Roll call was taken by Mary James and a quorum of the Commission was present.
II. APPROVE AGENDA Vice Chair Wooten asked for a motion to move agenda item VIII h. (1) 11-2227 North Mesa
Builders from Executive Session into New Business VI. (a) and to approve the amended agenda.
Commissioner Armstrong MOTIONED, Commissioner Kaufman SECONDED. Motion
passed by UNANIMOUS APPROVAL.
III. PUBLIC COMMENT Public comments were received limiting comments to 2 minutes per individual speaker and
refraining from revealing the names of parties or case detail pertaining to disciplinary matters
pending before the Commission.
IV. DIRECTOR’S REPORT Acting Director Romero presented the Director’s Report. The report is attached to the minutes.

VI. NEW BUSINESS
a. North Mesa Builders Case 11-2227
An Order to Show Cause was issued to North Mesa Builders, case 11-2227 to appear before the
Commission to explain non-compliance of a Decision and Order issued by the Commission. The
Respondent and his Counsel appeared before the Commission.
b. Approval of Licenses issued in March and April 2018 Commissioner Armstrong MOTIONS to approve the issued licenses. Commissioner Kaufman
SECONDED the motion. Motion passed by UNANIMOUS APPROVAL.
c. Approval of Electrical Continuing Education Courses
Commissioner Kaufman MOTIONS to approve the electrical continuing education.
Commissioner Romero SECONDED the motion. Motion passed by UNANIMOUS
APPROVAL.
d. Approval of Plumbing and Mechanical Continuing Education Courses
Commissioner Kaufman MOTIONS to approve the plumbing and mechanical continuing
education. Commissioner Fellows SECONDED the motion. Motion passed by UNANIMOUS
APPROVAL.
e. Approval of the Repeal of Title 14, Chapter 6, Part 7 of the Administrative Code
[14.6.7 NMAC] as to Consumer Bonds and replacing 14.6.7 NMAC with Modular Building
Structures which was incorrectly placed under Manufactured Housing.
Commissioner Armstrong MOTIONS to approve the Repeal of Title 14, Chapter 6, Part 7 of the
Administrative Code and replace with 14.6.7 NMAC with Modular Building Structures which
was incorrectly placed under Manufactured Housing. Commissioner Fellows SECONDED the
motion. Motion passed by UNANIMOUS APPROVAL.
f. Approval of Modular Policy.
Commissioner Davis MOTIONS that an interim policy be approved pending rule change to
allow MHD-1, 2 & 3 installers to complete the anchoring process for modular units when
complying with CID requirements as to application, bonding and experience requirements,
successfully completing the business & law exam, and complying with scope of work and
permitting requirements as noted in the proposal. Commissioner Kaufman SECONDED the
motion. Motion passed by UNANIMOUS APPROVAL.
Commissioner Davis made an Amended Motion to the Modular Policy.
The policy will not be implemented until December 31, 2018. Commissioner Fellows
SECONDED the amended motion. Motion passed by UNANIMOUS APPROVAL.

g. Subcommittee Report and Motion on Oil & Gas in New Mexico.
Commissioner Davis MOTIONS, that based upon the recommendation from the Commission’s
subcommittee, the Commission direct Acting Director, Martin Romero, to issue a policy that
Construction Industries Division staff conform to the statutory exemption from inspecting
petroleum (“oil”) and gas industries work relative to oil wells as beyond the scope of jurisdiction
of the Construction Industries Division pursuant to NMSA 1978, Section 60-13-3(D)(2), (7) and
(8) as determined by legal counsel and after reviewing the Act and applicable law. Recognizing
that oil and gas industry work involving drilling, completing, testing and operating are integral
parts of the installing, altering or operating of a system owned by the gas or oil company are
exempt from compliance of the Construction Industries Licensing Act (“CILA”), its rules, codes
and standards. Therefore, the Construction Industries Division does not have jurisdiction to issue
permits, conduct inspections, or require compliance with other requirements of the Construction
Industries Licensing Act. However, the statutory exemption does not extend to CILA
regulations and codes when oil and gas companies erect permanent buildings not intended for
temporary use and to be occupied by individuals. The effective date for compliance with this
policy shall be no later than July 1, 2018. Commissioner Kaufman SECONDED the motion.

Commissioner Armstrong made a MOTION for the approval of amendments to Title 19,
Chapter 15, Part 40, NM Liquefied Petroleum Gas Standard, of the NM Administrative Code to
reflect adoption of the 2015 NFPA 54 and the 2017 NFPA 58. Commissioner Romero
SECONDED the motion. Motion passed by UNANIMOUS APPROVAL.
VII. EXECUTIVE SESSION
Vice Chair Wooten made a MOTION that the Commission will enter into executive session to
discuss the cases listed on the agenda, pursuant to NMSA 1978, Sections 10-15-1(H) (1),(3) and
(7) of the Open Meetings Act. Authorizing closed sessions for matters related to issuance,

1:05 p.m. Vice Chair Wooten stated that pursuant to NMSA 1978, Section 10-15-1(J).of the
Open Meeting Act the matters discussed in Executive Session were limited only to the items
listed in the motion.

