Fire Chief Report

As many of you have probably seen, the Harry Chapin Food Bank has been visiting our island on a weekly basis to provide meals to members of our community, and specifically the service industry workers who have been struggling to make ends meet during this water quality crisis. Our team members have had the great opportunity to volunteer and assist with this event and I am happy to report that the Harry Chapin Food Bank was able to hand out approximately 300 meals to our community in the first two weeks. I would like to thank our members who have volunteered, the members of our community who have supported this effort, and the Harry Chapin Food Bank for providing meals to our community during this time of need. Members of our team attended a Geographic Division meeting at the Lee County Emergency Operations Center to continue preparations for hurricane operations and to review updates to the hurricane plan in order to be able to ensure that we are all working collaboratively to ensure the safety of our members and our communities. Recently members of our department had the privilege of being a part of the Brotherhood Ride. The 2018 Brotherhood Ride was dedicated to 20 Fallen Heroes from Florida who died in the line of duty while protecting their communities. The riders cycle through the state of Florida for 7 days, covering over 600 miles and average 80-100 miles a day. The ride began in North Naples on September 9th and will ended on September 15th in Tallahassee, Florida. We would like to thank the riders for including our department along their way to honor our Fallen Brother Battalion Chief Michael Coenen.

A couple of weeks ago, we hosted a 9/11 Remembrance Ceremony at Fire Station 33 to honor the victims of this tragic event. I would like to thank the community and our members who attended the event and give a special thank you to our Honor Guard for putting on such a wonderful event for such a somber occasion.

Please join me in congratulating our newest Driver Engineer’s, Shaun Jensen, Billy Galewski, and Alex Gonzalez. These individuals were involved in the promotional examination process and have been selected from the eligibility list for the three vacant Driver Engineer positions. We will see their swearing-in ceremony in the coming months.

Operations Branch Supervisor-Executive Assistant Fire Chief Scott Wirth The search for the very best ladder truck for our community continued in August. The committee wrapped up its evaluation of the three preferred vendor’s products. The committee took a day trip to The Villages community to test drive and operate their 95’ mid-mount platform ladder truck. The hands-on experience really provided some invaluable insight into the E-One product offering. On August 27, the committee took a three-day trip to Pierce Manufacturing in Appleton, Wisconcin. Pierce flew the committee members to Wisconsin for two days of test driving and operating Pierce’s mid-mount 100’ platform ladder truck. The committee also received tours of their ladder, chassis and assembly plants receiving insight into the entire process that goes into building these complex vehicles from the ground up. The final recommendations were provided to the Chief for the next step in the process. Executive Assistant Fire Chief Wirth, EMS Division Chief Kraus, and Facilities and Logistics Manager Mike Annunziato attended the recent Operative IQ training and conference. Operative IQ is the inventory and asset management system used to track repair, supply, and inventory requests throughout the department. The event provided three days of training sessions on managing the various modules offered by Operative IQ. Emergency Medical Services (EMS)

EMS Division Supervisor- Division Chief Randy Kraus In August, the Emergency Medical Services Division conducted quite a bit of training on the heart. Our review consisted of the pathophysiology of the electrical system of the heart, and different arrhythmias that can cause heart related illnesses. Those protocols included bradycardia, tachycardia, bundle branch blocks, and ventricular dysrhythmias. We also reviewed congested heart failure, and cardiac related chest pain. In our monthly in service, our crews participated in cardiopulmonary resuscitation (CPR) contests with our new Quality CPR Manikins, which will be required nationally in 2019. The final training in August was on a new occlusive dressing, which is used for treating “sucking chest wounds” in trauma patients. The new dressing provides a one-way vent, which can automatically allow for the release of pressure build up within the thoracic cavity.

First, the proposed Fee Schedule Draft was completed and submitted to the Fire Chief. Secondly, the Life Safety Division has been working very closely with the Town of Fort Myers Beach in regards to Short Term Rentals. With an effective date of the Town’s ordinance of August 1, 2018 this led to a meeting to discuss the process for joint enforcement by the two agencies working cooperatively together. This will effectively add a bit more enforcement capability to the Fire Department’s Ordinance. A significant amount of time has been devoted by the Life Safety Team to get such companies as Century 21 Tri-Power to make their properties available to us for inspection. Working with Town Code Enforcement, they have scheduled numerous properties for inspection. Finally, thanks to efforts of Life Safety Specialist Lloyd Adams, working with our partners in the Safe Kids Coalition of Southwest Florida, our community is going to be the recipient of the inaugural Southwest Florida Water Safety Symposium. This symposium will be a community education event bringing a multitude of experts to educate our community about the prevention of drowning and water accidents in our community.

