Sec. 22

Any employer who:

Pays to employees less than the minimum rate of wages fixed for that employee’s class of work, or less than the amount due to him under the provision of his Act, or

Contravenes any rule or order made under section 13, shall be punishable with imprisonment for a term which may extend to six months or with fine which may extend to five hundred rupees or with both [Sec. 22].

In imposing any fine for an offence under section 22, court shall take into consideration the amount of any compensation already awarded against the accused in any proceedings taken under section20. [Provision to Sec. 22]

Further, any employer who contravenes any provision of this Act or of any rule of order made there under, shall if no other penalty is provider for such contravention by this Act, be punishable with fine which may extend to Rs. 500 [Sec.22-A]

Where an employer is charged with an offence against this Act, he shall be excused from liability if he can show that some other persons was responsible for the offence and that:

a. he has used due diligence to enforce the execution of this Act; and

b. the said other person committed the offence in question without his knowledge, consent or connivance.
