WASHINGTON THIS WEEK CBS Inc. was granted a temporary 18 -month waiver of the FCC's 12 -12 -12 ownership rule and a waiver of the one -to -a- market rule, so the network can acquire WLTE(FM) in Minneapolis. CBS already owns stations WCCO -TV and WCCO(AM) in the same market, and twelve other FM stations in the U.S. By adding WLTE, CBS will exceed the rule's ownership limits. The temporary waiver will give CBS time to sell KLOU in St. Louis, MO in order to meet FCC requirements. The FCC said that CBS met the Top 25 Markets /30 Voices standard for the one -to -a- market waiver because it has established more than 30 separate "voices" in the Minneapolis -St. Paul market, which is rated as Arbitron's 14th ranked television market in the U.S.

The NAB has criticized the FCC's proposed ruling on broadcast hoaxes, saying such a rule could encroach broadcasters' First Amendment rights and cause a "chilling" effect on broadcast speech and "reduce program diversity." The NAB is concerned that the FCC's definition of hoaxes as the "broadcast of material which the licensee knows to be false," might unfairly include broadcast of dramatic programs, which are fictional and might according to the NAB, "intentionally subject large numbers of viewers to distress," while not causing serious harm. The NAB said the FCC should reconsider adopting a hoax rule, but that if such a

rule is adopted its definition should be narrow enough to "limit the intrusiveness of regulation by requiring real and significant physical harm to persons or to property in order for the rule to be violated."

The FCC amended the FM Table by substituting 99.7 C2 for 100.1 A in Shreveport, LA, and accordingly modifying the license of KMJJ -FM. James Reeder, former licensee of KMJJ -FM (now licensed to SunGroup Broadcasting of Louisiana, Inc.), had initially submitted a counterproposal for the upgrade, proposing alternate allotments for conflicting proposed allotments in Homer, LA, and San Augustine, TX. The FCC returned Reeder's counterproposal because it did not meet any of five requirements established under the FCC's Docket 84 -231 "omnibus" rulemaking which

WASHINGTON THIS WEEK(Cont'd) set forth 689 proposed FM allotments. The FCC also said it would not substitute omnibus allotments unless there was a compelling need or Commission error. Reeder appealed the ruling to the Commission and the U.S. Court of Appeals. The court found that the Commission had adopted its omnibus policy without the requisite notice and opportunity fcr public comment as required by the Administrative Procedure Act. Based on the court's decision, the FCC issued a further notice of proposed rulemaking to consider Reeder's proposals, which resulted in the grant of the upgrade, making the required channel substitutions in order to accommodate the upgrade, and making related amendments to the FM Table.

Appledore Communications, Inc.'s petition for reconsideration for a new FM station at 96.5 MHz in Bedford, NH, was dismissed by the FCC as procedurally defective. Appledore requested that the Commission reconsider its grant of the station to Donna A. MacNeil. MacNeil was given the grant because of her superior integration, as well as her status as a female owner. Appledore had challenged the constitutionality of the female preference credit by citing a Supreme Court decision in Metro Broadcasting, Inc. v. FCC. The FCC found that Appledore did not adequately explain the earlier decision's relevance to the proceeding and that his complaint did not satisfy FCC criteria that reconsideration petitions must present new facts or changed circumstances previously unknown to the petitioner.

FCC Chairman Alfred Sikes will be Lhe keynote speaker at the Broadcasters' Law & Regulation luncheon, April 14, at NAB '92 in Las Vegas. Sikes is expected to discuss recent FCC actions and proposed FCC reforms.

CANADA THIS WEER The CRTC has issued a notice calling for interested existing FM licensees who want to apply for a move to former CKO frequency 99.1 MHz in Toronto, which is the only available class Cl frequency in the city. The CRTC noted that it has not yet decided on the frequency's most appropriate use. In addition to a decision on appropriate use, the CRTC is considering such applicant criteria as financial capability and financial impact of the proposed change. Interested applicants must file a letter of intent no later than January 13, followed by a formal application to the CRTC no later than February 14. Technical documentation must also be submitted by February 14.

