Concerning the amendment of the ministerial decree number (94)

of the year 2003 for the executive By-law of the federal law number

(39) of the year 1992 regarding production, importing,

and circulating fertilizers and soil conditioners

The Minister of Agriculture and Fisheries,

In accordance with the federal law number (1) of the year 1972

concerning the function of ministries and the powers of the ministers and

the laws issued in amendment thereof,

And the federal law number (4) of the year 1979 concerning the control

of deception and fraud in trade transactions,

And the federal law number (5) of the year 1979 regarding agricultural

quarantine and the laws issued in amendment thereof.

And the federal law number (3) of the year 1987 concerning the issuance

of punitive law,

And the federal law number (39) of the year 1992 regarding the

Production, importing, and circulation of fertilizers and soil

conditioners, Recourses in the United Arab Emirates,

And the federal law number (18) of the year 2004 regarding the

organizational structure of the ministry of agriculture and fisheries,

And the punitive law of the federal law number (94) of the year 2003

concerning the executive by- law of the federal law number (39) of the

year 1992 regarding production, import, and circulation of fertilizers and

soil conditioner.

And the necessities of the public interest.

The following has been decided:

Article ( 1 )

Definitions

In view of the implementing the provisions of this law, the following

wards and terms shall have the meanings hereby assigned to them unless

the context otherwise required,

Country: The United Arab Emirates

Ministry: The Ministry of Agriculture and Fisheries.

Minister: The minister of agriculture and fisheries.

Deputy Minister: The deputy minister of agriculture and fisheries.

Competent Department: Agricultural Affairs Sector in the ministry, or

any organisational unit in each Emirate.

Circulation: Presentation for sale, or storing, or transportation by any

means of transport.

Article (2)

Scope of application

The provisions of the federal law number (39) of the year 1992 are

applied on fertilizers and soil conditioners as follows:

Firstly, fertilizers:

They are materials that provide plant with all needed of food elements,

and maintain the fertility, and productivity of soil:

1- Chemical fertilizers:

They are chemically manufactured fertilizers and include feeding

materials for plants:

Simple Fertilizers: They contain one fertilizing element such as (Azotic-

Phosphatic- Magnesium- Calcium and trace elements fertilizers.

Compound Fertilizers: They contain more than an element.

2- Organic Fertilizers: The residues of plants, or animal, or mixture of

them, which contain feeding elements and organic materials necessary

for improving the physical, chemical, and biological characteristics of

soil.

Secondly Soil conditioners: They are materials, which act for improving

or reclaiming the characteristics of the soil, and the beneficial

Microorganisms, which perform increasing the production of crops

when added to the soil, they are consisting of:

A- Organic soil conditioners:

They are products of organic origin of either fauna or flora (organic soil

conditioners and artificial soil) as well as the residues of petroleum

industries.

B- Non- organic, they are not including any organic materials like:

Agricultural Gypsum, Sulphur, Polymer (Hydrojel) sand, Bentanite

Chemical acids, Clay soils, and Agricultural Berlite.

2- Micro- organisms: they are added to soil, or mixed with seeds, in

order to fix air Nitrogen in the knots of the roots or dissolute the

elements in the soil to be absorbed and utilized by plants, or to improve

its characteristics such as Azotiobacter- knotting bacteria – Rizobia and

Micorazia fungi .

Article (3)

Kinds of fertilizers, soil conditioners, and their specifications

Firstly: Chemical fertilizers.

Organic fertilizers.

Thirdly: Soil conditioners.

Fourthly: Artificial agricultural soil.

Their production, manufacturing, importation, or circulation shall be

subject to the following conditions and specifications.

Firstly: Chemical Fertilizers

A- Simple fertilizers are:

(Nitrogenous, Phosphates, Potassic, Magnesium and Calcium and Micro

elements with all natural and chemical specifications together with their

contents of feeding elements.

1- 1- Nitrogenous Fertilizers:

-Urea

Total soluble nitrogen in water shall not be less than 46% and Biuret

shall not exceed 1.0%.

1-2 Urea Phosphate

Total soluble nitrogen shall not be less than 17%.

