2. General Clarifications To Questions From Bidders
Q1. Reference to Tender Call Document, Section 4 -Scope of Work:
Please clarify the set milestones for the project completion (page 44 of 141), for demolition by August 4, 2016 and Archeological by December 20, 2016 , in relation to the following constraints:
a) What is the anticipated approval time for pre-installation submissions of 100 Ton Chiller package, stamped demolition and monitoring plan (a condition of demolition permit), engineered hoarding drawing?
Please note that building demolition may not commence until asbestos abatement procedures and commissioning of mechanical services are completed.
A1. a.) This is for the General Contractor to schedule accordingly. The Contractor shall provide Shop Drawings for Consultant review to suit meet the Contractor schedule and identify reasonable time for provisions, review, and return of shop drawings. Allow a minimum of 10 Working days. Contractor schedule to reflect all activities immediately after award to achieve milestone dates. Please note that the statement about commissioning of mechanical services in Q1 is not correct. The general contractor has other means and methods to address this item.

Q2. The time frame required to obtain street occupation permit, traffic control, utilities and
other permits from authorities having jurisdiction specified in various sections of the documents.
What is required by right of way permits, air encroachment agreement, hydro permits, overhead insulation of power lines, lifting permits related to this project (43 of 141)? Where is the use of adjacent land required by this project (Section 011000-1.16)?
A2. The General Contractor is to contact Authorities Having Jurisdiction (AHJ) and Utilities and schedule accordingly. General Requirements, Section 01 10 00-1.16 As specified any required access to adjacent lands Municipal or private are the responsibility of the Contractor to seek and get approval directly from those respective land Owners.
Q3. What is the time required for preparation of construction staging plan, contractor mobilization and award of subcontracts?
A3. It is the General Contractors responsibility to meet the Project Deliverable date confirmed by
the bidder at time of Tender submission. Q4. Will the Hall Facility continue to be occupied' (42 of 141)? Please revise loading dock delivery schedule from 2015.
A4. The loading dock is to be available to the Hall at all times unless scheduled in advance by the
General Contractor and approved by the City. The GC does not have exclusive access to this area. It is only on a temporary as needed basis for the shortest duration possible. An updated schedule will not be provided.
Q5. What are the Contract security/bonding requirements for the pre-qualified subcontractors, including for the extended 24 month warranty period?
A5. Section 5 – Supplementary Conditions: Refer to page 79 of 141 and Section 5A – Specific
Conditions page 94 of 141 for insurance provisions as identified.
Q6. Please specify 'Other Contracts' that may take place within the construction limits during the project duration (91 of 141) and impacts on project milestones?

Q7. Clarification is required on Archeological monitoring services for the removal of existing Service Tunnel, temporary chiller services, test pits and the time frame required for MTCS, HPS approvals (Section 01 4000-1.15.1.1.2). A7. The Pre – Approved Archaeological Sub Trade is responsible to carry out the monitoring
services as required by the Authorities Having Jurisdiction (AHJ) as specified for the duration of the test holes, and any excavation required to complete the enabling Works to install the permanent chiller and any excavation. There is no reference to approvals in the section referenced by the bidder question.
Q8. What is the intent of a reference to Winter Archeology Document in Section 01 4501?
Is this for the scope of work if the project duration is anticipated to extend through the winter. If so, please define the work for 'keeping site properly drained (Section 01 5000- 1.2.5), discharges of pollutants/contaminants (93 of 141) defined under the pre-qualified Archeological subcontractor's operations.
A8. All cost related to the requirements of Winter Archeology are to be included in the Total cost
of Work submitted by the General Contractor should the Contractor schedule dates confirmed with the Tender submission extend into the period as per the referenced MTCS 2013 Document. The General Contractor and Sub Contractors are responsible to meet all of the requirements for discharging any water pumped or otherwise to meet the requirements of all municipal and AHJ requirements.
Q9. Please clarify 'The Owner shall be reimbursed by the Contractor .... as the result of such delay, including all services required from the Consultant' in relation to the above- mentioned project restraints.
A9. We are not clear on your question. Require reference page in order to clarify this question.
Q10. What is required by 'utilities found by locates' and who is responsible for locates (46 of 141 and Section 01 10 00-1.19)?
A10. The General Contractor is responsible for all locates.

