Re: Partial Surety Bond Release, The Cove at Strong Creek, File #S 1597-08

The Cove at Strong Creek is a 9-lot plat/planned unit development located off Old Priest River Roadon the Pend Oreille River. The subgrade and base course for the subdivision roads were constructedand as-builts approved by the Bonner County contract engineer. RE: THE COVE AT STRONG CREEK S1597-08 - REVIEW OF ENGINEERED IMPROVEMENTS

Dear Mr. Ollerton:

In accordance with the July 18,2017 Work Order from Bonner County Planning Dept. to J-U-BENGINEERS, Inc. (J-U-B), I have reviewed the submitted package of completion of engineeredimprovements for The Cove at Strong Creek, pursuant to Condition C-4.

Condition C-4 states that, "Prior to final plat recording, all roads within the subdivision shall meet the

latest private road standards for a "B" standard private road, consistent with Title 12, Appendix A,Bonner County Revised Code. The road improvements shall be constructed and certified in writing by aprofessional engineer as complete, in accordance with the private road standards, prior to recording thefinal plat. Two copies of the engineer-certified final road construction report and as-builts, pursuant toSection 3.8 of Appendix A, shall be submitted to the Planning Department prior to final plat approval.The private easements serving the subdivision shall be dedicated to the homeowners association on the

final plat, to the satisfaction of the Bonner County Planning Department."

Tim Blankenship, P.E. has provided the Required Inspection and Information Checklist with a signedCertification of Completion and As-Built drawings (signed 7/12/2017). For compliance with BonnerCounty Revised Code (BCRC), I recommend the applicant provide information regarding the following,prior to approval;

1. Horizontal curvature information; the minimum 50-ft centerline radius cannot be verified. (BCRC§12 Appendix A.2.5.A)

2. Road Name signage; "no new private road...shall be considered completed until a road name signhas been installed" (BCRC §12 Appendix A.3.6.A)

Based on J-U-B ENGINEERS, Inc. letter dated July 19,2017, Martin Taylor email replied the same daynoting that project signage was previously approved in the surety agreement.

Updated as built drawings were submitted with centerline radius information displayed and theminimum 50-ft centerline radius is now confirmed with those plans.

Based on the above, it appears that Condition C-4, for the above-mentioned project, is complete.

Dear Matt:

Please find the attached gradation tor Top Course (3/4" Base Rock) from the Bodie Canyon Gravel Pitlocated near Priest River. The contractor would like approval for this material for use as Top Course forthe proposed private road.

This material is very close to, but does not meet the County specification for. Top Course. The materialhas only 22% passing the "8 sieve where 30% to 50% required.

The material does meet the ITD gradation for A Base Rock and is commonly used in TTD pavingprojects. All roads within the subject subdivision are paved. It is my opinion that this material is suitablefor use as Top Course for the proposed private roads within the subject subdivision.

Please reply that the proposed material is an acceptable alternative to County specification for use inroadway construction.

Dear Tim,

Per your request. 1 have looked at the proposed gradation for ITO Type A V., ' base rock as a substitutionfor the Bonner County specification for top course grave! under asphalt pavement m The Cove at StrongCreek. While not a public road over which I will nave junsdicrion it is ■Tiy understanding that someplanning Oeparrment fequiremenrs are still at play which require the Borner County approved rockgradation The decision on thts matter ultimately rests with the Planning Department but I'm writing thisin support of your request.

It IS my opinion that the proposed substitution would be equivalent when used under an asphalt roadsurface and is an acceptable alternative. The proposed ITO Type A rock has less fines which bind thematerial together This lack of fines could cause washboards and product loss m a gravel road surfacebut should not be an issue under an asphalt road where the asphait keeps the product in place in lieu offines, The strength of the maiensi comes from the larger aggregate m the mix. which is present andmeets Bonner County specincations for top course

Perhaps the most compelling evidence that the rock is suitaole is that it's approved by ITD for use underpaved roads ITD has far more extensive testing and quality control practices m place than BannerCounty and I believe that their specs are acceptable when doing similar work

SURETY AGREEMENT

THIS AGREEMENT made and entered into this ^ day of2015, by and between Thomas R. Newbury, Manager, BBTB, LLC, a Washingtonlimited liability company, hereinafter referred to as "Applicant," and the BonnerCounty Commissioners, hereinafter referred to as "County."

