Mr.!Ryan!Niblock!from!SJ!COG!reported!that!after!discussions!with!EPA,!there!is!no!change!to!the!lockdown!schedule!circulated!in!April!and!will!continue!to!monitor!and!update.!!!As!Mr.!Ryan!Niblock!has!noted!in!previous!updates,!EPA!approval!of!the!2012!PM2.5!Plan!and!EPA!adequacy!finding!of!revised!conformity!budgets!for!8XHour!Ozone!and!PM10!will!end!the!lockdown!for!all!four!MPOs!–!Fresno,!San!Joaquin,!Stanislaus,!and!Tulare.!EPA!is!on!track!to!take!action!on!approval!and!adequacy!findings!in!August!2016,!effective!September!2016!to!end!the!lockdown.!!If!statutory!processes!and!other!factors!cause!the!EPA!actions!to!slip!past!October!1,!2016,!these!MPOs!will!need!to!adopt!an!“exempt!only”!FTIP.!The!“exempt!only”!FTIP!will!be!effective!until!all!EPA!actions!are!complete!and!effective.!!

BOARD BRIEFING REPORT
DATE: June 30, 2016 TO: SJVUAPCD Governing Board

RE: EPA’s Inaction Places the Valley in Jeopardy for Potential Costly Federal Sanctions
We were just notified by EPA that the agency will not act to approve the District’s 2015 PM2.5 Plan which included an attainment deadline extension request. EPA’s failure to act comes as a shock in that EPA had proposed in January to approve the plan and extension request. Under the federal Clean Air Act, EPA’s failure to act by July 1, 2016 will now subject the Valley to nearly impossible mandates. For instance, this inaction by EPA now sets the attainment deadline at December 31, 2015 which has already passed. Furthermore, the Valley is now required to adopt a new plan that achieves a minimum of 5% reduction in emissions every year until the Valley reaches attainment. EPA is telling us that they decided not to finalize their proposal to approve the District’s plan based on comments they received from Earthjustice, an environmental law firm from San Francisco. We are frustrated by EPA’s inaction since we had worked closely with EPA in crafting the plan, and that the District was not given any opportunity to rectify any shortcomings in the submittal before the deadline had expired. EPA had the District plan for nearly a year as your Board adopted the plan in April 2015 which was subsequently forwarded by ARB to EPA in June 2015. We continue to believe that the plan met all applicable requirements under the Clean Air Act. During adoption of the 2015 PM2.5 Plan, your Board provided direction to staff to develop options for turning over responsibility for regulating PM2.5 to EPA if the plan and extension request were not approved by

EPA. This direction was provided in recognition of the irreparable consequences under the Clean Air Act if the San Joaquin Valley was not provided the requested five year extension and was found in nonattainment past the December 31, 2015 deadline. This inaction by EPA also creates potential uncertainties and additional administrative requirements for Valley COGs and MPOs in relation to their conformity budgets and federal funding for transportation. We have been in contact with them and are working to address related issues. The above summary information is provided to your Board as a heads up while we work to fully assess the consequences and potential options for your Board’s consideration. These matters will be presented to your Board in detail at our next regularly scheduled Governing Board meeting on August 18, 2016.
