For the second year in a row, a Bush administration plan to impose a user tax on broadcasters has died in Congress. The $125 -550 annual fee was shot down on Sept. 25 during house and senate committee meetings to reconcile their FCC budget bills.
The National Assn. of Broadcasters has set up a toll -free hotline to answer station questions about political advertising rules. If you're confused, call 800 -331 -6807. Also, NAB has filed comments on the FCC's proposed streamlining of its license renewal application form 303 -S asking the commission NOT to ask for less information on station translators.
Although it has operated as one for years, WNYC, New York is now officially a non -commercial station this week.
The Commission has granted the applications of Radio Ohio, Inc., the licensee of WBNS AM & FM, for renewal of their licenses. Although the renewals had been opposed by the Ohio NAACP and the NBMC, the Commission found no evidence that the licensee's implementation of its EEO program warranted sanctions.
In the NAL department this week, the Commission handed out fine notices in record nun;bers this week. KRCY, Kir,gman AZ was hit for $12,500, and WTMJ, Wausau WI for $6,250, for violating anti -lottery provisions. KKFI, Kansas City MO owes $2,500 for failing to make the station's public inspection file available during regular business hours. WTPA Harrisburg PA owes $6,250 for violation of the contest rules.
Sending a warning to stations running taped newscast overnight, an unusual violation cost WMBO, Auburn NY $5,000. The fine is for allegedly taping newscasts and making them appear to be live and by operating at times without a licensed operator on duty.
Two Colorado stations had their fines reduced this week after the Commission reviewed each case. KNNG, Sterling Colo. had its fine dropped from $4,500 to $2,800. KCCY, Pueblo Colo. dropped from $4,750 to $4,000.
ELSEWHERE
As the brave new world of the FCC ownership rule changes continues, Cox and EZ Communications have announced a station swap that would give Cox's WSOC, Charlotte, N.C., to EZ Communications (owner of WMXC there) in exchange for WHQT, Miami where Cox owns WIOD /WFLC. Cox's press release says they'll keep WHQT urban /AC, although one should note that Cox has no experience in urban and WHQT is currently the #2 urban in its market, something few broadcasters want to be. In other LMA /duopoly news, NewCity's WZZK- AM -FM, Birmingham, Ala., is taking over long -troubled country rival WIKX via an LMA. And in an old- fashioned sale that doesn't involve duopoly, Infinity's WYSP, Philadelphia nabs new AM partner WIP for approximately $13- million.
As it was in July, combined national and local revenue was flat during the month of August, according to new figures from the Radio Advertising Bureau. Local revenue was up 3% since January and flat from August, 1991. National revenue was off 9% on either comparison. Network revenue, meanwhile, continued to drop precipitously, going down 18% against last August and 13% since the beginning of the year.
Also, the RAB, having brought you the Certified Radio Marketing Consultant training program is now unveiling a two day seminar for those who hold or aspire to sales management positions. The first Certified Radio Sales Manager seminar will be held in Denver on November 14 -16. Registration is $600, not including the cost of taking your managers to see "Glengarry Glen Ross" for the fourth time afterwards. Call 212 -254 -4800.

Arbitron has announced that there will be a Miami /Ft. Lauderdale book this summer, despite the aftermath of Hurricane Andrew. Arbitron claims that it was running ahead on sample before Andrew and was thus only 8% off its planned in -tab.