ELSSWH=RZ After a review of its October 2, 1991 "radiothon" and in response to complaints from competitor WHTZ -FM in New Jersey, WPLJ in New York City was placed below the line for ratings bias in Arbitron's 1991 Fall book. During its radiothon, WPLJ personalities discussed the station's performance in earlier Arbitron books and asked listeners to pledge quarter hours of listening via phone or fax to the station. WHTZ -FM had complained that the radiothon constituted both rating bias and distortion. Arbitron agreed with the charge of rating bias, which is defined in its rules as "announcements or statements which encourage participation in current or future surveys or in any way alert, sensitize or remind listeners of current or future surveys." However, the ratings service said the WPLJ's actions did not constitute ratings distortion since listeners were never asked to record or report "listening other than their actual listening." By putting WPLJ below the line, Arbitron wanted to discourage other stations from airing similar "radiothons." In its defense, WPLJ said Arbitron's ratings policy does not give stations adequate notice that such a "radiothon" would be in violation of its rules. In response, Arbitron said it will review the clarity of its present rating bias policy and determine if amendments should be made.

Arbitron has upgraded the Santa Rosa, CA, market from a Condensed Radio Market Report to a Standard Radio Market Report. The upgrade will give Santa Rosa market stations more detailed audience information based on a larger population sample, which is a result of the population increase in the Santa Rosa market. The upgrade is effective with Arbitron's Fall book, and will also move Santa Rosa in Arbitron's national Metro Survey Area ranking from 114 to 107.

In the wake of Birch's demise, Seattle -based ratings service Willhight Research, Inc. has announced plans to compete with Arbitron by expanding its services to include all of the U.S. and Canada, adding to its current western U.S. base. Willhight employs a 24 -hour telephone recall method using a minimum 1000 in -tab sample size for each market, and asks respondents for the following station identifiers: call letters, band, dial position, city, format, slogans, special programs, and air talent. ELSEWHERE(Cont'd) Wilihight is also vying for competition on the ratings violation front, as it has cited KBOZ -FM, in Bozeman, MT for ratings bias during Willhight's Fall 1991 sweep. According to Willhight, KBOZ -FM ran a newspaper ad saying: "Public Notice: If someone calls you and asks what radio station you listen to, tell them the 'Phrase That Pays,' 'I listen to 93.7 KBOZ -FM.' You could win $93.70 in Cash!!!" As a result, Wilihight has flagged KBOZ -FM with an asterisk in its reports and is listing the station last on each data page, after listings of noncommercial stations.

The Unistar Radio Network is revamping its news programming and cutting personnel. Effective February 1, the network will combine its Unistar 1 and 2 newscasts into one hourly broadcast, dropping its contemporary news network. The separate newscasts, aimed at specific older and younger demographics and broadcast on similarly targeted stations, originated with the old RKO radio network, which was purchased by Unistar. The merging of the programs is part of a current trend of national networks aimed at gross audience numbers, rather than specific demographics.

Although he didn't make it into the Baseball Hall of Fame in this week's election, baseball expatriate Pete Rose will begin a new career this year when he broadcasts his own syndicated two -hour talk show over the Florida Network. The program will start airing in March when the grapefruit league opens azd will continue through the regular baseball season.

Chuck Harder's For the People talk show is offering up to six hours of free interview time for all presidential candidates. The air time will be offered in three separate two -hour time blocks, to be carried on Harder's weekday afternoon program. The first candidate to take advantage of the offer was Republican Pat Buchanan, who was interviewed January 3. Other candidates scheduled to participate in the next few weeks are Democrat Jerry Brown and Libertarian Andre Moreau. Harder said invitations were sent to "all presidential candidates for whom we can get addresses." Any other interested candidates can contact Harder at (904) 397 -4145.

Veteran rock 'n roll jock "Cousin Brucie" Morrow will join the Independent Broadcasters Network, starting Friday, February 21, with a two -way talk program from 1 to 3 p.m. (ET). Morrow's program will feature guests from the music, arts, and entertainment industries.

