Welcome to the May/June edition of the Master Plumber Magazine for 2016!

What a busy first half of the year it has been, including some significant milestones achieved that our industry should be proud of.

The World Plumbing Day Breakfast held on Friday 11 March in Brisbane was a great success, with over 360 attendees and the support of many special guests. Attendees heard first hand from the Queensland Premier, Annastacia Palaszczuk of her support of such an important industry, and also the Hon. Mick de Brenni MP, Minister for Housing and Public Works of his commitment to listening to industry and understanding the core issues plumbers and gasfitters face. MPAQ was also proud to appoint our first ever female Ambassador for women in plumbing, Rebecca Senyard from ‘The Plumbette’ who shared her story of becoming a tradie and battling the challenges women face in a male dominated industry.

Following World Plumbing Day was the announcement of the establishment of the Service Trades Council, where the voice of our members will once again be present with the government on National policy development. As well as saying thank you to all our members who have assisted us in advocating for this positive step within the industry, I would especially like to acknowledge MPAQ’s Executive Director, Penny Cornah, whose passion and commitment to our industry is evident through her persistence in meeting and communicating with various Ministers, Industry Regulators and other relevant stakeholders on a regular basis. Penny commits herself to ensure our member’s voices are clearly heard at a government level, and takes the time to visit members face-to-face on as many occasions as she can.

So far this year we’ve had some great events and met some wonderful people at our PIPEs and Golf Days. Thank you to everyone who has made the effort to come along. Check out some pictures from the past few months on page 32.

MPAQ has had a win for the Plumbing Industry with the re-establishment of a dedicated plumbing industry regulatory body. The Service Trades Council (STC) Bill was passed in Parliament on Thursday 24 March.

MPAQ has been the key driving force in negotiations with this government. This important piece of legislation demonstrates that MPAQ is here to be a voice for the plumbing and gas community. For more information please refer to page 16.

So what has your Association been working on from a policy perspective? We have been working on a number of key items: • Security of Payments Review • Review of the Home Warranty Insurance Scheme • Licensing Review • Non-conforming Products• Housing Strategy • Public Health and Water Amendment Bill

Security of Payments Review We have undertaken extensive consultation with our

membership, as well as industry stakeholders and found that there is a clear and growing acknowledgement that the current legislative framework relating to building and construction industry payments requires reform. The matters currently being experienced by subcontractors are creating substantial solvency issues and are increasing the level of uncertainty. This makes effective and accurate business planning and tendering extremely difficult.

As part of implementation there is also a need to address other issues that relate to payments to ensure all aspects of uncertainty are addressed. These issues include variations and the use of bank guarantees.

There is no doubt that reform is needed in this area. This has been demonstrated by recent activity within the sector and well as at the roadshow consultations undertaken by the Government.

Home Warranty Insurance Scheme MPAQ has voiced some concerns regarding the current Home

Warranty Insurance scheme. This scheme is currently being reviewed by the Department of Housing and Public Works. MPAQ has advised the Department that it receives a number of complaints from members about the scheme as it applies to working on units, complexes or townhouses. For example, if a member is replacing a boxed gutter at a unit complex which covers multiple units, the QBCC enforces that Home Warranty Insurance be paid for each unit that the gutter comes into contact with. In some instances this can be more than the value of work required.

The Department was looking to implement the threshold if the insurable value of the work is more than $5,000 than home warranty insurance will be required. MPAQ has concerns that most work would be over $5,000 and therefore increasing the value to $5,000 will not achieve anything, nor will it solve the

issues raised. MPAQ believes the threshold should be increased to $20,000 and will continue to discuss this with the Department.

Licensing ReviewMPAQ has been involved in recent discussions regarding

the licensing review. There are approximately 250 licence classes under review, with Roofing and Stormwater licence classes included. The Roofing and Stormwater qualifications are taught in Certificate III Plumbing, and MPAQ supports that these should be licensed work under a plumbers’ occupational licence. Plumbers undertake the qualifications during their apprenticeship and are best placed to work in this area. The QBCC acknowledges Roofing and Stormwater in its top ten defects list, where it has remained for many years.

The framework for the fire qualifications and licence outcomes are also under review. We support the concept of making the licensing regime easier but we require further information to make an informed decision.

Non-conforming Products The prevalence of non-conforming products is a major

concern for the Queensland building and construction industry. MPAQ holds concerns for consumer safety and seek to better support our industry in meeting its obligation to provide installations that are safe.

We believe there is an urgent need to reform the current system to provide specifiers, purchasers, installers and certifiers with a clear mechanism to determine whether products are fit-for-purpose as defined under the National Construction Code. More must be done to remove non-conforming products at the point of sale and to proactively identify and remove from our buildings non-conforming products that slip through the net. MPAQ has prepared a submission voicing our concerns to the Department.

Housing Strategy MPAQ attended at the Minister’s request the Housing

Strategy Launch. A discussion paper has been developed seeking feedback from the community on the future direction for housing in Queensland. The discussion paper goes beyond just identifying improvements to the homelessness and housing assistance system, extending across the entire housing continuum from homelessness and social through to affordable rental and home ownership. The department is seeking assistance to help identify and shape the key strategic priorities that require action to create a housing system in Queensland that is accessible and affordable to all. As some members will be impacted by this, MPAQ will prepare a submission and work with the government on this important topic.

