    Report by the Head of Planning on a Forthcoming Application byForemost Properties (Scotland) LLP for Residential Developmentat Land at McDonald Road, EdinburghProtocol NoteThe report by the Head of Planning is to brief and inform members in advance of aformal planning application for this site. The process is as was agreed by thePlanning Committee on 7 August 2008 and in the context of changes todevelopment management procedures under the Planning, etc (Scotland) Act2006.Following the presentation, members will have the opportunity to ask questions andindicate key issues they would like the developers to consider, but withoutexpressing any view on the merits of the proposals.Local ward councillors may attend the meeting and observe the presentation anddiscussion but cannot take part in the debate. They will however have anopportunity to ask questions and raise issues through the parallel NeighbourhoodPartnership briefing process.Following submission of any formal planning application, the finalised proposalswould be presented to the Sub-Committee in the normal way. This additionalprocess does not replace or curtail any part of the established procedure.

    REPORT ON FORTHCOMING APPLICATION by Foremost Properties(Scotland) LLP for residential development at land at McDonaldRoad, Edinburgh.Development Management Sub-Committee

    1. Purpose of the ReportTo inform the Development Management Sub-Committee of a forthcoming planningapplication in respect of a major development on land at McDonald Road.Pre-application reports give the Committee an opportunity to raise issues which itwould like to see addressed in the planning application.2. Summary

    This report advises members of a forthcoming planning application for residentialdevelopment at a site at McDonald Road. The site is within the Urban Area as shownon the Edinburgh City Local Plan Proposals Map.In accordance with the provisions of Planning etc (Scotland) Act 2006, the applicantssubmitted a Proposal of Application Notice on 29 March 2012.3. The Site and the ProposalSite DescriptionThe application site is an L-shaped plot located on the southwest side of McDonaldRoad. Covering 0.444 hectares in area, it is bounded by McDonald Road to thenortheast, McDonald Place to the southwest, McDonald Street to the southeast andBellevue Road to the northwest. The site occupies the majority of an urban block withthe exception of a row of four storey tenements which front onto McDonald Road atthe northern corner of the block. The tenement gardens and boundary walls back ontothe application site.The site formerly accommodated Crawford's bakery from 1930 to 1969, when itbecame a cash and carry until 1989 and subsequently the Martin and Frost Furnitureshowroom. All buildings on the site have been demolished. The site previouslyincorporated an open car park accessed from McDonald Road and six off streetparking spaces accessed from McDonald Street.

    The wider area is characterised by a mix of uses, scales of building and architecturalstyles.Site History12 August 2004 - Planning application withdrawn for new build mixed residentialdevelopment, with commercial units at ground floor to McDonald Road (reference04/01918/FUL).1 May 2007 - Planning application for new build mixed residential development withcommercial units at ground floor fronting onto McDonald Road withdrawn following'Minded to Grant' decision by committee on 20 July 2005 (reference 05/00021/FUL).24 April 2008 - Planning application for erection of commercially managed studentaccommodation arranged as 295 bedrooms, contained within 63 cluster flats and 2studio flats, with a commercial unit on the ground floor. The application was refusedon the grounds that it would result in an excessive concentration of studentaccommodation in the area and for inappropriate design, materials and mix of housingtypes. The decision was overturned on appeal subject to the signing of a section 75agreement. The legal agreement was to be completed within 3 months. The ownerssold the site on and the agreement was never completed. The Reporter subsequentlyrefused the proposal on 21 May 2009 (reference 07/01518/FUL).07 October 2010 - Planning application for 86 flats incorporating underground parkingwas 'Minded to Grant' subject to the signing of a section 75 legal agreement. Thelegal agreement has not been signed and therefore a decision note has not beenissued (reference 10/01514/FUL).

    Description of the ProposalFull planning will be sought for the erection of approximately 69 residential units andassociated landscaping and parking. The draft proposals show a flatted block alongMcDonald Road with the remainder of the site proposed for a colony styledevelopment.

    Community ConsultationThe Proposal of Application Notice (reference 12/01168/PAN) outlined a communityconsultation event to be held at the McDonald Road Library on 9 May 2012. Thiswould be supplemented with a leaflet drop to neighbours prior to the event andexhibition boards displayed at McDonald Road Library for the two weeks following theevent.The applicants also propose to meet with the New Town and Broughton CommunityCouncil on dates to suit.The results of the community consultation will be submitted with the application aspart of the Report on Community Consultation.4. IssuesThe key considerations against which the eventual application will be assessedinclude whether:

    a) the development would be acceptable in principle having regard to thedevelopment plan;The site is within the urban area in the Edinburgh City Local Plan, where generalhousing and amenity policies apply.

    b) the design, layout are acceptable within the character of the area;The application is likely to come forward as a detailed application. At this stagethere have been some indicative details on the layout of the proposals forinformation but not for assessment. The applicant is required to submit a Designand Access Statement with the application.

    c) access arrangements are acceptable in terms of road safety and publictransport accessibility;Access to the site will be taken from McDonald Street. The applicants will berequired to demonstrate that the site is capable of accommodating the proposeduse in terms of parking and servicing.

    d) there are any other environmental factors that require consideration:The applicants will be required to submit sufficient information to demonstrate thatthe site is capable of being developed for the use stated and is compatible with thesurrounding uses. In order to support the application the following documents willbe submitted: surface water management plan/SUDS; sustainability statement; and site investigation (contamination).

    5. ConclusionThis report highlights the main issues that are likely to arise in relation to the variouskey considerations. This list is not exhaustive and further matters may arise when thenew application is received, and consultees and the public have the opportunity tocomment.6. RecommendationsIt is recommended that the Committee note the key issues at this stage and advise ofany other issues.
