Cal-OSHA Releases Revised Proposal of Heat Illness Prevention StandardsI reported back in September that Cal OSHA

is proposing to update the existing Heat

Illness Prevention Standards. I also reported

that we are part of an employer coalition who

has written letters and testified against the

proposed changes as being overreaching and

unnecessary.

Cal OSHA released a revised proposal the

other day which provides for 15 days’ to

respond to the proposed revisions. Following

is the link to the proposed revisions along

with an explanation that lists a summary

of comments and Cal OSHA’s response or

rationale for their proposed language.

review these revisions this coming Monday. I

Cal/OSHA Cites Disney Construction for 2 Worker Fatalities: Faulty Equipment, Untrained Staff Caused Deaths at Job Site Sacramento—Cal/OSHA cited Disney

Construction, Inc. of Burlingame $106,110

for serious violations following the May 30th

deaths of two employees who fell 80 feet

from a crane-hoisted platform at a bridge

construction site in Winters.

The Sacramento District Office’s investigation

found:

• Disney Construction’s crane had not been

certified or visually inspected for defects

to satisfy current testing and examination

standards

• The crane operator failed to perform an

unmanned trial run or have a competent

person inspect the rigging and platform

before usage

• There was no qualified, trained signal

person to assist with the lifting operation

“Employers in California are required to

perform regular equipment inspections to

identify and prevent mechanical problems that

can lead to tragedy,” said Christine Baker,

Director of the Department of Industrial

Relations (DIR). Cal/OSHA, formally known

as the division of Occupational Safety and

Health, is a division of DIR.

Disney Construction was hired to build a new

concrete vehicle bridge to connect the City

of Winters in Yolo County to Solano County

across Putah Creek. Workers were using a

pile driver crane when a cable broke near

the top of a pile driver. A second crane was

used to hoist a personnel platform with two

workers, Marcus Powell of Los Gatos and

Glenn Hodgson of Richmond, so they could

troubleshoot the cable on the pile driver. The

rigging used to connect the platform to the

crane dislodged, causing the platform and

workers to fall some 80 feet to the ground.

“Specific regulations are in place to operate

cranes safely. This incident is a sobering

reminder of the tragedies that can occur when

safety protocols are not followed,” said Acting

Cal/OSHA Chief Juliann Sum.

Cal/OSHA also cited Disney Construction for

not thoroughly surveying the conditions of the

work site for predictable employee hazards

and neglecting to implement the necessary

safeguards required to perform this type of

operation.

Cal/OSHA helps protect workers from health

and safety hazards on the job in almost every

workplace in California. Employers who want

to learn more about California workplace

health and safety standards or labor law

violations can access information on DIR’s

website.

Cal/OSHA’s Consultation Program provides

free and voluntary assistance to employers and

employee organizations to improve their health

and safety programs. Employers should call

(800) 963-9424 for assistance from the Cal/

OSHA Consultation Program.

Employees with work-related questions or

complaints may call the California Workers’

Information Hotline at (866) 924-9757 for

recorded information in English and Spanish

on a variety of work-related topics.

The Impact of the President’s Executive Action Upon U.S. Employers

The law firm of Ogletree Deakins, a firm

that specializes in employers/employees and

immigration reports: On Thursday evening,

November 20, 2014, President Obama

announced that he was taking executive action

that will primarily shield up to five million

illegal immigrants from deportation. U.S.

employers will benefit from business-related

portions of the executive action, but these

provisions will be implemented gradually

as regulatory review is necessary in many

cases. Ogletree Deakins will be conducting a

webinar on December 2, 2014, to discuss the

president’s action in more detail. To register for

this timely program, click here.

U.S. employers will experience the impact of

executive action in several ways:

Undocumented Workers Will Receive Employment Authorization Documents• Four to five million people will become

eligible to apply for employment

authorization to lawfully work in the

United States. U.S. employers that

employ these workers will need to ensure

compliance with Form I-9 employment

verification requirements.

The Benefit of Adjustment of Status to Employment-Based Immigrants Will Advance• Beneficiaries of approved employment-

based immigrant visa petitions (and their

eligible family members) may become

eligible to file for adjustment of status to

permanent residence sooner and obtain

interim benefits, such as employment

authorization and travel documents.