Public Health and Water Amendment Bill We have prepared a submission regarding the proposed

changes for to the Public Health and Water Amendment Bill, with details covered in President’s message on page 7.

In my last message, I mentioned a welcome announcement by the Hon. Cameron Dick MP, Minister for Health and Minister for Ambulance Services stating that a bill would be introduced enforcing private health care and aged care facilities to implement processes to control the potential outbreak of legionella in their cold and hot water supply systems.

On 17 March, the Minister introduced the amendment to the Public Health Act 2005. In his explanatory address to Parliament he stated, “International consensus is that the proportion of acute infections caused by legionella bacteria that are fatal tends to be much higher for healthcare acquired infections. This may be attributable to the fact that those at highest risk are likely to spend increased time as hospital inpatients or as residents of aged-care facilities, and that the complexity of the plumbing in these premises may encourage the multiplication of legionella bacteria.” He later went on to say, “Water risk management plans are recognised internationally as the most effective method of managing health risks associated with water related hazards.”

This Bill is a very welcome change and addresses a community health and safety concern that MPAQ have been lobbying for some time. The very concerning fact is that when compared to Europe, the U.K, and America, Australia is sadly lacking when it comes to appropriate state and national policies and regulations regarding legionella control in the private sector. State owned and run hospitals have regulations in place for legionella control, but for some reason (best known to our bureaucrats) they seemed to believe the private sector carried less risk in this area, and policy to protect the health and safety of patients in private health care and residents in aged care wasn’t warranted.

It is anticipated the Bill will be tabled in Parliament by the end of June. Prior to that, the Bill was referred to a Parliamentary Committee for review and open for public hearing, at which MPAQ gave representation and also prepared a submission on this important initiative.

As the Minister has eluded to, the crux of the proposed changes mandate the requirement for private health care providers and aged care facility operators to implement Water Quality Management Plans. In turn, the requirements of the Amendment Bill center around a set of guidelines released by a Federal Government body (enHealth) in late 2015. These guidelines and practices have been in practice in the northern hemisphere for some time. A document released by the World Health Organisation in 2007 on the prevention of Legionellosis, sets down recommendations or a format for water quality management plans, which is included in the enHealth guidelines.

Again I ask, why are we so lax in putting these practices in place? There are many in our political advisory system who conveniently start rambling about red tape creation or regulatory impact. To this I say rubbish, and the health and safety of the community should always take precedent. But I digress.

A brief summary of the Amendment Bill before parliament is:

• Requirements for Water Risk Management Plans

• Contents of the plans

• Requirements to amend the plans

• Complying with the plans

• Obligations to notify the Department of Health of Legionella

• Obligations to provide copies of reports

• Power to enter facilities

An interesting aspect to the guidelines is the recommendation for each facility to form a risk management committee which should include the plumbing contractor servicing the facility.

So what does this mean for you, the contractor? In a nut shell, it means mandated management and maintenance of cold and hot water infrastructure in the mentioned facilities, which translates into more stringent thermostatic mixing valve (TMV) maintenance. So if you haven’t already done so and you wish to work in this area, get your TMV endorsement. Having said all that, nothing is certain until the Bill is passed through Parliament.

Changes to the Plumbing Code of Australia

In 2016, the Plumbing Code of Australia (PCA) will include two major changes. The first major change regards the plumbing standard AS/NZS 3500 Parts 1 to 5 and the adoption of the 2015 editions.

The second major change surrounds the restructuring of Parts A2 and G1 to implement the improved WaterMark Certification Scheme.

It is important to note that while PCA 2016 takes effect in all States and Territories from 1 May 2016, the improved WaterMark Certification Scheme is not expected to be fully implemented until later this year. To cover this, a transitional clause (A2.0) has been included in the PCA to allow the content of Part G1 from 2015 to continue to be used until this time.

New QBCC Commissioner AnnouncedThe new Commissioner for the Queensland Building

and Construction Commission (QBCC) has been appointed. Mr Brett Bassett is currently the Queensland Regional Commissioner for the Australian Securities and Investment Commission (ASIC) and will commence his role with the QBCC on Monday 30 May 2016.

Minister for Housing and Public Works the Hon. Mick de Brenni MP has endorsed the recommendation to appoint Mr Bassett to the role of QBCC Commissioner as he will bring a wealth of knowledge and experience from his time at ASIC, the Australian Competition and Consumer

Commission, the New South Wales Department of Fair Trading and the Queensland Police.

Feedback Received on Security of Payments

Master Plumbers across Queensland experience the current system of payments every day and it has been their strong feedback that this is an area that needs reform. It is not only insolvency that leaves subcontractors unpaid for work they have performed but it is also the payment practices that are encouraged under the current legislation. These practices have led to the bankruptcy of countless small businesses while many others experience setbacks costing their business significant funds for a number of years. Consultation has shown how common this practice is.

