The insurance company resisted the payment of the insurance oa the groniid asthat McCne was hnng,public policy forbad tbe enforcement of the contract. It is said the company will now appeal to.the supreme couit of the United Slates.
At the same term, tbe court rendered an opinion upholding the validity of the Virginia constitution of 1903. Tbe contention was made that by the failure of the members of the convention to take aa oath to snpport the constitution of the; United States and of tbe state, the instmment. framed by them was void.
