Windsurfi ngWith FREE tuition in windsurfi ng included at most of our resorts, there’s no excuse not to have a go. Whether you are experienced or starting out, our range of clinics, private lessons and RYA courses give you the opportunity to master the sport.

We have a wide selection of boards to suit all abilities for both adults and children, from high volume teaching boards to shorter wide style and low volume free-ride boards. All are highly regarded brands such as Tushingham and Starboard.

Windsurfi ng conditions are usually good at all our beach resorts, lighter winds in the morning are ideal for beginners, and strengthening afternoon winds suit the more intermediate. And if you are keen to learn ‘Stand Up’ Paddle Boarding, we have Paddle Boards at most of our resorts.

Sailing Whether you are an adult or child, a complete novice or simply need a refresher, we can help. We operate a variety of FREE sailing sessions and clinics throughout the week tailored to ability and with the aim to get you out on the water as quickly as possible. Simply come along to an informal briefi ng at the start of your holiday to book your spot.

For those looking to accelerate their progress, we have a full range of RYA courses on offer which can be pre-booked in the UK, as well as private one to one tuition.

We operate waterskiing and wakeboarding at Lemnos and Levante Beach Resorts in Greece and also Sea Garden Beach Resort in Turkey (through a third party).

These resorts are particularly well suited for waterskiing and wakeboarding often with calm sea conditions. We offer a high quality range of skis, which include standard and wide combo skis for beginners and a good selection of mono/slalom skis, wakeboards, junior skis and kneeboards.

Waterskiing and wakeboarding are provided on a ‘pay-as-you-go’ basis and are booked in resort.

Whatever age your children, from four months to 17 years old, we’ve perfected the art of keeping them entertained. What’s more, childcare is pre-bookable. A half day session, every day, is FREE for children booked into our Toddler 2 and Mini Clubs, and full days for the Junior, Kidz and Indy Clubs. We do make a modest charge for the under twos as our staff/child ratio is high.

Our childcare staff provide an inexhaustible range of activities for younger groups from face painting to pool games and mini tennis.

For the older ones, learning to sail, snorkelling, trying windsurfi ng and playing beach volleyball are all part of the fun time we’ll give them.

With full day childcare and a FREE evening crèche available too, it’s easy to plan each day so that the whole family can make the most of what’s on offer.

See pages 87 – 89 for full information on our childcare and children’s clubs.

Teenagers love their families but there’s a limit to everything! That’s where the Indy Club comes in – it runs throughout the school summer holidays and again at October half term. It’s the perfect opportunity for 14-17 year olds to make new friends while having a great time and it’s included in your holiday cost.

There’s a full programme of daytime activities and evening entertainment designed to keep teenagers amused and occupied. Supervised watersports such as sailing and kayaking are part of a typical day and ‘Indy dinner’, a team challenge and fl oodlit volleyball keep the atmosphere going well into the evening.

Our Indy Club is very popular and places fi ll up fast so we strongly advise you pre-book your free place in the UK prior to departure.

Singles, couples and groups of friends enjoy our holidays just as much as families.

There’s an informal range of activities to enjoy from social barbecues to group dinners and sporting pursuits from sailing to fi tness to try. In the evening the hotel bars are the perfect spot to recount the day.

Our Club Mark Warner weeks, introduced to give adult guests the chance to meet other fellow holiday-makers, are not surprisingly very popular. Local excursions and group nights out in good company, combined with all the usual Mark Warner activities, will make your stay memorable.

Fun for adults too

Levante Beach Resort

At Levante Beach Resort we have a wide range of accommodation including 92 suites and 7 suites with their own swimming pool. All the rooms come with balcony or terrace, en-suite bath or shower, air-conditioning, fridge, satellite TV and all are furnished in a contemporary style.

There are four swimming pools, one of which is indoor. Complimentary beach towels are offered and all pools have plenty of sun loungers and umbrellas for you to nestle under when you fi nally read that book you’ve been meaning to get round to for months.

We have tailor-made our own waterfront centre on the beach and hotel guests can take their pick from the usual array of excellent craft and water-based activities.

There is a purpose-built tennis centre boasting six courts including a fantastic show court, all of which have an astroturf surface and are fl oodlit. Our team of dedicated Mark Warner LTA-qualifi ed tennis coaches are on hand to put you through your paces whatever your standard.

The hotel has a gym and signature spa so you can pamper yourself to your heart’s content – why not try the exotic aromatherapy massage, a hand or foot treatment or maybe just a ten-minute restorative break in the sauna or steam room.

Below is the stylish bar, great for a pre dinner drink. Or put your toes in the sand and enjoy a cocktail at the beach bar. Shaded by a grove of trees, it’s open all day for coffee and drinks. Dinners at Lemnos are rather special, barbecued al fresco and served on the main terrace looking out to sea.

The resort’s sandy and gently shelving beach is excellent for watersports and splashing in the shallows. Calm morning seas entice waterskiers before breezes gradually build to create perfect conditions for sailing and windsurfi ng. Other seafront activities are kayaking, stand up paddle boarding, beach volleyball or simply lazing on a sun lounger.

Mountain bikes are also on hand for exploring the countryside or the sights of nearby Myrina. Alternatively enjoy a game of tennis on one of the resort’s four tennis courts, two of which are fl oodlit. Our fi tness instructor runs a daily programme of exercise including aqua aerobics. After all that activity, unwind with a well deserved treatment in the Viva salon.

For children, there is a large air conditioned crèche with outdoor play area and a small children’s pool which is located beside the main swimming pool. Complimentary beach towels are available for everyone.

Perdepera Beach Resort

Perdepera Beach Resort is situated on a beautiful, white sandy beach, on the eastern coast of Sardinia just south of the village of Cardedu. The scenic drive from the airport at Cagliari takes in the beautiful mountains and red cliffs overlooking the Mediterranean Sea.

The hotel is made up of 120 rooms (comprising doubles, triples and family rooms that comfortably accommodate 4). The accommodation is in attractive terraced villa-type buildings dotted around the gardens and built in traditional style with colour wash and stone rendering. The rooms all have terraces, air-conditioning, fridge, television, safe and en-suite facilities with shower.

Dining is on a full board basis with breakfast, lunch and dinner taken in the typically Sardinian restaurant offering buffets, grills and local and international dishes. Wine, water and soft drinks are included at lunch and dinner.

There is a swimming pool and a separate children’s pool, but most popular is the long sandy beach with crystal clear water perfect for swimming. There are plenty of beach beds and sunshades and complimentary beach towels are provided.

For the more energetic there are 2 tennis courts with our resident coach who is on hand to provide group or private tuition. Mountain bikes are available to hire free of charge, giving you the opportunity to explore this beautiful region.

Protected by a headland the sailing is fantastic for learners and novices in the morning, with the wind picking up in the afternoon making for more challenging sailing. The Mark Warner watersports centre offers free sailing and windsurfi ng tuition throughout the week. There is a local PADI dive centre for those who would like to scuba dive, and for those wishing to keep their feet fi rmly on dry land, a full aerobics and fi tness programme is available and is included in your holiday cost.

San Lucianu Beach Resort

The ruggedly beautiful East coast of Corsica is the location for San Lucianu Beach Resort. Situated on a long stretch of sandy beach, with soaring mountains as a backdrop, it’s set amongst elegant gardens and Eucalyptus groves. Close by is the picturesque old port town of Bastia, with its fi ne Baroque churches and elegantly crumbling houses. If you fancy exploring, there’s wonderful walking to be had in the mountains, with a chain of waterfalls to visit either on foot or as part of our guided mountain bike tours.

