MARION COUNTY COMMISSION MARCH 19, 2014 1 The Marion County Commission sat in regular session pursuant to its adjournment on Wednesday, March 5 th , 2014. Present were Commissioner Elliott, Commissioner VanGilder and President Tennant. The proceedings of Wednesday, March 5 th , 2014, together with those had and done under the supervision of Janice Cosco, Clerk and Recorder for the Marion County Commission on March 6 th , 7 th , 10 th , 11 th , 12 th , 13 th , 14 th , 17 th , and 18 th , 2014 were approved as submitted and signed. D. D. Meighen led the Court with a prayer. Charlie Reese led the Court with the Pledge of Allegiance. President Tennant called the meeting to order. Commissioner Elliott moved to dispense with the reading of the minutes of Wednesday, March 5 th , 2014 and accept them as presented. Commissioner VanGilder seconded. President Tennant concurred. For the record, note James Priester, Assessor presented to the County Commission the following Exonerations for approval. Dated March 19, 2014 Nos. #2014-154 through #2014-236 Pursuant to the recommendation of James Priester, Assessor and approval of Patrick Wilson, Prosecuting Attorney; Commissioner Elliott moved that the President sign Nos. #2014-154 through #2014-236. President Tennant seconded. Motion passed. The Commission received an Order of Probate of Wills from the County Clerk’s Office for the month of February, 2014. Kris Cinalli stated that this Order is a list of Estates in which have been admitted to Probate in the County Clerk’s Office, in vacation of the Commission, from February 1, 2014 through February 28, 2014 pursuant to West Virginia Code §41-5-10, as amended.

Commissioner Elliott moved that the Commission sign the Order Confirming the Probate of Wills. Commissioner VanGilder seconded. President Tennant concurred. This day came David A Glance, Fiduciary Supervisor for Marion County, West Virginia, and presented to the Commission His Report of Claims and First and Final Settlement Reports for the following estates which reports he has filed in the Office of the County Clerk of the County Commission, pending confirmation. There being no further objections received to these reports and no errors appearing, the Report of Claims and First and Final Settlement Reports are hereby ratified, confirmed and approved. At a Regular Session of the County Commission of Marion County, West Virginia, continued and held for this County at their offices in the J. Harper Meredith Building on March 12th, 2014.

This day came David A. Glance, Fiduciary Supervisor for Marion County, and presented to the County Commission the Waivers and Applications for Short Form Settlements, Proposed Settlements and Annual Settlement Reports filed by the personal representatives of the following estates, which he has reviewed and approved and which are the same estates which were advertised for proposed settlement in the March 3rd, 2014, issue of the Fairmont Times West Virginian, all in accordance with West Virginia Code 44-3A-19.

Commissioner Elliott moved that the Commission sign the Waivers and Applications for Short Form Settlements, Proposed Settlements and Annual Settlement Reports. Commissioner VanGilder seconded. President Tennant concurred.

The Commission presented the Resolution to Accept Conditions of the Contract for West Virginia Community Participation Program Funds and to Authorize Signature on behalf of the Marion Regional Development Corporation.

Commissioner Elliott moved that the Commission sign the Resolution to Accept Conditions of the Contract for West Virginia Community Participation Program Funds and to Authorize Signature on behalf of the Marion Regional Development Corporation. Commissioner VanGilder seconded and asked if this is for the signs at the former drag strip Industrial Park. Charlie Reese answered in the affirmative. President Tennant concurred.

The Commission received a request for Reimbursement from West Virginia Division of Justice and Community Services to cover expenditures from March 1, 2014 to March 31, 2014. County Administrator Kris Cinalli stated that this request is in the amount of $2,396.00 for our Victim’s Advocate Grant, 12-VA-011.

Commissioner Elliott moved that the Commission President sign the document. Commissioner VanGilder seconded. President Tennant concurred. The Commission received a request for funds by United Way for the “3rd Annual Heston Farms Arts and Music Festival”. County administrator Kris Cinalli stated that they are requesting $2,000.00 from our Hotel/Motel Fund for this event, Saturday, July 14ht, 2014. Tiffany Samuels made the presentation in person. They will utilize these funds to advertise outside our area.

Commissioner Elliott moved that the Commission sign the grant $1,000.00 to the Heston Farms Arts and Music Festival and that those funds be appropriated from the Hotel/Motel Fund. Commissioner VanGilder seconded. President Tennant concurred. The Commission received a request for funds by Leadership Marion and United Way for the “Spring into Action Fair.” Bud Sapp spoke on behalf of this request and stated that they donate all of these funds to the local non-profits.

Commissioner Elliott moved that the Commission sign the grant $1,000.00 to the Spring into Action Fair and that those funds be appropriated from the Hotel/Motel Fund. Commissioner VanGilder seconded. President Tennant concurred. The Commission received a request for funds by NACMHA for the “1st Annual Open House Celebration”. Cherie Coogle was present to explain the event and raise awareness to our local coal mining heritage.

Commissioner Elliott moved that the Commission sign the grant $1,000.00 to the June 7th function and that those funds be appropriated from the Hotel/Motel Fund. Commissioner VanGilder seconded. President Tennant concurred. For the record, note the Commission received the Valley Falls Public Service District Reconciliation summary for period ending 1/31/14. For the record, note the Commission received that effective March 27, 2014, Comcast will add HSN2 to channel 88 on the digital Starter level of service. Charlie Reese stated for the record that the Palatine Project began today and is in the hand of Thrasher Engineering, and their man Jim Decker. He added that Mayors on the Move will meet Monday, March 24th in the building.

The Commission received the Consideration of the Outside Allocation applications. Various individuals came before the Commission to present their requests for consideration to the Commission in person.

Commissioner Elliott moved that the Commission take all of these requests under advisement. Commissioner VanGilder seconded. President Tennant concurred. There being no further business to come before the County Commission, it is ordered that this Commission do now recess until, Wednesday, March 26th, 2014 at 7:00 p.m. for the next scheduled County Commission Meeting. __________________________________