The Sun Radio Network has added a new call -in program called U.S.A. Outdoors, airing Sundays from 5 - 7 a.m. (ET) with host Dr. Kris W. Thoemke. The program will focus on all aspects of the outdoors and the environment. Thoemke, who is known as Dr. Kris, has been the host of Florida Outdoors, a similar program carried on WNOG, Naples, FL, since 1988.

WASHINGTON THIS WEEK The FCC upheld its dismissal of the application of New Life Enterprises, Inc. for a new FM station at 99.3 MHz in Fresno, CA. Because New Life had filed an earlier application for a station at 104.1 MHz in Woodlake, CA, the FCC found the two applications to have overlapping contours, and the Fresno application was dismissed for violating the duopoly and inconsistent application rules. New Life applied for reconsideration of the decision, giving the following arguments: 1)

the apparent overlap of the contours was de minimus; 2) the application was in substantial compliance with the duopoly rule; 3) given side -mounting and proposed characteristics of the Woodlake antenna, no actual overlap existed; and 4) the FCC staff was arbitrary and committed an abuse of discretion when it allegedly applied a new policy regarding inconsistent applications retroactively, because New Life had withdrawn its Woodlake application prior to the dismissal of the Fresno application. The Commission rejected all of New Life's arguments as follows: 1)

If the contour overlap was found to be de minimus, the applicant must still request and obtain a waiver of the duopoly rule, which New Life made no effort to do; 2) There is no history, nor are there subsequent case interpretations of the duopoly rule that suggest that a "substantial compliance" standard is appropriate. Once ownership and overlap are established the duopoly rule is in effect. Thus,

WASHINGTON THIS WEER(Cont'd) if applicants submit proposals violating the duopoly and inconsistent application rules, they are not "similarly situated" to applicants who propose substantial compliance with city coverage rules; 3) New Life did not specify directional characteristics of its proposed antenna on its application, and may not now claim the benefit in its reconsideration petition.

The Commission upheld its staff action dismissing Premier Broadcasting, Inc.'s application for a new FM station at 92.9 MHz in Montecito, CA. The application had been dismissed because Premier's 50 percent shareholder Frederica Yamin, was also a shareholder in the application of South Coast Radio, Inc. for a new FM station in Ellwood, CA, with an overlap in violation of FCC multiple ownership rules. Although the South Coast application had been returned, it was reinstated nunc pro tunc, resulting in the dismissal of Premier's application as inconsistent. In its application for reconsideration of the dismissal, Premier argued that: its application was not under common control with that of South Coast, thus not violating multiple ownership rules; South Coast's application was not pending when Premier filed its application; the instant situation was distinguishable from, and therefore not controlled by the authority cited by the FCC; South Coast's application, which was ultimately dismissed, should not have been reinstated and therefore, no violation of the rules occurred; Mrs. Yamin should have been allowed to choose which application to prosecute, in accordance with FCC precedent. The FCC rejected Premier's arguments, saying that under FCC attribution rules and "hard look" criteria, South Coast and Premier are considered to be the same applicant. Thus, the filing of the Montecito application violated rules forbidding the subsequent filing of inconsistent applications on behalf of the same applicant.

In other actions, the FCC dismissed as repetitious Poughkeepsie Broadcasting Limited's petition for reconsideration of the denial of its application for a new station at 96.1 MHz in Poughkeepsie, NY, because the applicant did not offer any new facts or circumstances in its petition; affirmed the Review Board's decision granting the application of Kennelwood Broadcasting Company, Inc. for a new station at 94.5 MHz. Competing applicants Excelsior Communications, Inc. and Chase Communications, Inc. sought review of the decision, questioning the Board's analysis of their integration proposals. The FCC upheld the board's decision that Kennelwood's application was superior to the others, because Kennelwood had a

longer continuous residence and was awarded credit for its 50 percent female ownership.

