FOREWORD At the time I was entrusted with the ICCAT Chairmanship, I made the commitment to study the tasks that would improve the work of our Commission in order to carry out its mission and achieve the objectives for which it was created. In the course of 2006, with the collaboration of the Secretariat, I was able to organize a number of workshops with the Contracting Parties in the various regions of the ICCAT Convention area. From the very informative discussions at these workshops, I have been able to discern a number of needs, at least some of which I felt that I, with the help of the Secretariat, could address. One of these, as it turns out, concerns the need for a tool that would provide ICCAT Contracting Parties and others with a better understanding of the reporting requirements and obligations of the Commission. ICCAT has many such requirements, and discussions during the 2006 workshops made it clear that a majority of Parties felt that these requirements should be more clearly presented to facilitate compliance. It is in this sense that I have instructed the Secretariat to develop the present document which constitutes the Manual of Procedures for the Submission of Information Required by ICCAT. The objective of this Manual is to present a summary of the requests for information required by ICCAT and to explain the procedures to provide the data and information. Thus, this guide does not substitute the recommendations and resolutions adopted by the Commission, which continue to be our legal references, but it serves to enhance our understanding of what information needs to be reported to ICCAT. I would like to take this occasion to congratulate the Secretariat for its efforts in successfully carrying out this work, which is for the benefit of us all. It is hoped that the Contracting Parties and others will make good use of this Manual. In so doing, I would like to ask all users to inform the Secretariat of any comments aimed at its improvement.

INTRODUCTION In order to achieve the objectives of the Convention, the International Commission for the Conservation of Atlantic Tunas (ICCAT) has adopted a number of Recommendations and Resolutions that concern, in some cases, the submission of information on specific dates and in a well defined format. The Secretariat has developed this Manual which is simply a tool to orient the Contracting Parties, and the Cooperating non-Contracting Parties, Entities and Fishing Entities in fulfilling their obligations in relation to the submission of information required by the Commission. The objective of this Manual is not to replace the Abridged Compendium or the Compendium of Management Recommendations and Resolutions, but to serve as a guide for better understanding of the data requirements. For each data request, the Secretariat transmits a specific circular with the guidelines concerning the manner and the format of their submission. These circulars are accessible on the ICCAT web site, at: www.iccat.int/circulars. In order to accelerate the assimilation of the information described below in the Secretariat’s databases and to avoid data collection errors, the use of the electronic forms prepared and distributed by the Secretariat for this purpose is highly recommended. The Secretariat encourages the use of electronic files and recommends avoiding, inasmuch as possible, sending information by fax or scanned documents which can be difficult to read and thus cannot be processed. All the forms are attached to this Manual as Annex 1 and are available on the ICCAT web site at the following address: http://www.iccat.int/SubmitCOMP.htm. Annex 2 of this Manual explains the alphabetic codes of species, fishing gears, fishing areas and other codes or abbreviations used in some forms. As a general rule, the Secretariat acknowledges receipt of all information in order to indicate conformity of the data or to request clarifications, without expressing any judgment on the quality or reliability of the data. To facilitate consultation, this Manual is divided into five parts:

– Vessels in general. – Farming and management measures for east Atlantic bluefin tuna. – Implementation of Statistical Document Programs. – Declaration tables and trade measures. – Basic statistical and biological information required.

Each chapter is subdivided into four sub-chapters:

– Parties concerned: Indicates the Parties concerned regarding the data request. – Deadline date: Dates by which the information should be submitted. – Form: Title and code of the form for the submission of data. – Instructions and guidelines: Major instructions to complete the forms.

VESSELS IN GENERAL

Within the framework of the management of fishing effort aimed at tunas and tuna-like species and in order to fight against illegal fishing, the Commission has adopted a series of Recommendations and Resolutions to better manage the fishing fleets that operate in the Convention area. This chapter is divided into three sub-chapters. The first refers to the basic information on the vessels, the second to chartering, and the last chapter is dedicated to the vessels considered to be involved in illegal, unreported and unregulated fishing activities. A. Basic information on the lists of vessels A.1 Submission of the list of vessels over 24 m authorized to fish in the Convention area In accordance with the Recommendation by ICCAT Concerning the Establishment of an ICCAT Record of Vessels over 25 Meters Authorized to Operate in the Convention Area [Rec. 02-22], the Contracting Parties and the Cooperating non-Contracting Parties, Entities or Fishing Entities shall submit to the Secretariat the list of their vessels over 24 m operating in the ICCAT Convention area. All vessels over 24 m operating in the Convention area and which are not included on this list are deemed not be authorized to fish. A.1.1 Parties concerned All the Contracting Parties and Cooperating non-Contracting Parties, Entities or Fishing Entities that have vessels over 24 meters that are likely to fish in the Convention area must submit the list of these vessels to the Secretariat. A.1.2 Deadline date No deadline for updates has been established by the Commission. It is highly recommended that this information be submitted as soon as it becomes available. A.1.3 Form The form for the submission of this information is COMP-001-VESS-24.XLS. It is essential that this form be completed electronically to facilitate the processing of the data. A.1.4 Instructions and guidelines It should be ensured that all the required information is included on the forms. The inclusion of vessels on other lists of vessels required by the Commission does not exempt the Parties from submitting this specific list. The ICCAT identification number that is found in the first column of this form will be assigned by the Secretariat; it will be unique and will remain for the life of the vessel. Any lack of information may run the risk of being detrimental to the interests of the CPC by delaying trade and other operations. A.2 Report on the internal measures taken to guarantee that vessels over 24 meters observe the ICCAT