• A special thank you to Executive Assistant Fire Chief Ron Martin for the endless hours of research,

planning and coordinating with vendors to transition our phone and data communications to a state-of-the-art system. The new system reduces our monthly communications cost and allowed us greater control over internal programming of our phone system. Better and more efficient systems at a reduced cost, this is truly a win-win for our team members and community.

• Human Resource Assistant Patty Coram attended the annual Florida State Society for Human Resource Management Conference. This conference provides valuable updates to federal laws and state laws, compliance challenges, and best practices for a wide spectrum of human resource related issues. Two hot topics at the conference were ‘coaching employees’ and ‘employee engagement’ – these are areas that Tenzinga (our new performance management system) will address and aid us in retaining employees.

• Administrative staff began the final phase of records review of physical documents contained in onsite and offsite storage locations. We anticipate completion of this process by the end of the fiscal year, allowing additional space for better organization of filing current documents.

• The District’s auditor is scheduled to begin fieldwork for the current year’s audit the week of October 15th.

• The Fort Myers Beach Retiree Insurance Trust Fund published a request for proposal for audit

services with a response deadline of 3pm on September 28, 2018. • Twenty-six (26) applicants responded to the updated posting for the position of Assistant Chief of

Training, Education and Safety. Candidates have also completed the video interview portion of the assessment, and are now in the essay assessment.

HISTORY In previous meetings, discussions took place regarding options on funding the Life Safety Division and what tax versus fee ratios currently exist, in comparison to the desired ratio. Following those meetings, multiple presentations were delivered to the Board and community on the proposed Fee Schedule, as well as examples of the schedule’s impact. REFERENCE Florida State Statue 191.006: General powers (11) To charge user and impact fees authorized by resolution of the board, in amounts necessary to conduct district activities and services, and to enforce their receipt and collection in the manner prescribed by resolution and authorized by law. The recommended Fee Schedule is in direct correlation with the District’s Proposed 2018/2019 Budget.

RECOMMENDATION Staff recommends Board members approve Resolution 2018-07 and the proposed Schedule of Fees, superseding all previous prevention-based Fee Schedules.

A RESOLUTION OF THE BOARD OF COMMISSIONERS OF THE FORT MYERS BEACH FIRE CONTROL DISTRICT, LEE COUNTY, FLORIDA, TO ESTABLISH/AMEND USER FEES AUTHORIZED BY FLORIDA LAW; TO RESCIND ALL RESOLUTIONS AND FEE SCHEDULES IN CONFLICT; TO PROVIDE FOR SEVERABILITY; TO PROVIDE FOR LIBERAL CONSTRUCTION; TO PROVIDE FOR SCRIVENER’S ERRORS; TO PROVIDE FOR AN EFFECTIVE DATE.

WHEREAS, Chapter 191 of the Florida Statutes, in particular § 191.006(11),

authorizes the Board of Commissioners, by Resolution, to establish and charge user

fees in amounts necessary to conduct District activities and services; and,

WHEREAS, § 191.009(3) of the Florida Statutes authorizes the Board of

Commissioners to provide for a reasonable Schedule of user charges, including but not

limited to, charges for special emergency services, for fighting fires as a result of an

illegal burn, for responding to or assisting or mitigating emergencies that either threaten

or could threaten the health and safety of persons, property, or the environment,

including a charge for responding to false alarms, and for inspecting structures, plans,

and equipment to determine compliance with fire safety codes and standards; and,

WHEREAS, § 191.009(3)(e) of the Florida Statutes provides that the District shall

have a lien upon any real property, motor vehicle, marine vessel, aircraft, or railcar for

any charges assessed under § 191.009(3), Florida Statutes; and

WHEREAS, the Board of Commissioners has determined that user fees/charges

in the amounts described in the Schedule of Fees attached hereto as Exhibit A are

necessary to conduct District activities and services and that the adoption of said

Schedule of Fees is in the best interest of the public and the taxpayers in the District;

and,

WHEREAS, the Board of Commissioners has previously adopted a Schedule of

Fees, last amended by Resolution No. 2012-02; and,

WHEREAS, the Board of Commissioners now wants to amend the District’s

Schedule of Fees, in part, to implement plans review services and increase resources in

the Life Safety Division of the District.