The FCC has released its study entitled, "Induced Body Currents and Hot AM Tower Climbing: Assessing Human Exposure in Relation to the ANSI Radiofrequency Protection Guide." The study investigated the effect of radiofrequency fields on individuals who perform maintenance tasks on AM broadcast towers. The FCC will use the data to help broadcasters determine the level of transmitting power that would allow such tasks to be performed, while preventing exposure of tower climbers in excess of the recommended RF protection guidelines. ELSEWHERE The talk -formatted American Radio Networks (ARN) surprised its over 200 affiliates, one of its 50 percent partners, and other interested parties today, when part owner Ed Graham announced the network's impending merge with the Independent Broadcasters Network (IBN), via a fax featuring the combined networks' new program clock. The fax was sent this morning announcing that "Beginning at 10 am today (ET) ARN will begin a cooperative broadcasting agreement as part of a

pending merger with IBN." Without notification to partner Don Emanuel, Graham sold his 50 percent of ARN to IBN and then merged the networks' programming. Graham has named the new network the American Independent Radio Network. Befuddled partner Emanuel told M Street that he had no prior knowledge of the sale, and that according to ARN corporation bylaws, he must be given first right of refusal and 60 days to respond. He speculated that Graham's hasty sale may have been made in relation to ARN cash flow problems caused by late payments from its rep firm. Emanuel also said that he and Graham had signed a letter of intent to sell ARN to the Business Radio Network (BRN). BRN's Pat McCrummen told M- Street, "No one is more surprised or baffled by this development than we are." M- Street also spoke to IBN president Steve Wiegner who acknowledged that he had purchased Graham's share of ARN and is planning on purchasing Emanuel's share. Emanuel said he had not been contacted by Wiegner or IBN. M Street was unable to reach Ed Graham, who did not return our phone calls. According to Steve Wiegner, IBN is still negotiating to acquire the United Press International. Radio Network.

According to Inside Radio, album rocker WWZZ -FM in Knoxville, TN, recently dropped its music for 24 hours. In its place, the station aired a campaign for listeners to patronize station clients and confront those who aren't clients. The station repeatedly named names of businesses who don't buy time, such as Hardees and McDonald's and urged listeners: "when you reach into your wallet tell them who you listen to." McDonald's called to protest after local restaurants were "deluged" with WWZZ listeners. The station relented by stopping the naming of names, but said they would send the fast food chain a "no- charge" invoice for the mentions. Station GM Michael Benne said the concept was hatched in response to advertisers who object to the station's rock format because it appeals only to "tattoos and motorcycles."

The RAB has released its revenue figures for November, showing a network revenue gain of 7.6% versus the same month in 1990. Local radio revenues decreased in November by 2.8 %, with national down by 7.7 %, for an overall decrease of 3.9% from 1990 figures. Year -to -date figures show a decrease in local revenue of 3.2% through November, with national down 3.8 %, versus the same period in 1990. The only local revenue gains were in the Southwest, which showed a November increase of 0.8 %. Predictably, the East had the worst showing in local revenue with a

decrease of 4.6 %. The West followed closely with a local revenue decrease of 3.5 %. The West had the distinction of most decreased national revenue in November with -14.9% versus the same month in 1990. It was followed by the Southwest, which had a 12.5% decrease. The RAB attributed the sharp regional declines in nat:_-al revenues to the strong fourth quarter showings by the West and Southwest i^ 4th Quarter 1990, when those regions had not yet felt the effect of the re = ssion. RAB president Gary Fries said, "While the decrease in national radio revenues in October and November continues to be a concern, at this point we're far more interested in what the future holds, and fight now it's looking encouraging." Fries is predicting a slight revenue increase for the first quarter this year.

The RAB has issued its new Instant Background book, Volume 1 for 1992 to member stations this week. The book features marketing profiles of 50 different business categories, with specific data that will help radio sales personnel address clients' needs. The weekly Signals radio program, which airs over shortwave station WWCR, Nashville on 7435 KHz, can now be heard on the AM band in the Charlotte market over WGTL, at 870 KHz on Sunday afternoons. Signals is dedicated to "radio - related communications media of all kinds," and features a segment from the M

Street Journal. The program has been airing on WWCR since October, and can be heard every Saturday at 11:35 pm (ET).

