technical of above

said products are not available however it was also noted that concentrates (extract) of

Azadirachtin are available that can be used for making formulation. Therefore, the

manufactures of such concentrates (extract) may be encouraged to register so that the

formulators can make use of the same for registration under 9(4) “Me Too” category.

However, it was noted that there is no availability of technical/concentrates of

Tricontanol and Sulphur. It was further observed that Sulphur being naturally extracted

product may be considered for relaxation of Consent Letter for formulators of Sulphur.

As regards the relaxation for Consent Letter for Tricontanol is concerned, it was decided

that further technical discussions are required before considering the issue. A public

notice to this effect may be uploaded by the Sectt. of CIB&RC on the website.

11.3 RTT permit – regd.

Committee was informed that Sectt. of CIB&RC has received several representations for

not mentioning the names of insecticides in the minutes approved for RTT with the

request that it is an information they want to keep confidential for their business point of

view. The matter was considered and decided that the list should be projected in Agenda

with the File No. only along with name of applicant without mentioning the name of the

pesticide approved for RTT.