Below is a short summary of the major issues identified through consultation:

RelationshipsDue to the small number of head contractors, it is vital for

subcontractors to maintain a positive relationship with these contractors in order to be able to continue to successfully tender. These relationships often come at a financial cost as subcontractors are regularly requested to accept lower payments, particularly at final payment stage, in order to maintain a favourable relationship and secure additional work on the next project with the same head contractor.

Payment TimeframesConsultation has shown that it is rare for a subcontractor

to be paid on an agreed date. The delay in payment varies from days to months. During this time head contractors, who have received the funds from the principal, are not restricted on how this money is used. Lack of on-time payment results in the requirement for subcontractors to seek alternative funds to cover operational costs such as labour and supplies.

Bank GuaranteesHead contractors require bank guarantees from

subcontractors. It is often agreed that these guarantees will be released back to the subcontractor at the completion of a project and at the end of the defect period. However, consultation has stated that these timelines are rarely met and are in fact commonly delayed by significant periods.

VariationsIt is regular practice for variations to be a significant part

of a project (consultation suggests 10-15% of total cost in dollar terms). Variations are not required to be in writing and are often paid ‘on account’. ‘On account’ payment means that although the dollar amount quoted by the subcontractor is paid by the head contractor, it is not an amount accepted as accurate by the head contractor. The amount is instead subject to later negotiation which often occurs at final payment, which may be many months later.

MPAQ also strongly believes we need to address the issue for projects under $20 million, as these projects are more likely to significantly impact on the smaller plumbing and gas businesses throughout Queensland. As the same legislative environment currently applies, the smaller plumbing businesses are more likely to be sub- sub-contractors, with even tighter cashflow issues to contend with. MPAQ would therefore respectfully argue that any evaluation of the current legislation, and any introduction of new legislation, should also take into account actions that will positively impact on the smaller business.

Plumbing and Drainage Compliance Activities

One of the main roles of the Queensland Building and Construction Commission (QBCC) under the Plumbing and Drainage Act 2002 is to investigate complaints about plumbing and drainage work which is defective, non-compliant or has been performed by an unlicensed person.

The QBCC has a dedicated plumbing and drainage investigation team, which investigates complaints, monitors compliance with licensing requirements and engages with licensees and industry to educate about legislation, codes and standards.

Recently, the proactive role of investigators has increased, with plumbing investigators now conducting licence checks on sites across Queensland on a daily basis.

These licence checks, along with other investigative activities, have led to 10 penalty infringement notices (PINs) being issued for performing plumbing and drainage work without a licence so far this year.

QBCC Acting Commissioner, Kellie Lowe said, “The QBCC is committed to protecting public health and safety by ensuring plumbing and drainage work is performed to a high standard by appropriately licensed individuals.”

“To help identify non-compliant or defective work more easily, the QBCC has introduced a complaint form specifically for complaints about plumbing and drainage work.”

This form is available on the QBCC website at www.qbcc.qld.gov.au and can be used by licensees to notify the QBCC about unlicensed or defective plumbing and drainage work.

We believe there is an urgent need to reform the current system to provide specifiers, purchasers, installers and certifiers with a clear mechanism to determine whether products are fit-for-purpose as defined under the National Construction Code.

We believe there are ways to achieve this:

Prohibit the sale of products without WaterMark • The electrical industry is reeling from the “infinity cable”

debacle, where counterfeit, substandard electrical cable was imported, sold and installed affecting 40,000 installations. There is a potential for the substandard cable to cause injury through electrocution and property damages via the associated fire risks.

• A non-conforming products group was formed with an alliance of industry Associations who share an interest in the specification, installation and certification of building, plumbing and electrical products in Queensland.

• The impact of non-conforming products is a major concern to the Queensland building and construction industry, where non-conforming products do not meet regulatory, Australian or industry standards.

• The prevalence of non-conforming products presents very real concerns that may not be obvious at the time of installation, with the consequences possibly not being realised for some time and only after there has been a failure or fatality.

• Even with the current levels of controls provided by WaterMark, ‘plumbing and drainage products’ are cited as the area most likely to be found to be non-conforming.

• By not having proper controls at the point-of-sale, the problem is not being addressed and the responsibility for ensuring fit-for-purpose falls to products with the plumber, builder and certifier.

Point of Sale legislation could help solve the issue of non conforming products entering the marketplace. With the proliferation of cheap imported products that do not require Watermark for import or sale, we have merely accepted the lowest common denominator. This is akin (for example) to the importation of vehicles to be sold and driven here in Australia without the requirement to meet the required safety standards. We must then question why we allow the import and sale of products directly responsible for the supply of drinking water and the removal of waste, without the requirement for mandatory standards to be met?

Currently, the responsibility of policing the installation of unapproved products falls onto the installing licensed plumbing / drainage contractor whose responsibility should be concentrated on installation to the relevant Australian Standards. Unfortunately, with the vast quantity of non watermarked products available in many hardware stores, the handyman and DIY markets are not policed. Watermark should encompass point of sale legislation to truly protect water and waste infrastructure and intern the construction industry. If non approved products cannot be sold or purchased they cannot be put into service legally.

