WORKFORCE DEVELOPMENT BOARD MEMORANDUM OF UNDERSTANDING

ONE-STOP JOB CENTER SYSTEM PARTNERSHIP

The Workforce Innovation and Opportunity Act (WIOA) sec. 121(c)(1) requires the Local Board, with the agreement of the Chief Elected Official (CEO), to develop and enter into a Memorandum of Understanding (MOU) between the Local Board and the One-Stop Partners, consistent with WIOA Sec. 121(c)(2), concerning the operation of the one-stop delivery system in a local region. This requirement is further described in the Workforce Innovation and Opportunity Act; Joint Rule for Unified and Combined State Plans, Performance Accountability, and the One-Stop System Joint Provisions: Final Rule at 20 CFR 678.500, 34 CFR 361.500, and 34 CFR 463.500, and in Federal guidance.

Additionally, the sharing and allocation of infrastructure costs among one-stop partners is governed by WIOA sec. 121(h), its implementing regulations, and the Federal Cost Principles contained in the Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards (Uniform Guidance) at 2 CFR part 200.This Memorandum of Understanding (MOU) establishes the spirit of cooperation and collaboration in the Southwest Missouri Workforce Development Region, per the Workforce Innovation Opportunity Act (WIOA).

The MOU identifies “Shared Customers”, as individuals with disabilities, education, language and income barriers, and those with Veteran status who will achieve measurable outcomes in the areas of education, training, job placements/retention and career pathways towards self- sufficiency. For maximum flexibility and efficiency, the MOU is a collection of individually signed and customized agreements with the one-stop system partners. Each MOU describes how the parties will use their various funding streams and resources to serve their mutual customers, youth, job-seekers and employers, through an integrated system of service delivery. In addition to the comprehensive site at the Joplin Missouri Job Center, one affiliate Job Center at Monett and Access points throughout the region. The parties to the MOU understand that the development and implementation of these sites will require mutual trust and teamwork between the partnering agencies.

ONE-STOP CENTER DELIVERY SYSTEMVISION STATEMENT, MISSION STATEMENT AND GOALS

1. Describe the shared vision and commitment of the Local WDB and required partners to a high-quality local workforce delivery system (vision must be consistent with federal, State, regional, and local planning priorities, as well as the Governor’s guidelines).

The Southwest Region WIOA Partnership aims to increase access to and opportunities for employment, education, training and support services, particularly for individuals with the greatest barriers to employment, through stronger alignment of workforce system and other human services systems in order to improve the workforce system. To accomplish this the Partnership agrees to provide an integrated service delivery method that is accessible, customer focused and performance based. Equip job seekers and existing workers with high- quality career training and supportive services needed to obtain and maintain a quality job/career path. And support a system that values all Partnerships and the resources available, through consistent collaboration and communication in order to meet the needs of our shared customers.

The Southwest Region constantly strives to integrate services and provide a seamless system to both job-seeking and employer customers. Staff at the Job Centers often collaborate cross-agency and programs to provide customer services.

Examples:Classroom Training/Pre-Apprenticeship:

• Mercy Hospital PCA Pre-Apprenticeship: Staff Members from WIOA, SkillUp, MWA, and other community partners collaborated to braid funding/resources for tuition, work experience, supportive services, food, housing, and transportation.

Employer Services:• The Job Centers Employer Services Team (EST) (WIOA, SkillUp, MWA, JVSG)

regularly meets to discuss job-seeking customers needing placement. They also discuss employer outreach and ways to promote the Job Centers programs as a whole. Referrals are made within the team to optimize finding the right fit for placement between job-seekers and employers. The EST also participates in the Employer customer centered committees in the region, Employer Link (Serving Eastern Counties) and Business League (Serving Western Counties).

Job Centers Intake/Resource Area:• Staff from multiple Job Center programs work in this area (Wagner-

Peyser, WIOA, Skill Up, SCSEP) to provide customers with self-directed and informational services.

may include mediation efforts by any, or more than one, of the State partner agencies that are members of the Missouri State Public Workforce Council.