The long- debated standard for Radio Broadcast Data System (RBDS) was finally agreed upon today with the passage of a standard that will allow radio manufacturers to begin production. According to the NAB's John Marino, Manager of Technical Regulatory Affairs, the approval of version 2.0 of the standard is subject to some minor editorial changes that will be reviewed at a November 10 subcommittee meeting.
REDS is a data transmission system utilizing the 57 kHz subcarrier of FM radio Stations to transmit real time data to the radio. It can be used to transmit call letters, format, slogan, or text. It also has potential uses for EBS. No word yet on whether or not it will figure in to the revised EBS plan. It's already in use in Europe and, with the adoption of the standard, many manufacturers are poised to introduce radios equipped with the technology in the U.S. While REDS does not operate on AM, included in the standard is a gateway, designed by California -based ID Logic, for updating an internal database that would allow the radio to store and use basic information for all AM stations, as well as non -participating FM's.
In a renewal of its spring push for Canadian -style protectionism, the National Assn. of Broadcasters has sent a letter to FCC chairman Al Sikes complaining about the commission's FM allocation policy and contending that said policy "creates the same kind of over -saturation conditions that the new ownership rules were designed to help alleviate." The letter cites four new FM allotments in the already struggling Eastern Long Island market. FCC suggests that new FM allotments be used to improve "service from existing stations" and to "advance minority ownership."
The Commission revoked the license of WOKJ, Jackson, MS, but reduced the amount of forfeiture to $8,000 for failing to illuminate the station's towers. The Commission took such drastic measures because of the station's close proximity to the local airport.
WMUS /WMUS -FM, Muskegon, MI was slapped with a $5,000 fine, reporting conditions, and a less- than -full -term renewal of license for violation of the FCC's EEO rules. WLCS, North Muskegon, MI got through its license renewal, but not without a $2,000 fine and reporting conditions for EEC violations. WSFN /WSNX -FM Muskegon, MI were not fined, but are also subject to reporting conditions.
The Commission has notified Surrey Front Range Ltd., licensee of KDZA, Pueblo, CO, of its apparent liability of $6,000 for missing items in its public inspection file. WOKI -FM in Oak Ridge, TN owes $6,250 for willful and repeated violations of the Commission's anti -lottery provisions.
What translates into little more than a transfer of license with a lot of noise, the Commission has granted the application of Jupiter Broadcasting Corporation for the existing facilities of WTRU, Jupiter FL. The Commission has notified Robert B. Taylor, the previous licensee of the station that he could possibly be found liable for forfeiture for misrepresentations and lack of candor in declarations to the Commission, and granted a motion to dismiss his application to renew the license. The Commission has enlarged issues against Taylor to determine whether he abused the application process by engaging in "anti- competitive conduct" and whether he is fit to remain the licensee of WTRU's sister station, WEXI Jupiter.

It won't come as a pig surprise to most people, but cost per point in most major- _ and medium -markets has stayed stagnant or dropped slightly since 1986 according to
a study by Katz Radio Research, CPPs for men 25 -54 are down in the top 20 market; comparable female CPPs are up slightly. Markets where the CPP have been most ravaged are Boston (down 23% for 25+ men since 1986) and Pittsburgh (down 35% for that demo.)
The Radio Advertising Bureau has announced CBS "Osgood Files" host Charles Osgood as host of the 1993 Managing Sales Conference. Next year's confab, to be titled, "Managing Out Of The Box," will be held Feb. 4 -7 at Dallas' Lowes Anatole.
In other convention news, KPSA- AM -FM, Alamagordo, N.M., owner /GM Bob Flotte has been named chairman of the NAB's small /medium market radio roundtable to be held in Tucson on Nov. 4 -7. Seemingly ubiquitous FCC Mass Media Bureau chief Roy Stewart will be there. So will NAB VP /general counsel Jeff Baumann. Also, to keep up with the few little regulatory changes that have taken place this year, the NAB has published the 1992 supplement to its legal guide. Cost is $65 for members; $130 for others. Promising "to change religious television forever," in the words of a spokesman, Bud Paxson --who has already done a pretty good job cf leaving his mark on the
state of Florida --has launched a cable TV channel called WORSHIP, which it
describes as a 24 -hour nonstop church service complete with customized Christian music videos, bible study lessons that flash on the screen during the videos, and a 900 -number for counseling (as well as an 800- number for members. WORSHIP, Paxson says, will be non -profit and its "on -air worship leaders are trained ministers of the Gospel ... not television personalities functioning as ministers. ")

Shadow Broadcast Services (Shadow Traffic) moves into the Bay Area this week,
adding San Francisco's KCBS, KIQI, KKIQ, KKIS- AM -FM, and KJAZ, San Jose's KLOK and KUFX, and two area TV stations.

This is the beginning of M Street's annual compilation of radio station format statistics. This is the first of three charts featured over each of the next three weeks providing insight into the status of station's formats.
The big news is that the addition of 121 N/T outlets this year pushed that format to the number three position while 125 AC stations that went away. N/T profited from the proliferation of available programming this year as well as the rise of the all- sports format. It also got more than a little help from the near total death of the full- service AC AM station (which, one figures, also accounts for at least some of AC's population loss --that which isn't explained by a lack of stars or available new music.)