Currently the Water Efficiency Labelling and Standards (WELS) scheme implements point-of-sale requirements on products that fall under the scheme (lavatory equipment, clothes washing machines, dishwashers, urinals, taps, showers and flow controllers). These products must display, at the point of sale, a star rating of their water efficiency and information about the volume of water used. Toilets and washing machines also have minimum water efficiency standards. These products must be registered with the WELS regulator before being offered for sale. It is proposed that similar restrictions be implemented surrounding the Watermark scheme.

Too often I hear people say that they look for the WaterMark, and if the product has it that MUST mean it’s okay to install. This can be a real trap if you rely on this assumption completely.

The Australian Building Codes Board is the body in Australia who is responsible for administering the WaterMark Scheme.

Their website is a wealth of information so I quote from their site (refer to www.abcb.gov.au/product-certification/watermark).

“What is WaterMark? Material and product failures in plumbing systems can cause contamination of the water system and be a public health concern. The WaterMark Certification Scheme is a mandatory certification scheme for plumbing and drainage products to ensure that plumbing and drainage materials and products are fit for purpose and appropriately authorised for use in plumbing installations.

The Plumbing Code of Australia requires certain plumbing and drainage materials and products to be certified and authorised for use in a plumbing or drainage installation. These materials and products are to be certified through the WaterMark Certification Scheme and listed on the WaterMark Product Database.”

Innovation and technological advances often make it difficult to assess a product that has multiple functions and operations against only one Standard. A simplistic example could be that you have invented a new pencil and want to have this approved against an existing Standard for pencils. However, this pencil has various design features like an eraser attached to the end, a built in sharpening device and food grade material instead of graphite, for when people lick the end of the pencil.

The problem arises because although it is only a pencil, there may also be Standards for the other functions. So which Standard applies to this product so an approval can be granted? Or do they

all apply? Is it the responsibility of the WaterMark Conformity Assessment Body to identify all the applicable Standards and request the necessary testing? The manufacturer may ask that it only be assessed as a pencil as the other features are not integral to the function of the pencil.

Now relating this back to plumbing products and backflow prevention, this exact issue is being seen every day where products are designed to be connected to the water supply, perform multiple functions and operations through technical advancement and innovation.

These products include cooking equipment, beauty equipment, dental equipment, bathroom fixtures, hygiene equipment, agricultural equipment, and the list goes on and on.

The Australian Backflow Prevention Association (BPAA) is regularly made aware of WaterMarked products being sold throughout Queensland where the risk of a cross connection may be possible, should a backflow event arise. Upon clarification or investigation, often the protection offered is inadequate and does not meet the requirements of the applicable Standard AS/NZS2845.1-2010. Therefore installation of this product to the water supply would require additional backflow protection in line with the applicable hazard rating. This adds additional cost to the installation and confuses the end user when they believed the WaterMarked product would suffice.

Manufacturers need to be aware that even though they have invented a new ‘pencil’ and it receives approval as a ‘pencil’, it may also need to meet additional Standards before it is suitable for installation and use in Australia.

Notifiable Work expands the amount of plumbing and drainage work that does not require a permit or mandatory inspections. When a licensee performs notifiable work, they must simply lodge a Form 4 to the Queensland Building and Construction Commission (QBCC) within 10 days of the work becoming live or an invoice being issued. We have recently had a few requests from members in relation to Notifiable Work.

Q: Repairs to a Thermostatic Mixing Valve (TMV) changing washers – Is this Notifiable Works?

A: Repair work would be considered minor work. However if the plumber replaces the TMV then it is Notifiable Work and a Form 4 is required.

Q: If a plumber is replacing a water filter cartridge, is this Form 4 or Minor work?

A: Replacing a domestic water filter cartridge is unregulated work. It can be undertaken by an unlicensed person. No form 4 is required if a licensed person replaces the filter cartridge for a domestic water filter.

Q: In the schedule of Notifiable Work, page 2 it says, ‘Plumbing and drainage work that is not notifiable work’. Should this say that it is compliance assessable work?

A: The examples referred to in Part 2 of Schedule 2 are compliance assessable work.

Notifiable Work Q & AQ: If you replace a soakage trench in a septic system – is this

minor work or Form 4?

A: For the replacement of a soakage trench for a septic system (or an on-site sewerage treatment or grey water use facility), a compliance permit is required.

Q: If I am moving a coffee machine at a service station from one area to another, is this Form 4 work?

A: A coffee machine is considered an appliance (definition in the glossary). If the work doesn’t require extending or altering the existing pipe work, it would be considered minor work. If a new tap/connection is required or work necessary to extend the existing connection, then the work becomes notifiable. This is also the case if a tundish or other connection to sanitary drainage is required or extended.

Q: If a plumber invoices work in stages, are they required to submit a Form 4 at each stage or just at the completion of work?

A: Under s87 of the Plumbing and Drainage Act (PDA), a Form 4 must be given to the QBCC Commissioner within 10 days after the completion of the work. Notifiable work is completed when the work becomes operational or an invoice has been issued for the work. So in the above example, a Form 4 is required to be lodged after the invoice is issued, however, if the invoice/s are for a progress payment (part of a single transaction) a Form 4 will only be required when the work becomes operational or an invoice has been issued for the work that formed part of the original quotation for the work.