NOW THEREFORE, be it resolved by the Board of Commissioners of the Fort

Myers Beach Fire Control District, that:

SECTION ONE. INCORPORATION OF RECITALS.

The recitals set forth above are true and correct and form a part of this

Resolution.

SECTION TWO. AUTHORITY.

The Board of Commissioners of the District is authorized to adopt this Resolution

by Chapter 191, Florida Statutes, especially § 191.006(11) and § 191.009(3), Florida

Statutes, and other applicable laws.

SECTION THREE. ESTABLISHMENT OF SCHEDULE OF FEES.

The Board of Commissioners hereby finds that it is necessary to charge user

fees/charges to conduct District activities and services in the amounts described in the

Schedule of Fees attached hereto and made a part hereof as Exhibit A. The Schedule

of Fees attached hereto and made a part hereof as Exhibit A is hereby adopted as the

Schedule of Fees for the District on all matters described in the said Schedule of Fees.

SECTION FOUR. LIENS IN FAVOR OF THE DISTRICT.

As authorized by § 191.009(3)(e), Florida Statutes, the District shall have a lien

upon any real property, motor vehicle, marine vessel, aircraft, or railcar for any

fee/charge assessed under § 191.009(3), Florida Statutes, including the fees/charges

described in the Schedule of Fees attached hereto as Exhibit A.

SECTION FIVE. RESCISSION OF ALL RESOLUTIONS IN CONFLICT.

The Board of Commissioners hereby rescinds all prior Resolutions and other

official action of the Board of Commissioners to the extent of any conflict with any part

of this Resolution or the contents of Exhibit A attached hereto. In particular, the Board of

Commissioners hereby rescinds all prior adopted fees/charges of the District, including

those fees/charges adopted by Resolution 2012-02, as amended, to the extent of any

conflict with any part of the Schedule of Fees attached hereto and made a part hereof

as Exhibit A.

SECTION SIX. SEVERABILITY.

If any section, subsection, sentence, clause, or other provision of this Resolution

is held invalid, unconstitutional, inoperative, or void by a court of competent jurisdiction,

such portion will be deemed a separate provision, and such holding shall not affect the

remainder of this Resolution or of the Schedule of Fees attached hereto and made a

part hereof as Exhibit A. The Board of Commissioners further declares its intent that this

Resolution would have been adopted even if such invalid or unconstitutional provision

was not included herein.

SECTION SEVEN. SCRIVENER’S ERRORS.

The Board of Commissioners intends that all sections of this Resolution and of

the Schedule of Fees, attached hereto and made a part hereof as Exhibit A, which

contain typographical errors that do not affect the intent of this Resolution or the

Schedule of Fees attached hereto as Exhibit A can be administratively corrected by the

authorization of the District’s Fire Chief, or his designee, without the requirement of

having the corrected Resolution having to be adopted by the Board of Commissioners.

VI. Convenience Fee: A. A convenience fee not to exceed more than 5% of the total service fee shall be assessed when

applicable for all forms of electronic payment including credit card payments.

VII. Cost Recovery and Collection: A. All fees for service are due at the time of service, plan review comments, inspection results, or permit

sign offs will not occur until all fees are fully paid.

B. Late Payment Fees: Fees not paid within the terms identified are subject to a 1.5% monthly finance charge after (30) days.

C. Returned Check Fee: Fees associated with returned checks shall be in compliance with Florida Statue

68.065 which are as follows: 1. $25.00 – Face value of $50.00 or less 2. $30.00 – Face value in excess of $50.00 but does not exceed $300.00 3. $40.00 – Face value in excess of $300.00 or 5% of the face value, whichever is greater

D. Direct costs of collection fees and legal fees associated with collection of Fire Department fees, shall

be added to the original invoice amount.

