Roberts, AICP Planning Manager SUBJECT: Public hearing on a variance to allow lighting on existing unlit billboards. BACKGROUND: This is a request for approval of a variance to allow lighting on several existing billboards along the east side of Central Expressway, north of Ridgeview Drive. The subject billboards where constructed prior to the area being annexed into Town limits. STATUS OF ISSUE: The owner has eight (8) billboards along Central Expressway within town limits. Of those, four (4) are unlit (see map attached). The applicant is requesting to allow lighting to be installed on these specific billboards. Since the subject billboards were installed prior to the land being annexed into the town, and the town does not permit billboards as an allowable sign type, the signs are considered nonconforming. According to the Zoning Ordinance, Section 14.02.006 Nonconforming Use, a nonconforming use may remain as long as there are no expansions and no structural alterations. In this case, since the subject billboards are nonconforming, the installation of the lights on the unlit billboards constitutes an expansion of a nonconforming use, therefore, installation of lighting on these unlit signs is not permitted. The applicant is requesting a variance from this section of the zoning ordinance to allow the installation of lighting on these specific signs. The specific signs are highlighted on the attached map with the addresses of: 4704, 4754, 4824 and 4914 US Highway 75. Included with this packet is the information regarding the type of lighting proposed for the signs. This is for informational purposes only. The lighting fixture, light trespass, and bulb type are regulated by the lighting ordnance and is not actionable by the ZBA.