1-1-3 Ammonium Sulphate

Total soluble nitrogen shall not be less than 20% as ammonium (NH4)

1-1-4 Ammonium Nitrate

Total soluble nitrogen shall not be less than 33.5% (50% as NH4 and

50% NO3)

Prior permit by the ministry of interior is necessary for importing,

manufacturing, or circulation of Ammonium nitrate.

1-1-5 Calcium Nitrate

Total soluble nitrogen shall not 15.5% and the ammonium nitrogen not

less than 1.5%.

1-1-6 Magnesium nitrate:

Soluble nitrogen in water shall not be less than 11%.

1-2 Phosphatic fertilizers:

Mono super phosphate:

1-2- 1 Total soluble phosphor (P 205) in water shall not be less than

15%.

1 - 2- 2 Moisture shall not exceed 1%.

It is preferable to be granule solid and none caked.

1-2-3 Triple phosphate (TSP):

Total soluble phosphor should not be less than 42%.

Moisture shall not exceed 4%.

Fertilizer shall be granule that 95% of granules can easily pass through

screen holes of 5mm.

Fertilizer shall not be caked, paste or solid.

1- 2- 3 Double Ammonium Phosphate (DAP):

Total soluble Phosphor (DAP) shall not exceed 39%.

Total phosphor (P205) soluble in citric acid shall not exceed 46%.

1- 3- 4 - Total soluble nitrogen in water shall not exceed 18%.

1- 3- 5 – Fertilizer shall be granule, and the size of granules shall be

between (1-3) mm.

1- 3- 6- Mono Ammonium Phosphate (MAP):

Total soluble Phosphor (P205) in water shall not be less than 48%.

Total soluble nitrogen shall not be less than 11%.

1- 3- 7- Mono ammonium phosphate (MKP):

Total soluble phosphor (P205) soluble in water shall not be less than

52%.

1- 3- 8- Phosphate stone:

Average of phosphor (P205) shall be 35%.

1- 4- Potassium Fertilizers:

Potassium sulphate:

Total soluble potassium (K20) in water shall not be less than 48%.

Average of moisture shall not be not less than 05%.

Average of Chlorine in fertilizer should not exceed 2%.

1- 4- 1- Potassium Nitrate:

Soluble nitrogen in water shall not be less than 13%.

Soluble Potassium (K20) in water shall not be less than 46%.

Permit from the ministry of interior is necessary before importing,

manufacturing, or circulation.

1- 4- 2- Mono Potassium Phosphate (MKP)

Soluble potassium (K20) in water should not be less than 34%.

1- 4- 2- M magnesium Fertilizers:

Magnesium sulphate, soluble magnesium (Mgo) in water shall not

exceed 15%.

Humidity shall not 1%.

Percentage of sodium chloride shall not exceed 1%.

Magnesium Nitrate (Mgo) soluble in water (percentage not less than

10%).

1- 4- 3- Calcium Fertilizers:

Calcium Nitrate (CaO) soluble in water (not less than 19%).

1- 4- 4- Compound and mixed fertilizers (soluble, granular, suspended,

and liquid).

They should comply with the following:

1- Total contents of NPK+ MgO+ T.E shall not be less than 40%.

2- Contents shall be conforming to the manifested elements.

3- The main source of potassium shall be potassium sulphate or

potassium nitrate.

4- To be completely soluble in water

Microelements fertilizers:

1- 4- 5- Chelated form:

Single fertilizers:

They are allowed according to the percentage of the main element of

nutrient conformed by the produced company, as written in the

analytical certificates and the bags. The nutrient elements shall not be

less than 5% of each separately.

Solid and liquid compound fertilizers:

The total content of (Cu + Fe + Mn + Zn….etc. should not be less than

10%.

Sulphates:

They should include all the natural and chemical specifications and their

contents of the nutrients.

1- 4- 6- Indoor plant fertilizers:

-The total content of nutrient elements shall not exceed 16% either solids

or liquids.

-They should be homogeneous, and their nutrient elements are

conformed to the elements written on the bags or the pots together with

the statement (special for indoor plants).

- Solid indoor plants should be completely soluble in water.

1- 4- 7- Organic Fertilizers:

They are the plant, either animal residues or mixture of them.

A- Powder:

It should be fermented organic mature, heat treated, not mixed with soil

or sand, free of seeds, bacteria, fungi, viruses, nematodes, insects, pests

and other harmful pathogens.