At San Lucianu, accommodation is in the 4-storey hotel, located at the heart of the resort. Each of the cool, airy rooms is decorated tastefully and almost all have spectacular sea or mountain views. There are a number of inter-connecting and family rooms, and a number of the rooms have been refurbished to a superior standard.

Dining at San Lucianu is on a half board basis with breakfast and dinner taken alfresco on the restaurant terrace. Dinner is from the à la carte menu or buffet and one evening a week we organise a barbecue with grilled fi sh and meat. Lunch (at a supplement) can be taken buffet-style in the Terrace Restaurant, which offers fresh pasta cooked to order at the pizzeria and hot salads alongside the gelato station. There is also a snack menu at the beach bar.

San Lucianu offers plenty of activities and has 2 swimming pools. The good mix of wind conditions, ensures great sailing and windsurfi ng for all levels, while the gently shelving sandy beach is reassuring to even the most apprehensive beginner. We offer a range of RYA courses in sailing and windsurfi ng or why not try the popular craze of stand up paddle boarding? There are three tennis courts from which we run a full coaching programme.

This is a great resort for families, with a large air-conditioned childcare centre which is home to our baby and toddler crèches and mini club. Fully equipped with kitchen, baby sleeping area and too many toys to mention.

Ocean Club Beach Resort

The Ocean Club is situated in the village of Luz on the stunning western Algarve coast and combines all the Mark Warner fi rst-class facilities with the benefi ts of being in a traditional Algarvian village. Within its cobbled streets are numerous restaurants, cafés and shops which lead down to the lovely wide sandy beach.

Accommodation is in apartments, clustered in different areas around the village and all within a 10-minute walk from the Mill restaurant and bar where all meals are taken. When you want to play tennis, dine or socialise with fellow guests the ‘Mill’ offers a central country club style hub to enjoy as you please.

This is where the childcare centre, family pool, reception and tennis centre are located. There are 2 additional swimming pools with bars, one of which is reserved exclusively for adults and early/late season there is a heated indoor pool. Most apartments overlook the gardens or the pools, others have sea views and each has a balcony or terrace, fully-equipped kitchen and maid service twice a week.

We offer half board dining which includes a delicious daily buffet breakfast and a three-course à la carte dinner on 6 nights per week, leaving you free one night to try one of the many nearby local restaurants.

The bay of Luz is stunning with a pretty promenade dotted with bars and cafés stretching the entire length of the seafront, a lovely place for a stroll and cocktail at sunset.

If you’re a tennis player Ocean Club is perfect. Our Tennis Centre has 5 tennis courts, a full time resident professional and coaching programme. There is also some great mountain biking on offer, which is free of charge. Take off with our mountain bike guide and explore the local area and coastline which provide some outstanding rides.

The Algarve is synonymous with golf and this part of the region has four nearby championship golf courses. We have negotiated discounted green fees at most courses for our guests and are happy to book a tee-time for you.

When you are on holiday, you want to know your children are in expert hands, being cared for in a happy and safe environment, whilst you relax.

That’s why all our childcare staff are professional and hold either a DCE, NNEB, NVQ or equivalent qualifi cation or have at least 2 years’ relevant experience.

Our comprehensive facilities and level of care provide a safe and stimulating environment for children of all ages from 4 month old babies through to active 13 year olds.

All our childcare clubs are free, except for our Baby and Toddler 1 Clubs, where the high ratio of childcare staff to children means we make a charge.Childcare has to be pre-booked in the UK for all age groups.

Our English-speaking, professional childcare staff have an inexhaustible supply of fun ways to keep children happy. They organise face painting, art activities, songs, stories and games on the beach for the younger children, whilst older children learn to snorkel, try their hand at windsurfi ng or enjoy a light-hearted game of beach volleyball.

All of this allows you to relax safe in the knowledge that your children are enjoying themselves whilst being safely supervised by our staff.

Evening entertainmentFor children aged 6 to 13 years, we will be running a fully supervised evening entertainment programme. We ask that you sign children in and out if they wish to join in our entertainment programme whilst you are dining.

Children with special needsWe are happy to assist should your child have any special needs. We would ask that you telephone our Reservations Team prior to booking your holiday to discuss arrangements, including the possibility of one-to-one care should it be required.

Please bring a small rucksack (labelled with your child’s name) for your child’s belongings during the day containing all the items from our checklist opposite.

Please note that babysitters are in high demand, and whilst every effort is made to accommodate requests, this service is subject to staff availability and cannot be guaranteed. Travel Information

Flight and transfer detailsAs our travel arrangements are made many months in advance, the flight details shown here, on the accommodation pages and on our website are provisional flight arrangements and approximate flying and transfer times. All flight timings are provisional and may change up to the point of departure. Your flight numbers and timings will be confirmed when e- tickets are issued approximately 7 – 10 days before departure. The airline or likely airline which will operate your flight will be advised at the time of booking. Where we can only advise you of the likely airline at the time of booking, we will confirm this as soon as we are in a position to do so. Bookings are not accepted on the basis that they are conditional on particular flight timings or carriers and a change of flight timing or airline does not entitle you to change or cancel your holiday unless otherwise stated in our Booking Conditions.

On busy dates, it may be necessary to buy in extra seats which may be with different airlines and operate at different times to those shown in our brochure or on our website. Supplements may be payable for these flights. As transfers for these extra flights will often be operated in conjunction with our usual flights, there may be a short additional waiting time at the airport.

Scheduled and regional flightsIn addition to our contracted flights as listed, we can request further seats, subject to availability, from many airports. Price supplements for these will be payable. Please enquire at the time of booking and full details will be given to you. Scheduled international flights may operate at different

times to our charter flights and separate transfers may then need to be arranged and paid for. Please note that if you miss your outbound scheduled flight, you must contact us or notify the airline directly to ensure your homeward flight is not affected.

InfantsPlease note that those under 2 years of age on the date of return travel to the UK are not allocated a seat on the aircraft or transfer coach and will need to sit on a parent’s knee. The cabin crew will be happy to heat up food you have brought with you. It may be possible on some of our charter flights on certain dates to purchase a seat for infants. For details, please ask our reservations staff. Scheduled airlines make charges for infants of which we will advise you at the time of booking, where applicable.

Travel details and e-ticketsE-tickets will be sent to you approximately 7 – 10 days before the start of your holiday. We must have an up to date email address for your booking. Please check your documents carefully as soon as you receive them as flight details can sometimes change from those published in the brochure or detailed on your confirmation invoice. Bookings made within 10 days of departure will be subject to a minimum £15 per person late booking administration fee.

Connecting flightsPlease note that flight timings given at the time of booking are provisional and subject to change. Bookings are not accepted on the basis that they are conditional on particular flight timings. Guests with onward connections should allow plenty of time in the event of a schedule change or flight delay. We strongly recommend that tickets for onward connections are booked on a fully flexible basis to accommodate any changes or delays.

Check-in and securityCheck-in desks are opened at least two and a half hours before the scheduled departure time. As

passengers who attempt to check-in after the last check-in time will not be allowed to do so and queues for check-in can be lengthy, we would ask you to arrive at the check-in desk with plenty of time and we recommend not less than two hours prior to the scheduled departure time. You should do so even if you have checked in online (where available) if you have hold luggage. Please also allow plenty of time to pass through security as this process can be slow. You will generally not be allowed to board the aircraft if you arrive at the gate after this has closed.