WHEREAS, the Applicant is required to post security for the construction orinstallation of the following improvements by applicable ordinances of Bonner County,conditions of preliminary plat approval and the laws of the State of Idaho, to wit;

Improvements required by preliminary plat condition C-4, to wit:

Prior (o final plal recording, all roads widiin ihc subdivision shall meet the latest private roadstandards for a " B" standard private road, consistent with Title 12. Appendix A. Bonner CountyRevised Code. The road improvements shall he constructed and certijied in writing by aprofessional engineer as complete, in accordance with the private road standards, prior torecording the final plat. Two copies of the engineer-certified final road construction report andas-builts. pursuant to Section 3.S of Appendix .1. shall be submitted to the Planning Departmentprior to final plat approval. The private ea.sements serving the subdivision shall be dedicated tothe homeowners association on the final plat, to the satisfaction of the Bonner County PlanningDepartment.

The SLibgradc and base course for all roads within the project boundaries have been constructedconsistent with Bonner County "Local Road B" private road requirements. All signage anddrainage improvements have also been completed consistent with the approved plans. Theapplicant is proposing to bond for the remaining top course and asphalt improvements. Theengineer's 4/17/15 estimate (attached) for completing the remaining roadway improvements wasapproved 5/1/15 (attached).

To confirm the proposed surety of $143,354 (150% of the project engineers'estimated costs for completion of said improvements), refer to the attached4/17/15 project engineer Tim Blankenship letter to planning director Glare Marleyestimating the cost of completing road improvements. Also refer to the attached5/1/15 county contract engineer Andrew Baden letter confirming the amount of***$95,569.00*** X 1.5 for a total surety amount of ***$143,354.00*** securing thecompletion of road improvements (preliminary plat condition C-4).

WHEREAS, the above described improvements are to be constructed by theApplicant with regard to certain real property described, as follows:

That the Applicant covenants and agrees to post security for construction of theabove described improvements and the County agrees to accept said security, each inaccordance with the terms and conditions of this Agreement.

That the Applicant, simultaneously with the execution of this Agreement, depositswith the County the attached corporate surety bond written by an insurance companylicensed In Idaho having a rating from A. M. Best & Company of "A" or better equivalentto one hundred fifty percent (150%) of the project engineer's estimated cost ofconstruction of the Improvements for the purpose of guaranteeing completion of thework and repair of any defects in improvements which occur within one (1) year of thefirst acceptance of the completed work by the Board from Travelers Casualty andSurety Company of America, Bond No. 106292986, in the total amount of***$143,354.00***, hereinafter referred to as "Surety," as security for completeperformance and construction of the above described improvements upon the followingterms and conditions:

1. That the Applicant shall complete construction of said improvements on orbefore (2) two years from the date of the execution of this agreement, or saidamount shall be due and payable to the County, and said Surety may be drawn by theCounty to the full amount thereof.

2. That said Surety shall be made in the name of the "Bonner CountyCommissioners." authorizing the Chair to sign for the release or modification thereof,and said Surety shall be held by the Bonner County Treasurer.

3. That in the event the Applicant fails or refuses to complete saidimprovements on or before the date set forth in paragraph Number 1 herein, the Countyshall have the right to cash or make demand for, and receive payment of. said Surety,and apply the proceeds thereof to the construction of said improvements and to do sowithout any recourse by the Applicant. Further, the county, its agents, contractors ordesignees shall have the right to enter the subject property as necessary to carry outthe completion of the improvements covered by this agreement.

4. In case of default by the Applicant, if the total cost of constructing saidimprovements Is less than the amount of the Surety, the difference between the actualcost of constructing said improvements and the amount of the Surety shall be paid tothe Applicant. However, If the cost of installing said Improvements is greater than theamount of the Surety, the Applicant agrees to reimburse and hold harmless the Countyfor any and all additional costs incurred by the County installing and constructing saidimprovements.

