BACKGROUND

The World Bank aided Maharashtra Agriculture Competitive Project (MACP) through Agri

Business Promotion Facility (ABPF) organized an “Investors’ Meet” on October 18, 2012

with an objective to inform stakeholders from the private sector about opportunities in

agri-marketing in view of the amendments in the Maharashtra Agricultural Produce Market

(Dev. & Reg.) Act 1963 (MAPM Act, 1963) pertaining to private markets, contract farming

and direct marketing. The policy aspects, nature of programs designed to facilitate

agribusiness investment and market development in the state along with probable

investment opportunities were discussed in the meet.

The meet witnessed diverse group of participants including investors, private sector

players, academicians, bankers, commodity exchanges, collateral management agencies

(warehousing receipts), entrepreneurs, etc. The event facilitation team created enabling

environment for participants for insightful discussion and encouraged them to come

forward to invest in a win-win proposition. Dignitaries from various other Government

departments who also participated in the meet created great networking opportunity.

The meet was addressed by eminent speakers both from government and private sector

players (list of speakers in annex 3). Along with these presentations, license holders of

Private markets, direct markets shared their experience for cross learning.

The meet resulted in generating awareness amongst the private sector players/ investors

on the provisions in the Market Act and shared with them prospects of investing in the agri

business and agri marketing domain.

Welcome & Introduction:

Mr. R.S. Shingte, Nodal Officer, PIU (Agri Marketing), MACP

took the opportunity to welcome all the eminent guests, speakers

and delegates for the Meet.

The meet was formally launched

with the lighting of lamp. The

participants were then introduced to

the brief prologue on MACP

including its key objectives. It was

clearly stated that the role of private

players in the project is very crucial

and demanding. So, this meet is

just one step taken by the

Government towards generating

awareness about the initiative and

create enabling environment for the players and investors for win- win proposition.

Objectives of the Meet

Following are the key objectives that were clearly spelt out during the start of the Meet;

To create awareness and popularize the project through such multi stakeholders

meet

To seek more private party participation in the project

To explore probable and potential areas of investment and engagement

To collate suggestions and feedback from participants (private parties) so that

Government can act further on facilitating creation of enabling environment for

private investors

SESSIONS

First Session

Mr. Kishor Z. Toshniwal, Director of Marketing, Maharashtra

State, Pune was the first speaker of the meet. He shared salient

features of the amended Maharashtra Agricultural Produce Market

(Dev. & Reg.) Act 1963. His deliberation provided insights on the

following aspects as stated below;

Issuance of Model Act, where the States were asked to amend the Acts, reform markets, find alternative markets, etc. Maharashtra has been the first one to make market reforms and introduce alternative marketing channels for the benefit of both farmers and marketers.

Dr. Toshniwal shared the initiatives and after effects of Agricultural Marketing Reforms in the state of Maharashtra and shared his insights on Market Reforms, Private market participation and Terminal markets.

Among the many aspects, he informed the forum that because of the monopolistic structure of markets, there are apprehensions and resistance from the APMCs in accepting the market reform agenda but with the passage of time, he reflected, APMCs also realise importance of being competitive and are bound to take concrete steps to remain effective in the market place.

The broader topics on which the deliberations rolled out were o Direct marketing o Private markets o Farmer-Consumer Markets o Contract farming o Special Commodity Markets o Single License System

Quoting Government’s efforts in creating platforms for attracting private investment he requited forum to visit MSAMB’s official website to gather information on the details of the support required (captured in the RFP) for the proposed Terminal Market in Nagpur.

Mr. Milind Akre, Deputy Project Director, AIDIP in his deliberations

shared details about the Agribusiness Infrastructure Development

Investment Programme (AIDIP) that has been initiated in two states

(Maharashtra and Bihar) of India to establish Integrated Value Chains

(IVCs). The objectives of this project as stated by him are as follows

o Lack of private investment o Limited diversification in high value horticulture crops

To attract private sector investment for agricultural infrastructure development.

Farmer’s capacity building

Value addition for perishable crop.

Strengthening of existing facilities with physical and institutional development along with value chains

He further detailed out on the key components of the project, the hub & spoke model for

carrying out interventions, infrastructure and facilities that is proposed to be created under

the project.

It was discussed that in the state of Maharashtra, PPP models are prevalent in sectors like power, roads etc. whereas in Agri Business sector it is lacking.

The speaker informed that Model Guidelines for PPP (Public Private Partnership) are being developed by Government of Maharashtra which will boost investment in Agribusiness Sector of Maharashtra.

Second Session

Post tea break, the second session of the Investors Meet witnessed three speakers from the

private market domain. This session focussed on experience sharing by License holders of

Private Markets, Direct Markets & Contract Farming. Dr. R.M. Kharche moderated the

session.

Mr. C Dayakar, CEO, Saastha Warehousing Limited, was

the first one to share his experience on cold chain facility at

Panvel, Navi Mumbai. (for complete presentation please refer

Annexure – 2 (c). The key highlights of his experience sharing

and following discussion is captures below;

Mr. Dayakar shared that that due to lack of clarity on starting a Private Market venture, Saashta could not make use of the license which they had procured from Director of Marketing, Maharashtra State. They were specifically not clear on Government Rules and Regulations as well as Provisions for starting a private market.