conservation and management measures In accordance with the Recommendation by ICCAT Concerning the Establishment of an ICCAT Record of Vessels over 24 Meters Authorized to Operate in the Convention Area [Rec. 02-22], the CPCs having vessels included in the ICCAT Record of Vessels over 24 meters should review their own actions and measures taken to ensure that their vessels comply with the ICCAT management measures and to present this review to the Secretariat for its transmittal to the Commission. A.2.1 Parties concerned All the Contracting Parties and Cooperating Parties, Entities or Fishing Entities that have vessels over 24 meters that may fish in the Convention area.

Any other action, regulation and measure taken and not included on the form can be reported to the Commission. Please ensure that all the blanks on the form COMP-010-INT-24.XLS are completed. A.3 Submission of the list of vessels targeting northern albacore In accordance with the Recommendation by ICCAT Concerning the Limitation of Fishing Capacity on Northern Albacore [Rec. 98-08], the Contracting Parties and the non-Contracting Parties should transmit a list to the Secretariat of vessels targeting northern albacore in the ICCAT Convention area. A.3.1 Parties concerned All the Contracting or non-Contracting Parties, Entities or Fishing Entities which participates in a directed fishery for northern albacore are required to submit a list of their vessels participating in this fishery. Recreational fishing vessels are exempt from this regulation as are Parties whose average annual catches for the period 1993-1995 are less than 200 t, except Parties or Entities that have previously limited their fishing capacity in 1999. A.3.2 Deadline date Information relative to this measure should be submitted by June 1 of each year. A.3.3 Form The form for the declaration of these data is the « List of Vessels Operating a Direct Fishery for Albacore in the North Atlantic »: COMP-003_VES_ALB. A.3.4 Instructions and guidelines Ensure that all the required information is included on the forms. The inclusion of these vessels on other lists does not exempt the Parties concerned submitting this specific list. The ICCAT identification number included in the first column of this form will be assigned by the Secretariat will be unique and held exclusively by the vessel during its life. Vessels less than 24 meters can also be included on this list. A.4 Submission of the list of vessels authorized to receive transhipments in the ICCAT area In accordance with the Recommendation by ICCAT Establishing a program for Transshipment by Large-scale Longline Fishing Vessels [Rec. 05-06] and the Recommendation by ICCAT Establishing a Program for Transshipment [Rec. 06-11], the Secretariat should implement a database of the carrier vessels authorized to receive tunas in the ICCAT Convention area from large-scale longliners.

A.4.3 Form There are two forms for the submission of information to the Secretariat concerning this requirement. The first form is for submitting the list of carrier vessels authorized to receive the transshipments (COMP-002-VESS-TC) whereas the second form is to record the transshipment declaration (COMP-019-TS-DEC). A.4.4 Instructions and guidelines In order to ensure the correct entry of the information in the Secretariat databases, the submission of data in electronic files (MS.Excel or MS.Access) is recommended. In completing the form COMP-002-VESS-TC, it is essential to ensure the inclusion of mandatory information (flag, vessel name and registration number, previous name and flag, international radio call sign, type of vessel, names and addresses of the boat owners and operators). A.5 Submission of the list of vessels that fish for, provide, or transfer bluefin tuna for farming purposes In accordance with the Recommendation by ICCAT to Amend the Recommendation on Bluefin Tuna Farming [Rec. 05-04] and the Recommendation by ICCAT on Bluefin Tuna Farming [Rec. 06-07], the Contracting Parties and Cooperating non-Contracting Parties, Entities or Fishing Entities should transmit to the Secretariat a list of vessels that fish for, transport or provide bluefin tuna for farming purposes. A.5.1 Parties concerned All the Contracting Parties and Cooperating non-Contracting Parties, Entities or Fishing Entities whose flag vessels fish for or transfer bluefin tuna to cages.

A.5.2 Deadline date Changes affecting the information relative to the list of vessels that fish for, provide, or transfer bluefin tuna for farming purposes should be submitted to the Secretariat as soon as they occur. A.5.3 Form The form for the submission of this information is COMP-004-VESS-BFT.XLS. This form is based on that of the list of vessels over 24 meters. A.5.4 Instructions and guidelines The submission of the positive list (vessels over 24 meters authorized to fish in the Convention area) does not exempt the Parties concerned from submitting this list. In order to avoid duplication of information already submitted on the positive list, simply indicate the ICCAT vessel identification number. In the case where the vessel is not included on the positive list, all the information should be completed on the form. A.6 List of vessels authorized to fish eastern bluefin tuna

In accordance with the control measures defined in the Recommendation by ICCAT to Establish a Multi-Annual Recovery Plan for Bluefin Tuna in the Eastern Atlantic and Mediterranean [Rec. 06-05], the Commission should maintain a database of the vessels authorized to fish bluefin tuna in the eastern Atlantic and the Mediterranean. A.6.1 Parties concerned All the Contracting Parties and Cooperating non-Contracting Parties, Entities or Fishing Entities that have vessels authorized to fish bluefin tuna in the eastern Atlantic and the Mediterranean.