A11. The scope of work is reflected in the completed set of Contract Documents in its entirety. Specifications are only divided by division for convenience. Assignment of work items is a contractual arrangement by the General Contractor and his Sub-Contractors.
Q12. Please provide information for Division 21 - Fire Suppression, on mechanical drawings?
A12. No fire suppression scope is anticipated.
Q13. List of Manufactures Equipment: Does the Roof mounted Air Cooled chillers refer to Temporary 100 Ton chiller on concrete pad? Is any of these equipment pre-selected or readily available for the project?
A13. Yes, “roof mounted air cooled chiller” is the permanent exterior air cooled chiller. Refer to the
project technical specifications 23 64 29.00 and the bid form. The permanent chiller has not been pre-ordered.
The bidder shall indicate which manufacture is carried in the bid form, if this is not indicated, the described base equipment (top name listed) shall be furnished under this contract. Section 23 64 29.00 – ROOF MOUNTED AIR COOLED CHILLERS

its right to conduct cleaning and back charge the General Contractor for all costs of this service.
Q16. Section 01 1000-1.5: Please clarify the requirement of a Land Surveyor, Property Survey and Pest Control (01 5000-1.7.3) in pertinent to this project.
A16. The General Contractor is responsible to maintain iron pins, survey bars, monuments,
geodectic datum's, and similar reference markers which maybe disturbed moved or lost during Demolition Work.
Pest Control (01 5000-1.7.3) The General Contractor is responsible at time of the Work to conform as specified.
Q17. Section 01 5000 -1.7.1.3:- Is any structural shoring work required? Please confirm 'Available
Information 1.2.9: Memorandum from Alstom Associates regarding shoring is not relevant to this project.
A17. Temporary Facilities and Controls - Section 01 50 00 refers to the Contractor work plan
(means & methods) to under take the Work. Any Structural shoring or other means and methods the contractor requires are to be designed and under the supervision of the General Contractors Structural Engineer. With regards to 1.2.9 Alstom Report, any shoring is to be designed by the Shoring Contractor if required.
Q18. d) Section 00 50 00- 1 .3: Please clarify that the site office to accommodate 20 persons and sanitary facility with closets, urinals, basins are not relevant to this project.
A18. d.) Revise the contract documents to read "The General Contractor shall provide the required
trailer(s) and sanitary facilities to meet their needs and conformance with any OHSA requirements or other Authorities". The 20 person trailer facility is not required however the trailer must be large enough to accommodate site meetings.
Q19. The concrete precast roofing is covered with some texture material. Please verify if it is

A19. Please refer to the Pre-Demolition Survey Reports #13.1.6 by ECOH Management dated
December 19, 2011 and #13.1.10 ECHO Inc. dated May 8, 2014 for 92 Front Street East in the available information section of the documents page 51 of 141 for all designated substances. (Items # 1.2.6. and 1.2.10 on the disk).
Please also refer to the Pre-renovation survey reports for 157 King Street #13.1.12 by ECHO dated December 18, 2015 and #13.1.11 Annual Survey dated June 30, 2015 in the available information section of the documents page 51 of 141 for all designated substances. . (Items 1.2.11 and 1.2.12 on the disk).
Q20. Reference to Drawing. LD-100 Note at top left of the drawing indicates “Existing Granite paving to be removed and stored. Storage location TBD by owner”. Please indicate total plan area of Granite paving to be removed.
A20. For further clarity, granite paver sets to be crated and shipped for storage are located within
the hoarding area to the north of the existing building and the entire loading area of the Hall. Q21. Item No. 3 on the Pricing Form – Itemized Prices, found on page 38 of 141 in the Tender
document indicates $25,000 as the ‘Cost for the Final Archaeological Report preparation, assembly, submission and approval of the Ministry of Tourism, Culture and Sport and the City of Toronto Heritage Preservation Services’. It is not clear how this dollar amount was derived. Based on the Archaeological Sub-Contractor’s experience with the completion of large, complex urban Stage 4 Archaeological Assessment Final Reports, this dollar amount is entirely inadequate. Please remove this amount from the itemized pricing list.
A21. Refer to Revision 5 above. The amount will not be removed from the bid form.
Q22. Please define what liquidated damages are part of this Tender Contract A22. Refer to Section 5 Supplementary Conditions: Zero (0) dollars is specified for Liquidated
damages. Refer to page 71 of 141. Q23. Please add the following sentence, indicated in bold to Section 02 21 13.23, Sub-Section
3.5.5, ‘Assist with developing a strategy for conveying the history of the St. Lawrence Market and the Old Town including the archaeological evidence to the public with the new development, in accordance with the Heritage Interpretation Plan for Old Town Toronto 2013.’ Assume 80 hours will be required for this task.
A23. This scope of work is a deliverable of the contract and the bidder(s) are to price accordingly for