MPAQ have had a win for the Plumbing Industry with the re-establishment of a dedicated plumbing industry regulatory body. The Service Trades Council (STC) Bill was passed in Parliament on Thursday 24 March.

MPAQ has been the key driving force in negotiations with this government. This important piece of legislation demonstrates that MPAQ is here to be a voice for the plumbing and gas community, to initiate and spearhead change in increasing the professional standards of the industry, to be vocal when it comes to Government policy and initiatives, and to be the body that stakeholders (like the Government) call and ask “What do you think?”.

What Do I Pay Superannuation Guarantee Contributions On?

The MPAQ Workplace Relations team are regularly asked this question, “What do I pay Superannuation on?”

Currently the Superannuation Guarantee (SG) rate is 9.5%, which is payable on the Employee’s ordinary hours of work. The maximum ordinary hours of work defined under Fair Work legislation is 38 hours per week (although some employees regularly work more than 38 hours per week, these hours are classed as reasonable additional hours).

These are the current minimum amounts that SG contributions are calculated on, for employees including the following types of payments (subject to changes):

• Allowances (other than a reimbursement of expenses)

• Bonuses

• Christmas bonuses

• Payments in lieu of notice

• Commission

• Over Award payments

• Shift loading

• Casual loading

• WorkerCover payments, including top-up payments paid by the employer where work is performed

• Pay for annual holiday leave taken

• Government (wage) subsidies (e.g. wage subsidy scheme allowance)

• Pay for Personal/Carers leave (sick leave)

• Pay for long service leave taken

• Director’s fees

• Payments to a contractor who is taken to be an employee under the Superannuation Guarantee (Administration) Act 1992

The following types of payments are not included in the minimum amount that SG contributions are calculated on:

• Overtime

• Reimbursement of expenses (e.g. travel costs)

• Benefits subject to fringe benefits tax

• WorkCover payments (including top-up payments) where no work is performed

• Payments when on jury duty, defence forces reserves leave or emergency services leave

• Parental leave payments (includes maternity, paternity and adoption leave)

• Annual leave loading

• Redundancy payments

• Other payments paid by the employer on termination of employment

• Dividends

• Partnership and trust distributions

so what does this actually mean? The industry will have a dedicated Plumbing Industry Regulatory body, known as the STC.

The STC will:

• Confer on National policy development and implementation for the trade

• Have direct access to the Minister to report on any issues relating to the trade

• Make recommendations to the QBCC commissioner about the performance of the commissioner’s functions under the Act

• Establishing a panel of the council to assist the QBCC commissioner, to be involved in complex licensing matters.

The Hon Mick de Brenni MP, Minister for Housing and Public Works quoted in Parliament, “During our extensive consultation process, a number of stakeholders have expressed a desire for the responsibilities of the Service Trades Council to be expanded to incorporate other allied trades such as fire

protection, gas fitting, roofing, storm water and mechanical services. Our government’s election commitment was specifically linked to the plumbing industry, however there may be benefits for including other trades under the responsibility of the Service Trades Council in time. Further consultation would need to be undertaken to consider any potential impacts on the affected industries and, of course, the community. The government is proposing to review the licenses administered by the Queensland Building and Construction Commission. Expansion of the Service Trades Council to other trades will be considered as part of this review. The bill sets out the minimum membership requirements. Should the scope of the Service Trades Council be expanded in the future, additional appropriately experienced members can be added without further legislative amendments. Once again I would like to thank all of the stakeholders for their engagement in this process.”

The Service Trades Council is due to commence in July this year. MPAQ looks forward to being a part of Council and will raise key issues that impact our industry.

World Plumbing Day A Great Success

11 March, Every Year, Everywhere

MPAQ celebrated World Plumbing Day with the industry’s biggest breakfast of the year on Friday 11 March at the Brisbane Convention and Exhibition Centre. The breakfast had a great support with over 360 attendees, coming together on such a significant occasion to celebrate the important role plumbers and gasfitters play in modern society.

Immense support was seen also by the Government, with special guests in attendance including Premier Annastacia Palaszczuk, Premier for Queensland and Minister for the Arts, the Hon. Mick de Brenni MP, Minister for Housing and Public Works, the Hon. Grace Grace, Minister for Employment and Industrial Relations, Minister for Racing and Minister for Multicultural Affairs, Rob Molhoek, Shadow Minister for Housing and Public Works and Anthony Chisholm, Labour Candidate for the Senate.

The Premier spoke on behalf of the current Queensland Government, acknowledging the close working relationship this Government has with both MPAQ and the Plumbers Union, and also the cross-support of opposition with the Shadow Minister for Housing and Public Works, Rob Molhoek’s attendance. She re-iterated the importance of having properly skilled and licensed plumbers, as they are critical to a healthy and functioning society. It’s days like World Plumbing Day that awareness can be spread to educated communities on how

important the role of a plumber and gasfitter is in their home, and how the Government wants to ensure that it is licensed plumbers who have installed dependable, safe water services for our society.