It should be free of toxic heavy elements (lead, mercury, cadmium,

chrome cupper, selenium nickel, zinc, molybdenum, etc).

Their content of the above heavy metals shall not exceed the following

limits:

- Organic material in the imported fertilizer shall not be less than 50%

and not less than 40% in the local manufactured organic fertilizer.

- Electrical conductivity (EC) of fertilizer shall not exceed 10 mm\cm in

an extract 1: 5.

- PH shall not exceed 7.5 in an extract of 1:5.

- Moisture shall not exceed 25%.

- Average of carbon to nitrogen (C/N) shall not exceed 20/1.

- Additives shall be shown on the pot, and the average of peiroit shall

not exceed 0, 5% when urea is added.

- Percentage of sodium chloride in organic fertilizers either imported or

locally manufactured shall not exceed 2% and the soluble sodium

chloride shall not exceed 8%.

- Weight of package shall be 25 kilogram, tightly closed and strong to

endure handling and circulating.

- All information including type of fertilizer, trade name and other

information related to the product should be written on the package.

- Organic fertilizers should be free of radiation.

1 – 4- 8- Biological fertilizers:

- Moisture shall not exceed 30%.

- Certificate of analysis should include names of biological microbes.

- In addition to the other conditions stated for organic fertilizers.

1- 5- Seaweed, fish, blood and bones fertilizers, or any other similar

kinds.

Their content of the organic material and nutrient elements shall not be

less than 50%.

1.6 – Municipality wastes and drainage fertilizers:

It is not allowed to import municipality waste and drainage fertilizers, or

any organic fertilizers containing any of these wastes, and clause number

1.6 is only concerned with the local factories of the municipalities in

UAE.

They should comply with the following:

- Their content of heavy elements such as lead, mercury, cadmium,

chrome, cupper, selenium, nickel, zinc, molybdenum…etc should not

exceed the allowed percentages as shown in the following table:

- Fermented fertilizers produced from drainage wastes are not allowed to

be added to the lands contain any of the heavy elements as shown below:

Fermented fertilizers produced by drainage wastes should not by any

means be scattered on fresh agricultural crops.

- It should be free of radiation, unless its average has not exceeded 300

pickerel/ kg.

- The product should have brown black colour, and 95% percentage of it

can pass through screen of 12 mm diameter.

- Free of bad smell.

- Free of weed seeds, or parts of grown up plants.

- The organic material should not be less than 35% in weight.

- Average of carbon to nitrogen shall not exceed 25:1.

- PH shall not be less than .05 and not exceeding .08.

- Clarify the source of the nutrient elements of the product either they

are organic or metallic.

- Moisture content should not exceed 25% in weight.

- Electrical conductivity of the saturated paste of the product shall not

exceed. 10 mm /cm.

- The product content of coli form bacteria should be less than 1000

cells, and salmonella cells are less than 3 in one gram of the dry

material.

1-7 Liquid fertilizers:

Fertilizers, which their main content is an organic matter:

- The organic content should not be less than 50% (w/w or w/v).

- Fertilizers which their main content is humic, or folic acid, or both:

- Their percentage either together or separated shall not be less than

12%.

Sea weeds, fish, blood, bones and other similar fertilizers:

- Their content of the organic matter and nutrient elements shall not

be less than 25% of (w/w or w/v).

Fertilizers which contain organic matter + NPK + humic and folic acids

+ TE…etc.

- The percentage of the contents shall not be less than 50% of (w/w/v).

1-8 Agricultural Conditioners:

They are consisting of the following:

Solid agricultural conditioners:

They should comply with the following specifications:

- Organic material shall not be less than 60%.

- PH should not exceed 0.7 for an extract of (1-5).

- Electrical conductivity (EC) should not exceed 0.10 mm /cm. for an

extract of (1:5).

- Moisture shall not exceed 30%.

- Percentage of sodium chloride shall not be more than 1%.

- Percentage of carbon to nitrogen (C/N) shall not be more than 35/1.

They should be free from diseases, pests and organisms particularly

nematode.

1-9 Non-organic conditioners:

- They should be accompanied by certificate of analysis, chemical code,

ingredient matter and type of using soil. They are:

- Agricultural gypsum

Calcium sulphate should not be than 80% and Sodium chloride not less

than 3%.