The mission of the WIB is to prepare businesses and the workforce for economic prosperity and global competitiveness. This mission is achieved through the categories of talent development, business development, and regional development. To fully seize the opportunities provided in WIOA, the WIB convened two important stakeholder groups at the comprehensive Job Center in Joplin, the Workforce Partners and the Business League.The stakeholder groups share the priorities of expanding the reach of services to more customers in a manner that increases volume and skill outcomes while lowering cost and other barriers to participation. The purpose of the Missouri Job Centers is to advance the economic well-being of the local workforce development region by developing and maintaining a quality workforce. The Local Workforce Boards responsibility is to assist in the development of the MOU among all the required One-Stop Partners. The Local Chief Elected Official (LCEO) must approve this MOU, and all required Partners are signatories. The Infrastructure Funding Agreement (IFA) details how every required OneStop Partner will contribute to non-personnel operating costs. Every required Partner must help subsidize the infrastructure operating costs of the One-Stop Center(s), in a proportionate manner, with cash, non-cash, or third-party in-kind contribution.

Description of services to be provided through the One-Stop Delivery system including the manner in which the services will be coordinated and delivered through the system are described in the following pages.

The Workforce Investment Board of Southwest Missouri (WIB) is an IRS-registered 501 © (3) nonprofit organization, with a seven-county service area composed of Barry, Barton, Dade, Jasper, Lawrence, McDonald, and Newton counties. The WIB oversees employment and training programs at two Missouri Job Centers one comprehensive center located in Joplin and one non-comprehensive center located in Monett.Missouri Job Center Services Basic Career Services- MJCs must provide WIOA basic careerservices to any individual upon request. These are services that must be made available to all job seekers. They include informational and labor exchange services.Individualized Career Services-These are services that must be made available if determined to be appropriate in order for an individual to obtain or retain employment. They also must provide individualized career services and training services to individuals if the frontline service staff determines that the participant needs those services to obtain or to retain employment.Priority for Individualized Career Services for customers funded under the Title I adult program must be provided to participants who are public assistance recipients, other low- income individuals and individuals who are basic skills deficient.Follow-up Services-These services are provided, as appropriate, to participants in Adult and Dislocated Worker activities. Follow-up services must be available and provided as appropriate. Additional service information outlined in the chart on the following page under services.

In order to eliminate duplication of services, the parties to this MOU agree to coordinate the delivery of services and activities to:

• Collaborate and promote the coordinated delivery of services through program integration whenever possible and participate in joint planning at the State and local level.• Coordinate resources and programs to ensure a streamlined and efficient Workforce Development system.• Provide direct access to services through real-time technology.• Promote information sharing and coordination of activities to improve the performance of the One-Stop System in part through the use of data access agreements.• Continue to support and implement the unified system of measuring program performance and accountability.

Coordination will be accomplished by attending regularly scheduled Partnership meetings, Cross training staff, Staff Presentations, Social Media Page for updates and notifications, texting club and regular presence at the Job Center location.

Every Missouri Job Center (MJC) must provide “access” to the programs and services of all required One-Stop Partners. WIOA requires, as a basic career service, the provision of assistance (which the rules more stringently describe as “meaningful assistance”).

Meaningful assistance means:• Providing assistance onsite.• Providing assistance by phone or via other technology.

All Partners staff should assist customers in contacting another Partner agency in order to help them understand the program and any eligibility requirements. Meaningful assistance is not simply providing the customer with a Partner’s name or phone number, or simply supplying a website address, leaving the customer to make contact on his or her own. All Job Center staff are accountable for knowing enough about each required Partner’s available services to give an individual the information needed to make an informed consumer choice as to whether or not to access those services. Our intent of this MOU is to equip all Partner staff with the resources to make those referrals.

Missouri Services NavigatorEach Job Center Staff is required to provide—and to document—Service Referrals. Job Center Staff are encouraged to utilize Missouri’s Services Navigator website to them with making appropriate referrals. All required Partners have access to this website, and it is the preferred source of referral information. It provides good referrals not only to, and from, the local MJC, but among the other required Partners as well. This website is only for staff use.

SectorReady Resource NavigatorThe Southwest Region Workforce Board also developed a “Resource Navigator” on Sectorready.org to assist both Job Seekers and Partner Agencies when referrals are needed. Through this MOU each Partner will be encouraged to enter agency information along with the referral process and contact information for each of their location. Each partner will be responsible for updating their agency information as needed. Invitations have been sent to partners not listed and updates will be facilitated by WIB staff ensuring information is available to our Job Seekers and Staff.

