Commodore’s LetterThursday Race Night “Host Boat”

DelightWe’ve been blessed so far in 2017 with delightful dining since Opening Day through Glenn Hontz Memorial Race #2 thanks to creative catering options by Bonjolea II and the NYC Board members. Big shout out to Charlotte Ross for orchestrating delicious entrees from Mark’s Place and soon to be served Marcie Millett’s Amaize, Inc. out of Hanapepe. The entrees by local caterers are outstanding and the sides made by the Host Boats were wonderful. Our first catered entrée

was Roast Beef au jus. The second entrée was Asian Steamed Fish with Bok Choy. The fish turned out to be fresh Mahi Mahi, exquisite! With the new catering support, dinner prices have gone to $15 to keep us on budget. I believe our dinner menus will only get better. NOTICE to all members: Don’t miss Thursday night after-race celebrations!

NYC Lease Renewal ProcessAs most of you are aware, our 15-year lease with DLNR expired last September 1st. We’ve been in close contact with both local and O`ahu-based DLNR officials since 2015 requesting planning support for a new long-term lease. There are many details behind the lease renewal process, but suffice to say…DLNR has been slow to respond. Jim Saylor, Staff Commodore, and one of our longest-standing members, is leading us through this maze of due diligence. Jim and I just returned from O`ahu where we attended DLNR’s Quarterly Land Board meeting on Friday, February 24th. We learned only one week prior that we (NYC) were on the agenda! DOBOR (Division of Boating and Ocean Recreation) submitted a proposal to continue a “Holdover Lease” for NYC on a month-to-month basis for one year. The DLNR Land Board meeting was asked to approve this proposal along with a 58% increase in rent ($1,107 to $1,746) retroactive to last September. This amounted to an unplanned $6,000 hit to our budget! Again, many details behind the proposal, but as you can imagine, we were stunned. NYC was invited to share testimony: and, so we did. Off to O`ahu we go!I’d love to share details of this experience, but it would take most of this newsletter to cover it all. Bottom Line: We requested that rent remain the same through this holdover period. And we are grateful the DLNR Board approved our request! The DLNR Land Board members were impressive, very knowledgeable, and patiently listening to all testimony. Ours took just 30 minutes, but others lasted hours. What our DOBOR planners misunderstood was the need to consider “Character of Use” in our property appraisal. Our Character of Use was NOT a profit-driven enterprise, but rather a non-profit community-based program that shares the love of boating and ocean recreation

for all of Kaua`i. The DLNR Board recognized this immediately and to some degree scolded the DOBOR contingent for misrepresenting our club!So, we won this battle. But we are still in the war of retaining a long-term lease that protects our club’s future and allows us to grow our mission to higher levels. It will take hard and creative work on the part of all: both NYC and KSA Board members must work together to successfully capture a new long-term lease. This will require cooperation from everyone. Racing NewsOn Wednesday, February 15, Commodore Fred Styer and Vice Commodore Kevin Arndt attended the HYRA Spring General Meeting at Kaneohe Yacht Club as NYC delegates. As the roll call was taken, a round of applause came from the group as our names were called! The group encourages “outer island” delegates to attend and contribute to the meetings. The agenda included voting on clerical modifications to Notice of Series for the All Island and Season Series. There was discussion on possible government regulations affecting the boating industry such as a possible requirement for propeller guard for inboard/outboard engines.

A mention was given on the fact that training was available to HYRA members to obtain the status of US Sailing Area Race Officers (ARO) and Regional Administrative Judges (RAJ). These are intensive courses covering racing rules and race administration. Under new business, we discussed the “best practices” of scoring a downwind race and how these relate to our own Kaua`i Channel Race. This new knowledge gained will be discussed at the first committee meeting for the 2017 KCR scheduled for March 6th at 5 pm at NYC. Before and after the meeting, several boat owners remarked that they felt that the Kaua`i Channel Race is the premier racing event in Hawai`i and that NYC is the best host. The weather at the Opening Day Race Series was rainy with light winds so the start of the race was postponed an hour. After the postponement the boats were drifting around the start area when the Race Committee decided to postpone the race again but for 15 minutes. That’s all it took because the wind filled in, the sun came out, and we got two good races completed before heading back to the clubhouse for the Champagne Picnic.

The first Offshore Skippers Choice Race for 2017 will start on Saturday, March 10 at 10 am. These offshore races are good opportunities to fine tune your crews racing skills all the while enjoying a nice afternoon sailing among the whales and porpoises. Don’t miss the skippers meeting at 9 am on the day of the race.April 6th will be the start of the Louie Abrams Memorial Rum Series. This six race series requires that each boat must present a bottle of rum with a label that includes the boat’s name and art work on it. The bottle will be stocked at the bar for consumption by all NYC patrons. This is timely because we’re running low on rum at the bar.

Quiz 94 Four boats are approaching a port-hand windward mark, two on starboard tack (SA and SB) and two on port tack (PW and PL). One of the starboard tack boats (SB) is approximately two lengths behind the other starboard-tack boat (SA) and half a length to windward of her. The two port-tack boats (PW and PL) are both ducking SA, with PL to leeward and about three-quarters of a length ahead of PW. As the boats are passing astern of SA, PL hails PW for room to tack to clear SB. Because PW can’t tack right then without hitting SA, PW does not reply. PL immediately luffs sharply to try to avoid SB, but SB needs to luff to avoid hitting PL. PW tries to avoid PL but can’t and there is slight contact between them with no damage or injury. SB protests PL for breaking rule 10 (port/starboard), and PL protests PW for failing to respond to her hail under rule 20.2 (responding to a hail for room to tack at an obstruction). You are on the protest committee; how would you decide this?

ANSWER TO QUIZ 94Boat PL is penalized for breaking rule 10, On Opposite Tacks, rule 16.1, Changing Course, and rule 20.2(a), Room to Tack at an Obstruction: Responding. PW breaks rule 11, On the Same Tack, Overlapped, but is exonerated under rules 21, Exoneration, or 64.1(a), Decisions: Penalties and Exoneration, because she is compelled to break rule 11 by PL’s rule breaches. Both SA and SB are obstructions to PW and PL because both PW and PL are required to keep clear of them under rule 10 (see the definition Obstruction). When PW and PL are passing astern of SA, they are overlapped. Rule 19.2(b), Giving Room at an Obstruction, requires PL to give PW room to pass SA, which she is doing. Safety requires PL to make a substantial course change to avoid SB; and rule 20.1, Room to Tack at an Obstruction: Hailing, gives her the right to hail PW for room to tack to avoid SB. However, rule 20.2(a) requires PL to give PW time to respond to the hail before tacking. One of PW’s options for responding is to tack as soon as possible (rule 20.2(c)). When PL hails, it is not possible for PW to tack due to her proximity to SA. As soon as she can she begins tacking, but PL has already started to tack and the boats collide. Therefore PL fails to give PW time to respond before tacking. Furthermore, when PL luffs, i.e., changes course, she fails to give PW room to keep clear, thereby breaking rule 16.1.

Regarding the contact, it is not possible for PW to avoid contact, so she does not break rule 14, Avoiding Contact. PL on the other hand can avoid contact with PW by passing astern of SB instead of tacking. Therefore PL breaks rule 14, but is exonerated (not penalized) for breaking that rule because she is the right-of-way boat and the contact does not cause damage or injury (see rule 14(b)).Answers to Dave Perry’s 100 Best Racing Rules Quizzes are based on The Racing Rules of Sailing for 2013-2016.
