Arroyo The Seventh Northern Marianas Commonwealth Leg- islature recently passed the Second Partial Appropriations and Budget Authority Act of 1991 after criticism from some sectors on the manner some ap- propriations were made. The Seventh Northern Marianas Commonwealth Leg­islature recently passed the Second Partial Appropriations and Budget Authority Act of 1991 after criticism from some sectors on the manner some ap­propriations were made.

The bill that would enact such a measure was passed by both houses of Congress in separate sessions after a joint Conference Committee came to a compro­mise on differences between the original House version (House Bill 7-230, H.D. S.C.S. 1)

The Conference Committee agreed that there were no sub­stantial differences between ap­propriations in the substitute Senate bill and the correspond­ing appropriations in the House

version.According to a Committee

report, the main difference be­tween the two versions of the bill lies in the number of items funded and the total amount of additional identified revenue resources identified in each.

Mendiola counsels allege illegal search

A motion which sought for the suppression of evidence and ultimately, the dismissal of charges filed against a Tinian man who is alleged to have smuggled about $2.1 million of crystal methamphetamine into the Commonwealth, was heard in Superior Court yesterday with Judge Alex Castro presiding over the matter.

The defense attorneys for Francisco Barcinas Mendiola are seeking that several pieces of evidence be suppressed by the court as they have been ob­tained through an illegal search and seizure.

Mendiola’s lawyers are also seeking that the court vacate the search warrant which they con­tend, have violated their client’s Fourth Amendment right and

that the case be dismissed due to alleged prosecutorial miscon­duct.

The case was argued in court Friday and was continued up until today where three defense and one government witnesses are expected to take the stand.

Mendiola has been identified as the consignee of a container van which originated from the Philippines. Inside die van, law enforcement agents from the Department of Public Safety - Special Operations Division (SOD), Boating Safety, Tinian DPS and Customs officers, found construction materials, 100 bags of birdseed and two tanks of which one contained four and a half pounds of the seized contraband.

The Supreme Court of the Northern Marianas has re­cently affirmed the decision of the Superior Court on a complaint jointly filed by the Commonwealth Ports Au­thority and the Duty Free Shoppers, Ltd. against Hakubotan Saipan, Ltd.

The trial court in January

Law-enforcement agents are contemplating if charges of pos­sible involuntary manslaughter or homicide will be filed against a former police officer who is being named as a suspect in the stabbing death of a San Antonio last Friday evening.

Chief of Police Tony Reyes said on Monday that Pascual Cango, a Carolinian national from San Antonio, has been tagged as the primary suspect in the death of Sylvester F. Nugam, a 28-year old Yapese national who works as a warehouseman at the Payless Supermarket.

Cango himself sustained a stb wound but was pronounced in , stable condition after he under­went surgery for a laceration in the abdominal area which was allegedly a stab wound, Reyes said.

Initial investigations show that Nugam died of multiple stab wounds in the head, chest and abdominal areas after he attacked Cango with a knife.

Investigations revealed that on the night of the incident, Nugam allegedly trailed Cango who was in a with wife Evelyn heading south along Beach Road.

Nugam allegedly blinked his lights prompting Cango to make a stop near the San Antonio Elem. School. The vehicles were parked alongside each other and Reyes said that Nugam, who was seen carryinga 14 inch knife, attacked Cango immediately after he alighted from his vehicle.

Investigatiops revealed that Nugam may have already stabbed Cango even before he managed to wrestle the knife from Nugam.

The police were alerted of a stabbing incident in the San An­tonio area when an unidentified call was made at the DPS Cen­tral in Susupe.

Minutes after the call, re­sponding officers found Cango inside his in-laws house in San Antonio. He was found by the police sitting inside the house with a white towel wrapped around his wound, Reyes said.

An hour after the call was made, DPS Central again re­ceived anonimous call inform­ing them that a body was found near the vicinity of the. San An­tonio Elem. School.

Itwas therewhere police found the partially clothed body of Nugam laying below the front driver’s door of a red Mazda pick-up which was left open.

Benjamin D. Lawan was pro- nounced'dead at the Common­wealth Health Center after ef­forts to resuscitate him proved futile.

Lawan allegedly died while spearfishing with some 5 friendsnear the vicinity of the Hotel Nikko in Marpi.