First Female AmbassadorThe Premier also spoke on her commitment to addressing

key concerns for women, in line with National Women’s Week. As an advocate for encouraging women to achieve their goals and increasing opportunities for women in the workforce, she announced the first ever women in plumbing ambassadorship, awarded through MPAQ to Rebecca Senyard from the Plumbette.

As one of only 46 women out of the 16,000 licensed plumbers in Queensland, Rebecca spoke about her plumbing journey, some of the challenges she has faced along the way and where her career has led her today.

As a female apprentice working alongside her Dad, Rebecca wanted to become a plumber so she could learn how to run a business, and some day take over the family plumbing company. She spoke of times when it was truly challenging in her apprenticeship, as she had to learn to manage discrimination, sexual harassment and deal with the isolation and doubt that can come by being in the minority.

After her apprenticeship, the next challenge was dealing with being pregnant while on the tools, and how often she would be throwing up in toilets rather than installing them.

Three children later and at a time where the business had to close, Rebecca pursued her commitment to her plumbing blog, the Plumbette. Originally initiated to share the experiences she had as a female plumber with her dad, and the challenges that came with managing a business and children, her blog became a key communication tool to her readership, inspiring female apprentices who once gave up on a plumbing career to pursue their goals and finish what they started.

MPAQ are looking forward to collaborating with Rebecca in 2016 to promote plumbing as a career to individuals, no matter their gender and promote equality within the industry.

World Plumbing DayCommitment to Removing Barriers in our Industry

The Hon. Mick de Brenni, Minister for Housing and Public Works spoke at the event about how the current Government is committed to removing barriers from our industry, and providing more collaboration and opportunities within the trade through the reduction of red tape, addressing initiatives to assist businesses in getting paid on time and in full, and supporting initiatives for gender diversity within businesses. The Minister acknowledged that MPAQ was one of the first industry bodies to welcome him to the role. The Minister also recognised that the Government and MPAQ share an understanding of the importance the building and construction industry has on delivering jobs growth in our state, none of which can happen without plumbers. He also spoken on important reforms which will see this industry better regulated through a dedicated plumbing industry body, the Service Trades Council.

On stage at the event, the Minister was interviewed by two industry leaders, with the first question surrounding how the Minister’s agenda fit with addressing the welfare of family businesses. The Minister’s response was that he was committed to going out and meeting with small business owners and found a cultural and systemic problem with sub contractors getting paid for the work they perform.

Plumbers’ Union representative Mick Weich stated that the Minister’s actions directly affect everyone in the industry, so how will the Government’s agenda help stimulate construction spending in regards to large projects. The Minister responded by noting a number of issues, including non-conforming building products, particularly imported and poorly regulated. He stated that the Government are looking to limit importation of non-regulated products and also the similar issues surrounding bathroom pods.

“The draft Infrastructure Plan is currently under review and due for release shortly, which will include lists of projects statewide to help stimulate the economy. The Housing Strategy will be released in a couple of weeks, and Government will invite comment on the changing nature of home ownership, what the future of housing should look like, sustainability, water and energy efficient homes,” he said.

and champion, Steven Richards. Steven has been in partnership with Laser Plumbing Group with Porche Performance Racing for over five years and we were very fortunate that he could share his story of racing. He told the audience in particular of his father’s influence when he was growing up as child and that at the age of 15 he was driving go karts, later on moving into Formula 4, racing at the Victorian State Racing circuit.

In 1994, having finished an apprenticeship as an aircraft mechanic to ensure he had a profession to fall back on, Steven won his first major race and joined Gary Rogers Motor Racing. He went to Europe to try his luck as a test car driver, and came back to co-drive at Bathurst and won.

Bob Kimlin, MPAQ Past President and I had the opportunity to undertake a road trip in early March. The trip commenced in Mackay with a visit to apprentices at CQ University. I provided an update to second year apprentices about industry changes and Bob shared his stories with the group, encouraging the apprentices to continue to train and upskill after their apprenticeship is completed. Bob also highlighted the importance of giving back to the industry that you work in and how being part of MPAQ has been invaluable to him over the years.

Elizabeth Palmer-Bright from the Queensland Building and Construction Commission (QBCC) also attended and gave a presentation to apprentices enrolled in the Certificate III in Plumbing. Information was provided to the apprentices about the functions of the QBCC, licensing (including changes to requirements for provisional licensees upgrading to an open licence), completing and providing evidence relevant post-apprenticeship practical experience, requirements for working under licensed contractors and notifiable work.

Michael Wilson, CQ Plumbing Teacher offered a tour of the recently renovated plumbing and gas workshops at CQ, which included a 4-storey plumbing tower. The facilities are very neat, tidy and impressive.

MPAQ offers a free apprentice membership with a range of benefits suitable to assist apprentices. We also hosted a Mackay Division meeting whilst in town and were fortunate enough to have Jason Costigan, Member for Whitsunday and Shadow Assistant Minister to the Opposition Leader attend. Jason had the chance to hear first-hand about the local issues impacting plumbers, drainers and gasfitters. The QBCC, along with the Mackay Regional Council plumbing inspectors attended this very informative dinner meeting. I had the opportunity to provide attendees with an update on the new Service Trades Council, the licensing review, the review of the Plumbing and Drainage Act and notifiable works.