A.6.3 Form The form for the submission of this information is COMP-020-VESS-EBFTfish. A.6.4 Instructions and guidelines The procedures and instructions for the submission of vessels over 24 meters also apply to this list. Any fishing vessel that is not included in this database and targets eastern bluefin tuna may be considered by the Commission as having carried out activities in contravention of the ICCAT management measures. B. Information on the list of chartered vessels B.1 Submission of information on vessel chartering

For purposes of clarification and in order to assist in better understanding this management measure, the following definitions have been used in this Manual:

– Charterer: Party, Entity or Fishing Entity that hires a vessel. – Flag CPC: Party, Entity or Fishing Entity to which the vessel is registered.

In accordance with the Recommendation by ICCAT on Vessel Chartering [Rec. 02-21]:

• The chartering nations should be ICCAT Contracting Parties. • All the Parties, Entities or Fishing Entities applying the ICCAT conservation and management

measures can be owner parties. • The catches made are deductible from the chartering Contracting Party’s quota. • At the time the chartering arrangement is made:

- The chartering Contracting Party should provide information to the Secretariat on the vessel identification, the duration of the agreements and the conservation measures adopted.

- The flag CPC will inform the Executive Secretary of its consent to such an agreement. B.1.1 Parties concerned All the Contracting Parties chartering vessels as well as the flag non-Contracting Parties, Entities or Fishing Entities are required to submit information to the Secretariat. The information required varies according to whether it the Party is a charterer or an Flag CPC B.1.2 Deadline date For charterers, the required information should be submitted when the chartering agreement is made. In addition the pertinent details of the agreements concluded the previous calendar year, including information of catches taken and fishing effort deployed by the chartered vessels, should also be submitted to the Secretariat by 31 July each year.

For the Flag CPC, the information relative to their consent as well as the measures taken to implement the ICCAT management measures should also be transmitted when the chartering agreement is made. B.1.3 Form For the charterers, the form to use to report the chartered vessels is COMP-005-CHAR-CP.XLS. Since the Recommendation also has other requirements, a document should be attached which includes the measures adopted to implement the provisions foreseen in the management measure as well as the Flag CPC ’s consent.

The Flag CPCs should use the form COMP-06-CHAR.XLS. Flag CPCs should also attach a report to this form indicating the measures adopted to implement the regulatory provisions and a confirmation of their consent to the chartering arrangement. There is no standard format for submitting the annual summary report. The format used is at the discretion of each chartering CPC. B.1.4 Instructions and guidelines To ensure correct processing of the information in the Secretariat’s databases, information should be submitted through on electronic files. The charterer and the Flag CPC should inform the Executive Secretary when a chartering arrangement has ended. The chartered vessels should not be on ICCATs list of IUU vessels. C. Information on the list of IUU vessels C.1 Submission of the list of vessels presumed to have carried out IUU fishing activities In accordance with the Recommendation by ICCAT Amending the Recommendation by ICCAT to Establish a List of Vessels Presumed to Have Carried Out Illegal, Unreported and Unregulated Fishing Activities in the ICCAT Convention Area [Rec. 06-12], the Contracting Parties and Cooperating non-Contracting Parties, Entities or Fishing Entities shall send a list to the Secretariat of the vessels flying the flag of a non-Contracting Party presumed to have carried out IUU fishing activities in the ICCAT Convention area. C.1.1 Parties concerned All the Contracting Parties and Cooperating non-Contracting Parties, Entities or Fishing Entities that have identified vessels carrying out IUU fishing activities. C.1.2 Deadline date Information should be transmitted at least 120 days prior to the annual Commission meeting. Any additional and pertinent information can be transmitted at any time to the Executive Secretary for subsequent distribution. C.1.3 Form The form for the submission of this information is « List of Vessels Presumed to have Carried Out Illegal, Unreported and Unregulated (IUU) fishing activities in the Convention Area » (COMP-011-IUU.XLS). C.1.4 Instructions and guidelines This list should necessarily be accompanied by all the supporting evidence concerning the presumption of these IUU activities. The preparation of this list should be based on the information contained in Recommendation 06-12.

Paragraph 1 of Recommendation 06-12 provides a list of 10 points that could serve as a guideline to define IUU activities. C.2 Vessel observations In accordance with the Resolution by ICCAT on Compliance with the ICCAT Conservation and Management Measures [Res. 94-09], the Contracting Parties shall collect and transmit to the Secretariat all the available information on vessels that fish in the Convention area in contravention to the management measures adopted by the Commission. C.2.1 Parties concerned All those Contracting Parties which have information on suspected IUU activities to report

C.2.3 Form The form adopted for the submission of this information is the «Sighting Information Sheet» which is attached as an Addendum to Resolution 94-09, and is available from the ICCAT Web site at : http://www.iccat.int/SubmitCOMP.htm (Vessel information) C.2.4 Instructions and guidelines The Contracting Parties are asked to encourage their fishers to collect the maximum amount of information as a means of cooperating more effectively in the implementation of this measure. Information on the type, length and name of the vessel, the flag and port of registry, international radio call sign, registration number, vessel length, fishing gear used, nationality of officers, dates of entry and departure are essential and should be included.