PregnancyLadies who are more than 33 weeks pregnant on their return date cannot travel on our charter flights. After the 28th week of pregnancy, a medical certificate confirming ‘fitness to fly’ is required which must confirm the expected date of birth. This must be issued as close to your departure date from the UK as possible. Scheduled airlines have their own policies on pregnancy which will apply. Please check your insurance policy for any restrictions on cover provided.

Airport representativesFor our charter flights, our own Mark Warner representative will be on hand at your departure airport to assist you to get away smoothly. Details of our UK representatives will be sent with your final travel documents. When you arrive at your destination airport, our representative will be waiting to welcome you after you’ve come through Customs and escort you to your transfer coach.

Baggage allowanceAt the time of going to print, baggage allowances per person are as follows:-

British Airways 23kg hold luggage which must be carried in 1 bag. Infants have a 23kg hold luggage allowance.

Monarch Airlines20kg hold luggage which can be carried in more than 1 bag. Infants have a 10kg hold luggage allowance.

Jet 222kg hold luggage which must be carried in 1 bag. Additional bags can be booked directly with Jet 2. Infants do not have a luggage allowance.

Full details of your baggage allowance will be printed on your e-tickets. Size restrictions may apply in addition to weight restrictions. Even if you combine your total luggage allowance for your family / group, there is a weight restriction of a maximum 32kg per item of hold baggage. If you go over this limit, you may be required to split your bags at check-in. One piece of hand luggage which must fit in an overhead locker may also be taken. If you wish to pre-book and pay for luggage in excess of these limits or any sporting items such as a windsurfer, water ski or golf bags, please contact our Flight Operations Department. Please note these items must usually be booked onto the aircraft in advance and there is a charge levied by all airlines.

CateringOur British Airways flights are catered with a meal appropriate to the time of the flight. Our other flights operate a “buy on board” service with a choice of hot and cold beverages, snacks and light meals for you to purchase.

Travel delaysIn the event of a delay departing from your UK airport, we do not provide refreshments, meals or accommodation. However, in certain circumstances, the airline may be required to provide assistance and their airport representatives will be able to advise. For delays on the return journey, we endeavour to arrange for the provision of assistance on the following basis: for a delay of more than 3 hours, light refreshments; for a delay of over 4 hours a meal at the appropriate time and for overnight delays, hotel accommodation and meals as appropriate. The provision of these facilities is generally the responsibility of the airline under the Denied Boarding Regulations (see our Booking Conditions) and cannot be guaranteed as circumstances often change. Where any arrangements

Page 93: Mark Warner Beach Resorts Summer 2015

91

Flight Information

are to be provided by Mark Warner (rather than the airline), our representative’s decision is final. Transfer coaches will occasionally be meeting more than one flight and any delay in flights arriving can cause a delay in the coach departing from the airport. Delays of more than 12 hours on either the outward or homeward journey may be covered by your personal travel insurance policy.

Own transportFor travellers making their own way to resorts, we may offer a discount on the travel inclusive holiday cost, depending on the date and destination. This discount is only applicable to holidays sold at full brochure price and will only be given if we are advised at the time of booking that you do not require our flight or transfers and cannot be added at a later date. If a coach transfer is required from the overseas airport where you have made your own flight arrangements, there will be a charge for this (subject to space being available). You must request this at the time of booking.

Passports & visa requirementsFor holders of British or EU citizen passports, no visa is required for visiting any of the Mediterranean countries featured in this brochure except Turkey. Citizens of other countries should consult their embassy or consulate for any passport and visa requirements.

Visitors to Turkey please note, there is a visitor’s visa charge levied by the authorities. For Summer 2014 this was 20 US Dollars, payable in advance by visiting www.evisa.gov. At the time of this brochure going to press, the charge for Summer 2015 has not been confirmed. Details will be sent with your e-tickets. Contact our Reservations department if you have any queries.

For British Citizens, adults require a ten year British passport for all the countries we operate to and children a five year British passport. A British passport generally takes approximately 3 to 6 weeks to obtain but can take longer at busy times. You should allow as much time as you can. Passports can be renewed up to 9 months prior to their expiry date with the unexpired time being added to the new passport. If you are 16 or over and haven’t yet got a passport, you should apply for one at least 6 weeks before your holiday. The UK Passport Service has to confirm your identity before issuing your first passport and will ask you to attend an interview in order to do this. Full details are available by either telephoning the Passport Office on 0300 222 0000 or visiting their website www.passport.gov.uk

If you are not a British citizen or hold a non British passport, you must check passport and visa requirements with the embassy or consulate of the country(ies) to or through which you are intending to travel.

Please also check the validity of your passport, as some countries require passports to be valid for a certain length of time, which may be up to 6 months, after the end of your holiday arrangements. If you are unsure, please contact the appropriate embassy or consulate of the country you are travelling to. It is the party leader’s responsibility to ensure that all members of the party are in possession of all travel and other documents necessary for your holiday. We cannot be held responsible if guests are prevented from travelling, entering any country or re-entering the UK due to the lack of passports or visas which meet the applicable requirements.

The Foreign Office publishes regularly updated travel information on its website www.gov.uk/foreign-travel-advice which you are recommended to consult before booking and in good time before departure. This includes information on passport and visa requirements.

HealthIt is your responsibility to ensure you are aware of all recommended vaccinations and health precautions in good time before departure. Details are available from your GP surgery or local travel clinic and from the National Travel Health Network and Centre www.nathnac.org. Information on health abroad is also available on www.nhs.uk/Livewell/Travelhealth. You should ensure that

vaccinations or preventative measures such as malaria tablets are taken early enough (which may be a month or more prior to departure). At the time of publishing this brochure, no vaccinations were required for visiting any of the Mediterranean countries featured in this brochure. For holidays in the EU/EEA you should obtain an EHIC (European Health Insurance Card) prior to departure from www.ehic.org.uk. The EHIC may entitle you to reduced cost, sometimes free, medical treatment in public hospitals and clinics while you’re in a European Economic Area, although restrictions apply. It must be noted however that the EHIC is not a substitute for travel insurance which must be taken out before departure. If you are undergoing any form of medical treatment, we recommend that you consult your GP in good time prior to departure and ensure that you take sufficient medication and corresponding prescriptions with you where necessary. In some countries the services and drugs provided may be of a different standard to that received in the UK. Please remember to pack any vital medication in your hand luggage. Health requirements and recommendations may change and you should check the up to date position in good time before departure.

You must accordingly check your e-mails on a regular basis. We may also contact you by post if we cannot, for whatever reason, contact you by e-mail or you have booked directly by phone and have chosen not to be contacted in this way. References in these Booking Conditions to “send” include e-mail and post, as appropriate. If you wish to and you have booked direct with us, you may contact us by e-mail for any of the reasons mentioned in these Booking Conditions (for example to request an amendment or notify a cancellation) providing you do so to [email protected]. If you have booked through one of our authorised travel agents, all correspondence with us must be carried out via your travel agent. Please note that telephone calls to our reservations department may be monitored/recorded for training and customer services purposes. Except as set out in clause 14, these Booking Conditions only apply to holiday arrangements which you book with us in the UK and which we agree to make, provide or perform (as applicable) as part of our contract with you. All references in these Booking Conditions to “holiday”, “booking”, “contract”, or “arrangements” mean such holiday arrangements. References to “departure” mean the start date of the holiday arrangements.