3. Clarifications
1. Section 4, Scope of Work, Page 52 of 141 item #13.1.23. Environmental Sampling – Archaeological Stage 2 and 3 Investigation dated October 26, 2016 authored by MMM is reissued in its entirety due to corruption of Figure 3 diagram on some disks. (Item # 1.2.23. on available information disk) Enclosed 32 pages.
2. Refer to drawing AD1.51 Rev B, at interior partition removals and slab removal, the intent is
for the contractor to remove the greatest extent of slab as close as possible to existing footing location. The graphics on plan / section details are only to illustrate that the below grade structure is not to be disturbed with the building demolition scope.
3. Time is of the essence and the General Contractor shall approach this contract in such a way
addressing appropriate means and methods to meet the schedule as defined in Section 4, Scope of Work, on page 44 of 141. The General Contractor must consider the possibility of acquiring a rental chiller unit while waiting for delivery of the permanent chiller unit. Delay to the schedule will not be accepted by the City due to lead times for the permanent chiller.

and Private Trees in Conjunction with Proposed Re-development of the St. Lawrence Market North Building Site at 92 Front Street East, Toronto
1.0 Introduction This report has been prepared to provide details on the extent of crown pruning work and other injury-mitigating measures that are to be undertaken for a number of by-law protected trees to facilitate demolition of an existing building and to construct a new building structure, known as St. Lawrence Market North, at 92 Front Street East, Toronto. Our services have been retained to undertake an assessment of fourteen trees and to determine the extent of crown pruning work and any root pruning that may be necessary to provide sufficient space to install City-approved site hoarding and to both demolish the existing building and construct the replacement building structure. Each of these fourteen trees, along with other trees surrounding the subject lands, were previously assessed for this project. Tree assessment findings on species, size, health condition, location and other factors were presented for all trees on a Tree Inventory & Landscape Removals Plan, drawing no. L-100, prepared by Quinn Design Associates Inc. Our tree assessment work was completed on Wednesday, April 20, 2016 using the drawing for reference. Thirteen of the fourteen trees are located on City-owned lands, either on lands south of the existing St. Lawrence Market North building, or on the abutting City-owned Market Square lands. These thirteen City-owned trees are identified as trees #8, 9, 10 and 17 – 26 on the provided plan. In addition to these trees, one private tree (tree #13 in this report) was assessed on private property in conjunction with this assignment. The private specimen, a 42.5cm dbh littleleaf linden (Tilia cordata), is located north of the northwest corner of the proposed building. All trees were inspected from the ground only with botanical health of deciduous tree cover assessed based upon bud development. It may be prudent to re-inspect each deciduous specimen during the upcoming growing season to better evaluate its vigour. Trees were tallied by tree number, common name, botanical name, dbh, health condition, by-law applicability and tree dripline (m)/required Tree Protection Zone (TPZ). Photographs are presented in this report of the fourteen trees, crown sections to be pruned back and prescribed areas for tree protection hoarding installation. Detailed information on all trees is provided in Appendix A – Tree Inventory Data. Management recommendations were made on removal, protection and maintenance work based on the trees health and/or anticipated adverse construction effects upon the tree.