FARMING AND MANAGEMENT OF THE EASTERN ATLANTIC BLUEFIN TUNA STOCK In the framework of the management of bluefin tuna in the east Atlantic and the Mediterranean (eastern stock), the Commission has adopted two important recommendations. The first, the Recommendation by ICCAT on Bluefin Tuna Farming [Rec. 06-07] covers the bluefin tuna farming activities, and the second, the Recommendation by ICCAT to Establish a Multi-Annual Recovery Plan for Bluefin Tuna in the Eastern Atlantic and Mediterranean [Rec. 06-05], aims at establishing a multi-annual program to recover the eastern Atlantic and Mediterranean bluefin tuna stock. D. Information required for bluefin tuna farming activities D.1 Submission of the List of Tuna Farms In accordance with the Recommendation by ICCAT on Bluefin Tuna Farming [Rec. 06-07], the Contracting Parties and Cooperating non-Contracting Parties, Entities or Fishing Entities shall submit a «Record of Farming Facilities authorized to operate for Farming of Bluefin Tuna Caught in the Convention Area». D.1.1 Parties concerned All the Contracting Parties, and Cooperating non-Contracting Parties, Entities or Fishing Entities that operate farming facilities in the Convention area. D.1.2 Deadline date Changes affecting the information relative to the list of bluefin tuna farming facilities should be submitted to the Secretariat as soon as they occur. D.1.3 Form The form for the submission of this information is COMP-007-FARMS.XLS. D.1.4 Instructions and guidelines The name, location and capacity of the farm must be reported, as well as the name(s) and address(es) of the owners and operators. The use of electronic files is highly recommended when submitting information to the Secretariat. Scanned or faxed information is often illegible. The list should include the following information: name and number of the farming facility, names and addresses of the owners and/or operators, geographic location and capacity (in tons). D.2 Submission of the «List of Vessels that Fish for, Provide or Transport Bluefin Tuna for Farming

Purposes» This section is discussed earlier in this Manual (see Section A.5 for more detailed information). D.3 Submission of the quantities of bluefin tuna placed in the cage for farming purposes In accordance with the Recommendation by ICCAT on Bluefin Tuna Farming [Rec. 06-07], the Contracting Parties and Cooperating non-Contracting Parties, Entities or Fishing Entities shall transmit to the Secretariat the amounts of bluefin tuna transferred to cages for each farming facility, as well as the commercial quantities and an estimate of the growth and mortality. D.3.1 Parties concerned All the Contracting Parties, and Cooperating non-Contracting Parties, Entities or Fishing Entities that operate farming facilities in the ICCAT Convention area. D.3.2 Deadline date Information should be transmitted to the Secretariat prior to August 31 of the year in course.

D.3.3 Form The form for the submission of this information is COMP-008-FMREP.XLS. D.3.4 Instructions and guidelines The name of the farm must be provided; the quantities should be expressed in metric tons. Since the Recommendation also requires transmission of the quantities placed in cage during the previous year, the same form can be used for the current year and the previous year, but the year to which the data pertain should be clearly idicated. This table should be completed for each farming facility. D.4 Submission of the quantities of bluefin tuna placed in cage per vessel In accordance with the Recommendation by ICCAT on Bluefin Tuna Farming [Rec. 06-07] and the Recommendation by ICCAT to Establish a Multi-Annual Recovery Plan for Bluefin Tuna in the Eastern Atlantic and Mediterranean [Rec. 06-05], the Contracting Parties and Cooperating non-Contracting Parties, Entities or Fishing Entities shall inform the Commission of the quantities of bluefin tuna transferred to cages by each fishing vessel or transport vessel. D.4.1 Parties concerned All the Contracting Parties and Cooperating non-Contracting Parties, Entities or Fishing Entities that have bluefin tuna farming facilities in the ICCAT Convention area D.4.2 Deadline date Information should be submitted to the Secretariat each year prior to August 31. D.4.3 Form The form for the submission of this information is COMP-009-FMDEC.XLS. D.4.4 Instructions and guidelines This report shall include information relating to the validation numbers and the dates of the Statistical Document, the quantities (in tons and in number of fish) of the losses during transport, the dates, locations, vessel name and gear and the flag names and registration numbers. E. Data required in the framework of the Eastern Atlantic and Mediterranean Bluefin Tuna Management

Program E.1 Submission of the List of Vessels authorized to fish bluefin tuna This section is described previously in Section A.6. E.2 Submission of List of Traps authorized to fish bluefin tuna and quantities taken by traps In accordance with the Recommendation by ICCAT to Establish a Multi Annual Recovery Plan for Bluefin Tuna in the Eastern Atlantic and Mediterranean [Rec. 06-05], the Contracting Parties, and Cooperating non-Contracting Parties, Entities and Fishing Entities shall send the Secretariat a List of Traps authorized to fish in the Convention area, as well as the quantities of bluefin tuna sacrificed within 48 hours of landing after each fishing operation. E.2.1 Parties concerned All Contracting Parties, and Cooperating non-Contracting Parties, Entities and Fishing Entities that have tuna traps authorized to catch bluefin tuna in the east Atlantic and Mediterranean.