Director's Update:
Good Morning! Thank you for the opportunity to report to you today the events
of CID for the months of March and April, 2018.
I'd like to introduce Mary James who will serve as the lead person of allcommission meetings from now to the end of the year. Her responsibilitieswill include coordinating all CIC meetings and public hearings.
Mary James also serves as the front end supervisor of the Santa Fe.
Albuquerque, and Las Cruces office.
Fire code enforcement is often seen simply as conducting inspections, notingviolations, and conducting re-inspections to ensure violations have been
corrected. In its pure and simple form, this is true. However that's not the case.
Contractors, Architects, and fire protection engineers are recently beingburdened with attempted over-enforcement of code requirements by the state
and local fire marshals. The law is clear. The design and construction of new
structures shall comply with the International Building Code which must be
considered prior to Fire Marshall Codes as the International Building Code sets
the standards for construction. Any alterations, additions, changes in use orchanges in structures required, must be compliant with and within the scope ofthe Intemational Building code.
Mr. Chairman, due to the over enforcement actions I have requested a meetingwith the New Mexico State Fire Marshall, and [which] Fire Chief and wouldlike to involve the CIC sub-committee to address fire code requirements and theprocess of the building code requirements.

The purpose of this presentation and training was to discuss the code approval processes andto explore more ways to keep each other better informed about industry issues.
Presentations provided by all three bureaus and compliance were well received and therewere plenty of questions?
Concerns unlicensed contracting in the Alamogordo area was a notable topic of discussion.In discussions with Amanda Roybal, Carolyn Hernandez had visited the area a week beforeare visit. There are currently 28 investigations been prosecuted in the area and one of theunlicensed contractors that they were complaining about is currently under investigation. Alot of work goes into these investigations from the moment they start until they are
completed.
There are unlicensed contractors out there I agree. Anyone who can (or can't!) swing a
hammer can claim to be a contractor, but few are licensed to do so. With that said I believe
that Amanda Roybal and her group have done an outstanding job of the enforcement ofunlicensed contracting in New Mexico and her interaction with theses contractors and
presentation in Alamogordo is an example of that. To Amanda and her group I would just
like sayjob well done.

BUREAU UPDATES
GENERAL CONSTRUCTION BUREAU - March and April, 2018
Ron Hibner - Acting Bureau Chief
Acting Bureau Chief Ron Hibner met on April 4 with Steven Saavedra,Representative for the City of Aztec, Kimberly of Winters Construction and
Architect Timothy Christensen. There was a tour of the HUB Building to review ofthe proposed design with discussion regarding occupancy classification, exitingrequirements and corridor fire rating requirements.
Acting Bureau Chief Ron Hibner met with Veronica Chavez of New MexicoDepartment of Homeland Security Emergency Management, Wendy Blackwell,CFM, State Hazard Mitigation Officer, Jesus Carrasco, Director of NMMHD todiscuss coordination between various agencies and the local flood plainadministrators. There was also discussion of CID inspector's attendance of the FEMADamage Assessment Training in the past.
Inspectors from the northern and central areas attended Stucco and EIFS Assembliestraining sponsored by Preferred Providers, LLC and RWC Building Products at theRWC office and yard in Albuquerque. The training included code requirements,product identifi cation and proper installation recommendations.
Code training with other CID Bureaus for the BCAOC (Building ContractorsAssociation of Otero County) providing presentations on current codes, listening tofeedback from the local contractors and discussion concerning issues and concerns.
The meeting was very successful in promoting a better understanding of issues fromboth points of view and improving communications.
General Construction Inspectors from the entire state attended training on SeismicDesign for Fire Sprinklers in Santa Fe sponsored by the Northern New MexicoAssociation of Public Safety Officials. This training was especially helpful inclarifying methods in determining seismic design categories for specific locationswithin the state.
General Construction Bureau TAC Meeting in Albuquerque. Discussions includedFlammability Standards for safety and health in building insulation, the Southwest

Energy Efficiency Project 2009 IECC, Code change Proposal to the 2015 NewMexico Historic Earthen Building Code.
MECHANICAL BUREAU - March and April, 2018
J.T. Baca - Bureau Chief
Mechanical Bureau Chief J.T. Baca traveled to IAPMO HQ. In Ontario CA toattended two committee meetings. The UPC Workshop Committee develops
plumbing scenario drawing which are utilized in training at the annual International
Education and Business Conference. Bureau chief Baca has submitted a drawing
which was one of six chosen to be used for this year's training to be held inPhiladelphia PA in late fall. This drawing will also be published in the international
IAPMO magazine. This is Bureau Chief Baca's 5th consecutive drawing to be
accepted for training and publishing. The second meeting was with the IAPMO
standards council to which Bureau Chief Baca was recently appointed and represents
govefilment regulators on the panel.
Bureau Chief Baca recently attended the Electrical TAC Meeting where he provided
valuable information regarding proper procedures for adopting and amending codes
and information regarding CEU training to the E TAC for future use.
Bureau Chief Baca and Compliance Manager Amanda Roybal met with NMED
Liquid Waste program manager Bob Italiano and his senior staff. The meeting was to
discuss collaboration with CID regarding compliance issues, training on codes and
overlapping jurisdiction. Future meeting will take place with a larger stakeholders
group to further develop training and share information.