Partner agency staff that identify a participant barrier that they are unable to address should refer participants directly to the most appropriate Partner agency equipped to

barrier. In cases where a Partner agency staff is unsure which Partner is most appropriate to address the barrier, they should refer the participant to the Job Center.

A referral requires communication between the Partner agency and a Job Center Staff, not just communication to the participant.

Minimally, the referral should include: Name—Participant being referred;• Date Contact Made—Date the referring Partner provides referral information

to referred Partner. This is the start of the referral process between Partners;

• Response Received/Date—Response from the referred Partner, acknowledging/confirming the referral; Referral To—Partner organization receiving the referral; and

• Reason for Referral—Why the participant is being referred and/or what services are being sought. Documentation should always be completed with the above referral information in a Case Note, and follow up on referred.

In addition to the referral information above please see Section 6 Systematic Referral Process for Job Center Customers.

In accordance with 20 CFR 678.420, 34 CFR 361.420, and 34 CFR 463.420, each required partner program will:

◆ Provide access to its programs and activities at the Job Center. ‘‘Access’’ to programs and services means having either:

Program staff physically present at the Job Center;Partner program staff physically present at the Job Center, appropriately trained to provide information to participants about the programs, services, and activities available through Partner programs; orA direct linkage by phone, email, or through other real-time, web-based communication to a program staff member with the competency and authority to assist the participant with applying for, or obtaining, program benefits or services.

◆ Provide appropriate career services and work collaboratively to maintain a strong workforce development system.

◆ Participate in the operation of the Center consistent with the terms outlined in this MOU by offering its respective services through on-demand access to the required career services in the most inclusive and appropriate setting and makes necessary accommodations for individuals with disabilities, which are necessary to achieve effectiveness and physical and programmatic accessibility.

◆ Attend Partnership meeting to gain insight on all required programs, coordinate referral process.

All partners will agree to a commitment to share data and technology as allowable by partner agency. This would include sources of data such as customer surveys, specific program and community data. The Southwest Region works with its partners to transition to an integrated, technology enabled intake system.

• The MOJOBS case management system is used by the Missouri Job Center partner staff. Information housed in the system is kept confidential. Reports are pulled for the WDB, or by request of a program manager to assist in program planning and/or day-to-day operations.

• Information on case management and business services are currently accessed via MOJOBS System by multiple programs. Common intake forms are developed where possible, and any gathered aggregate information on performance, service numbers, or other relevant non-confidential information is shared across partners through the Missouri Job Center.

• Specialized aggregate data collection efforts to track special projects such as serving ex- offenders, serving individuals with severe mental illness, or serving homeless customers are developed in collaboration with the relevant parties, and non-confidential information is shared between parties.

By signing this agreement, all partners agree that they will release information as it pertains to Quarterly Partnership Reporting and the continuous improvement process associated with the SW Region Workforce System. NOTE: Partners are encouraged to seek clarification from their respective core partner state agency and/or data staff regarding information needed for this section.

The purpose of this MOU is to articulate the roles and responsibilities of each Party in the creation of a seamless customer-focused service delivery network that integrates service delivery across programs, enhances access to services and improves long-term employment outcomes for individuals receiving assistance. The MOU provides a foundation for assuring alignment and coordination of policies and operations across programs, supporting a responsive service delivery system, enhancing access to program services that meet the workforce development needs of adults and lead to long-term employment outcomes. Programs and services will be coordinated and integrated where feasible by jointly serving common customers, supporting interagency in- service training and providing information and services that most directly meet the customer’s needs.

The Division of Employment Security (DES)

The Division of Employment Security (DES) administers Missouri’s Unemployment Insurance (UI) program. UI programs provide partial protection for workers against loss of wages during periods of involuntary unemployment. The benefits paid to insured workers bolster the economy of the state during periods of economic downturns by helping maintain a degree of consumer purchasing power.

UI programs and activities that fall under the operation of DES include the regular UI program, unemployment compensation for ex-service members, unemployment compensation for federal

employees, the Shared Work program, the Reemployment Services Eligibility Assessment program, Disaster Unemployment Assistance and Trade Readjustment Allowances, including Reemployment Trade Adjustment Assistance.