WASHINGTON THIS WEEK

The FCC was closed Tuesday, January 14, due to a water main break near the Commission's offices in Washington.

The NAB's Radio Board issued several policy statements from its winter meeting last week. Chief among them was the board's strong advocacy of an FCC freeze on new FM station licensing and allotment, with a review of FM allocations and licensing policy. The Board said it is urging a freeze because of the present economy, growth in the number of radio stations, and "industry and government recognition that past allocation and licensing policies have over -saturated the radio station marketplace." The board also cited the FCC's current AM policy which it said is "aimed at enhancing the technical, financial and public service viability of the medium in lieu of simply adding more stations." The board also called for new FCC standards regarding local marketing agreements, which the board said "can enhance broadcasters' abilities to serve their communities to the benefit of the public interest. Other NAB policy statements endorsed the relaxation of the duopoly rule, which it said "can result in substantial efficiencies for radio operators in all size markets, and allow radio operators to effectively compete, thus furthering the public interest "; and the elimination of the FCC's 12 station ownership rules which the board said "do not affect the diversity of voices available to listeners" and "do not promote any public interest role."

The FCC resolved several North and South Carolina FM allotment proposals under a

consolidation order, after the court of appeals ruled that the FCC adopted its 1984 "no substitutions policy" without the requisite notice and opportunity for public comment required by the Administrative Procedure Act. The court's ruling came as a result of an appeal by Marine Broadcasting Corp., which had its petition for an upgrade of its Jacksonville, NC station dismissed by the FCC because of the no substitutions policy. Under the consolidation order, the Commission considered several proposals and counterproposals that were filed during the Marine's pending appeal. A majority of the petitioners were granted alternate, equivalent class channels, while three proposals were denied, and one petitioner agreeing to a lower class allotment. The FCC granted seven upgrade requests, including that of Marine, and three new allotments. The allotments are as follows:

North Carolina: Carolina Beach - 106.7 A; Havelock - 105.1 C2; Hertford - 104.9 C2; Jacksonville - 92.3 C2, 98.7 Cl, 105.5 C2; Shallotte - 98.3 C3, 103.7 C3, 106.3 A; Wilmington - 97.3 C, 101.3 C2, 102.7 Cl, 104.5 A.

South Carolina: Bucksport - 107.9 C2; Darlington - 105.5 C3; Loris - 94.9 A; North Myrtle Beach - 105.9 C3; St. Stephen - 106.1 A; Surfside Beach, - 103.1 C3.

The FCC set aside a Review Board decision which dismissed Triad Network and law firm Maupin Taylor Ellis & Adams, P.C.'s (MTE &E) appeal of the Administrative Law Judge's ruling that ordered counsel and the law firm to discontinue their representation of Triad in the proceeding. The FCC also vacated the ALJ's underlying ruling removing counsel, thus allowing MTE &A to continue representing Triad. Triad has an application for a new AM station in Greensboro, NC. The ALJ initially granted the application of Palmetto Communications Company to modify facil;_ties at existing AM station WDIX in Yadkinville, NC. The Board supported the ALJ's decision that Palmetto had preference over Triad for providing first nighttime service to Yadkinville. Triad challenged the decision, alleging that Palmetto concealed its true ownership structure, and was thus unqualified to be a licensee. In the process of determining Palmetto's true ownership, the Board noted a possible conflict of interest in the proceeding for Triad because its counsel was also representing Robert Rickenbacker, Jr., who is one of Palmetto's partners involved in a separate proceeding for a station in South Carolina. The Board remanded the proceeding to the ALJ, who could not find absence of a conflict of interest. The ALJ then ordered counsel and his firm to discontinue representation of Triad. Triad and MTE &A appealed the ALJ's ruling to the Board, and Triad subsequently retained new counsel. As a result of Triad's changing counsel, the Board dismissed the appeal as moot. In the FCC's decision, the Board's dismissal of Triad and MTE &A's appeal was considered improper because the law firm gave its notice of withdrawal as counsel for Triad subject to consideration of its appeal, and FCC rules provide that an applicant has the right to appeal an ALJ's ruling removing counsel. In addition, because Rickenbacker had retained new counsel to represent him in both of Palmetto's application proceedings, the FCC decided that any possible conflict of interest MTE &A may have suffered because of the dual representation of Triad and Rickenbacker had been removed.