1. Making a bookingYour contract is with Mark Warner Limited (‘we’ or ‘us’). In all cases, these Booking Conditions together with our Travel Information and How to Book sections appearing on our website (www.markwarner.co.uk ) or on pages 90 to 97 in our brochure form the basis of your contract. References to ‘you’ and ‘the client’ mean all persons named on the booking (including anyone who is added or substituted at a later date), or any of them as applicable. Please see ‘HOW TO BOOK’ on pages 96 to 97 in our brochure or on our website (www.markwarner.co.uk) for full details. Before making a booking with us, you must ensure you have read and understood these Booking Conditions (raising any queries you may have with us). By asking us to confi rm your booking, you are liable to be regarded as having had the opportunity to do so and to have actually done so before a contract between us comes into existence. When you make a booking, the fi rst named person on the booking must pay us (if booking direct with us) or your travel agent (if you have booked through a travel agent) deposits or full payment as applicable (see “HOW TO BOOK” as set out above). Please note: if booking direct with us, deposit payments (or full balances if booking within 10 weeks of the start of your holiday) must be made by either credit or debit card at the time of booking.A. Bookings made by telephone or in personA binding contract between us comes into existence when: 1) we (if you book direct with us by telephone) or your travel agent (if you book through one of our authorised travel agents) have received all appropriate payments at the time of booking (if you choose to pay by credit or debit card you must have authorised us or your travel agent to deduct the appropriate payments from your card)and 2) we have verbally confi rmed the booking to you or your travel agent over the telephone. A confi rmation invoice will be dispatched to your travel agent or to the fi rst named person on the booking if you have booked direct with us once a binding contract between us has come into existence as set out above.B. Online bookingsA binding contract between us comes into existence when we have received all appropriate payments from you at the time of booking and we have e-mailed our

confi rmation invoice to you. Please note; all bookings are subject to availability.Full payment less any deposit pre-paid must reach us not less than ten weeks prior to departure. The fi rst named person on the booking is liable for making full payment for all persons named on the booking (including anyone added or substituted at a later stage). If payment is not received in full by the due date, we will issue a reminder to you (if you are booking direct with us) or to your travel agent. If, within 7 days of our issuing the reminder, we have not received full payment, we are entitled to assume that you wish to cancel your booking and we will retain the deposit paid. If we do not cancel straight away because you have promised to make payment, you must pay the cancellation charges shown in clause 5 depending on the date we reasonably treat your booking as cancelled. Should you book your holiday through one of our authorised travel agents, all monies paid to the agent for a fl ight inclusive holiday with us will be held on behalf of and for the benefi t of the Trustees of the Air Travel Trust subject to the travel agent’s obligation to pay such monies to us in accordance with our trading terms unless we fail. In the unlikely event of our fi nancial failure, all monies then held by the travel agent or subsequently paid by you to the travel agent for your fl ight inclusive holiday will be held by the agent on behalf of and for the benefi t of the Trustees of the Air Travel Trust without any obligation on the agent to pay such monies to us. For all non fl ight inclusive holidays, all monies you pay to one of our authorised agents will be held by the agent on your behalf until a binding contract between us comes into existence. After that point, your agent will hold the monies on our behalf until they are paid to us.Please note: all credit card transactions incur a handling fee which at the time of this brochure going to print is 2% of the payment value (not applicable to debit cards). If the card issuer increases its charges to us, we reserve the right to increase this handling fee. Please carefully read your confi rmation invoice, tickets and all other documents we send you as soon as you receive them. Contact us (if you have booked direct) or your travel agent immediately if any information appears to be incorrect or incomplete as it may not be possible to make changes later. We regret we cannot accept any liability if we are not notifi ed of any inaccuracy (by us) in any

document within 14 days of our sending it out (5 days for tickets). We will do our best to rectify any inaccuracies notifi ed outside these time limits. However, you will be responsible for any costs and expenses involved in doing so except where we made the mistake and there is a good reason why you didn’t contact us within the time limit. See clause 4 if you need to correct any inaccurate information you have provided us with.

2. Medical conditions, disabilities and reduced mobilityIf you have any medical condition or disability or suffer from reduced mobility which may affect your holiday (including any which may affect the booking process), please tell us (if you are booking direct) or your travel agent before you confi rm your booking so that we can advise as to the suitability of the chosen arrangements and, if applicable, assist you with making your booking. In any event, you must give us or your travel agent full details in writing at the time of booking. If you wish to book online you should email or telephone us with these details prior to making your booking online. You must also promptly notify us of any deterioration or adverse change in or development of any medical condition or disability or of any deterioration or change in your mobility which may affect your holiday which occurs after you book.

3. Prices and surchargesThe holiday prices quoted in our brochure are based on exchange rates as taken from the Financial Times Guide to World Currencies published on 19th June 2014 and known costs on that date. The exchange rate is Euro 1.2511.We reserve the right to make changes to and/or correct errors in advertised prices at any time before your holiday is confi rmed. We will advise you of any change or correction of which we are aware and of the then applicable price at the time of booking.Once the price of your chosen holiday has been confi rmed at the time of booking, we will only increase or decrease it in the following circumstances. Price increases or decreases after booking will be passed on by way of a surcharge or refund. A surcharge or refund (as applicable) will be payable, subject to the conditions set out in this clause, in the event of changes in transportation costs (e.g. fuel, scheduled airfares and any other airline surcharges which are part of the contract

between airlines (and their agents) and the tour operator) and/or in any dues, taxes or fees payable for services such as landing taxes or embarkation or disembarkation fees at ports or airports and/or where our costs increase or decrease as a result of any changes in the exchange rates which have been used to calculate the cost of your holiday. Even in the above cases, only if the increase in our costs exceeds 2% of the total cost of your holiday (excluding any amendment charges) will we levy a surcharge. We will only levy a surcharge in respect of the amount by which any increase in our costs exceeds 2% of this total holiday cost. If any surcharge is greater than 10% of the cost of your holiday (excluding any amendment charges), you will be entitled to cancel your booking and receive a full refund of all monies paid to us (except for amendment charges) or alternatively purchase another holiday from us of a similar standard as originally booked if available (if the alternative we specifically offer you is less expensive, you will receive a refund or price reduction, but if it is more expensive, you will not be asked to pay any more. If you wish to purchase a holiday other than the one we specifically offer you, you will have to pay the applicable price). A refund will only be payable if the decrease in our costs exceeds 2% as set out above. Where a refund is due, we will pay you the full amount of the decrease in our costs. Please note that travel arrangements are not always purchased in local currency and some apparent changes have no impact on the price of your travel due to contractual and other protection in place. You have 14 days from the issue date printed on the surcharge invoice to tell us in writing if you want to cancel or purchase another holiday where applicable. If you do not tell us that you wish to do so within this period of time, we are entitled to assume that you will pay the surcharge. Any surcharge must be paid with the balance of the cost of the holiday or within 14 days of the issue date printed on the surcharge invoice, whichever is the later. We promise not to levy a surcharge within 30 days of departure. No refund will be paid during this period either. Please note, changes and errors occasionally occur. You must check the price of your chosen holiday at the time of booking.

4. Amendments by the clientAll amendments to bookings must be requested by telephone to the After Sales Department on 0844 884 3806 (and confirmed in writing if requested by the After Sales Department) or by e-mail to [email protected] or if you have booked through one of our authorised travel agents, through the agent. If we are able to accept the change we will charge an amendment fee of £35 per person per occasion a change is made. Amendment may result in the recalculation of the holiday price and the loss of previously applicable discounts or other special offers if the amendment means the conditions applicable to the previous calculation or a discount or other offer are no longer met (for example, because the number travelling has fallen below the minimum required) or the basis on which the price was calculated has changed (for example, because only one person is occupying a twin or double room). Changes made within 10 weeks of departure and any change of holiday dates will be treated as a

cancellation of the original arrangements by you and cancellation charges will apply as shown in clause 5. However, if the change is to increase the number of persons booked (without any other change) no amendment fee or cancellation charges will apply (although you will of course have to pay any increase in the total holiday cost). Subject to your meeting the conditions set out in clause 5, no amendment fee or cancellation charges will apply for a name change where the holiday arrangements otherwise remain exactly as originally booked unless flight tickets have been issued. In this case, a £35 per person amendment fee is payable. In addition, scheduled airlines may treat any change (including a name change) made to a scheduled flight after tickets have been issued as a cancellation of the original booking and impose 100% cancellation charges. In order to make such a change in this situation, the full cost of the flight(s) affected must be paid again, in addition to the amendment fee of £35 per person. Please also see clause 5 below.