WIOA requires that claimants receive meaningful assistance with filing a claim for unemployment insurance. Meaningful assistance means:

• Providing assistance on-site using staff who are well trained in unemployment insurance claims filing and the rights and responsibilities of UI claimants; or

• Providing assistance by phone or other technology, as long as the assistance is provided by trained and available staff and within a reasonable time.

To meet the requirement to provide meaningful assistance to UI claimants in need of help filing a UI claim, MJC staff must be familiar with the DES online claims filing system and the rights and responsibilities of UI claimants to the point of being able to help them understand DES publications and correspondence. Additionally, a priority phone line is maintained in each MJC for claimants to speak directly with DES staff with little to no wait.

An electronic feedback system is in place for MJC staff to refer potential UI eligibility issues to the DES for investigation.

Post-Secondary Career and Technical Education under Perkins

Support and expand the availability of high-quality work-based learning opportunities for all individuals and employers.

The WIB will include Perkins Program Staff to participate in established Regional Business League Meetings and Partnership Meetings in order to work with employers and associations, K- 12 and post-secondary educational institutions, local board and others.

o Assist to identify and develop work-based learning opportunities that lead to future employment or credential attainment.

o Encourage Teacher Internships with Employerso Utilize Supportive Services for eligible participants in work-based learning,

WIOA (20 CFR 678.700 through 678.755) requires all one-stop partner programs to contribute to infrastructure funding of the one-stop system.

Attachment I: Infrastructure Budget/Agreement defines these costs for the Joplin Comprehensive One-Stop Center. All formal cost sharing agreements are negotiated and executed as a separate instrument for the relevant parties. All agreements will ensure services are provided seamlessly and without duplication, expand the one-stop system capacity and accurately represent each partners contribution to the system.

Co-located partners include any program that is placing staff members in the same facility that is identified as a comprehensive one-stop center by a local board. Infrastructure cost were determined by the following:• Based on the number of Partner staff members active at the center.• A usage percentage shall be determined by calculating the full-time equivalent (FTE) of

the partner program divided by total FTE of all programs in the center.• That percentage shall be multiplied by the sum total of infrastructure costs of:

rent/lease, utilities, maintenance, General IT (excluding capital equipment purchases and non-shared subscription services) and phone.

• An annual allotment will be determined based on the usage percentage multiplied.Non-co-located partners include all partner programs referenced in WIOA section 121 (Ozark Area Community Action Corporation does not provide employment and training activities carried out under the Community Services Block Grant referenced in WIOA 121) who do not have staff physically located at the identified comprehensive one-stop center in a local region. These partners will provide an in-kind service in lieu of cash payment for one day per month at the Job Center.

The MOU must also include contributions made to the One-Stop System through other avenues, such as donations made by a non-partner entity (e.g., a local business donating computers for a learning lab). Third-party in-kind contributions made to supplement the operation of the American Job Center must also be documented.

No additional contributions are made to the Southwest Region One-Stop System.

WIOA defines infrastructure costs to be non-personnel costs related to the delivery of services in a local region and can include:

Infrastructure cost were determined by the following:• Based on the number of Partner staff members active at the

center. or• The Partners can agree to provide a proportionate share of staff time or cost

for common functions. Staff time or cost will be contributed in the same proportion as the staff located in the Center.

In addition to jointly funding infrastructure costs, one-stop partners must use a portion of funds made available under their programs’ authorizing Federal law (or fairly evaluated in- kind contributions) to pay the additional costs relating to the operation of the one-stop delivery system, which must include applicable career services.

Shared service costs may include the costs of shared services that are authorized for, and may be commonly provided through, the one-stop partner programs to any individual, such as initial intake, assessment of needs, appraisal of basic skills, identification of appropriate services to meet such needs, referrals to other one-stop partners, and business services.

These shared costs must be allocated according to the proportion of benefit received by each of the partners, consistent with the Federal law authorizing the partner’s program, and consistent with all other applicable legal requirements, including Federal cost principles in chapter II of title 2 of the Code of Federal Regulations (or any corresponding similar regulation or ruling) requiring that costs are reasonable, necessary, and allocable.