In other actions, the FCC: dismissed as moot Seashore Broadcasting Corp.'s motion to strike joint opposition to notice of appeal, denied its petition to intervene, and dismissed its appeal in the proceeding for a new station at 105.7 MHz in Manahawkin, NJ; denied Sunshine Broadcasting Inc.'s petition for reconsideration of a review board decision in the proceeding for a new station at 98.5 MHz in Hartsville, SC.

The NAB is offering a live teleconference addressing political broadcasting issues via satellite to radio and television stations on January 30, from 1:00 - 3:00 p.m. (ET). Scheduled to participate in the conference are the FCC's Milton Gross, chief of the Political Broadcast Branch; Jeff Baumann, NAB executive VP & general counsel; Steve Bookshester, NAB associate general counsel counsel & First Amendment attorney; Robert Pettit, general counsel; and Craig Blakely from Sidley & Austin, Washington, DC. The conference will include a explanation of the FCC's new political broadcasting rules and a question and answer period with the aforementioned legal panel. The NAB will provide toll free numbers for listener /viewer questions. Radio station operators can access the program on Satcom C -5, Transponder 23, DATS 8. After learning of the impending merge of American Radio Network with Independent Broadcasters Network, ARN fifty percent partner Don Emanuel joined the Business Radio Network as the vice president of a new division called the American Forum Radio Network. With him, Emanuel brought most of ARN's programming, which officially debuted as American Forum on January 18. Included in the new network's lineup are The Sports Final's talk, news, and trivia programs from 10:00 p.m. to 6:00 a.m. (ET); AM Sports during morning drive; talk programming with Stuart Taylor, Dr. Lonnie Carten and Dennis Krause during the afternoon; and an afternoon drive interview program with Al Malmberg called "What's the Point Newsmagazine." In response to the new ARN /BRN alliance, the Independent Broadcasters Network issued a fax to "former American Radio Network Affiliates" recommending that they join IBN, and dissuading them from joining the new network. The new American Forum can be found on Satcom C -5 and Galaxy 2. For more information on American Forum contact BRN at 800 -321 -2349. There is no change in programming on the Business Radio Network.

According to the Wall Street Journal, Westwood One has agreed to settle a

complaint made to the Federal Election Commission (FEC) that the company made $13,000 in illegal corporate contributions to Senator Joe Biden's presidential campaign in 1987. The FEC found that Westwood chairman Norman Pattiz had several Westwood executives contribute $1,000 each to Biden's campaign, which he later reimbursed to the contributors through falsified expenses. Pattiz claimed that he didn't know the reimbursement was illegal. Under a series of agreements, Pattiz and Westwood said they would pay a total of $72,300 in civil penalties to the U.S. Treasury. The settlement was said to be one of the largest amounts ever obtained in a federal election agency judgment.

Charleston, SC, jazz outlet WMGL -FM issued a memo to its clients announcing the station's "temporary" sign -off while the FCC investigates the NAACP's petition to deny the sale of the station. Station owner Millcom, Inc. denies any allegations by the NAACP, and shut down the station because of difficulties in selling the station during the investigation.

WFMX in Statesville, NC, was listed in an Arbitron 5B notice for rating bias, when it ran an contest /promotion asking listeners to "write down things about WFMX -FM like you would a diary," as well as other diary references, which Arbitron said were suggestive of its survey process. Station promotional liners included: "keep a daily diary," "we will announce a name of a correct diarykeeper," and "every time you hear a reason write -it -down, keep a list, like a diary, everyday." The ratings service said the announcements could prompt or remind Arbitron diarykeepers to report WFMX listening in Arbitron diaries. In issuing its notice, Arbitren reminded stations that such practices "have the potential to bias survey participants or distort survey results."