A couple of key issues below were raised by local licensees:

• Plumbing and drainage work on mining land - licensees raised issues in relation to non-compliance. Elizabeth from the QBCC advised that they had previously been taking action to assist local governments with their compliance activities in relation to work on mining land in the Central Highlands area.

• Increased activity of handymen working in the Mackay area and performing regulated plumbing and drainage work - Closure of mines in the Mackay area has led to increased

numbers of handymen in the area. QBCC will continue to monitor the performance of regulated plumbing work to ensure that it is performed by licensed persons. QBCC also undertook compliance activities in the Mackay area in late 2015.

After Mackay, Bob and I travelled through to Townsville and stopped at Proserpine, Airlie Beach and Bowen on the way. We visited a number of members at their office or onsite and provided them an update on the industry. We also stopped in at the local plumbing supply stores to meet and greet and dropped off some Master Plumber magazines.

When we arrived in Townsville, we attended the Security of Payments sessions which the Hon. Mick de Brenni MP, Minister for Housing and Public Works hosted. This session deliberated the discussion paper that the Department circulated to ensure that all subcontractors get paid for the work they perform.

The Association has undertaken extensive consultation with our membership as well as industry stakeholders and found that there is a clear and growing acknowledgement that the current legislative framework relating to building and construction industry payments requires reform. The matters currently being experienced by subcontractors are creating substantial solvency issues and are increasing the level of uncertainty. This makes effective and accurate business planning and tendering extremely difficult.

The Minister met with a number of MPAQ members during his visit to Townsville. Members shared insights into our industry and in particular how the government can do better on the apprenticeship deal on government projects. The Minister heard first hand from members how the good players in the plumbing industry sometimes get a raw deal on many construction projects including government projects. The Minister took this feedback on board and his department is currently reviewing this issue. I would like to thank the Minister for attending and for engaging with the plumbing community.

I would also like to thank Bob for hitting the road with me. We are very fortunate to have board members who give up their time to attend these regional trips to meet with members.

The Importance of Fire Hydrants in Buildings

The purpose of the Queensland Fire and Emergency Services (QFES) is to enhance community safety, quality of life and minimise the impact of loss of life from fires, hazards and emergency incidents with people.

Often the first responders in an emergency fire situation are the firefighters. Life safety is one of the most important jobs of a firefighter, and they often risk their own lives in order to help others.

Fire hydrant systems provide a safety measure or emergency equipment, which provides a source of water to assist fire authorities in the event of a fire. The fire appliance is a critical part of their firefighting operation as it enables a firefighter to connect from a hydrant so they can enter safely into a building to fight fire.

A Fire Hydrant Booster Assembly enables the fire appliance to boost the hydrant system to a desired pressure for the connection of fire hoses to the hydrant system.

In Australia, the Building Code of Australia (BCA) sets out the Deemed-to-Satisfy Provisions for a hydrant system, required both within and outside buildings to the degree necessary to facilitate the needs of the QFES.

The end-point of a fire hydrant system is the Fire Hydrant (also known as a Hydrant Valve, Landing Valve or Millcock). Fire Hydrants are required to be provided in accordance with the provisions of AS2419.1-2005 “Fire Hydrant Installations”.

Fire hydrants are required to be provided to serve a building when there is a total floor area greater than 500m2 and where a fire brigade is available to attend a building fire.

Of the two different types of fire hydrants available, a ‘Feed’ hydrant is used as a source of water supply, where water is drawn or fed into the QFES Appliance. From the appliance, the water is pressurised up to an operational 700KPa. The hydrant hoses are then run directly from the appliance to the fire source.

On the other hand, an ‘Attack’ hydrant system is used as name suggests; as a point of attack. These hydrants are used as a base point from which to connect the hydrant hose directly to and from these points to the fire source. Attack hydrants are typically designed with more pressure, contain a booster assembly and may or may not require pumps and on-site water tanks, dependant on the situation and type of mains pressures available. The Attack Hydrant is not intended to supply an appliance.

Hydrant LocationsThe location of fire hydrants must consider accessibility,

obstructions and proximity to the building being protected. External hydrants are preferred by fire authorities to internal hydrants and they provide a safer entry point to fight the fire source.

In determining the hydrant coverage, the distance from the hydrant to the fire source is taken as the most direct laid on the floor. For fire hydrant coverage where external hydrants cannot provide sufficient protection for the whole building, internal hydrants must be provided to protect all parts of the building.

Fire hydrants may be located in the following locations:

• Externaltoabuilding

• Internaltoabuilding

• Ontheroof top

• Servinganopenyardormarina.

External HydrantsExternal hydrants servicing multi-storey buildings will

generally only be able to access one storey below and one storey above the point of access, provided that all points on the floor are covered given the 60m hose limit.

External hydrants must be above ground and provide two separate outlets. Hydrants on council water mains using spring type hydrants can be used to provide coverage.

Internal HydrantsInternal hydrants are required to protect all parts of the

building that cannot be protected by an external hydrant. They will only cover the level on which they are installed.