2.0 Assessment of Potential Impacts and Tree Management Requirements Crown pruning work necessary to facilitate site hoarding installation and to construct the proposed building structure will require crown pruning work on a number of the fourteen assessed trees. With one of the tallied trees (tree #26) to be removed in conjunction with building demolition works the remaining thirteen trees are scheduled for retention. All of the retained trees are expected to endure any ill effects of crown pruning work and subsequent building demolition and construction activities due to the species’ intrinsic tendency to endure ill effects of crown pruning work and due to the manageable extent of crown pruning work that appears required. Ten of the thirteen retained trees will require at least some crown pruning work to facilitate construction. One of these trees (tree #19) is expected to incur significant adverse effects from crown pruning work, with up to 1/3 of its crown to be pruned back, whereas two trees (trees #20 and 22) are anticipated to incur notable effects from pruning work, seven trees (trees #9, 13, 18, 21, 23, 24 and 25) minor crown injury and three trees (trees #8, 10 and 17) no crown injury to undertake scheduled works. In addition to crown pruning work necessary to clear branching back from the building structure, all of the retained trees should also be subject to general crown pruning to remove crown deadwood and interfering cross-branching, balance their respective crowns, etc. All crown pruning and root pruning (tree #13) work is to be completed in accordance with good arboricultural standards, as set out by the International Society of Arboriculture (ISA). Details on the extent of crown pruning work for each tree is provided in Appendix A. In addition to the thirteen City-owned trees, there is a private littleleaf linden (tree #13) that is expected to incur minor crown and root injury in conjunction with construction of the northern extent of the proposed building structure. Injury-mitigating measures to be initiated for protection of this tree include crown pruning work, hoarding installation, hydro-vacuum operations or hand-dug excavation, and subsequent root pruning activities. It will be necessary to conduct a site meeting between the tree care contractor retained to carry out crown pruning works and designated building officials who are familiar with the extent of space requirements needed for demolition of the existing building as well as construction of the proposed taller structure. The Toronto and East York District Office of Urban Forestry, Tree Protection and Plan Review (416-392-7391) should be contacted at least one day prior to any crown pruning or other tree work that may have any impact upon a tree(s). The retained tree care company should be certified with the ISA or other qualified arboricultural industry association, be familiar with ISA pruning standards and the pruning standards of the City of Toronto’s Urban Forestry Services and preferably have at least 10 years of experience providing professional arboricultural services within the City of Toronto. Subject: Environmental Sampling - Phase 2/3 Archeological Investigation 92 Front Street East, Toronto, ON
MMM Group Limited (MMM) was retained by the City of Toronto, Facilities and Real Estate Department (the “City”) to complete supplemental soil sampling and site observations during the Phase 2/3 Archeological Investigation at 92 Front Street East, Toronto, Ontario, (the “Subject Property”). The investigation was conducted by Golder Associates (Golder) under contract with the City. The location of the Subject Property is illustrated in Figure 1.
The purpose of the supplemental sampling is to assist in the further characterization of soil for offsite soil management during planned construction activities. This letter presents the findings of the environmental sampling prior to and during the Phase 2/3 Archeological Investigation.
Background
A 2006 environmental investigation [CRA 2006] identified concentrations of lead and several polycyclic aromatic hydrocarbons (PAHs) exceeding the Ontario Ministry of the Environment (MOE – now Ministry of the Environment and Climate Change (MOECC)) Table 3 standards [MOE 2011] for industrial, commercial and community (ICC) land uses, which are applicable to the Subject Property. The contaminants were identified in soil at the northern (lead) and southern (PAH) portions of the Subject Property. A 2012 supplemental Environmental Subsurface Investigation [MMM 2012] included environmental sampling in association with a geotechnical investigation. The Environmental Subsurface Investigation didn’t identify further soil impacts or groundwater impacts. No methane was measured in the two subsurface vapour samples collected at the Subject Property.