Alpine Electronics is the latest radio manufacturer to add the ID Logic automated format scanning system in its new automobile receivers. The new Alpine model 1310 ID Logic tuner was unveiled at the recent Consumer Electronics Show in Las Vegas. With ID Logic, a listener can locate a favorite format in an unfamiliar (or familiar) city at the touch of a button. Containing a computer chip with a

database of call letters, formats, geographic location, and frequencies for over 13,000 stations, ID Logic enables a listener to learn at a glance which station he is listening to, or seek out specific stations. Alpine's first ID Logic receiver will be its 1310 model, which is scheduled to be available early this summer. One new ID Logic feature found in the 1310 is the ability to select up to six user defined formats from a list of 24 formats. This allows format selection as targeted as Southern gospel or CBC English programming. Alpine's receiver joins two Panasonic ID Logic car radios already on the market the model ID -60 and ID -90. Formats, call letters and station frequencies are prcvided to ID Logic by M Street Corp.

The Radio Advertising Bureau is issuing a new twice -weekly fax report called, "Radio Sales Today." The report is a newsletter featuring sales promotion ideas, marketing news, and information to help station increase sales. The RAB is offering the report without charge to all U.S. stations for the next 30 days. Thereafter, only RAB members will receive the report. For more information, call the RAB at (2.2) 254 -4800.

The Rochester, NY based North East Satellite Entertainment (NESE) network is offering personality -based regional newscasts to its affiliates. The half -hourly newscasts will air daily from 6:00 p.m. to 5:30 a.m. From Sunday through Tuesday, 6:00 p.m. to midnight newscasts will be anchored by Rochester television anchor Maggie Brooks. Other anchors will include Jim Diehl, Dave Michela, and Steve Hugel. NESE is adding the newscasts to its current nighttime programming featuring music and personalities. The network is targeting affiliates in 13 states in the northeastern U.S.

WASHINGTON THIS WEEK

Federal bank regulators voted unanimously last week to phase out Highly Leveraged Transaction rules in an effort to ease the current credit crunch. As a result of the decision, broadcasters demonstrating good cash flow may soon be eligible for delisting with lending institutions. Under the new agreement, companies may be delisted after meeting specific criteria, such as reducing their leverage level to 75 %, showing historical casn flow superior to industry or peer groups, and being able to service their debt. The current regulatory definition of HLTs will be eliminated June 30, 1992, after which banks will not be required to report on HLTs or collect HLT credit data. The NAB's Edward Fritts, who was pleased with the decision said, "The immediate recognition of a cash flow criterion and the total elimination later this year of the HLT definition should go a long way to improve the broadcast lending climate."

Salem Media's WMCA in New York, NY, was notified by the FCC of an apparent liability for a forfeiture of $12,500 because of repeated violation of FCC sponsorship identification rules. The forfeiture is the result of a complaint alleging that WMCA's " Healthline" program hosted by Dr. Stuart Berger, was not properly identified as a paid -for program. WMCA responded to the complaint by saying that Berger purchases time from the station for his health program, and then sells time to sponsors. Upon investigation of station tapes, the Commission found that the program lacked sponsorship identification, and that the program's content alone does not clearly indicate that Berger pays for "Healthline." While WMCA has indicated that it will correct the violation, the Commission said the licensee will not be excused from past violations of the sponsorship rule because of subsequent corrective measures.

According to the Chicago Sun -Times' Robert Feder, the FCC shut down MM Group's WCFL(FM) in Morris, IL, because the station illegally boosted its power to over twice its authorized ERP of 11,000 watts and used a nondirectional, rather than directional antenna. The illegal increase was found in an FCC field investigation prompted by complaints from local broadcasters. Such a violation, the FCC said, could increase possible interference with other stations. The station was fined $3,000 for similar ,'iolations in 1990 which, according to the FCC, was never paid. The station issued a press release indicating that the station "volu.Ztariîy" went

off the air to install a new antenna. The FCC will keep WCFL off the air until it

complies with FCC requirements, which include paying its fine and completing construction of a directional antenna. FCC field investigations chief Dan Emrick said such action against a station is "very uncommon" and that it "really shows how seriously we feel about operating under proper authority."