E.2.2 Deadline date Changes to the information regarding the List of Traps shall be sent to the Secretariat as soon as they occur. Quantities shall be transmitted to the Secretariat immediately after the death of the fish. E.2.3 Form The forms for the submission of this information are COMP-021-TRAPS.XLS and COMP-022-TRAPDEC.XLS. E.2.4 Instructions and guidelines Form COMP-021_TRAPS includes a List of authorized traps and form COMP-022_TRAPDEC.XLS indicates the catches taken by these traps. It is compulsory to indicate the name, number, and geographical area of the trap, as well as the quantities caught that shall be indicated in kilograms and number of fish. The names and addresses of owners and/or operators shall also be specified. E.3 Submission of bluefin tuna catch declarations In accordance with Recommendation by ICCAT to Establish a Multi Annual Recovery Plan for Bluefin Tuna in the Eastern Atlantic and Mediterranean [Rec. 06-05], Contracting Parties, and Cooperating non-Contracting Parties, Entities and Fishing Entities shall transmit their monthly catches to the Secretariat, as well as catches taken by vessels. E.3.1 Parties concerned All Contracting Parties, and Cooperating non-Contracting Parties, Entities and Fishing Entities fishing bluefin tuna in the Eastern Atlantic and Mediterranean. E.3.2 Deadline date Each CPC shall send the Secretariat a report on the provisional monthly catches of bluefin tuna within 30 days of the end of the calendar month in which catches were made. Reports of catches by vessel shall be made 10 days after initial entry into the E-BFT Plan Area, and every five days after 1 June of each year E.3.3 Form The forms for the submission of this information are COMP-025-BFT-CBM and COMP-026-BFT-CBV. E.3.4 Instructions and guidelines Form COMP-025-BFT-CBM includes the monthly catches by gear and geographical area and form COMP-026-BFT-CBV indicates the catches taken by each vessel. E.4 Submission of the List of Transshipment Ports and/or bluefin tuna landings In accordance with Recommendation by ICCAT to Establish a Multi Annual Recovery Plan for Bluefin Tuna in the Eastern Atlantic and Mediterranean [Rec. 06-05], Contracting Parties, and Cooperating non-Contracting Parties, Entities and Fishing Entities shall transmit to the Secretariat the List of Ports where transshipment and/or landings of East bluefin tuna stock is authorized. E.4.1 Parties concerned All Contracting Parties, and Cooperating non-Contracting Parties, Entities and Fishing Entities with authorized transshipment and landing ports. E.4.2 Deadline date Changes to the information contained in the Record should be sent to the Secretariat as soon as they occur.

E.4.4 Instructions and guidelines A non-exhaustive list of ports and port codes by Contracting Party is available on the ICCAT Web site. It is recommended that the authorization period granted to carry out these landing and transshipment operations be indicated. This declaration should indicate whether the ports are authorized for transshipment and/or landing, as the same form is used for both cases.

F. ICCAT Scheme of Joint International Inspection F.1 Submission of information under the ICCAT Scheme of Joint Inspection In accordance with paragraphs 56 and 57 of the Recommendation by ICCAT to Establish a Multi Annual Recovery Plan for Bluefin Tuna in the Eastern Atlantic and Mediterranean [Rec. 06-05], Contracting Parties and Cooperating non-Contracting Parties, Entities and Fishing Entities agreed, in the framework of the multi-annual management plan for bluefin tuna, to apply the ICCAT Scheme of Joint International Inspection [Ref. 75-02]. F.1.1 Parties concerned Parties wishing to carry out at-sea international inspection in the eastern Atlantic Ocean and Mediterranean Sea. F.1.2 Deadline date There is no deadline for information. Vessels and inspectors should be notified to the Secretariat as soon as possible. Inspection reports should be sent to the Secretariat as soon as available. F.1.3 Form The form for requesting inspector Identification cards has been sent to all Contracting Parties. Additional forms are available from the Secretariat on request. The Inspection Declaration form has also been circulated and is available on the ICCAT Web Site as COMP_INSP-028.doc F.1.4 Instructions and guidelines

IMPLEMENTATION OF STATISTICAL DOCUMENT PROGRAMS With the aim of reinforcing the effectiveness of management measures on bluefin, swordfish and bigeye, adopted by the Commission, a Statistical Document Program on catches of these species has been established. This program has experienced several improvements throughout its initiation and requires Parties to submit information on document validation and the declaration of commercialized quantities. G Information to be submitted under the ICCAT Statistical Document Programs G.1 Issuance of ICCAT Statistical Document In accordance with Resolutions and Recommendations adopted by ICCAT, in particular Resolution by ICCAT concerning the Effective Implementation of the ICCAT Bluefin Tuna Statistical Document Program [Res. 94-05], Recommendation by ICCAT concerning the ICCAT Bigeye Tuna Statistical Document Program [Rec. 01-21], Recommendation by ICCAT establishing a Swordfih Statistical Document Program [Rec. 01-22] all swordfish, bluefin tuna and frozen bigeye that is imported to the territory of a Contracting Party and Non-contracting Cooperating Party, Entity and Fishing Entity, with the exception of bigeye caught by purse seine and baitboat and destined principally for the canneries in the Convention area, shall include an ICCAT Statistical Document duly validated. Exported products shall carry a statistical document that includes essential information to validate their transfer, in particular, the names, administration seals and technical references of vessels and fishing gear. G.1.1 Parties concerned All Contracting Parties and Non-contracting Cooperating Parties, Entities or Fishing Entities to the Convention that export bluefin, frozen bigeye and swordfish shall carry a duly completed ICCAT Statistical Document with the products of these commercialized species. The Parties that import these products shall request the presentation of this document and shall verify its correct validation by consulting the Secretariat database on the validation of Statistical Documents.