It was discussed that the Clause in Government Act regarding setting up of the infrastructure and then applying for license could be a hindrance for investors in Private Markets.

During discussions it was also clarified that Government does not regulate the time of License for Private Market. It is considered as permanent license however, it can be cancelled in case of default.

The stakeholders of Private Markets are not clear about the user-charges / commissions to be paid for using facilities / services offered by Private Market Operators.

More proactive steps have to be taken to popularize and create awareness about DOM initiatives

Mr. Nishant Sinha, Branch Manager, ITC shared his experience on

Direct Marketing – a key to agribusiness supply chain success. In his

deliberation and presentation, he focussed on how ITC leveraged

direct marketing through e-Choupal and transformed the Agri

supply Chain (Detailed presentation in Annexure-2(d). ITC has been

operating Direct Marketing license for the past several years. It was

discussed in detail about the importance of investing in backward

linkages for successful integrated program.

Mr. Dayanand Yadav of ADM Agro (TINA OIL MILLS) shared

ADM’s experience as a direct marketing license holder in the state of

Maharashtra. During the presentation, he focused on various

extension services that ADM Agro has provided to its farmers since

2001 {presentation in Annexure - 2 (e)}. He elaborated that the

company set up village level Agricultural Service Centres, one each

for a cluster of about 30 villages for effective reach out. About 15

such centres known as ‘Krishi Vikas Kendras’ have been formed and are being managed by

local agricultural diploma holders/ graduates. Through continuous contact with farmers and

by working with them throughout the cropping cycle, right from soil testing, seed supply,

land preparation, following best management practices, harvesting, storage and

marketing, the company has established tremendous rapport credibility with farmers.

He mentioned that ADM Agro is procuring Soybean and Sunflower from Latur area under

the direct marketing license. He went on to share that due to availability of an assured

market at remunerative prices, significant land area came under Soybean cultivation in

Latur.

Discussion points

The participants raised certain queries about storage limits, contract farming and direct marketing licenses.

It was clarified that processors are exempted from the storage limit in warehouses. Similarly, the producer companies and farmer groups (if the material procured and stored is from the farmer members) are also exempted from the storage limit norm.

Third Session

The third session was an open session that had Dr. Kishor Z. Toshniwal, Director of

Marketing, MS, Pune, Shri. Subhash Dumbare, Project Director, MACP, Pune and Mr.

Milind Akre, Dy. Project Director, Agriculture Infrastructure Development, Investment

Programme (AIDIP) as its eminent panellists. The purpose of this interactive session was to

generate Feedback / Action points / Inputs for Government.

Following are the key highlights of this session

In case of private market license, it was proposed that there is a need to amend the norm of setting up infrastructure prior to applying for license. The house proposed that the investors must be given a “Letter of Intent / Consent” to start building infrastructure for private market development. Upon creation of minimum required infrastructure, license may be issued by the concerned authority.

It was also discussed that there is an opportunity for Producer Companies or Farmer Associations to act as Direct Marketing license. This will give them the flexibility to build, operate and manage their own storage space and also operate Pledge Loan scheme.

There is not a clear understanding about the user charges levied by Private Markets. Hence, there is a need to develop guidelines for charges to be levied by Private Market operators to use the services / facilities being offered.

Regarding the contract farming norms, it was discussed that as on today, the SPONSOR of contract farming is not required to submit any Bank Guarantee or Solvency certificate at the time of registration with the DDRC or DSAO. However, any change, to that effect will be communicated.

During interactions with Industry it was realized that there is lack of understanding about execution and implication of rules, regulations and norms pertaining to Markets particularly for private investors.

It was proposed that a workshop may be organized for DDRC and DSAO to disseminate knowledge and create awareness about the amended norms under the Market Reforms agenda.

It was also discussed that Private Market operators have to pay APMC cess even though they do not use any infrastructure of APMC. The rationale for the same was not clear. The DoM said that the issue has been taken and he would place it before right authorities and communicate further developments.

It is also proposed that a critical analysis of Open Session discussions, separate case studies of Direct Marketing, Private Markets and Contract Farming may be developed and learning may be published for the benefit of stakeholders.

It is also realized that the Directorate of Marketing (DoM) is expected to play more facilitative role in order to promote alternative marketing channels, by way of publishing simplified version / interpretation of amendments in Market Acts n Rules.

It was clarified that producer groups need no license for primary processing activities and also for selling the produce in the retail market. However, it was stated that license and payment of fees at stipulated rates will be required on selling the produce through wholesale market.

It was clarified that individual loanee/ non- loanee farmers are eligible for coverage under crop insurance scheme, the contract farming agency has agreements with farmers, hence no separate coverage/ facility is available to the agency. The issue relates to insurance companies and further clarification may be obtained from them.

It was clarified that govt. has no role in execution of the agreements and the terms of agreements of contract between the parties and the bankers have to follow course of action usually as per banking law and practice

It was clarified that as at present only the range of rates of commission has been stipulated without prescribing minimum & maximum limits, however, proposal is under consideration of the govt. to prescribe an upper limit of rate of commission.

It was clarified that marketing board has no role to play as the issue can be dealt with the respective societies by keeping view the provisions of their bye-laws and decisions of their board of directors/ committees