5. That in the event the Applicant completes construction of saidimprovements on or before the date set forth in paragraph Number 1 herein, the BonnerCounty Treasurer shall release to the Applicant the Surety one (1) year after firstacceptance of the completed \A/ork by the Board upon receiving notice by the BonnerCounty Planning Department, pursuant to and under the direction of the CountyCommissioners, that said improvements have been installed according to applicablespecifications and that the same have been approved by Bonner County. If constructionis not completed within one (1) year of the date of this agreement, the Applicant shallprovide a status report to the County within one (1) year advising of constructionprogress and confirming the surety agreement remains in full force under the terms ofthis agreement and the surety standards of Bonner County Revised Code 12-644(C).

6. Sureties guaranteeing the work and repair of any defects in improvementswhich occur within one year after first acceptance of the completed work by the Boardmay be reduced by the Board by one-half (Vz) for that one year. The surety agreementshall be valid for a period not to exceed two (2) calendar years from the date ofapproval. At any time prior to the expiration date of the surety agreement, thesubdivider may make a written request to the Planning Director for a single extension ofthe surety agreement for a period up to two (2) years. As a condition of granting anextension, the County may obtain a revised estimate at the applicant's expense todetermine if the original amount of the surety as identified herein is sufficient to coverthe cost of the improvements, construction or reconstruction. The Board may considersuch request for extension at any regular business meeting. The extension requestmust be approved or denied by the Board prior to the expiration date of the suretyagreement.

The plat of The Cove at Strong Creek was recorded subject to the terms and conditions of a suretyagreement approved August 4, 2015, securing the completion of road improvements limited to theplacement of top course and asphalt (agreement attached).

All improvements have been installed. Please find attached the July 12, 2017, "APPENDIX A,PRIVATE ROAD STANDARDS MANUAL REQUIRED INSPECTION & INFORMATIONCHECKLIST." together with the July 12, 2017. engineered as-built plans.

Pursuant to the tenns and conditions of the surety agreement (paragraph 5), the applicant requeststhat the top course and asphalt improvements be accepted as complete by the countycommissioners, and that the surety amount be reduced by one-half for the forthcoming one yearwarranty period (paragraph 6).

Please advise when this matter will be placed on the business meeting agenda.

AUTHORIZATION FOR PARTIAL RELEASE OF SURETY

WHEREAS, the Bonner County Board of Commissioners and ThomasR. Newbury, BBTB, LLC. A Washington limited liability company, hereafterreferred to as Applicant entered into a surety agreement on August 4, 2015, inthe amount of $143,354.00 for completion of the remaining road including the topcourse and asphalt improvements to be completed on or before August 4, 2019(Date extended on July 27,2017 by the Board), for the plat of The Cove atStrong Creek, File #81597-08; and

WHEREAS, the above described improvements have been constructed bythe Applicant with regard to certain real property described, as follows:

THAT PROPERTY DEPICTED ON THE PLAT OF THE COVE AT STRONG

CREEK, AS RECORDED IN BOOK 9 OF PLATS, PAGE 68, RECORDS OFBONNER COUNTY, IDAHO.

WHEREAS, a surety in the said amount was posted in the form of acorporate surety bond from Travelers Casualty and Surety Company ofAmerica for the specified improvements; and

WHEREAS, project manager Marty Taylor of Sewell and Associatescertified in a letter dated July 18,2017, that the road improvements limited to theplacement of top course and asphalt have been completed pursuant to theconditions of approval for the subdivision. In a memo dated August 9, 2017, TheCounty contract engineer. Drew Baden of JUB Engineers, inc. confirmedimprovements have been met to the satisfaction of Bonner County.

NOW, THEREFORE, the Bonner County Board of Commissioners herebyaccepts the subdivision improvements as complete subject to the terms of thesurety agreement. File #81597-08, and hereby authorizes the release of one-halfthe surety or $71,677.00 and hereby retains the surety in the amount of$71,677.00 until one year from the date of this acceptance. The Board ofCommissioners hereby further authorizes the Bonner County Treasurer torelease as soon as practical, allowing sufficient time for processing, said$71,677.00 of the surety specified herein upon the submission by the applicant ofa replacement surety in the amount of $71,677.00 in a form specified at Section