Agricultural sulphur

- Content of sulphur element should not be less than 85%.

Polymers (Hydro gel):

- Water holding capacity (WHC) shall be fixed.

Sand:

- It may be used to improve the characteristics of the clay soil. Salinity

of sand shall not exceed 4 mm /cm and percentage of Calcium carbonate

shall not exceed 10%.

Bentanite:

Bentanite or any other clay mineral could be added to sandy and gypsum

soil to improve their characteristics, provided that percentage of Sodium

chloride should not exceed 2%.

Chemical acids:

- Such as Sulphuric acid (H2S04), Phosphoric acid (H3P0.4) Nitric acid

(HNO.3) .They could be used to improve the characteristics and reclaim

the salty, alkaline, and gypsum soil.

(Importation or manufacturing of Sulphuric and Nitric acids are subject

to the approval of the ministry of interior).

Clay soils:

They are used to improve the sandy and gypsum sand. Electrical

conductivity (EC) for an extract of saturated paste should not exceed 4

mm/cm, and Calcium carbonate should not exceed 10%.

- Agricultural berlite:

The water holding capacity (WHC) shall not be less than 300%.

1-10- Agricultural artificial soil:

It has to comply with the following:

- Free of natural soil and sand.

- Free from diseases, harmful pests, particularly parasitic nematode.

- Electrical conductivity (EC) should not exceed 0.3 mm/cm for an

extract of (1:5).

- Organic material should not be less than 75%.

- PH should not exceed 0.6 for an extract of (1:5).

- Sodium Chloride should not exceed 0.2%.

- Moisture in agricultural artificial soil either imported or locally

produced should not exceed 65%.

Article (4)

Conditions and procedures to announce for fertilizers and agricultural

conditioners. The Producer, importer or the manufacturer of fertilizers or

agricultural conditioners have to submit catalogues, or pamphlets

describe the characteristics of the product to be circulated as follows:

1- Name of producer, and country of origin

2- Brand name and trade mark.

3- Nature of fertilizer, and chemical formation.

4- Percentage of components.

5- Net weight of package.

6- Date of production and lot number.

7- Stickers must be put on packages of liquid fertilizers and minor

elements.

All information and directions on packages shall be clearly written in

Arabic language and not wiping off.

Article (5)

Specifications of packages of fertilizers and agricultural conditioners

Packages of fertilizer and agricultural conditioners should comply with

the following specifications:

1- Packages of simple and compound chemical fertilizers should be

made of polypropylene, with strengthen polyethylene lining, and treated

against Ultra violet (UV).

2 - Packages must be tightly closed.

3 - Packages of foliar fertilizers must not be rusty, and resistant to

corrosion due to the interaction of the fertilizer components, and

insulator to light.

4 - Package’s weight shall be as follows:

A - Packages of Urea, Ammonium sulphate, Potassium sulphate, and

granular fertilizers shall be 50 kg in weight.

B - Soluble and minor elements fertilizers (20- 25 kg).

C – Foliar and some of minor elements fertilizers (one kg/ litre).

Stickers should be put on packages to illustrate directions of use.

Conditions and procedures of examining and analysing fertilizers and

agricultural conditioners.

Agricultural chemicals:

Deliquescent fertilizers:

Metal probe is usually used with 60 cm in length to take specimen.

Non deliquescent fertilizers:

Specimen can be taken by using the probe in the package from four

parts as follows:

If the number of packages does not exceed five, then samples shall be

taken from all of them.

If the number of packages is more than five and not exceeding twenty,

then the percentage of samples shall be 40% in condition that the

number of samples shall not be less than six.

If the number of packages is more than 20 and not exceeding 200, then

the percentage of samples shall be 20% and their number of samples not

less than 8 packages.

If the number of packages is more than 60 and not exceeding 200, then

the percentage of samples shall be 10%, and the number of samples not

less than 10 packages.

If the number of packages is more than 200 and not exceeding 500, the

percentage of samples shall be 5% and the number of samples shall be

not less than 15 packages.

For packages exceeding 500 and not more than 1000, the percentage of

samples shall be 4%, and the number of samples 25.

For packages increasing 1000 the percentage of samples will be 3% and

collected samples shall not be less than 40.