In conclusion, the identified impacts from past investigations consisted of:
Concentrations of several PAHs at two boreholes (BH02-06 (0.61 to 1.22 m) and MW01-06 (0.61 to 1.22m), exceed the applicable MOECC Table 3 standards; and
Lead was detected at one borehole (BH05-06 (0.09 to 0.61 m)), at a concentration that marginally exceeded the applicable MOECC Table 3 standards.
The previous investigations included eight samples submitted for analysis of petroleum hydrocarbon compounds (PHCs) and volatile organic compounds (VOCs). These samples were recovered from various depths across the site and results indicated only very low concentrations of these contaminants in soil with no concentrations exceeding the most stringent MOECC Table 1 background standards. Therefore, PHCs and VOCs are not considered contaminants of concern at the Subject Property.
Phase 2/3 Trench Investigation
The Phase 2/3 Archaeological Investigation was completed at three pre-determined trench locations from August 31 to September 18, 2015. MMM field staff provided part-time site supervision during the soil excavation portions of the archaeological investigation and collected soil samples from the trenches to supplement the data collected during previous environmental investigations. The soil sampling was based on a judgemental sampling approach as identified in the then Ministry of the Environment document [MOE 1996].
Each trench was excavated by Petrie Contracting Ltd, measuring 1.0 m wide by 15.0 m long at the locations shown on Figure 2. The concrete floor was cut in the trench areas on August 31, 2015 and the slabs were removed from each area using a rubber tire backhoe fitted with a smooth edged/toothless bucket. The excavations of the three trenches were completed between September 1 and September 4, 2015. A MMM field person was onsite at times during the excavation works to observe site conditions and collect soil samples from each trench.
Seven soil samples were recovered and submitted for chemical analysis. Two soil samples were recovered from each of Trench 1 and Trench 2 with one sample representing fill material and one sample representing native soil from the deepest location of each trench. Three soil samples were selected from Trench 3; each sample represented fill material distributed to assist in the delineation of the previously identified contaminated fill.
Soil samples were placed into laboratory supplied sample jars, labelled with unique identifiers, and stored in a cooler for transport to Maxxam Analytics Inc. in Mississauga, Ontario for chemical analysis of metals, inorganics, and PAHs. Maxxam has been accredited by the Canadian Association for Laboratory Accreditation (CALA). Certificates of Analysis are provided in Appendix A.
The three trenches were backfilled with the excavated soil on September 18, 2015 after the archeological investigation had been documented and was observed by MMM to be generally in reverse order of removal.

Discussion of Results
In general, soil composition at the three trench locations was similar. The overburden soils were classified as sand to silty sand fill material including rubble consisting of red brick, ceramics, rock and gravel. The fill layer was observed to extend from 0.13 to 1.17 m below grade. The fill rests on a stratum of native silty clay soil which includes trace to some sand and a trace of gravel. The trenches were advanced to a maximum depth of 1.6 m below grade. No groundwater was encountered during the excavation works.
The results of analysis from past and current investigations were compared to the MOECC Table 3 standards for ICC land uses. A summary of the soil impacts for the Subject Property is provided in Table 1. The results for metals, inorganics and PAH analysis are presented for all sampling locations in Table 2 (2006 results) and Table 3 (2012 and 2015 results). The spatial distribution of contaminants is shown on Figure 3.

Samples of native soil were recovered at five locations and the concentrations of sampled parameters met MOECC Table 3 ICC standards. A comparison to more stringent standards indicates that not all native soil is suitable for use as inert fill (MOECC Table 1 background standards) or at a site accepting backfill (MOECC Table 2 residential, parkland or institutional standards) due to elevated values of electrical conductivity and sodium adsorption ratio. Additional sampling would be required to segregate impacted native soil from soil that could be managed as inert fill.