Reyes said that several of Lawan’s companions noticed that he may have encountered trouble when they saw his flashlight’s beam bobbing in different directions.

Public Land Corporation (MPLQ and Tasi Tours. The MPLC will shoulder half of the cost while and the remaining half will be shouldered by Tasi Tours, according to Tasi Tours representative Mr. Norita.

Plans are being made not only for the construction of a rainwa­ter catchment which will be the source in supplying water to the rest rooms and public open air showers that will be located near the beach but repairs will also be made to the existing pier on the island.

Norita said the main hall will also be expanded to the west for it to accommodate 200 persons while a first-aid shelter and an information desk will also be two of the other planned improvements.

Almost a year ago, Tasi Tours has extended $4.17 million to the MPLC as its payment for its five year concession on the is­land. The company has already made contributions which have exceeded the $5 million mark.

Presently, the company has 23 employees who look after the needs of the island’s visi­tors. Of the 23, 19 are locally hired. There are two lifeguards, two boat captains and two rangers who are assigned to provide peace and security in the area while two salesgirls manage the gift shop.

Other employees are as­signed as hosts, food servers and b a rten d e rs . A nother company which also has a concession on the island, operates scuba, snuba and skin diving services.

Measures passed to ensure swift action by MPLC

The House of Representati ves passed on Friday a measure which calls for the Marianas Public Land Corporation to im­mediately act On pending land exchanges and to expedite the processing of such claims prior to approving further proposals to lease public land for project development by foreign inves­tors.

The resolution which was in­troduced by Vice-Speaker Luis Benavente, M ajority Floor* Leader William Ada and Rep. Juan Tenorio affects those who have legitimate claims for land exchanges either as a result of previous land exchanges or for rights of way, wetlands and other public purposes.

Ada noted that while the MPLC has been constitutionally mandated to manage public lands for the people, the government agency has yet to take action regarding pending land ex­changes.

He also said that the MPLC should first exert efforts to re­solve all pending land exchange claims before the approval of land leases to possible investors and developers.

“The MPLC has done nothing so that the claimants can be given what is rightfully theirs,” Ada said.

Ada said that before the MPLC further approve any land lease from developers, efforts must first be made by the government agency to resolve all pending

land exchange claims that are still pending.

The issue of land exchange was also brought to the attention of MPLC Executive Director Bill Concepcion throughaletlerfrom Department of Public Works D irector Elizabeth Salas Balajadia inquiring about the status of the land exchanges for the roadways that are currently being improved.

Sharing Ada’s concern was Rep. Antonio Quitugua of Rota who said that something must be done for the MPLC to correct its previous m istakes, the recent one of which was the approval of a prim e beach front land in Garapan to a Japanese investor

Rep. William Ada who has proposed to construct a $100 million resort in the area.

Ada did not only question the MPLC’s inability to collectdues particularly from a major devel­opers on the island but, he also whose concern over the way the agency was spending its funds.

On the other hand, a resolu­tion which will give authority to the Governor to appoint the members of the Board of Edu­cation, was denied by the leg-

islators in a 6-2 vote against the measure.

Reps. Jesus Attao, Ada and Tenorio supported the measure which, they say, is a means to curb the Board’s actions par­ticularly in issues affecting the education department’s policies.

The legislators said that several instances showed that the Board has not performed its function as mandated by law and it has su­perseded the authority that has been vested in it.

The lawmakers cited the recent strike of the more than 500Public School System employees and the approval of the Commis­sioner of Education’s pay in­crease.

“The Board is taking all its initiative to break all the laws that have been approved by this House. Theydidnotactproperly during the recent teacher walk­out and that incident could have meant disaster,” Tenorio said.

Ada, on the other hand, noted that an appointed board such as during the time of the Camacho and Tenorio administration ac­complished work satisfactorily and with less funding.

In opposition to his colleagues, Rep. Gabriel Babauta said that an appointed board will not mean the solution to the current status and issues facing the Board of Education.

Aid that since there is a need to improve the way the Board of Education is performing its job, the lawmakers must find a sys­tem that will ease the current situation in the PSS.

the liquor in packing material supplied by Hakubotan and transports it, using a Hakubotan truck, to the air cargo section of the airport.