Collected samples shall be put on piece of cloth or paper and mixed well

until they become cognate. Four samples from this mixture are usually

taken of 200- 300 gm each to be put in packages itemized for this

purpose with a sticker showing the name of fertilizer, composition, date

of sample collection, quantity, name and signature of sample collector

and the owner or his representative.

Packages of samples shall be sealed with red wax and stamped by the

producer or the importer.

Two packages of samples together with the report will be sent to the

central laboratories of the ministry within 24 hours. One sample shall be

analysed and the other one is usually kept to be referred to in case of

any complaint or protest by the owner.

B - Organic fertilizers:

1-Packaged in bags: One bag is taken from every 1000 bags for analysis.

Unpackaged fertiliser : Samples or parts of 500 grams are taken for

analysis as follows:

25 parts for one ton.

30 parts for 1 – 2 tons.

35 parts for 2 - 5 tons.

40 parts for 5-10 tons.

45 parts for 10-25 tons.

50 parts for 25050 tons.

60 parts for 50- 100 tons.

Two more parts are usually taken for every 10 tons or their fractures

when the quantity exceeds one hundred tons.

Article ( 7 )

Check and analyse samples in the central laboratories of the ministry

are conducted to illustrate the following:

The natural characteristics of fertilizer.

Evaluate the percentage of the elements and their conformity to the

manifested ones according to the international standards.

Article (8)

Objection on the results of analysis

The concerned party has the right to complain of the result of analysis,

and claims to repeat it within fifteen days from the date of notification,

Otherwise the right for complain will be invalid and the results shall be

considered irrevocable.

Complaint against the result of analysis shall be submitted to the

concerned department in the ministry through a letter addressed to H.E.

the ass. deputy minister of agricultural affairs and attached with the

following:

A- certificate of analysis issued by the ministry.

B- One of the two samples kept by the complainant.

Article (10)

The following steps are taken to analyze samples:

Re analysis of samples shall be carried out by committee of three

members nominated by the concerned department, and the complainant

shall have the right to attend the analyzing process.

The committee shall receive the sample kept in the ministry and the

sample owned to the complainant in purpose of checking seals and

stamps, to guarantee that they were not touched.

The same method of re analysis shall be carried out with the sample

given by the complainant. If the results of the re analysis found

compatible, then the result will be considered final

In case the result was different, analysis will be carried out on the

sample which is kept in the ministry, and the result shall be considered

final.

The differences in the fertilizing components should not increase or

decrease 10% than the manifested percentages.

Article (11)

Non conformable imported fertilizers and soil conditioners shall be

subject to the following :

1-If the imported quantities were imported for the ministry,

governmental, or private directorates, they shall be informed about the

differences in fertilizing elements to take the necessary steps

accordingly.

2- In case the importer brought non- conformable fertilizers or soil

conditioners for trading or circulation purposes, then he has to re-export

the consignment at his own expense, otherwise, the ministry shall have

the right to destroy it, and the importer shall bear all the related costs.

Article ( 12 ) Terms of conditions and measures for producing and manufacturing

fertilizers and soil conditioners.

Production and manufacturing of fertilizers and soil conditioners are not

allowed unless obtaining prior permission from the ministry.

Article ( 13 )

The application form for licensing shall be attached with the following:

1- An approved architectural drawings.

2- Copy of the approved permission issued by the ministry of finance

and industry.

3- Copy of the approval order from the competent authorities in the

Emirate for production or manufacturing.

Article (14 )

Licensing for production or manufacturing shall be issued personally,

and it can't be transferred evening case of selling or renting the factory.

License shall be renewed annually, and the manager of the factory must must be specialized agricultural engineer in the same field.

Article ( 15 )

1- fertilizers and soil conditioners shall not be circulated unless being

registered according to the provisions of this decree, and being proved

congruent with the specifications through an approved certificate issued

by the ministry. Certificates of registration shall be renewed every five

years.

2- Numbered and stamped record shall be kept in the factory indicating

the numbers of codes, their manufacturing or preparing dates and

distribution, as well as trade record which shall include the names of

buyers. 3- These records shall be kept for five years as from the date of the last

registration, and to be forwarded on order.