Appeals - If a One-Stop Partner’s appeal to the State regarding infrastructure costs, results in a change to the One-Stop Partner’s infrastructure cost contributions, the MOU must be updated to reflect the final One-Stop Partner infrastructure cost contributions.

Referrals do not imply automatic eligibility; the result of the referral is dependent on eligibility determination by each partner based on their unique program guidelines and fund availability.

Referral should be seamless. Referrals must not be based on “sending a customer to a program,” but rather making services from programs available to customers based on their individual needs and the career pathway that has been identified in their plan. The partners agree to conduct referral for services in the following manner, whenever possible:

1. Each party will have information on and receive training about the services of all Partner agencies within the One-Stop System.

2. Customers accessing services through the One-Stop System will receive assistance in determining which of the Partner agencies may have services that will benefit the customer and will be provided an appropriate referral and means to contact said Partner program.

3. Staff will make appropriate referrals depending on each customer’s individual needs, eligibility requirements, and other support services. Referrals will be made to Partners/outside agencies based on intake and assessment and a determination of appropriateness.

a. All customers referred for services will receive a written referral form with the date, time, and place of the appointment. A copy of the referral form will be given to the customer and to the referring organization (via fax or email). The statewide workforce management information system through OWD may facilitate this process virtually in the future

b. All appointments will be scheduled within three (3) working days.c. The individual making the appointment will follow up within two (2) working days

of the scheduled appointment date.

The One-Stop Operator will provide oversight and coordinate the referral process among the required partners. This includes the development of a system-wide referral form. While the majority of referrals will originate in the Job Centers, other workforce development partners that are not occupying space in the Job Centers will initiate the referral utilizing the approved form. Referral reports will be reviewed and discussed during each Quarterly Partnership meeting by the One-Stop Operator. The One-Stop Operator will ensure partners update referral information in MoJobs (if Available) and the Resource Navigator.

See Chart Section 3.

One-Stop Operator will gather all referrals after each Quarterly Partner Meeting, tally the information and return the total referrals made to each partner in no more than one week after the meeting.

applicable requirements imposed by or pursuant to regulations implementing those laws, including but not limited to 29 CFR Part 37 and 38.

Access – The MOU must include methods to ensure the needs of workers, youth, and individuals with barriers to employment, including individuals with disabilities, are addressed in providing access to services, including access to technology and materials available through the One-Stop System.

Partners will assure the physical accessibility of the Comprehensive One-Stop Center(s), including the following:The Comprehensive One-Stop Center’s layout supports a culture of inclusiveness, Annual ADA compliant monitoring is currently conducted by the Independent Living Program.

The location of the Comprehensive One-Stop Center is recognizable in a high-traffic area, located in the middle of Joplin at 730 S Wall St. Joplin MO. Access to public transportation is available within reasonable walking distance, Joplin Trolley stops are located within 4 blocks of the Job Center. The location of a dedicated parking lot, with parking lot spaces closest to the door designated for individuals with disabilities are located on the north and south side of the building.

Programmatic accessibility is gained through accommodations made via such things as adjustable tables, and altering computer screens for text size and color. Staff have been trained on how to fulfill general requests for accommodation, as well as what to do if they do not know how to make the accommodation themselves.

Additionally, staff receive regular training focused on various protected classes/minority groups. Monthly trainings have included such topics as mental health first aid, age discrimination, service animals, unconscious bias and LGBTQ inclusion. Partner agencies and experts are consulted and sometimes deliver the trainings. Other trainings are conducted by the local EO officer.

The Missouri Job Center System will ensure access for individuals with barriers to employment By providing a direct link or access to other Missouri Job Center Partner staff that can provide meaningful information or service, through the use of co-location, cross training of Missouri Job Center staff, or real-time technology (two-way communication and interaction with Missouri Job Center Partners that results in services needed by the customer). The Southwest Region currently utilizes Google connect to provide services in outer areas along with 18 Access Point locations within the region to access Job Center Basic Services.

Access Points in the SW Region

The Missouri Job Center partners have a commitment to:

Offer priority for services to veterans and recipients of public assistance, other low-income individuals, or individuals who are basic-skills deficient when providing individualized career services and training services with WIOA adult funds.