Long-awaited guidance on job changes

that occur during the pendency of the

green card process is also expected.

Additionally, employment authorization

for certain H-4 spouses of H-1B

employees who have reached certain

green card processing milestones is also

likely to be provided.

Foreign Entrepreneurs Will Have Increased Immigration Options and the National Interest Waiver

Category Will Expand• The U.S. Department of Homeland

Security (DHS) will expand immigration

options for foreign entrepreneurs who

meet certain criteria for creating jobs,

attracting investment, and generating

revenue in the United States. The proposal

would include expanding national

interest waiver petitions to entrepreneurs,

researchers, inventors, and founders.

The U.S. Citizenship and Immigration

Services (USCIS) will also propose a

program that will permit the granting

of advance parole travel documents to

inventors, researchers, and founders of

start-up companies who have not yet

qualified for a national interest waiver.

The STEM-based Optional Practical Training Program Will Expand• DHS will propose changes that will

expand and extend the use of the existing

Optional Practical Training (OPT)

program. These changes will benefit

foreign students studying science,

technology, engineering, and mathematics

(STEM) at U.S. universities. These

changes should allow employers to

employ highly skilled workers beyond

the current maximum of 29 months in the

OPT program.

Guidance on L-1B Intra-Company Transferee Petitions Will be Clarified• DHS is expected to clarify its guidance on

temporary L-1B specialized knowledge

visas for foreign workers who transfer

from a company’s foreign office to its U.S.

office. It is hoped that the forthcoming

guidance will result in more predictable

adjudications by the government.

The PERM Labor Certification Process Will be Modernized• The U.S. Department of Labor (DOL)

plans to take regulatory action to

modernize the PERM labor market test

that is required of many employers that

sponsor foreign workers for immigrant

visas. Specifically, the DOL will seek

input on the following:

o options for identifying labor force

occupational shortages and surpluses and

methods for aligning domestic worker

recruitment;

o methods and practices designed to

modernize U.S. worker recruitment

requirements;

o processes to clarify employer

obligations to ensure PERM positions are

fully open to U.S. workers;

o the possibility for premium processing

of applications; and

o the introduction of a process for

efficiently addressing nonmaterial errors.

The Immigrant Visa System Will be Reformed• Finally, the administration will direct

federal agencies to look at modernizing

the visa system in order to make more

efficient use of the current allotment

of immigrant visas. More immigrant

visas may become available based upon

decisions on issues such as whether

dependent visa beneficiaries should be

counted and whether past unused visa

numbers can be recaptured.

The president’s executive action offers

employers the possibility of gradual

improvements in the processing of

employment-based immigration matters

as government agencies reexamine their

practices.

The Capitol Connection Q&A for Contractors By Shauna Krause, Capitol Services, Inc.

To keep consumers safe and squash unfair

competition for contractors are two of the

missions of the CSLB’s Enforcement Unit,

better known as SWIFT.

These agents scour the State of California

looking for unlicensed individuals ‘acting’

as contractors to keep the underground

economy in check while leveling the playing

field for legitimate licensed contractors. As

you will discover, some of those ‘playing

contractors’ in this drama are often also

criminals…

Q: I recently purchased a painting franchise and

I applied for a contractor’s license but haven’t

completed the application process yet. What

will happen if I contract without a license? Is

there some sort of temporary license I can be

issued while the application is being reviewed?

A: No, the CSLB does not issue temporary

licenses. As you may already be aware, it is

illegal for an unlicensed contractor to contract

for work over $500 for labor and materials. The

CSLB has an investigative team that frequently

conducts stings and sweeps to apprehend

unlicensed contractors and it can result in a

misdemeanor, jail time, and fines. Repeat

offenders can face even harsher penalties.

Additionally, contractors performing work

without a license have no legal right to enforce

contracts, so consumers are not legally required

to pay contractors operating illegally.