Article ( 16 ) 1- Trading in fertilizers and soil conditioners is not permitted unless

prior license from the ministry is issued.

2- The place prepared for this purpose should be fulfilling the

specifications of industrial and trading show rooms. Application for

trade license shall be forwarded to the competent authority.

3- Applications for trade license should be presented with the following

documents:

A- copy of the approval order concerning the shop issued by the

competent authority in the Emirate.

B- copy of the contract of rent or an evidence of ownership to the

showroom.

4- Licensing for trade shall be personal and it can't be transferred even in

case of sailing or renting the shop or the showroom.

Article ( 17 ) 1- Licenses for trading in fertilizers and soil conditioners are valid only

for one year.

2- The manager of the shop or the show room should be specialized

agricultural engineer in the same field.

Article ( 18 ) Licensed persons allowed for trading in fertilizers and soil conditioners

shall keep numbered record stamped by the ministry, showing

circulating movement, and this record shall be kept for five years as

from the last date of registration.

Licensed traders have to give customers invoices including the name of

fertilizer or soil conditioner, quantity and fertilizing components.

They have to keep copy of these invoices to be forwarded on order.

Article (19)

Terms of conditions and measures of fertilizers and soil conditioners

1-All kinds of imported organic fertilizers should be treated, heated or

fermented. Prior permission from the ministry is necessary before

importation, however fertilizer factories are excluded from this

condition.

Unprocessed organic and chemical fertilizers are allowed to be

imported by factories for manufacturing in condition that they obtain

prior permission from the ministry.

Applications for importing permission should be forwarded to the

competent department of the ministry two weeks before the shipment of

consignments from the country of origin. The attached bulletin must

include the following:

Name of the producer company.

General and trade name.

Chemical formulation and the percentage of the components.

Directions for best use.

Tendency for mixing with other chemical elements.

Further information the producer may find necessary.

Application form of importing should be attached with five samples of

kilogram each wrapped and stamped by the produced or the imported

company. The ministry shall only give permission of importing to

registered brands. The validity of importing permission is six months as

from the date of issue, in addition that the imported quantities can be

divided in continuous quantities during the validity period of the

permission in accordance with the provisions of this decree.

Article (21)

The importer should present the permission of import to the agricultural

quarantine office within three days as from the date of their arrival

attached with the following attested documents:

1-Health certificate issued by the concerned authorities in the exporting

country states that the shipment stated in the invoices is free from seeds

of Weeds, Bacteria, Fungi, Viruses, Nematode, and harmful insects.

2-Certificate of analysis indicates the formulation of the components of

fertilizer.

Article ( 22 )

Customs Departments have to coordinate with the ministry before

releasing the imported consignments of fertilizers and soil conditioners.

The ministry shall act to examine random samples to ensure that they are

free from diseases, insects, and harmful materials, as well as checking

the attached health certificates.

In case the consignment proved non conformable with specifications, the

importer undertakes to re export the consignment at his own expense and

he shall not have the right to claim for compensation from the ministry.

Article (23)

The ministry shall coordinate with the competent authority in the

concerned Emirate to carry out inspection of fertilizer and soil

conditioners producing factories and companies which import fertilizers

and soil conditioners as follows:

Periodical analysis of fertilizers and soil conditioners, and follow the

Same manner of analysis of samples in accordance with Article ( 6 ) of

this decree.

Article (24)

All publications and trading advertisements relating to promotion of

fertilizer products through information media are subject to approval of

the concerned party.

Article (25)

Production, manufacturing, export-import or circulation of all kinds of

fertilizers and soil conditioners shall be prohibited either permanently or

temporarily according to the necessities of public interest. Prohibition

shall be applied through decision by the ministry in accordance with the

recommendations of the competent authority in coordination with the

concerned authority.

Article (26)

The persons who currently operate in the country and whose activities

are part thereof fall under the provisions of the Federal Law number (41)

of the year 1992 shall adapt their situations to the provisions of the said

law and the decisions made in implementation thereof within six months

as from the date of tits enforcement, otherwise they shall be liable to

punishment as stated in the provisions of the law.

Article (27)

The competent authorities each within the limits of its jurisdiction shall

enforce the present decree as from the date of its issuance and any

decisions which violates or contradict this decree shall be cancelled. The

decision shall be published in the Official Gazette.