At the air cargo office, an airway bill is prepared identify­ing Pacific Forwarders as the shipper and Japan Travel B ureau (JTB) Cargo as the consignee.

By pre-arrangement with Hakubotan, JTB Cargo accepts the liquor in J apan and delivers it to-the customer there. Upon re­ceipt, the customer pays freight charges and a Japanese govern­ment tax.

Upon learning of the Hakubotan system, CPA felt that Hakubotan and Ayuyu were us­ing the airport to deliver mer­chandise in less than wholesale quantity within the meaning of the Act, thus violating the Public Law 4-60 and interfering with the MCA.

Invoking that the agency had statutory authority to award the exclusive use of NMI ports of entry to DFS under the master concession, CPA told Ayuyu to cease such an operation.

But Ayuyu disregarded the letter and continued to forward merchandise under the Hakubotan system, prompting the filing of the suit.

CPA specifically asked that the plaintiffs be enjoined from continuing the Hakubotan sys­tem; that the system be declared as being in violation of the Act and 2 CMC Section 2122 (b) “as endangering the 1987 CPA bond issue and indenture,and as tortiously interfering with the MCA.

The CPA also pressed for damages after which DFS sub­sequently intervened as party- plain tiff, seeking identical relief.

The High Court in analyzing the case, noted that under the MCA, DFS clearly has the sole right to offer to sell, to sell any merchandise at the airport, or to deliver merchandise in less than wholesale quality to departing individuals at the airport.

tice Ramon G. Villagomez, and Special Judge Edward C. King also noted that under the Hakubotan system, the delivery of the merchandise occurs and is completed in Japan, and not at the Hakubotan store or at the airport.

There was no dispute that if Hakubotan delivers the mer­chandise to a customer at its store, and the customer, in turn, transmits the merchandise to an independent shipper, no viola­tion of the Act or the MCA would occur.

CPA and DFS contend that the clause “use any port of entry...to deliver” refers to any activity involved in any stage of the delivery process and that

“use” of the airport is considered as any part of the delivery pro­cess.

According to their argument, The use of airport facilities is an essential step in the Hakubotan home delivery system, and that this system violates 4 CMC Sec­tion 2201 et. seq., which pre­cludes anyone from making use of the airport as any part of the delivery process.

Moreover, CPA and DFS in­terpret “delivery” to mean deliv­ery at the airport or any place beyond the airport, so long as the airport is used in the process of delivery, apparently basing on the common meaning of the word.

Appellees Hakubotan and Ayuyu, on the other hand, con-

tend that the common meaning of “deliver,” as used in the stat­ute, is physical delivery of the merchandise directly to a de­parting passenger, or to some individual such as a cabin atten­dant on his behalf or possibly by direct belly-loading of merchan­dise in a cargo hold of the air­craft for the benefit of the de­parting passenger.

In ruling in favor of the Appellees, the high court con­cluded that the word “deliver,” in its ordinary sense, does not mean any particular stage in the process of delivery. Rather, it means the completion of deliv­ery itself. It was surmised that the legislature, in passing out the Act into law. must have realized

that this meaning of the word corresponds with CPA’s overall jurisdiction.

Thecourt’sopinion recognized that CPA’s jurisdiction extends to all NMI ports of entry, but not beyond. Thus, it ruled that the restriction on use of the Saipan airport to deliver merchandize in less than wholesale quantity to a departing individual cannot ex­tend to deliveries completed out­side the airport.

“Since the delivery of liquor under the Hakubotan system is not completed until the product reaches Japan, the Hakubotan system does not violate 4 CMC Section 2205 (c), nor does it in­terfere with the MCA,” the court opinion read.

arrest, government witnesses in­cluding two Customs officers, Chief o f Tinian Customs Hofschneider and Tinian DPS Chief Tony Kiyoshi, it was re­vealed that the container van had been at Charlie Dock on Saipan about two weeks before it was transported to Tinian.

According to testimonies in court Monday, DPS officials connected with SOD have prior knowledge that the van contained a shipment of possible contra­band in it

Arrangements have been made for Mendiola to claim the cargo and about two weeks prior to his arrest, he was on Saipan however, no inspection was made on the container.