So-called ‘handy’ people are helpful, but when

time and materials exceed $500 for the job a

license is required to do the work. A recent

CSLB sting in the Sacramento area discovered

that among the suspects cited by SWIFT agents

for unlicensed activity was a man convicted of

rape. That conviction makes him ineligible for

a license, but he was still contracting without a

license and illegally advertising his services to

consumers.

Another unlicensed individual who responded to

the ‘sting’ requesting bids for work was wanted

for failing to complete a sentence for DUI

conviction. Ten were cited in this ‘round-up’

by SWIFT that located the suspects advertising

online.

According to the Sacramento Bee, “All but

one of the suspects also faces an additional

misdemeanor charge of illegal advertising.

State law requires contractors to place their

license number in all print, broadcast and online

advertisements. Those without a license can

advertise to perform jobs valued at less than

$500, but the advertisement must state that they

are not licensed contractors.”

The Contractors State License Board encourages

consumers to check the license status before

hiring a contractor by visiting the agency’s

website at www.cslb.ca.gov or by calling the

toll-free automated line, (800) 321-2757. The

board’s website also offers tips about how to

hire a contractor and the opportunity to sign up

for email alerts.

Musculoskeletal Disorders—Carpal Tunnel Syndrome

What is carpal tunnel syndrome?

Carpal tunnel syndrome (CTS) occurs when the median nerve, which runs from the forearm into the hand, becomes pressed or squeezed as it passes through the carpal tunnel in the wrist.

The result includes:

• Pain

• Tingling

• Weakness

• Numbness

• Restricted wrist movements

What causes carpal tunnel syndrome?

CTS has many causes, though usually it is a combination of many factors, including:

• A genetic predisposition or normal aging can cause the sheath around the wrist tendons to become thick and sticky.

• Highly repetitive tasks.

• Constant exertion.

• Awkward wrist positioning.

• Repeated use of vibrating tools.

• Damage to the bones from injury or other trauma in the hand or wrist, resulting in pressure in the carpal tunnel.

There are more common disorders such as bursitis and tendonitis in the wrists that have similar symptoms as CTS and can be caused by repetitive and forceful motions of the hands.

How is carpal tunnel syndrome treated?

The diagnosis and treatment of carpal tunnel syndrome by a qualified medical provider should happen as early as possible and may include:

• Resting the affected hand and wrist for at least two weeks.

• Avoiding activities that may worsen the symptoms.

• Immobilizing the wrist in a splint to avoid further damage from twisting or bending.

How is carpal tunnel syndrome treated? (continued)

• Taking non-steroidal anti-inflammatory drugs as instructed by a medical professional, such as:

− Aspirin

− Ibuprofen

− Other non-prescription pain relievers

• Doing hand and wrist stretching and strengthening exercises can be helpful.

• Yoga has been shown to reduce pain and increase wrist and hand strength.

• Alternative methods such as chiropractic care and acupuncture may be a treatment option but have not been proven as an effective method.

• Surgery and post-operative physical therapy is often successful as a last resort.

Can carpal tunnel syndrome be prevented?

Proper work habits can reduce the chances of having CTS:

• Physical conditioning and stretching exercises.

• Taking rest breaks from repetitive activities.

• Wearing supports or splints to keep wrists straight.

• Proper adjustment of workstations to assure correct posturing and wrist positioning.

• Taking vibration dampening measures (gloves, pads, slings) when using vibrating tools.

• Rotating jobs or alternating tasks.

• Adapting workplace conditions and job demands to the capabilities of employee.

In severe cases, CTS can result in permanent nerve damage. However, if diagnosed and cared for early, CTS is very treatable and will not create long-term problems.

• La intención de una posición neutra del cuerpo es reducir el riesgo de desarrollar un trastorno musculoesquelético (MSD por sus siglas en inglés).

La configuración de la terminal de trabajo:

• La cabeza está nivelada o ligeramente inclinada hacia delante, mirando hacia adelante y equilibrada, en general en línea con el torso.

• La cabeza es lo más vertical posible. Limite el movimiento de la cabeza de lado a lado.

• La distancia para ver es de entre 20 y 40 pulgadas. La parte superior del monitor está un poco más baja que el nivel del ojo.