5. Cancellation by the clientCancellation will take effect only when written notification from the first named person on the booking is received by us or your travel agent. In all cases of cancellation the deposit and any amendment charges will be forfeited. If the booking is cancelled 10 weeks or less before departure the following cancellation fees, expressed as a percentage of the total holiday cost excluding amendment charges, will become immediately payable to us. Cancellation charges for holidays which include scheduled flights and/or pre-bookable extras may incur additional cancellation costs. Check with our After Sales department. Details are available on request at the time of booking.Written confirmation from us of cancellation by you will be issued within 14 days of our receiving your written confirmation of your wish to cancel. Contact us or your travel agent immediately if you do not receive this.If you are unable to go for any reason or decide that you do not want to take the holiday, you may transfer the whole booking or the place on the booking of the person(s) concerned to someone else/other people suggested by you and acceptable to us providing you meet the following requirements:-(a) You must provide us with full details of who cannot or does not want to go on holiday and who you would like to go instead. We must receive this information from you or your travel agent as applicable at least 14 days before the start of the holiday. (b) Please see clause 4 for details of any amendment fees and other charges/costs which may be payable. Any part of the booking not transferred and/or subsequently cancelled will be subject to cancellation charges as detailed above.(c) Everyone who goes on holiday in place of anyone who was originally due to travel must

agree to these Booking Conditions and any other requirements which apply to the holiday before the change can be finalised. If the full price should have been paid when the change is requested but hasn’t been, this must also be paid before the change can be finalised.

6. Alteration/Cancellation by Mark WarnerArrangements for the holidays featured on our website and in our brochure are made many months in advance. Occasionally, we have to make changes to and correct errors in website and/or brochure and other details before and after bookings have been confirmed and cancel confirmed bookings. Whilst we always endeavour to avoid changes and cancellations, we must reserve the right to do so. The possibility of such changes (which may be significant) is greater for those bookings which are made prior to publication of the brochure. However, in no case will we cancel your confirmed holiday less than ten weeks before departure except where we are forced to do so as a result of an event or circumstances beyond our control or failure on your part to comply with any requirement of these Booking Conditions entitling us to cancel (such as paying on time). Most changes are minor. Occasionally, we have to make a significant change. A significant change is a change made before departure which, taking account of the information you give us at the time of booking and which we can reasonably be expected to know as a tour operator, we can reasonably expect will have a major effect on your holiday. A minor change is any other change. The following changes to your confirmed holiday when made before departure are examples of changes which will usually be significant: • a change of your UK departure airport to one which, in our reasonable opinion, is more inconvenient for you. A change from one London airport to another will not be a significant change (London airports are Gatwick, Heathrow, Luton and Stansted) • a change of scheduled UK departure time by 12 hours or more (not including flight delays)• a change of accommodation for the whole or a substantial proportion of your holiday Please note, a change in flight time of less than 12 hours, carrier, type of aircraft (if advised), destination airport (see also clause 9 below) or resort transfer arrangements will not constitute a significant change but will be treated as a minor change except where otherwise stated in these Booking Conditions. If we have to make a significant change or cancel, we will advise you or your travel agent as soon as we reasonably can and give you the choice of the following options if there is time to do so before departure: (a) (for significant changes) accepting the changed arrangements or (b) purchasing an alternative holiday from us, of a similar standard as originally booked if available (if the alternative we specifically offer you is less expensive, you will receive a refund or price reduction but if it is more expensive, you will not be asked to pay any more, if you wish to purchase a holiday other than the one we specifically offer you, you will have to pay the applicable price) or (c) cancelling or accepting the cancellation in which case you will receive a prompt and full refund of all monies paid to us. If we have to make a significant change or cancel 100 days or less before departure, we will, if and as appropriate depending on

the circumstances and when the significant change or cancellation is notified to you, as a minimum pay you the compensation set out below. Payment of any compensation in the event of a significant change or cancellation is subject to the following general exceptions. Compensation is not payable where we notify you of a change or cancellation more than 100 days prior to your scheduled departure. Compensation will not be payable and no liability beyond offering the above mentioned choices can be accepted where we are forced to make a change or cancel as a result of unusual and unforeseeable circumstances beyond our control, the consequences of which we could not have avoided even with all due care. No compensation will be payable and the above mentioned options will not be available if we cancel as a result of your failure to comply with any requirement of these Booking Conditions entitling us to cancel (such as paying on time) or if the change made is a minor one. No compensation is payable for children aged 2 or under at the date of return travel.

Period before Minimumdeparture when compensation we notify you or per personyour travel agent

More than 100 days Nil71 - 100 days £2029 - 70 days £3015 - 28 days £4014 days or less £50

Very rarely, we may be forced to change or terminate your holiday after departure but before the scheduled end of your time away as a result of ‘force majeure’ (see clause 8). In this very unusual situation, we regret we cannot make any refunds (except where these are obtained from suppliers) or pay any compensation or be responsible for any costs or expenses incurred by you as a result. If, after departure, we are unable to provide a significant proportion of the services we had agreed to provide as part of our contract with you, we will do our best to make suitable alternative arrangements in respect of those services. If we cannot do so or you refuse to accept these for good reasons, we will arrange to fly you back to your UK departure airport (if your holiday includes flights) or to transport you to the point our contracted services commenced (if elsewhere than your hotel) as soon as we reasonably can. Except as set out above, you will in addition be entitled to compensation where appropriate.

7. Denied Boarding RegulationsIf your flight is cancelled or delayed, your flight ticket is downgraded or boarding is denied, depending on the circumstances, the airline may be required to pay you compensation, refund the cost of your flight and/or provide you with accommodation and/or refreshments under EC Regulation 261/2004- the Denied Boarding Regulations 2004. Where applicable, you must pursue the airline for the compensation or other payment due to you. All sums you receive or are entitled to receive from the airline concerned by virtue of these Regulations represent the full amount of your entitlement to compensation or any other payment arising from such cancellation, delay, downgrading or denied boarding. This includes any disappointment, distress, inconvenience or effect on any other arrangements. The fact

a delay may entitle you to cancel your flight does not automatically entitle you to cancel any other arrangements even where those arrangements have been made in conjunction with your flight. We have no liability to make any payment to you in relation to the Denied Boarding Regulations or in respect of any flight cancellation or delay, downgrading of any flight ticket or denial of any boarding as the full amount of your entitlement to any compensation or other payment (as dealt with above) is covered by the airline’s obligations under the Denied Boarding Regulations. If for any reason, we make any payment to you or a third party which the airline is responsible for in accordance with the Denied Boarding Regulations, you must, when requested, assign to us the rights you have or had to claim the payment in question from the airline. If your airline does not comply with these rules you may complain to the Civil Aviation Authority on 020 7453 6888 or by e-mail to [email protected] or see www.caa.co.uk – Referring Your Complaint to the CAA.

