MAINTENANCE FOR WOMEN, CHILDREN & PARENTSUNDER SECTION 125 CR.P.C.

1. Who are entitled to claim maintenance and from whom under Section125 Cr.P.C?

Ans. The following are entitled to claim maintenance from a person under 125Cr.P.C:

From whom maintenance can beclaimed

a. Husbandb. Father c. Father d. Son

2. What is the limit of maintenance amount which can be awarded under this provision?

Ans. There is no limit to the amount which can be awarded as maintenanceunder 125 Cr.P.C.

3. Can interim maintenance be also awarded?

Ans. Yes, interim maintenance can also be awarded.

4. Which Courts are entitled to entertain and decide applications u/s125 Cr.P.C?

Ans. Proceeding may be taken against any person before a Judicial Magistrateof any district:-

a) where he is, or

b) where he or his wife resides, or

c) where he last resided with his wife, or as the case may be, withthe mother of the illegitimate child.

5. How the order of the Court is to be executed/implemented?

Ans. The Judicial Magistrate can send the defaulter to civil imprisonmentextending to one month for every months default.