WASHINGTON THIS WEEK
The FCC on Oct. 8 proposed allocating spectrum space between 2310 -2360 MHz for satellite DAB services. Besides this move, which the FCC calls "consistent with the recent results of WARC -92," the commission also requested comments on "technical developments and general policy issues as they relate to both satellite and terrestrial DAB" as well as for comments on proposals for in -band AM /FM DAB. Not surprisingly, given its past actions, the NAB has accused the FCC of "rushing to judgement" and says "the prospect that satellite development might be placed ahead of terrestrial DAB is troubling." NAB does say that it appreciates the prospect of in -band DAB at least being on the table here. The NAB has, as part of its request for a review of the FM allocation policy, asked the FCC to okay a "one -step process" for FM upgrades.
Charles gets Charged ?...When Tommy Charles and John Ed Willoughby, the morning team at WERC Birmingham, put a candidate for the Alabama House on the air last year, they found out time --among other things --is of the essence. The station was fined $14,000 for after allegedly not affording equal opportunities to a competing candidate, Jack Pratt. Pratt alleges his competitor for the House seat, Tony Petelos, attacked him on the air the day before the election. Pratt phoned the station after a relative heard the broadcast, and was put on the air to respond. The complaint stems from Pratt's allegations that he was cut off after 1 1/2 minutes, while Petelos spoke for five; and that Pratt was only permitted to respond to the questions asked, while Petelos spoke about a number of topics. The Commission agreed, stating that the station was actually censoring the candidate when the station cut off his responses. The bulk of the fine was for "discriminatic:: between candidates," while $1,500 of it was for not putting any of this in the station's political file.
In other fines, WFMC Goldsboro, NC, got hit for $5,000 for airing taped conversations without first informing the parties.
ELSEWHERE
From the "Where Will The Children Play" department: Both Inside Radio and the New York Post's Jill Brooke report that ABC and its Satellite Music Network are discussing the possibility of a childrens' network co- venture with the Disney people. ABC has already made forays into kids' radio, specifically its Barbara Bush story program. It's also had dealings with Disney before, running its "American Top 40" live from Orlando on occasion. The A -B -C, S -M -N, M- O -U -S -E rumors come at a time when the WWTC, Minneapolis people are on the verge of finally getting their Childrens' Satellite Network up and running.
On the LMA front, KQIZ -FM Amarillo, TX has entered into a sales LMA with KSLF and KAEZ Amarillo.
On the Brave New World front for this week: Clear Channel has announced that it will acquire Group W's KQXT, San Antonio, to pair with its existing WOAI /KAJA combo. Also, Stoner will pair WONE /WTUE, Dayton, Ohio with its WWSN there. And Inside Radio reports a likely Noble /Viacom swap that would give Noble KNOW- AM -FM, Denver to add to its KBCO -AM -FM and send KNDD to Viacom to put with KBSG- AM -FM.
The Carlyle Group, the primary backer of Jerry Lyman's Radio Ventures group, has announced its divorce from Lyman. Carlyle will keep its WXTR, Washington, WMXB, Richmond, and WAFX, Norfolk.
The Radio Advertising Bureau has announced its panelists for the first Certified Radio Sales Manager course to take place Nov. 14 -16 in Denver. Besides RAB's Gary Fries and George Hyde, the panelists include CBS -FM's Rod Calarco, Shamrock's Bill Clark, NewCity's Dick Ferguson, and the Research Group's Bill Moyes. This is the second chart in the series of M Street's annual compilation of radio station format statistics.
Any doubts you had about 1992 being the year of country radio will dissolve quickly when you look at this year's M Street format tally. Country radio, which grew by 4 -5 stations a year in the past, was up 95 stations this year, opening up a 600 station lead on the No. 2 AC format. CHR, not coincidentally, was off by 97 stations. That's a smaller drop than in the two years previous, but that's sorta cold comfort if you want to hear a mainstream CHR in, say, Baltimore, Washington, Dallas, Memphis, Santa Rosa, Cleveland, or any of the other markets that lost their only CHR this year. Last year, CHR suffered the indignity of falling behind oldies. This year it's behind AOR (counted with classic rock) and N/T too.
The other seemingly coincidental number is the addition of 121 N/T outlets this year and the 125 AC stations that went away. N/T profited from the proliferation of available programming this year as well as the rise of the all- sports format. It also got more than a little help from the near total death of the full -service AC AM station (which, one figures, also accounts for at least some of AC's population loss --that which isn't explained by a lack of stars or available new music.)

