Mentoring, she showed us techniques that we can use when we enter into a

Diversity

Diversity is a reality in America today; It is a people issue that focuses in the differences and simi-larities between individuals. Diversity issues have gained a lot of recognition and are considered very important. This is attributed at large to the increasing differences in the U.S. population, in-dustry globalization, among other things. It is essential that HR professionals acknowledge the risks an organization can be exposed to if diversity is not fully understood and dealt with.

A case study or latest information about this topic will be published on a monthly basis to illustrate the importance of understanding, addressing and preventing issues with diversity in the workplace.

New Bill - Adding unemployment to the list of Protected Groups under Title VII

Under Title VII of the Civil Rights Act, employers cannot discriminate against applicants based on race, color, religion, sex, or national origin. Rep. Hank Johnson (D-Ga.) introduced legislation on Wednesday March 16, 2011 that would add unemployed people to that list of protected groups.

The Fair Employment Act of 2011 (H.R. 1113), drafted by Johnson and co-sponsored by Rep. Jesse Jackson, Jr. (D-Ill.), would amend the Civil Rights Act to make it illegal for employers to refuse to hire or to lower compensation for a person because of employment status.

If the bill passes, the burden of proof would be on the plaintiff to show that he or she was discrimi-nated against based on employment status. Even though this kind of discrimination may be difficult to prove, it is expected that the legislation will stop employers from using discriminatory language in their job ads and refusing to look at resumés from jobless applicants.

INTERESTING FACTS :

Passover, or Pesach, is an eight day observance which begins at sunset on the 15th day of Nisan in the Hebrew calendar. During this time, Jews celebrate the flight of the Israelites from Egyptian slavery in the 1200's B. C. E. A ceremonial feast known as the Seder takes place on the first two nights of Passover. Symbolic foods, including unleavened bread, are placed on the table.

Easter celebrates the resurrection of Jesus, the most joyous occasion in Christianity. It also marks the end of Lent. The date of Easter varies each year but always falls between March 22 and April 25. The date is set by determining the Sunday following the full moon on or after the vernal equi-nox.

Legislative Director’s Report for March 2011 J. Lenora Bresler

Things I learned at the HR Florida Day on the Hill

Legislators, especially those who are relatively new, WANT to hear from their con-stituents, and when you are in Tallahassee, constituents, even those without appoint-ments, go to the head of the line ahead of waiting paid lobbyists.

You will have a longer, probably more successful discussion with a legislator in their home district office than in Tallahassee because the session is such a whirlwind.

If you are told a legislator is in a committee meeting, it is ok to go to the chamber and motion that you need to speak to the member as many of the meetings are pro-cedural in nature and the members can leave for a brief time. Also, just because a meeting is scheduled for an entire afternoon does not mean they will not get out early.

Because we are HR professionals and are not being paid to lobby, we do NOT have to register to lobby, but we nonetheless are not only representatives of our local chapters but also of HR Florida, which represents 14,000 members, and its parent organization, SHRM, which represents worldwide 250,000 members. Therefore, when speaking on HR issues, it is appropriate to distinguish HRFlorida or SHRM policy from any conflicting personal beliefs.

Do not be upset if you cannot speak to the legislator but instead to their staff; often the staff is more intimately knowledgeable about pending legislation.

Legislative aides run the gamut from a “secretary-type” to a “second brain” so you have to get to know the individuals to know how much influence they will have with the legislator.

Be sure you know the numbers of the Senate and House bills you want to discuss and that you know who is sponsoring the bills and to which committees they have been assigned, particularly because the legislator wants to know if the bill is coming before a committee on which she serves.

Be succinct; time in Tallahassee is valuable and you cannot waste it on small talk. Do small talk in the district.

Be clear as to what the current law is and what you desire it to be.

Never lie or fudge as you will lose credibility.

Be specific and direct in your request, i.e. “I want you to vote no on Bill #xxx.”

Listen closely and do not assume that vague statements indicate agreement.

Be prepared to leave information behind after a visit.

Legislators keep a “contacts” list so if you have a field of expertise, tell the legislator you would be happy to advise on that issue.

Sometimes ask the legislator what they are working on and how you might be able to help with their issues.

Be persistent.

Legislative Director’s Report for March 2011

I URGE SUPPORT OF BILLS TO LEVEL THE PLAYING FIELD IN UNEMPLOYMENT COMPENSATION CLAIMS:

HR Florida supports the following and I personally would urge you to write your state senator and state legislators in support: Senate Bill 562/House Bill 319 would change the definition of “misconduct” by which individuals become ineligible for unemploy-ment compensation. The current definition of misconduct is deemed by most employers to be the too-burdensome standard of “willful and wanton disregard of employer’s interests.” The bill would change the standard to “conscious disregard, actions that jeopardize a business’s ability to remain open, and include chronic absentee-ism and tardiness.” As it is, the hearing officers at the Agency for Workforce Innovation almost always allow claims even when employees have stolen or re-peatedly caused extremely serious safety issues. These officers give every indication of being extremely and proactively biased in favor of employees, including NOT allowing the hearsay exception of busi-ness records in hearings. Thus, many cases are lost by employers be-cause these hearing officers, whose training and lack of HR back-ground are questionable, do not permit regular business records to be admitted without the in-person testimony of not only the custodian of the records, but also the originator of the record (often a supervisor who is long gone). The horror stories about this appear to be wide-spread and consistent throughout the state. These matching bills ap-pear to be a step in the right direction of leveling the field in a com-mon-sense approach. I would be happy to compile horror stories of unemployment claims and send them to this Paula Dockery and Kelli Stargel.

The HR Florida State Conference & Expo is the annual conference of the HR Florida State Council, a state affiliate of the Society for Human Resource Management (SHRM).