• El monitor se coloca perpendicular a la luz entrante.

• Los hombros se relajan y la parte superior de los brazos se cuelgan normalmente en los lados del cuerpo.

• Los codos permanecen cercos al cuerpo y se doblan entre 90 º y 120 º.

• Las manos, las muñecas y los antebrazos están rectos, en línea y más o menos paralelos al suelo.

• Los pies se soportan completamente en el suelo o un reposapiés.

• Tomar medicamentos antiinflamatorios que no son esteroideos por instrucciones de un profesional médico, como por ejemplo:

− Aspirina

− Ibuprofeno

− Otros analgésicos de venta sin receta

• Hacer ejercicios de fortalecimiento y estiramiento para la mano y la muñeca puede ser útil.

• El yoga se ha demostrado reducir el dolor y aumentar la fuerza de la mano y la muñeca.

• Los métodos alternativos tales como la quiropráctica y la acupuntura puedan ser una opción de tratamiento, pero no se han demostrado como un método eficaz.

• La cirugía y la terapia física después de la operación son a menudo exitosas como último recurso.

• Inmovilizar la muñeca con una férula para evitar más daños de torsión o flexión.

¿Se puede prevenir el síndrome del túnel carpiano?

Los hábitos de trabajo adecuados pueden reducir las posibilidades de tener el CTS:

• El acondicionamiento físico y los ejercicios de estiramiento.

• Tomar descansos de actividades repetitivas.

• El uso de soportes o férulas para mantener las muñecas rectas.

• El ajuste correcto de terminales de trabajo para asegurarse de la postura y el posicionamiento de la muñeca correctos.

• La adopción de medidas para disminuir las vibraciones (guantes, almohadillas, eslingas) al usar herramientas que vibran.

• La rotación de puestos de trabajo o alternar las tareas.

• La adaptación de las condiciones de trabajo y los requisitos de empleo a las capacidades de los empleados.

En casos severos, el CTS puede resultar en daño permanente del nervio. No obstante, si se diagnostica y se cuida pronto, el CTS es muy tratable y no creará problemas a largo plazo.

In the event of an emergency, our first responders will be overwhelmed. It is critical for citizens to be prepared to take care of themselves, their neighbors, and their community for at least 3 days, and preferably 5-7.

ReadyMarin.org is Marin County’s website for information on emergency preparedness, whether you are just learning or an experienced emergency volunteer. Our mission is to provide guidance, training and resources to keep you and your family safe during an emergency, whether it requires you to evacuate or shelter in place. For those of you who wish to step beyond preparing your home and reach out to help your community in an emergency, train to be a Community Emergency Response Team (CERT) member.

The BA is a central part of the Estimating Team and is primarily responsible for acquiring, preparing and submitting bid documents. The BA is the liaison between Owners and the Estimators where bid documents and procedures are concerned as well as be-tween Estimators and the Bid Runner on bid days. The BA is directly responsible for the preparation of, and the expeditious flow of, documents (pre‐qualification packages, project advertising, bid database maintenance, bid documents, bid bonds, etc.) to ensure timely and complete bid submittal packages. Dutra is currently looking for an Estimating Administrator. This position supports the Estimating Department. Successful applicant will be re-sponsible for distributing, organizing and maintaining bidding documents such as plans, specifications, addenda and quotes. Will also work to support the Chief Estimator and Proposal and Contracts Manager in preparing estimates, proposals, Statement of Qualifications and marketing materials. Additionally, will assist the Contract Administrator with bonds, contracts and tracking SBE participation.

ESSENTIAL DUTIES AND RESPONSIBILITIES:• Distribute, organize and maintain bidding documents including printing, copying, filing and tracking distribution.• Assist in the preparation of estimates, proposals, SOQs and marketing materials.• Assist in the preparation of contract documents, bond requests and Small Business Enterprise (SBE) requirements and goals.• Keep accurate records of SBE participation. Ensure company is compliant with SBE regulations.• Maintain detailed and organized files on future, current and past projects.• Prepare reports, maintain estimating schedule and track contract deadlines.• Identify and track bidding opportunities.