8. Important Note – Force MajeureExcept where otherwise expressly stated in these Booking Conditions, we regret we cannot accept liability or pay compensation where the performance or prompt performance of our obligations under our contract with you is prevented or affected by or you otherwise suffer any damage, loss or expense of any nature as a result of “force majeure”. In these Booking Conditions ‘force majeure’ means any event which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events are likely to include (whether actual or threatened) war, civil strife, riot, industrial dispute, terrorist activity, natural or nuclear disaster, fire, flood, epidemic, technical problems with transport, adverse weather conditions, volcanic eruption, airport, port or airspace closure, restriction or congestion, flight restrictions imposed by any regulatory authority or other third party and all similar events outside our or the supplier’s control. 9. TravelIn accordance with EU Directive (EC) No 2111/2005, we are required to bring to your attention the existence of a “Community list” which contains details of air carriers that are subject to an operating ban within the EU. The Community list is available for inspection at http://ec.europa.eu/transport/air-ban/list_en.htm We are also required to advise you of the actual carrier(s) (or, if the actual carrier(s) is not known, the likely carrier(s)) that will operate your flight(s) at the time of booking. Where we are only able to inform you of the likely carrier(s) at the time of booking, we shall inform you of the identity of the actual carrier(s) as soon as we become aware of this. Any change to the operating carrier(s) after your booking has been confirmed will be notified to you as soon as possible. If the carrier with whom you have a confirmed reservation becomes subject to an operating ban as above as a result of which we/ the carrier are unable to offer you a suitable alternative, the provisions of clause 6 (Alteration/Cancellation by Mark Warner) will apply. We are not always in a position at the time of booking to confirm the flight timings which will be used in connection with your flight. The flight timings shown in our

brochure, on our website and/or detailed on your confirmation invoice are for guidance only and are subject to alteration and confirmation. Flight timings are outside our control. They are set by airlines and are subject to various factors including air traffic control restrictions, weather conditions, actual or potential technical problems and the ability of passengers to check in on time. Specific instructions relating to departure and travel arrangements will be sent with your e-tickets approximately 7 – 10 days before departure. You must accordingly check your tickets very carefully immediately on receipt to ensure you have the correct flight times. It is possible that flight times may be changed even after tickets have been despatched - we will contact you as soon as possible if this occurs. Any change in the identity of the carrier, flight timings, and/or aircraft type (if advised) will not entitle you to cancel or change to other arrangements without paying our normal charges except where specified in these Booking Conditions. In the unlikely event of a change to your confirmed overseas airport, we will of course arrange for you to be transported to and from the alternative airport without any additional cost to you. We cannot be held liable for any delay which is due to any of the reasons set out in clause 11(2) of these Booking Conditions (which includes the behaviour of any passenger(s) on the flight who, for example, fails to check in or board on time). In addition, we will not be liable for any delay unless it has a significant effect on your holiday arrangements. Notwithstanding the above, Mark Warner and the carrier will make all reasonable efforts as are practical to reduce the discomfort suffered by you as a result of the delay. See pages 90 to 91 in our brochure or our website (www.markwarner.co.uk) for details of what is usually provided in the event of any delay. All refreshments, meals and other assistance provided at the airport in the event of a flight delay are the responsibility of the airline concerned except where we expressly otherwise agree or advise you. It is the responsibility of the person who makes the booking to ensure that all members of your party are in possession of all necessary travel and other documents before departure. We regret we cannot accept any liability if you are refused entry onto any transport or into any country due to failure on your part to carry correct documentation. If failure to have any necessary travel or other documents results in costs, expenses, fines, surcharges or other financial penalty being imposed on or incurred by us, you will be responsible for reimbursing us accordingly.

10. Damage by and behaviour of the clientMark Warner and its employees shall be entitled to recover from you the cost (reasonably estimated if not precisely known) of any damage or loss caused by you either during or after your holiday. If the actual cost of any damage or loss is less than the amount paid by you at the time where only an estimate could be given, the difference will be refunded. Any extra must be paid if the actual cost turns out to be more than was paid at the time. You agree to behave reasonably and not to disrupt the enjoyment of others on holiday with you or prejudice Mark Warner’s

reputation with its accommodation or other suppliers. We reserve the right to immediately terminate the holiday of any client whose behaviour, in our reasonable opinion or in the reasonable opinion of any other person in authority, causes or is likely to cause distress, danger or significant annoyance to other clients, employees or to any third party or damage to property. In the event of such termination, our responsibility for the client concerned immediately ceases and we will have no further contractual obligations towards that person including return travel arrangements. We shall further be under no liability to make any refunds or meet any costs or expenses incurred by you as a result or pay any compensation.

11. Liability of Mark Warner(1) We promise to make sure that the holiday arrangements we have agreed to make, perform or provide as applicable as part of our contract with you are made, performed or provided with reasonable skill and care. This means that, subject to these Booking Conditions, we will accept responsibility if, for example, you suffer death or personal injury or your contracted holiday arrangements are not provided as promised or prove deficient as a result of the failure of ourselves, our employees, agents or suppliers to use reasonable skill and care in making, performing or providing, as applicable, your contracted holiday arrangements. Please note it is your responsibility to show that reasonable skill and care has not been used if you wish to make a claim against us. In addition, we will only be responsible for what our employees, agents and suppliers do or do not do if they were at the time acting within the course of their employment (for employees) or carrying out work we had asked them to do (for agents and suppliers). (2) We will not be responsible for any injury, illness, death, loss (for example loss of possessions or loss of enjoyment), damage, expense, cost or other sum or claim of any nature or description whatsoever which results from any of the following:-the act(s) and/or omission(s) of the person(s) affected or any member(s) of their party orthe act(s) and/or omission(s) of a third party not connected with the provision of your holiday and which were unforeseeable or unavoidable or ‘force majeure’ as defined in clause 8 above(3) Please note, we cannot accept responsibility for any services which do not form part of our contract. This includes, for example, any additional services or facilities which your hotel or any other supplier agrees to provide for you where the services or facilities are not advertised on our website or in our brochure as forming part of your holiday arrangements and we have not agreed to arrange them as part of our contract and any activity or excursion you purchase in resort. Please also see clause 14 “Website and brochure information and outside activities”. In addition, regardless of any wording used by us on our website, in any of our brochures or elsewhere, we only promise to use reasonable skill and care as set out above and we do not have any greater or different liability to you.(4) The promises we make to you about the services we have agreed to provide or arrange as part of our contract - and the laws and applicable standards of the country in which your claim or complaint occurred - will be used