All parts of the building must be within reach of a 10m spray from the fire hydrant nozzle given the 30m hose limit and the hose must extend 1m into the area being protected by the hydrant system.

Roof Top HydrantsEnclosed roof top plant rooms (other than lift machine

rooms) require a fire hydrant if they exceed 250m2.

Servicing an Open Yard or Marina:

• Hydrants must be located to protect all areas of an open yard and marinas following the same requirements as external fire hydrants.

Most contractors know that if you carry out ‘building work’ in Queensland you need a licence from the Queensland Building and Construction Commission (QBCC). But many do not know how wide ranging ‘building work’ can be and also just what requirements they need to meet in order to comply with the QBCC licensing requirements.

What is ‘Building Work’?The definition of Building Work is very broad, and includes

‘the usual suspects’ such as constructing or renovating a building (builders and carpenters), the improvement of a building (painters) and the provision of lighting, heating, drainage and sewerage (plumbers) in connection with a building.

Within the definition of Building Work are types of work that you may not know require a QBCC licence, such as:• Installing air conditioners (special rules apply if you’re an

electrician)• Restumping buildings• Structural landscaping

Certain work is excluded from being caught in the requirements of ‘Building Work’ and include electrical work, work by an engineer or surveyor, erecting scaffold, and certain types of Building Work where the work is under $3,300.00 in value.

It’s a common held belief that all electricians are excluded from holding a QBCC licence - this is incorrect. For instance, if you are an electrician that installs ducted air conditioners you will need a QBCC licence as this is Building Work. Further, if you are an electrician that carries out associated or ancillary Building Work in conjunction with electrical work and that ancillary work is over $3,300 in value, then you will need a QBCC licence. Ancillary or associated Building Work can be any Building Work that is work associated with the installation and can include installing brackets and laying foundations.

Licence RequirementsOnce you’ve got the correct QBCC licence, that’s it right?

WRONG!

You need to ensure that you continue to meet the requirements to hold the licence and avoid demerit points and penalties (which can lead to licence suspension and cancellation).

Some of the requirements include:

• Continuing to satisfy the financial requirements for licencing

• Adequately supervising any work being carried out by your employees or subcontractors that are working under your licence (8 demerit points if you fail to do this)

• Have written contracts in place, from the head contract all the way down the contractual chain to sub-subcontractors (4 demerit points if you fail to do this)

• Payment of a judgement debt (10 demerit points if you fail to do this)

• Keeping documents for 7 years (4 demerit points if you fail to do this)

• Stating your licence number and correct licensed name in any advertisements

If you fail to meet requirements and incur demerit points, be warned that if you accumulate 30 demerit points within a three year period you face disqualification from holding a QBCC licence for 3 years.

Further, if you accumulate another 30 demerit points within 10 years of the first ban you are disqualified from holding a QBCC licence for life.

Everhard Industries Launches into its 90th Year

National manufacturer and distributor, Everhard Industries Pty Ltd, officially launched its 90th anniversary year celebrations on Tuesday 22 March (World Water Day).

Member Milestones

Who founded the company and when?

Neil T Fallon founded our company in 1962. Back then we were an electrical contractor and we diversified to plumbing, drains and hot water in 2006.

How has the company changed over the years?

We purchased Neil T Fallon Electrical Contractors in 2005 when Neil retired with an idea to leverage the brand and good reputation across other trades. From 2005 to 2016 we have

grown from a small company of 23 people to a medium sized contractor, employing a team of almost 150 people. We now provide electrical, data, TV reception, appliance repairs, plumbing, drainage, hot water, drain relining, leak detection, air conditioning, carpentry and handyman services.

What does your company specialise in?

We specialise in the provision of highly responsive trade solutions to home and business owners. We aim to be the company of choice for all those who recognise exceptional customer service, quality and honesty. We are very careful in choosing who we work for. Over 75% of our work is for repeat and referral customers.

What have been the company’s major highlights?

We are very excited as we moved into our new premises at Mansfield in April. We believe strongly in providing an exceptional environment in which to work and our new premises has a gymnasium, three lunch areas, one fashioned to look like a bar, one a café and an outdoor dining deck with a great view of our garden. All of our team come to our in-house training room for two hours training every week. In conjunction with our team we have developed a culture plan to ensure balance between fun and high performance.

How do you feel the industry has changed over the years?

The industry has changed significantly since 2005. The internet has changed the way we advertise and the way we reach our staff and customers. Mobile phones, tablets, GPS tracking and mobility devices have improved our ability to respond quickly and communicate better. The world is getting smaller and we have been lucky enough to form alliances with companies in other states and overseas to help us stay at the cutting edge of the industry through sharing of clever thoughts and ideas.

How has your subscription to MPAQ helped the business over the years?

We have used MPAQ for technical advice over the years and this has helped us keep up to date with what is happening in the industry. We plan to remain members as long as we provide specialist plumbing solutions.

What are your future goals for the company?

We are planning to continue growing. In 2017 we will grow our revenue 20%. Our stretch goal is to achieve revenue of $50 million in 2020. We may add security or pest control to our range of solutions in the future and we have toyed with providing drain solutions to all capital cities.