The FCC renewed the licenses of L. M. Communications' combo WLXG(AM) and WCOZ(FM) in Lexington, KY, after investigation of alleged EEO violations. Kentucky branches of the NAACP and the National Black Media Coalition made the objection to the stations' license renewals, and asked the Commission to investigate the

stations' employment practices and designate the renewal applications for hearing. The Commission saw no grounds for a hearing, and granted the license renewals with an admonishment that L. M. Communications assess its EEO program on a regular basis, and make efforts to obtain a more diverse applicant pool for job openings.

Toledo Broadcasting's WSPD(AM) and WLQR(FM) had their licenses renewed, subject to EEO reporting conditions. The FCC said the stations' records showed insufficient efforts toward the recruitment of qualified blacks for upper -level vacancies, and that the station didn't make any meaningful efforts to change its EEO program until a few days before the end of its license term.

The FCC denied Playa Del Sol Broadcasters' review of a Review Board decision that granted the competing application of F.E.M. Ray, Inc. for a station at 104.1 MHz in Tucson, AZ. Playa had argued to the Review Board that its application was entitled to dispositive credit because of its superior coverage area and its sole principal's superior record as the owner of Sacramento station KWOD. The Review Board ruled that even if such credit was given, F.E.M. Ray would still have the superior application. Playa also contended that financial, misrepresentation, and candor issues should be added against Ray's application. The Board rejected such arguments, because Playa could not raise substantial questions of fact to enlarge the issues, and Ray was deemed to be financially qualified to construct and operate a new station. The Commission concurred with the Board's decision, saying that Playa made its contentions based on speculation without specific allegations of fact, supported by affidavits, sufficient to add the issues.

ELSEWHERE

Pittsburgh adult contemporary station WLTJ went into court to fight Arbitron last week and had its case thrown out. In its lawsuit against Arbitron, WLTJ alleged that the ratings firm did not follow its own rules and miscredited survey information that cost the station $1.4 million in lost revenues. WLTJ's specific allegations included: the crediting of Arbitron diary entries with former station call letters WPNT to Pittsburgh religious station WPIT; the attribution of "lite" entries to WWKS in Beaver, PA, which is 50 miles outside the Pittsburgh metro; and the crediting of entries of 92.5 to WDJQ -FM in nearby Alliance, OH (WLTJ is at 92.9 MHz, while WDJQ -FM is at 92.5). The judge threw the case out because WLTJ was unable to raise an issue of material fact and gave no evidence that Arbitron did not follow its own rules. In addressing the station's allegations, the Judge agreed with Arbitron. Specifically, the ratings service gave WLTJ credit for WPNT entries for a year since it changed calls and then reverted to its standard methodology; WLTJ was not entitled to all "lite" entries; and diary entries of 92.5 did indeed belong to WDJQ -FM.

Clear Channel Communications, Inc., of San Antonio, TX, announced that it will acquire the Kentucky State Network, which provides news to approximately 78

affiliates in Kentucky, including Clear Channel's WHAS and WAMZ in Louisville. The company has also announced a recently signed agreement to broadcast New Orleans Saints football games over its stations WQUE -AM /FM for the next three years. The broadcasts will be the first FM airing for the Saints. With the addition of pro football comes a format change for WQUE(AM) from urban contemporary to sports, news, and talk, scheduled to occur within the next month.

Veteran ABC sports commentator Howard Cosell announced that he will retire from the radio network at the end of January. Cosell began his career with ABC Radio in 1953, but gained his greatest fame on ABC television, as a commentator on NFL football games and professional boxing. Cosell's most recent radio programs were the daily segment "Speaking of Sports," and "Speaking of Everything," a weekly interview program.

The MMN Radio Networks, Inc. is introducing Minnesota's first statewide news and sports wire service. The service is called. MNNWIRE, and will feature hourly Mir.resota news and sports, in addition to national news and features. MNN distributes its programming to over 80 affiliates in Minnesota and four other nearby states. Minnesotans wanting more information can call (612) 696 -0123.