WASHINGTON THIS WEEK
R &R reports that the FCC --which has already voted to uphold $6,000 in fines against Infinity Broadcasting stations that carry Howard Stern, specifically WXRK, New York, WYSP, Philadelphia, and WJFK -FM, Washington, D.C., is mulling a $10,000 fine against Stern's L.A. affiliate, Greater Media's KLSX. Among the offending lines this time, Stern's threat to "strip and rape" rival KLOS morning hosts Mark & Brian. R &R also reports that Jesse Helms and Donald Wildman are opposing Infinity's acquisition of three Cook Inlet stations because it would lead to the further "outrageous sleaze" by Stern. Meanwhile, Stern announced his return to TV this week. He'll host a celebrity talk program for E! Entertainment Television beginning Nov. 27.
Following a petition for relief from the National Association of Broadcasters, the FCC has eased up its main studio personnel requirements. The FCC had required stations, such as those on the receiving half of an LMA, for instance, to have one management -level and one staff -level employee at the station during business hours. Now the management person can be almost any titled employee, ranging from the GM or president to a controller or chief accountant, as long as that person reports to the station on a daily basis and spends a "substantial amount of time" there. And the staff -level person only has to be there if the station would be otherwise unattended.
In other post -duopoly -world news, Greater Media has announced Boston's third duopoly. It plans to buy Emmis' long -troubled new age outlet WCDJ. And KGGO- AM -FM, Des Moines, Iowa owner Stoner Broadcasting has announced the purchase of religious outlet KDMI, which it says will stay religious.
And there's more. Arbitron has announced that it will give FCC attorneys the right to use the ratings' service's info for $125 per filing. Arbitron is also offering other info packages for $500- 10,000. Arbitron also recently announced that it would clamp down on its slogan ascription rules by requiring a slogan to be used at least four times an hour or, when there are fewer IDs, at least during 50% of those IDs. Slogan ID submissions must now reflect exact on -air usage. (i.e., "the new Mix 103.5" vs. "Mix 103.5. ")
Also, the NAB's technical newsletter of Oct. 19 features a sample map for those stations unsure of how to display the contours of a potential duopoly, and of the other stations within the service area that justify the duopoly. A station should depict the 3.16 mV /m contours for itself and its new partners, particularly the overlap, both contours should be highlighted. Then, the commercial stations whose city -grade contours intersect those of either station, should be numbered and depicted on the map, with the number used keyed to the location of the station's transmitter site. Make sure the stations in question are actually on the air.

Westwood One should be testing the waters for a daytime Larry King show by the time you read this and may, in any event, already be ready to go with a daytime King show beginning Jan. 4. Several days after reporting that King will do a week of election "specials" beginning 10/26, Inside Radio then reported that one affiliate had been told outright that King would move to 10 am -1 pm Eastern time next year. Jim Bohannon, who is hosting late night again during King's absence, would presumably be his successor. This, of course, creates trouble for the stations that can't pre -empt middays -- especially those with Rush Limbaugh.
"It's the first time I've been on a sales call in 15 years" was one of the quotes overheard at the Radio Advertising Bureau's semi -annual board of directors meeting in Universal City, Calif. this past week. The board split up into small teams on Monday and went knocking on major advertisers doors to extol the virtues of radio. Even though the client's advertising agency sat in on most of the calls, reports came back positive. Some of those companies visited are Hyundai, Disney, Honda, Hilton, and Mattel.
Also during the three days of meetings, Arbitron President Rick Aurichio took the same old questions and gave the same old answers during the open forum session on Saturday morning. Aurichio did reveal that radio contribute $94 million of Arbitron's $194 million in revenue last year. After several boisterous objections regarding rate differential in the same market, Arbitron's Jay Guyther said that one of the goals is to develop a rate card for their services. Arbitron and the RAB agreed it is time to set up a task force to review the relationship between the two organizations.
Sorry to report the death of WMAL, Washington, D.C., morning man Jackson Weaver of complications from diabetes on Oct. 20. Weaver was, for 32 years, half of WMAL morning legends Harden & Weaver. That team was one of the few pieces of WMAL's 1950s to early '80s ratings dynasty left relatively extant when WMAL made its switch from full- service AC to news /talk several years ago.
Broadcast Programming's music director Keith Chambers is named marketing manager and PD of BP's oldies format... Bud Stiker, most recently a consultant to the Bonneville Broadcasting System, is named Exec. VP for BBS.