As already mentioned, Bureau Chief Baca and Mechanical Chief Inspector James
Darnold along with CID Bureau Chiefs and Compliance Manager Amanda Roybal
traveled to Alamogordo New Mexico to provide power point code training and
information to the BCAOC. The training was regarding inspections and compliance.
This outreach was successful and Chief Baca recommends this be used as the model
for future outreach training/meetings with jurisdictional municipalities and builder's
groups throughout the state.
Bureau Chief J.T. Baca participated in a teleconference meeting which included City
of Farmington CBO, Derek Childers and Doug Doudy, Administrative Captain,
Farmington Fire Department. The meeting was to provide information regarding the
installation and inspection of residential plumbing based fire protection sprinkler
systems in one and two family dwellings. Chief Baca provided code guidance to help
resolve an issue between both parties.

Bureau Chief J.T. Baca long with other CID senior staff attended a meeting and demo
with RLD IT staff and Salesforce staff to introduce and provide insight to the newlyproposed permitting and inspection system to replace the Acela System. The demo
and meeting provided information regarding the proposed system while CID staffprovided basic feedback on specific needs and profiles for each bureau and section.
ELECTRICAL BUREAU - March and April,2018
Kelly Hunt - Bureau Chief
Bureau Chief Hunt, along with Chief Inspector Joseph Martinez and Inspector JasonDavis attended a meeting of Salesforce staff to introduce the newly proposedpermitting and inspection system which will replace the Acela System. Due to theirexperience, Joseph and Jason, as electrical bureau representatives, will assist in thistransition.
Bureau Chief Hunt has acknowledged that his bureau shall be providing training toMHD Inspectors for PV Solar systems on MHD Units, a noted responsibility of MHDinspectors. Bureau Chief Hunt has provided training to these inspectors in the past
which have proven successful. As Acting Director, I have requested that this trainingbe completed as soon as possible.
The Electrical Bureau is considering changes to the Administrative Code to reflectdiscussions of the technical advisory committee.
The same as other trade bureaus, inspections are increasing as CID has assumed
inspections of ABQ Albuquerque Public Schools, Hobbs and Roswell municipalinspections.
The Electrical Bureau is working with the Investigations & Enforcement Unit onseveral different complaints.

o Inspections for and movies and concerts included "Roswell" and "Rivers and Roads".
. Special events for February included the PBR Ty Murray Invitational and St Patrick'sDay Balloon Rally.
o On March 1 and 2,2018, Bureau Chief Bailey conducted the NMIAAI Board and
Officers meeting and the quarterly Membership meeting in Las Cruces.
o On March 21,2018, Bureau Chief Bailey attended the CIC meeting in Albuquerque.

a On March 22,2018, Bureau Chief Bailey and CID attorney Sally Galanter met withseveral individuals. This included two other attorneys, a fire investigator, twoengineers and family members. Bureau Chief Bailey is the lead investigator on thisincident that resulted in a fatality.
Inspections for and movies and concerts included "Rivers and Roads", "Cosmos" and"The Gold Finch".
Special events for April included the Albuquerque Public Schools Fine Arts Program,IINM Fiestas, Sustainability Expo, International Festival, Fiesta Del Cinco,Albuquerque Home & Garden Show, Gathering of Nations, NM Expo Flea Marketand Nizhoni Days Powwow.
On April 3,2018, Chief Inspector James Morrison attended the final vendors meetingin preparation for the Gathering of Nations being held at Expo NM.
On April 3 and 4,2018, All the LP gas inspectors attended an inspectors meeting and
training in Albuquerque.
On April 4, 2018, Bureau Chief Bailey along with other members of CID attended a
Sales Force meeting. During the breakout session for the Bureau, Chief Bailey,Administration AssistantBliza Casados and LP Gas [nspector Rob Sloan attended.
On April 30, 2018, Bureau Chief Bailey and Chief Inspector James Morrison met
with representatives from the Albuquerque Fire Department, The Albuquerque
Convention Center and The American Farriers Association. This meeting was
relating to the American Farriers wanting to return to Albuquerque for their 2020
event. In 2009 the event was held at the convention center. This event brings with itspecial concerns and considerations which requires at least one inspector present
during all competition spanning the three days.
