General Guide for Persons Appearing at Public Hearings of Applications:

1. Applications will not be heard prior to the time noted on the Notices of Application.

2. The Owner will be given an opportunity, if desired, to briefly explain to the

Committee and other persons who may be attending in connection with the application, the basis of their application and to answer any questions that may arise out of the hearing.

3. Persons speaking on an application must state their full name and mailing

address, for the record. Those appearing on behalf of the Owner, an individual or individuals, a company, law or consulting firm, should so advise the Committee. If a property owner in the area, the location or other satisfactory identification of the property owner should also be given.

4. All persons attending a hearing who wish to support or oppose the application

will have an opportunity to speak to the Committee, following the presentation by the owner/agent/solicitor. Ratepayers' group is so authorized.

5. ALL REMARKS ARE TO BE DIRECTED TO THE CHAIRPERSON OF THE

COMMITTEE. 6. A summary of statements by each person speaking on an application is made

for the record. The Committee may require that such statements be made under oath, or be subsequently confirmed under oath.

7. Decisions of the Committee are in writing and are made at the hearing.

Notices of decisions will be mailed not later than 10 days from the making of decisions. Decisions will be mailed to owners/agent/solicitor, but will be sent only to those others who file with the Secretary-Treasurer a written request for notice of the decision. Forms are available at the hearing for this purpose and may be completed prior or during the hearing for this purpose.

8. PLEASE NOTE: The Committee of Adjustment meetings are audio

recorded. Your name, address, comments and any other personal information is being collected and maintained for the purpose of sending correspondence relating to matters before the Committee of Adjustment and creating a record that is available to the general public, in a hard copy format, and on the internet, in an electronic format, pursuant to Section 27 of the Municipal Freedom of Information and Protection of Privacy Act. Questions about this collection should be directed to the Secretary-Treasurer.

Draft Conditions and Comments:

The draft conditions and all comments received regarding applications are on view at the back of the hearing room and you are requested to read these reports prior to appearing before the Committee. Your co-operation in this matter will facilitate the expediency of the hearings.

Request for Decision:

A "REQUEST FOR DECISION" form will also be available at the back of the hearing room, as well as being attached to the Notices of Application. Failure to complete the form will result in you not receiving a decision.

PLEASE PRINT: NAME: ADDRESS: POSTAL CODE: A completed form is required from anyone wanting to receive a decision of the Committee of Adjustment. Completion of this form will entitle you to the following: 1. A copy of the Committee of Adjustment decision. 2. An opportunity to address the Committee of Adjustment during the Public Hearing, if desired. 3. Notification of a hearing and decision of any Ontario Municipal Board hearing, should the

decision of the Committee of Adjustment be appealed.

Once completed, this form must be submitted to the Secretary-Treasurer or Committee of Adjustment staff, on or before the hearing date. A completed form should also be attached to any correspondence filed with the Committee of Adjustment regarding the application.

Addressing the Committee of Adjustment:

When addressing the Committee of Adjustment during the hearing, please state your name and address at the beginning of your presentation. Presentations to the Committee are generally limited to 5 minutes in length.

Petitions:

If you wish to submit a petition regarding an application, please make reference to the File Number and name of the Applicant on your petition. ALL NAMES MUST BE PRINTED CLEARLY ALONG WITH THEIR SIGNATURES AND ADDRESSES IN FULL, INCLUDING POSTAL CODE. Failure to do so will result in illegible names and incomplete addresses not receiving the notices. If you wish the petitioner(s) to receive a copy of the decision, you must attach this form with “a decision is requested for each petitioner on the attached petition” written across the space provided for the mailing address. This will also entitle the petitioner(s) to notification of any additional hearings pertaining to the application, if applicable.
