    MINUTES OF 354th MEETING OF REGISTRATION COMMITTEE (RC) HELD ON

    The 354th Meeting of Registration Committee (RC) was held under the Chairmanship of Dr.

    J.S. Sandhu, Deputy Director General (Crops Science) & Chairman, RC on 31.03.2015 at 1600 hrs.

    in the Committee Room No. 1, Ground Floor, ICAR, Krishi Bhawan, New Delhi. Dr. S. N. Sushil,

    Plant Protection Adviser, Dr. P. K. Chakraborty, ADG (PP), ICAR, Dr. K.K. Sharma, Project

    Coordinator, Dr. Rohit Misra, Assistant Industrial Adviser, M/o Chemicals & Fertilizers,

    3.0 Government Business

    3.1 Consideration of guidelines for registration of pesticides as formulation import (FI) and

    formulation indigenous manufacturing (FIM) used for post Harvest Treatment u/s 9(3)

    of Insecticides Act, 1968

    The Committee approved guidelines for this category as proposed in Agenda. (Annexure I)

    3.2 Consideration of bio-efficacy protocol for registration of pesticides u/s 9(3) of

    Insecticides Act, 1968

    The agenda was deliberated in detail and Committee decided to constitute an Expert

    Committee under Chairmanship of Dr. P.K. Chakraborty, ADG PP) with following members

    viz. 1. Head Department of Entomology, PAU, Ludhiana, 2. Head Department of Pathology,

    IARI, New Delhi, 3. Dr. Samunder Singh, Principal Scientist (Weed Control), CCSHAU,

    Hisar (Haryana) 4. Bioefficacy Experts from the Sectt. of CIB&RC, 5. Two representatives

    from Crop Life India (CLI), 6. Two representatives from Crop Care Federation of India

    (CCFI), 7.Two representatives from Pesticides Manufactures and Formulators Association of

    India (PMFAI) & 8. Dr. T.A. Usmani, DD (PP) as Member Secretary.

    3.3 Consideration of a communication of DAC regarding expansion of label claim on the

    crop in the absence of approved pesticide.

    The agenda was deliberated in detail and Committee agreed to the proposal from DAC for

    label expansion on the crops for the pests, for which no approved label claim by Registration

    Committed (RC) is available. The requisite data as per the RC guidelines for label claim

    expansion, can be submitted to the Sectt. of CIB&RC by State Govts./SAUs/Commodity

    Boards/ICAR etc. only when referred by the DAC. The label expansion shall be subject to

    fixation of MRL on the commodity by FSSAI. After approval of RC, the registrants of the

    formulation of the pesticides need to obtain necessary endorsement in their L/Ls.

    3.4 Complete online registration u/s 9(4) FIM category

    The Committee was delighted to learn that outstanding efforts have been made by NIC &

    Sectt. of CIB&RC in developing a software Computerized Registration of Pesticides

    (CROP) and great insight put for its implementation to speed up the registration process.

    After detailed deliberations, Committee decided to implement the complete online

    registration under section 9(4) (FIM) Me Too category w.e.f. 1st May, 2015 as proposed in

    Agenda. Complete application in Form-I duly signed, scanned and/or digitally signed along

    with required mandatory documents (Annexure II) as per revised guidelines in 354th RC &

    requisite fee shall be accepted online, scrutinized online and after approval of Registration

    Committee (RC), Certificates of Registration (CR) shall be sent by E-mail to the applicant &

    Concerned Director of Agriculture. This decision also be sent to DAC for acceptance as a

    policy.

    3.5 Providing the measuring devices along-with the packing of pesticide

    The agenda was deliberated in detail and Committee decided that this issue first be discussed

    by Expert Committee constituted in Agenda Item No. 3.2.

    3.6 Follow up action on the decision of Registration Committee in its 346th meeting on

    Minor Changes in Formulation of Pesticides

    The agenda was deliberated in detail and Committee appreciated the efforts made by the

    Expert Group. It was further decided that the same group will also formulate guidelines for

    implementation/requirements for Minor Changes in Formulation of Pesticides and the

    proposed guidelines be put up in next meeting of RC.

    3.7 Permission to use Synthetic Pyrethroid insecticide against sand fly (vector) for Kala

    azar elimination Programme by MOHFW

    The agenda was deliberated in detail, keeping in view the request of MOHFW as forwarded

    by DAC, Committee decided to permit use of some synthetic pyrethroid namely, (i.)

    Deltamenthrin 2.5% WP, (ii.) Cyfluthrin 10% WP, (iii) Lambda cyhalothrin 10% WP, (iv)

    Alpha Cypermethrin 5% WP (v.) Bifenthrin 10% WP provisionally for a period of two years

    against sand fly (vector) for Kala azar in four States (Bihar, Jharkhand, West Bengal & Uttar

    Pradesh) which are already approved by RC for control of malaria vectors under National

    Health programme. These insecticides shall be used in the same doses as approved for

    malaria vector. It was further decided that in the meantime, NVBDCP has to generate

    required data as per the guidelines of RC for expansion of label claim on regular basis for

    these insecticides against the voctor of Kala azar. The decision of RC be communicated to

    DAC for concurrence before communicating the same to MOHFW.

    3.8 Not fixation of MRLs of Pesticides-deletion of crops from label claim

    The agenda was deliberated in detail and Committee decided for deletion of crops from the

    label claim of the pesticides. A communication be sent to DAC for issuing notification as

    proposed in Agenda (Annexure III).