Ensure their policies, procedures, programs, and services are in compliance with the Americans with Disabilities Act of 1990 and its amendments, in order to provide equal access to all customers with disabilities.

Promote capacity building and professional development for staff in order to increase awareness and understanding of serving individuals with barriers to employment and individuals with disabilities. Americans with Disabilities Act and Amendments.

We agree that the Partners will develop commonly accepted expectations for customer service and engagement that are compliant with each individual entity’s employee policies. Each Partner will incorporate those expectations into their own employee-performance system and agree to conduct periodic performance reviews in accordance with the requirements of their organization.

The Parties will establish, implement and maintain written grievance procedures as outlined inWIOA to ensure enforcement of non-discrimination and equal opportunity provisions within the One-Stop System. Until stated differently the partners will follow Attachment 3 OWD Issuance 09-2012.

All partners will agree to the confidentiality policy set forth by the Office of WorkforceDevelopment and the policy of the WIB. Authorized staff will receive training and sign the confidentiality statement. All correspondence sent by email and fax will adhere to the confidentiality statement as set forth in the OWD Issuance 01-2008, Change 2 (see

The parties agree that the terms of this MOU as a whole will take effect as of July 1, 2020 and will continue in effect until June 30, 2023 or such time as any party will modify, extend, or terminate this MOU. Amendments to the MOU may be made upon consensus of all parties at least 30 days prior to the effective date of the change. The terms of the cost sharing are negotiated under a separate agreement.

The terms of the shared funding of infrastructure costs agreed to in Section IV will take effect as of July 1, 2020 and will continue in effect until June 30, 2023 or such time as any party will modify, extend, or terminate that subpart of this agreement.

If any part of this MOU is found to be null and void or is otherwise stricken, the rest of this MOU shall remain in full force and effect until renegotiated or rewritten.

Amendments to the MOU may be made upon consensus of all parties at least 30 days prior to the effective date of the change. Partners will be notified by email. The terms of the cost sharing are negotiated under a separate agreement.

This MOU may be amended upon mutual agreement of the parties that is consistent with the federal, state or local laws, regulations, rules, plans or policies or for one of the following reasons:1. The addition or removal of a partner from this MOU.2. Removal or addition of program responsibilities for any partner that administers more than one federal program.3. A change in the one-stop operator or a change in the physical location of the comprehensive one- stop center.4. A change in the services, service delivery methods currently utilized, referral methods, or methods to allocate costs.

Within 90 days prior to the end date of this MOU, the partners shall review the MOU and negotiate any needed changes to the provisions herein at a minimum of every three (3) years. The partners shall collaboratively evaluate the effectiveness of operations pursuant to this MOU, make any necessary modifications and renew the MOU for a term to be determined at the time of renewal.

Should there be any significant changes to the agreement before the expiration date, a meeting of the partners will be called for review and negotiation of a new MOU.The Parties seeking an amendment will submit a written request to the WIB of SWMO that includes:

• The requesting party’s name.• The reason(s) for the amendment request.• Each Article and Section of this MOU that will require revision.• The desired date for the amendment to be effective.• The signature of the requesting party’s authorized representative.

If the request is approved, the WIB of SWMO will notify the remaining parties of the intent to amend and will provide each remaining party thirty (30) days from the date of the notice (unless another time frame is specified in the notice) to review the anticipated changes and to submit a response WIB of SWMO. Failure by a party to respond within the prescribed timeframe will be deemed that the party has accepted the proposed changes.

In the event that a remaining party has questions and/or concerns regarding the proposed amendment, the party must list its questions and/or concerns in writing and submit the list to WIB of SWMO within the specified timeframe.

WIB of SWMO will review the listed questions/concerns and will issue a response within fifteen(15) days of receipt of the list. If WIB of SWMO deems it necessary, the listed questions/concerns will be sent to all other parties and/or a meeting with all parties will be scheduled to discuss the proposed changes and to achieve consensus on a final amendment draft.

The final, approved amendment draft will be signed by authorized representatives of the affected partners, then submitted to WIB of SWMO for the final signature.WIB of SWMO will distribute copies of the fully executed amendment to all Parties.

Any party to this agreement may cease participation in the agreement. Any party that intends to cease participation must notify the other parties to the agreement at least 30 days prior to the effective termination date.