Taco Bell president /CEO John Martin has been named the "client keynote speaker" for the Radio Advertising Bureau's 1993 managing sales conference to be held in Dallas on Feb. 4 -7. Martin will talk about Taco Bell's move to value menu pricing and radio's recession -era response, the "59 -cent value ratecard."
After reversing its long -time policy for several years, classical WFMT, Chicago will reinstate its ban on recorded commercials effective Jan. 1, according to the Chicago Sun -Times.

The Federal Communications Commission finally made good this week on rumors that it was rolling out the big artillery against semi -national morning man Howard Stern. R &R reported last week that the FCC was planning a $100,000 fine against KLSX Los Angeles for alleged indecency. The notice of apparent liability sent to KLSX actually duns the station $105,000. The FCC has also told Stern's home outlet, Infinity, that a Geraldo Rivera episode called "Unlocking The Great Mysteries Of Sex," which Infinity brought up in its defense, was "not intended to pander or titillate and was not otherwise vulgar or lewd."
It will be a moot point in the next few days, but the FCC has decided to let its current rules on political spots stand through the election, meaning that broadcasters worried about bizarre candidate requests must accomodate them only "as much as reasonably possible." The National Assn. of Broadcasters had asked for declaratory rulings protecting stations from having to sell candidates non- standard- length spots, but the FCC has declined to do so, instead deciding to keep the issue open until next January.

The Radio Advertising Bureau is predicting that 1992 will end with radio revenues up 2% or more following the release of September figures showing - ,mbined national and local sales up 8% over September '91. Local revenue was up 10 %; the long - troubled national spot area was up 2 %. Network revenue is st.1 off, falling 4 %. The bes_ regions for local were the southeast (an 18% rise) and the southwest (12 %). the southwest was the only area down in national sales, losing 10 %. The best national gains were in the southeast and midwest, both up 4 %. If you look at the year to date, radio revenue in general is now up 4% also.
Among this week's new duopoly /LMA action: KSFI Salt Lake City has LMA'ed crosstown IKDS with an option to buy. KKDS was the AM outlet of KRSP -FM (and was, at one time, AM rocker KRSP). KKDS, one of the few stations to tough it out with a childrens' format for the past few years, has been announced as one of the new additions for the Childrens' Satellite Network although that change hadn't actually taken place at press -time. Also, KSEV Tomball (Houston) is buying rival KPRC. (On the heels of this announcement comes another one that the CBS affiliation in Houston is moving from KPRC to KTRH).
Arbitron has reissued the summer book for Columbia, S.C., after listing full -time outlet WOIC as a daytimer.
A Florida judge has thrown out the evidence that authorities were planning to use against veteran radio /programmer Bill Tanner, thus effectively throwing out the morals charges against Tanner unless the state appeals. Tanner was arrested last year on drug charges which, combined with the arrest of another WPOW Miami personality, somehow blew up into accusations of a pederasty ring operating through South Florida radio stations.
Infinity has inked another good friend of the FCC, WWDC -FM Washington's morning host The Greaseman, when that jock's WWDC contract expires next year. Greaseman will be heard on Infinity's D.C., Philly, and New York stations from Los Angeles. Infinity hasn't found him an L.A. outlet yet and they also haven't decided where they'll put the Greaseman on D.C.'s WJFK -FM. One hint, however, is that WJFK midday host G. Gordon Liddy is also testing the waters for syndication.