Fill samples from 15 locations were submitted for analysis of metals, inorganics and/or PAHs. Results show that 45% of the fill samples are contaminated with concentrations of parameters that exceed the MOECC Table 3 ICC standard. Based on spatial distribution of these samples, they represent soil under approximately 60% of the building. Because the characteristics of the fill material appear to be similar at each sampling location, segregation of material would require extensive sampling at the time of remediation. Previous analysis indicated that the soil would be classified as solid, non-hazardous waste.
Previous estimates of soil quantities were based on two discrete contaminated areas. However, observations of the fill removed from the trenches suggest that segregation of impacted and non-impacted fill will not be feasible. An average thickness of fill of 1 m (observed to range from 0.6 m at the north end to 1.4 m at the south end of the building) under the entire building footprint would result in an estimated volume of 2,000 m3. If subsequent investigations (either archaeological or environmental) identify areas with different physical properties, additional sampling may be conducted to help refine the estimates of soil volumes requiring management as waste.
Conclusions
A review of the current and previous soil quality sampling programs at the Subject Property, indicated that fill material has been impacted by metals, inorganics and PAHs. The soil impacts appear to be present within silty sand fill material containing concrete and brick fragments that is present under most of the building. It is recommended that a quantity of 2,000 m3 of fill to be managed as waste be included in construction planning for the site.

PHASE II ENVIRONMENTAL SITE ASSESSMENT (PHASE II ESA)

1. EXCLUSIVE USE BY CLIENT
This Report was prepared for the exclusive use of the client identified as the intended recipient. Any use of the report by any other party without the written consent of MMM Group Limited is the sole responsibility of such party. MMM Group Limited accepts no responsibility for damages that may be suffered by any third party as a result of decisions made or actions taken based on this Report.
2. SCOPE, TERMS AND CONDITIONS OF
CONTRACT
The observations and investigations (hereinafter referred to as the “Work”) upon which this Report is based were carried out in accordance with the scope, terms and conditions of the contract or the proposal pursuant to which the Work was commissioned. The conclusions presented in the Report are based solely upon the scope of services described in the contract or the proposal and governed by the time and budgetary constraints imposed by them.
3. STANDARD OF CARE
The Phase II ESA was carried out in accordance with generally accepted environmental study and/or professional practices, industry standards and applicable environmental regulations. No other warranties are either expressed or implied with respect to the professional services provided under the terms of the contract or proposal and represented in this Report.
4. SCOPE OF THE PHASE II ESA
A Phase II ESA is conducted to obtain information about environmental conditions in the land or water on, in or under the subject property. This Report has been prepared based on information obtained at discrete borehole, test pit, monitoring well, or other (e.g., surface water) sampling locations. The conditions reported herein were those encountered at the subject property at the time the Work was performed and as present at the discrete sampling locations. Conditions
between sampling locations may be different than those encountered at the sampling locations and MMM Group Limited is not responsible for such differences.
5. REASONABLE CONCLUSIONS
The conclusions of the Phase II ESA regarding the environmental conditions at the subject property are based on the investigations conducted during the Work and information from other sources as may be indicated in the Report. The accuracy of information from other sources was not verified unless specifically noted in the Report, nor was it determined if the reviewed information constituted all information that exists and pertains to the subject property.
The conclusions made are based on reasonable and professional interpretation of the information considered. If additional information concerning environmental conditions of relevance to this Report is obtained during future work at the subject property, MMM Group Limited should be notified in order that we may determine if modifications to the conclusions presented in this Report are necessary.
6. REPORT AS A COMPLETE DOCUMENT
This Report must be read as a whole and sections taken out of context may be misleading. If discrepancies exist between the preliminary (draft) and final versions of the Report, the final version of the Report shall take precedence.
7. LIMITATION OF LIABILITY
MMM Group Limited’s liability with respect to the Phase II ESA is limited to re-performing, without cost, any part of the Work that is unacceptable solely as a result of failure to comply with industry standards. MMM Group Limited’s maximum liability is limited in accordance with terms in the original contract, provided that notice of claim is made within regulated timelines as of the date of delivery of the Report.