as the basis for deciding whether the services in question had been properly provided. If the particular services which gave rise to the claim or complaint were provided in compliance with the applicable local laws and standards, the services will be treated as having been properly provided. This will be the case even if the services did not comply with the laws and standards of the UK which would have applied had those services been provided in the UK. The exception to this is where the claim or complaint concerns the absence of a safety feature which might lead a reasonable holidaymaker to refuse to take the holiday in question. Please note, however, our obligation is to exercise reasonable skill and care as referred to in clause 11(1). We do not make any representation or commitment that all services will comply with applicable local laws and standards and failure to comply does not automatically mean we have not exercised reasonable skill and care.(5) Where we are found liable for loss of and/or damage to any luggage or personal possessions (including money) on any basis, the maximum amount we will have to pay you is £1000 per person. Any payment is subject to your producing appropriate proof of the contents and value of the luggage or personal possessions concerned and demonstrating that you have taken proper care of your property. For all other claims which do not involve death or personal injury, if we are found liable to you on any basis the maximum amount we will have to pay you is twice the holiday price (excluding any amendment charges) paid by or on behalf of the person(s) affected in total unless a lower limitation applies to your claim under clause 11(6) below. This maximum amount will only be payable where everything has gone wrong and you have not received any benefit at all from your holiday. (6) Where any claim or part of a claim (including those involving death or personal injury) arises from travel on any aircraft, ship or train (including the process of getting on and/or off the transport concerned) provided by any air, sea or rail carrier to which any international convention or EU regulation applies, our liability (including the maximum amount of compensation we will have to pay you, the types of claim and the circumstances in which compensation will be payable) will be limited as if we were the carrier in question as referred to below. The most we will have to pay you for that claim or that part of a claim if we are found liable to you on any basis is the most the carrier concerned would have to pay under the international convention or EU regulation which applies to the travel arrangements in question (for example, the Warsaw Convention as amended or unamended and the Montreal Convention for international travel by air and/or for airlines with an operating licence granted by an EU country, the EC Regulation on Air Carrier Liability No 889/2002 for national and international travel by air, EC Regulation 392/2009 and the Athens Convention for international travel by sea (as amended by the 2002 Protocol) and COTIF, the Convention on International Travel by Rail). Where a carrier would not be obliged to make any payment to you under the applicable international convention or EU regulation in respect of a claim or part of a claim, we similarly are not obliged to make a payment to you for that claim or part of the claim. When making any payment, we are entitled to deduct any money which you have

Page 97: Mark Warner Beach Resorts Summer 2015

95

received or are entitled to receive from the carrier for the complaint or claim in question. Copies of the applicable international conventions and EU regulations are available from us on request.(7) We cannot accept any liability for any damage, loss, expense or other sum(s) of any description which (1) on the basis of the information given to us by you concerning your booking prior to our accepting it, we could not have foreseen you would suffer or incur if we breached our contract with you or (2) did not result from any breach of contract or other fault by ourselves or our employees or, where we are responsible for them, our suppliers. Additionally we cannot accept liability for any claims, losses or expenses which relate to any business (including any loss of earnings incurred by any client who is self employed)

12. Airlines and other carriersWhen you travel with any carrier, the conditions of carriage of that carrier will apply, some of which will limit or exclude their liability to you often in accordance with the applicable international convention or EU regulation (for examples, see clause 11(6)). Copies of the conditions of carriage are available from the carrier or ourselves. Our website and brochure are our responsibility. Please note that in accordance with Air Navigation Orders, for a child not to be allocated their own seat on an aircraft they must be under 2 years of age on the date of their return flight.

13. Insurancespecific requirements. We will not be responsible for meeting any sums which would have been covered by such travel insurance. You will further be responsible for paying to and indemnifying us for any such sums which we meet on your behalf. Please read your policy details carefully and take them on holiday with you. It is your responsibility to ensure that the insurance cover you purchase is adequate for your particular needs. Please note most travel insurance policies do not cover hazardous activities such as scuba diving and certain water sports etc. If you intend to take part in any such activities, you must obtain appropriate specialist insurance cover. We do not check insurance policies. We do however act as an Introducer Appointed Representative for Citybond Suretravel who may be able to provide you with suitable travel insurance. Please see our brochure/website for further details.

14. Website and Brochure information and outside activities(a) The information contained on our website and in our brochure is correct to the best of our knowledge at the time of publication. Our website and brochure descriptions often refer to other activities and excursions which are available outside the hotel and are bookable directly with the operator/centre concerned. These activities and excursions are not run or controlled in any way by Mark Warner. They do not form any part of your contract with Mark Warner and are not recommended or endorsed by Mark Warner even where we suggest particular operators/centres or other third parties and/or assist you in booking such activities or excursions in any way. Accordingly, we regret Mark Warner cannot accept any liability in relation to these outside activities and excursions and clauses 6 and 11(1) of our

Booking Conditions will not apply to them. We do not however exclude liability for the negligence of ourselves or our employees (providing they were at the time acting within the course of their employment with us) resulting in your death or personal injury. (b) Where we or your hotel make or take any booking for or from you in respect of any activity or excursion available outside the hotel, we or the hotel, as applicable, do so solely as booking agent. This is the case regardless of whether the activity or excursion is advertised or mentioned in our brochure, in resort, on our website or elsewhere. Your contract for any such activity or excursion will be with the supplier or operator of that activity or excursion. Mark Warner has no liability for any such activity or excursion or for any act(s) or omission(s) of the supplier or operator or for any of its/their employees or agents or any other person(s) connected with the activity or excursion. If we or the hotel are found liable in any respect for any such activity or excursion (for example in our capacity as booking agent), that liability is limited to the cost of the particular activity or excursion concerned. We do not limit or exclude our liability for death or personal injury arising from our negligence or that of our employees (providing they were at the time acting within the course of their employment with us). (c) Where your hotel makes or takes a booking for or from you in respect of an activity, facility or service provided by the hotel but which is not advertised in our brochure or on our website as forming part of your holiday arrangements and we have not taken any payment from you for this activity, facility or service, your contract for that activity, facility or service is directly with the hotel and not Mark Warner. This contract will be subject to the hotel’s own terms and conditions. Mark Warner has no liability for any such activity, facility or service or for any act(s) or omission(s) of the hotel or any of its employees or agents or any other person(s) connected with the activity, service or facility. If however Mark Warner is found liable in any respect for any such activity, facility or service, that liability is limited to the price you paid for the particular activity, facility or service concerned. We do not limit or exclude our liability for death or personal injury arising from our negligence or that of our employees (providing they were at the time acting within the course of their employment with us). (d) We cannot guarantee accuracy at all times of information given in relation to any activities and excursions or about the resorts generally (except where this concerns the services which will form part of your contract) or that any particular excursion or activity will take place or be available as these services are not under our control. If you feel that any of the activities or excursions mentioned are vital to the enjoyment of your holiday, contact us before making your booking and we will tell you the latest known situation. If we become aware of any material alterations to resort information and/or such activities or excursions which can reasonably be expected to affect your decision to book a holiday with us, we will pass on this information at the time of booking.

15. ComplaintsShould you have a problem or complaint at any time during your holiday, you must report it immediately to the hotel manager or Mark

Warner representative and, if applicable, the supplier of any other services concerned who will endeavour to put things right quickly. Any complaint which is notified verbally must also be put in writing as soon as possible during your holiday. If you remain dissatisfied, please email our Customer Services department at [email protected] Alternatively, you can write to us at:Mark Warner Ltd20 Kensington Church StreetLondon W8 4EPIn either case, you must do so within 28 days of your return from holiday, giving your booking reference and all relevant information. Please include your e-mail address and daytime and evening telephone numbers (if you are happy for us to contact you in this way) as this will enable us to respond to you more quickly. If you are not satisfied with our response we must be informed within another 28 days from the date of our correspondence. If you fail to follow this simple complaints procedure, your right to claim any compensation you may otherwise have been entitled to may be affected or even lost as a result. 16. Special requestsIf you have any special requests, please inform us (if you have booked direct) or your travel agent in writing at the time of booking. Although we will endeavour to pass any reasonable requests on to the relevant supplier, we regret we cannot promise that any request will be complied with unless we or your travel agent (as applicable) have specifically confirmed this to you. For your own protection, you should obtain confirmation in writing from ourselves or your travel agent on our behalf that your request will be complied with (where it is possible for us to give this) if your request is important to you. Confirmation that a special request has been noted or passed on to the supplier or the inclusion of the special request on your confirmation invoice or any other documentation is not confirmation that the request will be met. Unless and until specifically confirmed, all special requests are subject to availability.