    3.9 Consideration of report of the committee on crop grouping with reference to MRL

    fixation of pesticides under the chairmanship of Dr. T.P. Rajendran, the then ADG(PP)

    The agenda was deliberated in detail and Committee accepted the recommendations of the

    Expert Committee in principal. The Committee further decided that this report be sent to

    FSSAI by DAC, for fixation of MRL on the basis of crop grouping.

    3.10 Consideration of a communication of Department of Agriculture & Cooperation

    regarding illegal import of Dimethoate Technical from China

    The agenda was deliberated in detail and it was decided that a final reminder of seven days

    may be issued to the offender M/s Anu Products Ltd. and the matter be brought in the next

    meeting of RC for appropriate decision/action.

    3.11 Consideration of case of a complaint on illegal import of Dimethoate Technical &

    Pendimethalin Technical by M/s Modern Insecticides Ltd., Ludhiana

    The agenda was deliberated in detail and it was decided that the company may be asked to

    surrender all the certificates of registration issued under Export category for making

    necessary corrections within fifteen days. In case, it appears that they are not

    surrendering/submitting the CRs deliberately, the process of cancellation of CRs be initiated.

    3.12 CWP No. by 17230 of 2011 and CWP No.14750 of 2012 in the High Court of Punjab

    and Haryana- Order/Judgment-regarding

    The Registration Committee noted the judgment / Order of the Honble High Court of Punjab &

    Haryana, Chandigarh in the matters for compliance. After detailed deliberations the RC also decided

    that the consent on affidavits as per detailed given below be submitted by the applicants along with

    registration applications:-

    1. An affidavit from the manufacturer of technical grade material for the supply of the

    required technical material to the applicant under section 9(4) FIM category while the

    certificates of registrations become operative. The proforma of Affidavit is enclosed at

    Annexure - IV

    2. The revised Affidavit in place of existing Affidavit (as per Annexure VII approved in

    338th RC Meeting held on 30-04-2013). The revised proforma of Affidavit is enclosed at

    Annexure - V

    Accordingly, both the above required documents i.e. an affidavit from the manufacturer of

    technical grade material (as per Annexure IV)as a commitment for the supply of the required

    technical material and revised Affidavit (as per Annexure V) replacing the earlier Affidavit be

    included in the CHECK LIST of mandatory required documents for application for registration under

    section 9(4) FIM category. (As per Annexure III of the Minutes of 349th Meeting of RC held on 9th

    July 2014.)

    The Committee further decided that:-

    A.) The applicants whose applications are approved in the present RC shall be subjected to

    submission of the above said Affidavits (as per Annexure IV & V) in the prescribed

    proforma within 45 days of the hosting of Minutes on the website of Sectt. of CIB & RC,

    which will be subjected to verification. In case, affidavit is not received within 45 days,

    the application shall be closed after giving 10 days final notice.

    B.) The applicant whose applications are at the stage of scrutiny in the Sectt. of CIB&RC and

    yet to be put up to RC, shall submit the above said affidavits (as per Annexure IV & V)

    within 15 days of the hosting of Minutes on website.

    C.) Henceforth, no new / fresh applications under section 9(4) FIM category shall be

    entertained which are not accompanied by aforesaid affidavits.

    A Public Notice to the above effect also be hosted on website of Secretariat of CIB&RC for

    compliance by all the stakeholders.

    3.13 Guidelines for registration of paints containing pesticides

    The representations on the guidelines for registration of pesticides for paint from different

    Paint Associations were deliberated in detail and Committee decided that the major Paint

    Associations like Indian Paint Association (IPA), Indian Chemical Council (ICC) &

    Confederation of Indian Industry (CII) may be asked to make presentation jointly on the

    proposed guidelines during the next meeting of RC.

    3.14 Consideration of an application of M/s Shobikaa Impex, Karur, T.N. for grant of

    registration for indigenous manufacture of Alphacypermethrin Incorporated Long

    Lasting Mosquito Bed Net (LLIN) 0.55% w/w under section 9(3B) of the Insecticides

    Act 1968.

    The agenda was deliberated in detail and Committee approved provisional registration u/s

    9(3B) for public health programmes, subject to the outcome of the court case having W.P.

    No. 8408/2015 & W.P. No. 8409/2015 before the Honble High Court of judicature at

    Madras. The Committee further decided that the case be sent to DAC for according

    permission for commercialization during provisional registration.

    3.15 Harmonization of data of bio-pesticide of already registered strain.

    The agenda was deliberated in detail and Committee decided to constitute an Expert group

    under the Chairmanship of Dr. S.N. Sushil, Plant Protection Adviser, Dte. of PPQ&S, NH-

    IV, Faridabad along with 1. Dr. P.K. Chakraborty, ADG(PP), ICAR, New Delhi, 2. Dr.

    (Mrs.) Sarita Bhalla, Sp. Gr. I, 3. Dr. Harish Chandra, JS(E), 4.Sh. Subhash Chand,

    DD(Chem), 5. Dr. (Mrs.) Vasudha Gautam, AD(E), 6. Sh. Abhishek, AD(Chem) as members

    & 7. Dr. T.A. Usmani, DD(PP) shall be the Member Secretary. This group shall suggest the

    modalilities /guidelines for future registration of Bio-pesticides on the basis of data base as

    proposed in agenda.

    Guidelines for registration of pesticides as formulation import (FI) and formulation indigenous

    manufacturing (FIM) used for post Harvest Treatment u/s 9(3) of Insecticides Act, 1968

    The data requirement for Toxicology, Chemistry and Package for registering pesticides for

    post harvest treatment will be same as applicable for registration of chemical plant growth regulators

    under different categories. However, the data on Bio-effectiveness and residue to be generated in the

    same experimental condition viz. temperature, humidity etc. without any variation in repeated trials.