E. Submitting parties with outstanding fees shall be required to pay all outstanding fees in addition to any new project submittal and prior to receiving service.

VIII. Fees for Response of Malfunctioning or Nuisance Alarms, Detection, and Suppression Systems:

A. Fire responses to malfunctioning systems not only create a burden on Fire Department resources, but also create a safety risk for the general public. Occupants in structures where malfunctioning systems are considered “routine” may become acclimated to the malfunctioning system and not pay attention to these critical systems during a “Live” Emergency. It shall be the responsibility of the owner, agent, or occupants of a structure having fire and life safety systems to maintain the systems for the life of the building, by employing a qualified contractor. All structures and premises shall adhere to the inspection, testing, and maintenance requirement as defined in the Florida Fire Prevention Code and (FFPC) National Fire Protection Association Standards Number (24) and (25).

B. It is the responsibility of the owner, agent or occupant(s) to have a qualified contractor on site within two (2) hours of the Fire Department’s request.

C. If there is no responsible party on-site at the time of a malfunctioning life safety system, and in the interest of saving lives and property, the Fire Department will post a “Fire Watch” and fees shall be assessed in compliance with this document. (See section II (N)) 1. First Response: No charge will be incurred if corrective action is taken within twenty-four (24)

hours by the property, owner, or agent.

2. Should no corrective action be taken, and the Fire Department called back for the same alarm within a forty-eight (48) hour period, there shall be a charge of $75.00 and a Second Response fee in accordance with the following table:

IX. Submittal of Inspection, Testing, and Maintenance Reports by Contractors: A. The Fire Department shall provide a contractor portal for submission by contractors at no charge. All

contractors performing inspection, testing, and maintenance shall submit their reports electronically. It is the owner, or agent, and occupants responsibility to ensure that contractors submit their inspection findings electronically.

B. All contractors shall be responsible for notifying the Fire Department when a Life Safety system is taken off line or out of service immediately. Contractors that fail to notify the Fire Department of an out of service life safety system shall be fined a $150.00 fee for each occurrence.

C. Owners, agents, and occupants shall be assessed a fee for contractors who fail to submit inspection, testing, and maintenance reports electronically per the following: First Occurrence $95.00 Second Occurrence $188.00 Third Occurrence and all Subsequent Occurrences

ACTION [Discussion/Approval]

PURPOSE Rescind District Resolution 2015-07, which required prevention and life safety related vendors to use a specific system for project submittal and payment, as this is superseded by the adoption of a new Schedule of Fees and system.

HISTORY In 2015 the District implemented a fee and submittal system for fire safety systems related to the use of Brycer LLC electronic formatting systems. With the adoption of the recent Schedule of Fees, this system is no longer required and the fee no longer necessary to charge vendors. This item is in direct correlation with the District’s Proposed 2018/2019 Budget and Schedule of Fees.

RECOMMENDATION Staff recommends Board members rescind the 2015-07 District Resolution.

RECOMMENDED MOTION Motion to rescind District Resolution 2015-07: A resolution of the Board of Commissioners of the Fort Myers Beach Fire Control District, Lee County, Florida, to require all fire safety systems inspections, testing, and maintenance reports performed by third party vendors, to be submitted through an electronic format, through a vendor of the Districts choosing, effective November 1, 2018.

PURPOSE Approve compensation schedule ranges for new prevention positions.

HISTORY As part of the 2018/2019 Budget, the addition of prevention resources includes two (2) new classifications. For implementation, the District conducted a study of compensation levels for comparative organizations in the area, as well as assessed where the positions will fit in the existing District schedule, related to duties and market conditions. The position of Life Safety and Support Services Assistant is recommended to fit within the same range already established by the District for technical level assistant positions for the 2018/2019 Budget, at $45,893.49 to $60,575.30. The position of Fire Plans Examiner and Community Risk Reduction Officer is recommend to fill the range of $87,000 to $107,000 for 2018/2019.

RECOMMENDATION

It is recommend that Commissioners approve the listed ranges for the positions of Life Safety and Support Services Assistant and Fire Plans Examiner and Community Risk Reduction Officer.