17. JurisdictionWe both agree that English law (and no other) will apply to your contract and to any dispute, claim or other matter of any description which arises between us (“claim”) except as set out below. We both also agree that any claim (and whether or not involving any personal injury) must be dealt with by the Courts of England and Wales only unless you live in Scotland or Northern Ireland. In this case, proceedings must either be brought in the Courts of your home country or those of England and Wales. If proceedings are brought in Scotland or Northern Ireland, you may choose to have your contract and any claim governed by the law of Scotland/Northern Ireland as applicable (but if you do not so choose, English law will apply).

18 Financial SecurityWe hold an Air Travel Organiser’s Licence issued by the Civil Aviation Authority (ATOL number 1176). When you buy an ATOL protected flight or flight inclusive holiday* from us, you will receive an ATOL Certificate. This lists what is financially

protected, where you can get information on what this means for you and who to contact if things go wrong. We, or the suppliers identified on your ATOL Certificate, will provide you with the services listed on the ATOL Certificate (or a suitable alternative). In some cases, where neither we nor the supplier are able to do so for reasons of insolvency, an alternative ATOL holder may provide you with the services you have bought or a suitable alternative (at no extra cost to you). You agree to accept that in those circumstances the alternative ATOL holder will perform those obligations and you agree to pay any money outstanding to be paid by you under your contract to that alternative ATOL holder. However, you also agree that in some cases it will not be possible to appoint an alternative ATOL holder, in which case you will be entitled to make a claim under the ATOL scheme (or your credit card issuer where applicable). If we, or the suppliers identified on your ATOL certificate, are unable to provide the services listed (or a suitable alternative, through an alternative ATOL holder or otherwise) for reasons of insolvency, the Trustees of the Air Travel Trust may make a payment to (or confer a benefit on) you under the ATOL scheme. You agree that in return for such a payment or benefit, you assign absolutely to those Trustees any claims which you have or may have arising out of or relating to the non-provision of the services, including any claim against us, the travel agent or your credit card issuer where applicable. You also agree that any such claims may be re-assigned to another body, if that other body has paid sums you have claimed under the ATOL scheme.*The flights and flight-inclusive holidays we arrange are ATOL protected providing they are made available in the UK. For further information visit the ATOL website at www.atol.org.uk.For any holidays which do not include flights, all monies you pay us will be paid into a trust account which is controlled by an independent trustee. These monies will not be released to us until your holiday arrangements have been completed. These arrangements mean all monies you have paid us will be refunded to you in the unlikely event of our being unable to provide your holiday due to our insolvency.

Where it is practical to do so, we will seek the consent of any clients who are prominently included in any shots. Consent will not generally be sought from clients who only appear in the background. For all bookings we will then give you a reference number for you to quote on all correspondence/calls. Please note all payments made by credit card incur a 2% handling fee (not applicable to debit cards). If the card issuer increases its charges to us, we reserve the right to increase this handling fee. Online bookings cannot be made less than 72 hours before departure.

At the time of booking, you will be required to give your travel agent your credit/debit card details or other acceptable form of payment for the deposit(s) (or full balance if booking within 10 weeks of the start of your holiday). They must then send us the deposit(s)/full payment. Please note that bookings made direct with us may not subsequently be transferred to a travel agent.

Deposit payments are £125 per person (excluding infants for whom no deposit is payable). We regret we cannot accept passengers under the age of 18 unless accompanied by an adult. We cannot accept personal cheques received less than 21 days before the start of your holiday even where you book through a travel agent. We will send you/your travel agent as applicable a confirmation invoice as soon as practically possible after receiving all appropriate payments.

Please note: All bookings are subject to availability.

Your ContractPlease read carefully our booking conditions on pages 90 – 95 of our brochure and on our website at www.markwarner.co.uk. By asking us to confirm your booking, you are liable to be regarded as having had the opportunity to do so. The booking conditions together with the information contained in this How To Book section and our Travel Information found on pages 90 – 91 of our brochure and on our website at www.markwarner.co.uk form the basis of our contract with you. A binding contract between us comes into existence when 1) we or your travel agent have received all appropriate payments at the time of booking and 2) we have verbally confirmed the booking to you or your travel agent over the telephone or, in the case of online bookings, we have despatched our confirmation invoice to you.

Prices and brochure accuracy

Changes and errorsPlease note that holiday information and prices shown in our brochure and on our website may have changed by the time you come to book your holiday. Whilst every effort is made to ensure the accuracy of the brochure, website and prices at the time of publication, regrettably errors do occasionally occur. We reserve the right to make changes to and correct errors in advertised prices at any time before your holiday is confirmed. We will advise you of any error of which we are aware and of the then applicable price at the time of booking. Your chosen holiday arrangements (including the price) will be confirmed on your invoice. Please note that bookings made prior to publication of the relevant brochure may be subject to significant changes upon confirmation of the programme and publication of the brochure. Please read clause 6 of our booking conditions for more details. During the season it may be necessary on certain dates to purchase extra flights and/or coach capacity. This may result in an increase in costs as we cannot always negotiate the same favourable seasonal rates. We will, however, only pass on such increased costs to you where your booking has not been confirmed. All such extra costs will be advised to you at the time of booking.

For price increases after booking, please see clause 3 of our booking conditions – Prices and surcharges.

Final PaymentPlease send the final payment so that we receive it no later than 10 weeks before the start of your holiday. This date will be clearly indicated on your invoice and failure to pay by this date may mean that your holiday will be cancelled and cancellation charges will apply – see clause 1 of our booking conditions.

Altered BookingsAll amendments to bookings must first be requested by telephone to the After Sales Department on 0844 884 3806 (and confirmed in writing if requested by them) or by email (if you have booked direct with us) to [email protected] or if you have booked through one of our authorised travel agents, through the agent. We will endeavour to assist if we can. Once we have issued the confirmation invoice, there will be a charge of £35 per person per occasion a change is made (if the change can be made) except as set out below. Changes made within 10 weeks of departure and any change of holiday dates will be treated as a cancellation of the original arrangements by you and cancellation charges will apply, please see clauses 4 and 5 in our booking conditions for further details (note that these cancellation charges apply to all pre-booked elements of your holiday). However, if the change is to increase the number of persons booked (without any other change), no amendment fee or cancellation charges will be payable (although you will of course have to pay any increase in the total holiday cost). Subject to meeting the conditions set out in clause 5 of our booking conditions, no amendment fee or cancellation charges will apply for a name change where the holiday arrangements otherwise remain exactly as originally booked unless flight tickets have been issued. In this case, an amendment fee of £35 per name change will be payable if on charter flights. For scheduled flights, the airline may treat any change (including a name change) made after tickets have been issued as a cancellation of the original booking and impose 100% cancellation charges. Accordingly, you may have to pay the full cost of the flight(s) in question again as well as the amendment fee of £35 per person affected.

Advance Passenger Information System (APIS)For security reasons, most European and many other countries now require airlines to provide information about their passengers before they fl y. This is known as Advance Passenger Information or API and includes full names, dates of birth, nationality, gender and passport details of all passengers but other details may also be required. The airlines set their own deadlines for receipt of this information which may be well in advance of departure. If it is not provided when required, you may be refused boarding on your fl ight. In this situation, full cancellation charges will apply. Accordingly, you must provide us with all information we ask you for when we ask for it. Where you make your own fl ight arrangements, you are responsible for providing API to the airline, if booking direct, or to your travel agent, when requested to do so. If, as a result of failure to provide information when required or the provision of inaccurate or incomplete details, you are unable to take your holiday, cancellation charges will apply as set out in our Booking Conditions.