G.1.2 Deadline date No deadline is established, however each time the product of one of these three species (bluefin, swordfish and bigeye) is exported, this document shall be completed, validated and shall accompany the product. All modifications to the list of institutions and individuals authorized to validate the document shall be notified to the Secretariat. G.1.3 Form The form adopted to accompany the traded product is the designated ICCAT Statistical Document Form (SDP-BFT, SDP-SWO and SDP-BET) which is contained in the Annex of Recommendation by ICCAT concerning the Amendment of the Forms of the ICCAT bluefin/bigeye/swordfih Statistical Documents [Rec. 03-19] including an example in Annex 1. A specific document exists for each of the three species. G.1.4 Instructions and guidelines This document shall be validated by the competent authorities that were previously included in the Secretariat database in accordance with clearly defined regulations. More extensive and detailed instructions are included in the annexes of the SDP-BFT, SDP-SWO and SDP-BET forms. If the document is filled out in a language other than English, French or Spanish, a translation shall be attached in one of the official languages of the Commission. At the time of issuance, this document shall not be transmitted to the Secretariat but shall accompany the commercialized product. In the event of re-export, the Re-export Certificate shall be completed and attached to the product, with a copy of the statistical document which accompanied the original import. G.2 Submission of signatures and seals for the ICCAT Statistical Document Validation In accordance with several Resolutions and Recommendations on the implementation of the ICCAT Statistical Document Program (Resolution by ICCAT concerning the Effective Implementation of the ICCAT Bluefin Tuna Statistical Document Program (BFTSD) [Res. 94-05], Recommendation by ICCAT concerning the ICCAT Bigeye Tuna Statistical Document Program [Rec. 01-21], Recommendation by ICCAT establishing a Swordfish

Statistical Document Program [Rec. 01-22] the Parties exporting the species covered by these programs (bluefin, bigeye and swordfish) are required to transmit to the Secretariat a list of institutions and if applicable, the individuals authorized to validate the ICCAT Statistical Documents. G.2.1 Parties concerned All Parties, Entities or Fishing Entities trading bluefin, frozen bigeye, and swordfish. G.2.2 Deadline date The information required in the framework of these programs can be transmitted to the Secretariat at any time. Parties shall transmit this information prior to the export of the afore-mentioned products in order to avoid problems at the time of import. Importing parties should verify document conformity, in particular, the validity of seals and, if applicable the signatures, upon reception of products. G.2.3 Form The form for the submission of this information on validation of ICCAT Statistical Documents is COMP-015_SDP_VAL. G.2.4 Instructions and guidelines The Parties concerned shall ensure that they report, in a timely fashion, the list of institutions authorized to validate the Document together with the seals of such authorities, and the signatures of the authorized individuals if applicable. All modifications to this list should be notified immediately to the Secretariat. It is recommended that Parties regularly verify the information published on the ICCAT web site and notify the Secretariat in the event of missing or incorrect information. The legibility of information and seals, as well as clear instructions in relation to whether information is to be added or replaced, is a guarantee of the rapid processing of information. G.3 Biannual report of data collected in the framework of ICCAT Statistical Documents In the application of Resolutions and Recommendations on the ICCAT Statistical Document Program, specific information collected through the program shall be submitted to the Secretariat every six months, by the dates and in the format adopted by the Commission. The Secretariat has devised an electronic format which may be used. G.3.1 Parties concerned All Contracting Parties and Non-contracting Cooperating Parties, Entities or Fishing Entities to the Convention importing bluefin, frozen bigeye and swordfish products shall report the quantities imported to the Secretariat. Likewise, it is requested that non-Contracting and non-Cooperating Parties collaborate in the implementation of management measures. G.3.2 Deadline date The deadline date for the submission of information to the Secretariat is established as April 1 for the period covering the second half of the previous year, and October 1 for the period covering the first half of the year in course. G.3.3 Form The form for the submission of this information is the ICCAT Statistical Document Report (COMP-016_SDP_REP). The Excel version comprises three sheets. The first sheet includes information on direct import, the second on re-export data and the third on codes to be used. The original format adopted by the Commission is also available, and may be used if preferred.

G.3.4 Instructions and guidelines The information regarding gear, point of export, area of catch and type of product is essential for the correct processing of the data. Failure to submit all the information required by the management measures in force may result in the Secretariat being unable to process the information submitted. In the event of re-export, the second page of this document shall be used, the Re-export Certificate Report. Detailed instructions are enclosed to the Annex of the form.

COMPLIANCE REPORTING TABLES AND TRADE MEASURES H. Compliance reporting tables Recommendation by ICCAT on Application on Three Compliance Recommendations [Rec. 98-14] requires the submission of compliance reporting tables; the revised formats and procedures for submission were approved by the Commission during the 18th Regular Meeting of the Commission held in 2003. The Secretariat will send each Party their individual tables to be completed and returned to the Secretariat. On the basis of this information, a summarized table will be prepared for the purpose of discussion and analysis by the Compliance Committee. H.1 Parties concerned All Contracting Parties and non-Contracting Cooperating Parties, Entities or Fishing Entities carrying out fishing activities in the Convention area and catching the species managed by ICCAT are required to submit the information requested in this recommendation. H.2 Deadline date The deadline for the submission of this information is established one month prior the Commission meeting for the preliminary version and on the first day of the start of the work of the Compliance Committee for the final version. Modifications to the tables after the first day of the Compliance Committee meeting will not be accepted except at the petition of the Compliance Committee Chairman. H.3 Form The form for the submission of this information to the Secretariat is the compliance form (COMP-013_COC) aimed at compliance and size limits. This form comprises three parts, divided in three different sheets

– The first sheet of this form includes the balance of quotas/catch limits and catches taken. – The second sheet comprises percentage estimations of regulated under sized catches of the species

concerned (yellowfin, swordfish and bluefin). – The last sheet of this form explains the method used for adjusting overages/underages consigned in

the first page. H.4 Instructions and guidelines This form allows the calculation of balances of quotas and catch limits in previous years in accordance with the pertinent recommendations of the Commission and the catches taken by species and stock, and hence the adjustment of future quotas, if applicable. The balance represents the difference between catches and quota or adjusted catch limits. The calculation of these adjustments shall be included in the third sheet of form COMP-013_COC (adjustment of underages or overages). The last sheet of the form includes the regulations implemented by each Party to adjust their quota or catch limits of their underages or overages. I. Information submission for the adoption of trade measures In accordance with Recommendation by ICCAT Concerning Trade Measures [Rec. 06-13], Contracting Parties and non-Contracting Cooperating Parties, Entities or Fishing Entities shall submit pertinent information to the Secretariat identifying vessels, fattening farms, species, catch areas, product weight and points of export. I.1 Parties concerned All Contracting Parties and non-Contracting Cooperating Parties, Entities or Fishing Entities that import products of tuna and tuna-like species or that land these products at their ports. I.2 Deadline date The recommendation does not establish a specific date, but indicates submission in a timely manner. To allow the Secretariat to collect and transmit this information, with the aim of allowing Contracting Parties and non-

BASIC STATISTICAL AND BIOLOGICAL DATA INFORMATION REQUIRED In accordance with the first paragraph of Article IV of the Convention, the Commission is responsible for the collection and review of all statistical information on current status and trends of tuna and tuna-like fisheries in the Convention area to carry out assessment studies aimed at maintaining the populations of these species at levels that allow a maximum sustainable yield. In accordance with Recommendation by ICCAT on Compliance with Statistical Declaration Obligations [Rec. 05-09] and pursuant to Article IX of the Convention, all Parties, Entities or Fishing Entities with fisheries of tuna and tuna-like species in the Convention area are requested to submit all basic statistical information on their fleets, nominal effective catches, fishing effort, surveys estimating the size of specimens caught, as well as the tagging programs carried out. All forms described below must be filled out electronically and sent by email. The statistical correspondent must only fill out the sections that are not shaded. A distinction must be made to separate the information resulting from the catches of free schools and those caught under floating objects. J. Fleet characteristics

O.4 Instructions and guidelines Tag information constitutes an important basis for stock assessment and allows to carry out a follow up of migrations, growth and stock of species. Information on areas (quadrant, latitude and longitude), date (month, day and year), fishing gear and fish size is important and must be included.

SUBMITTING INFORMATION FOR INCLUSION IN ICCAT RECORDS OF VESSELS

ICCAT Recommendations currently require the following lists of vessels to be submitted:

1. List of vessels over 24 metres authorized to operate in the Convention area [Rec. 02-22] 2. List of carrier vessels authorized to receive transhipments from longline vessels in the Convention area [Rec. 05-06; 06-11] 3. List of vessels operating a directed fishery for northern albacore [Rec. 98-08] 4. List of vessels which fish for, provide or transport bluefin tuna for farming purposes [Rec. 05-04; 06-07] 5. List of vessels authorized to fish for eastern Atlantic and Mediterranean bluefin tuna [06-05]

Please note that separate lists should be submitted for each of these requirements. In order facilitate submission and reduce repetition, the Secretariat has developed the following forms1:

All forms retain a format which is almost identical, the exceptions being COMP-001-VESS-24, which allows for the submission of additional optional information on vessel characteristics to take account of the FAO Agreement to Promote Compliance with International Conservation and Management Measures by Fishing Vessels on the High Seas, and COMP-002-VESS-TSC, which replaces the gear type field with a field for carrying capacity of the vessel.

For those who wish to include vessels on the lists of carrier vessels, bluefin farming vessels, eastern bluefin tuna fishing vessels or albacore vessels which are already entered in one of the other ICCAT Records of vessels, it is not necessary to repeat all the information, but can be included on these lists by filling in the ICCAT List Number on the relevant form, and in the case of transhipment vessels adding the carrying capacity in the relevant field (column L in the excel file).

All fields must be completed for carrier vessels, bluefin tuna farming vessels, and bluefin tuna fishing vessels, as the forms contain only the information stipulated in the Recommendation.

The Recommendation by ICCAT concerning the limitation of fishing capacity on northern albacore [Rec. 98-08] does not specify the information to be submitted, and the number of fields to be completed is at the discretion of each Contracting Party and Cooperating non-Contracting Party, Entity or Fishing Entity in accordance with their domestic legislation and confidentiality criteria. It would be appreciated, nonetheless, if form COMP-003-VESS-ALB were used for submitting these lists, leaving blank fields as necessary.

INSTRUCTIONS FOR SUBMISSION OF LISTS OF VESSELS TO ICCAT

The new structure of the data base requires that all the information required by the relevant Recommendations be provided. Failure to complete all the necessary fields may result in your submission being rejected by the system and the Secretariat being unable to publish your registered vessels on the ICCAT web site in a timely manner.

The Secretariat has developed forms for the submission of the information, and the cooperation of all Contracting Parties and Cooperating non-Contracting Parties Entities or Fishing Entities is requested by completing the form electronically where possible.

Those Contracting Parties or non-Contracting Parties, Entities or Fishing Entities which have a large number of vessels in the Atlantic Ocean and which have difficulty in adapting their current data base structure to this form are requested to contact the Secretariat to develop a customised reporting format, which contains the same information but which may be adapted to the constraints of individual data bases or structures.

Please note that submission of vessel lists or modifications to such lists will only be accepted from authorised government agencies of Contracting Parties or non-Contracting Parties, Entities or Fishing Entities.

Submitting new vessels

An explanation of the information required is attached, together with the codes for the ISSFG and ISSFV fields.

1. Excel file: If using the Excel file, one row should be used for each vessel, and one cell for each heading. If there is insufficient space in a given cell, please widen the column as necessary. Do NOT add or delete columns on the form. Please fill in the columns in the order in which they appear in the format.

If the column / field is irrelevant for a particular vessel, e.g. there is no previous flag, please note n/a in that cell. If the column is relevant but no information is available, please note no info in that cell.

2. Manual: If a manual submission is being made, please complete one line for each vessel.

Submitting changes to vessels already included in the Records.

When submitting changes to the information in respect of a vessel which has already been entered in the ICCAT Record, please cite the ICCAT List Number. This number can be found on the ICCAT web site in the download file (note: all list numbers will begin with AT).

Changes may be submitted either by completing the form the appropriate form (see previous page) inrespect of those vessels which require modification and indicating the changes by shading, or by completing only those fields to be changed. If preferred, a copy of the Excel file downladed from the web page, with the changes clearly marked, may be submitted.

Those who prefer to re-submit the entire list of vessels including the changes for replacement in the ICCAT Record, must ensure that the ICCAT List numbers have been correctly cited.

BIANNUAL REPORT OF IMPORT DATA COLLECTED UNDER THE ICCAT STATISTICAL DOCUMENT PROGRAMMES

Instructions for Re-Export Biannual Report Form

HEADER SECTION Year = Indicate the year to which the data pertain. Period = First semester (1- January – 30 June) or Second semester (1 July – 31 December) of the year to which data pertain. Please note ICCAT conservation and management measures require reporting by semester. Reporting Flag = Flag of party, entity or fishing entity making the report. Normally, this should coincide with the final Import flag (see below) Species = The species for which imports are being reported. Please send a separate report for each species; BET (bigeye tuna); BFT (bluefin tuna) SWO (swordfish)

REPORTING SECTION Fishing flag = flag of the country, entity or fishing entity which caught the fish, except in the case of chartered vessels where the vessel is under the management of the chartering nation. In this case, the chartering nation’s flag should be entered. Final Import flag (Reporting flag) = Final import flag refers to the latest importer at the time the report is being made (even though it may be again re-exported later), and not to future destinations, for which reason Final import flag should normally be the same as reporting flag. However, Contracting Parties comprising more than one sovereign state (e.g. EC) or more than one territory (e.g. UKOT) may indicate their Contracting Party name as reporting flag, but import flags should be separated, as in the example below: E Example: Reporting Flag = EC; Import Flag = EC.ESP (Spain) Intermediate imports = as tuna may have been through several destinations before reaching the final import destination, columns have been provided for up to three importers before final. Additional columns may be added if necessary. 1st import flag = Re-export certificate reports are only submitted where there has been an intermediate import between first import and reporting country, entity and fishing entity. First import flag should be that which made the first import of the fish after the catch. (The re-export certificate received by the CPC should have a copy of the original statistical document attached, showing fishing flag and (first) import flag.) 2nd import flag = second import flag, where an intermediate country has received a re-export. (See example below) (In this case, the Re-export certificate should have a copy of the original statistical document and the first re-export certificate attached.) 3rd import flag = As for second import flag, except copies of the previous two re-export certificates should be attached on receipt by the reporting CPC.

Example: Country A imports fish from country B. Country B originally imported the fish from country C which in turn imported the fish from country D, who caught the fish.

Final importer (reporting flag) = A, 1st import flag= B, 2nd import flag = C; fishing flag = D Last Point of Export = Point from which the fish were exported when imported by the flag reporting. Where possible, it would be appreciated if standard international port codes (available on the ICCAT web site at http://www.iccat.int/Forms/BFT_Ports_EC.xls for EC Member States and http://www.iccat.int/Forms/BFT_Ports_Other.xls for other Contracting Parties could be used.