On May 14, the container van apparently was transported to Tinian with law-enforcement agents ha ving no knowledge who on Saipan released it.

Kiyoshi was that a few hours after the container van arrived on Tinian, he was informed through a telephone call by the SOD not to release it.

In his testimony, Kiyoshi said that upon instruction, he imme­diately contacted Hofschneider. Contrary to the orders from Saipan, the container van was released and was already enroute to Mendiola’s residence when it was apprehended by Hofschneider.

Based on the motion filed in court, the defense argues that the May 15th search which led to Mendiola ’ s arrest should be sup­pressed and prohibited from the court as there was no search war­rant to justify the search and that the container was not inspected on Saipan which has been listed as the port of entry.

The defense has also con tended that there was professional mis­conduct in the way the govern­ment prepared for the case. Ac­cording to the document filed by the defense, the supporting affi­davit prepared an SOD special agent contained unrel iable infor­mation and that it did not supply the prosecution with the neces­sary probable cause for the case.

The case has been continuer! for today as the defense has two witnesses to testify on the case.

Other appropriations which encountered rough sailing in the budget approval process were the $2 million for the Talafofo Water Collection System and the $500,000for theFYU-LCU dry- docking project, which were both deleted in their entirety.

It was also specifically stipu­lated that the funds appropriated in the bill and under Public Law 7-21 are to be expended by the expenditure authority provided for in 1 CMC Section 7401 (a) through (M) except that the Chairperson of the Municipal Council in the First and Second Senatorial Districts or his desig­nee shall be the expenditure au­thority for appropriations to the respective Municipal Council.

Likewise, the mayors of each of those senatorial districts shall

be the expenditure authority for improvement projects.

It was also provided that the Chairperson of the Third Sena­torial Districts Municipal Coun­cil shall have expenditure au­thority for appropriations to the district’s Municipal Council and that the Mayor of Saipan shall have that authority over the of­fice of the mayor and as pro­vided by law.

Section 108 was added to pre- ventany company, organization, partnership or person that has been awarded a Commonwealth government contract for a capi­tal improvement project and failed, without justifiable rea­son, to complete the contract within 180 days of the date agreed upon, from being awarded any subsequent con­tract forany capital improvement project funded by this bilL

DPW starts use of anthskid coat on roadsThe Department of Public

Works has commenced the use of plant mix dense-graded anti­skid pavement surface for the Commonwealth’s main roads in compliance with a federal re­quirement recently imposed by the Federal Highway Adminis­tration.

This was revealed yesterday by DPW Director Elizabeth Balajadia, who said that the us­age of an anti-skid material that goes with asphalt has been implemented with an ongoing projectattheChalan Pale Arnold Road.

Other main roads are set to be layered with the material within the next few months.

Balajadia pointed out that the anti-skid project is in line with a road improvement and hazard elimination project being un­dertaken by the federal govern­ment and is being funded solely

by federal funding to the tune of $1.2 million a year.

Phase I of the Chalan Pale Arnold Road, stretching from Kaiser Construction all the way to Gualo Rai is nearing comple­tion after which Phase II of the projectinvolving the stretch from Gualo Rai to CHC will be next.

Balajadia, however, said that since this is the first project where the anti-skid material is being introduced, there was a lot of bumps that was noticed on the Phase I project.

“Western Equipment, con­tractors for the project will either be made to redo the installation of the material, scrape it off and replace it, orjustdo an overlay,” Balajadia said in an interview.

Security Council recommends Micronesia, Marshall Islands as United Nations members

UNTIED NATIONS (AP) - The U.N. Security Council on Friday unanimously recom­mended that the Federated S tates of Micronesia and the Republic of the Marshall Islands be ad­mitted to the United Nations.

They will be seated in the world body on Sept. 17 if as expected the General Assembly votes to accept their member­ship bids as well as those of North and South Korea.

The four new members would increase the General Assembly’s membership to 163 nations.

The new membership reflect the end of the Cold War between the United States and the Soviet Union.

For years, the Soviet Union had opposed ending the U.N. trusteeship over the two Pacific island nations because it said the United States as the administer­ing authority could use the re­gion for weapons testing and development

But last year the Soviet Union dropped its opposition after the United States gave assurances that it had no military designs on the region.

That cleared the way for the Security Council to terminate the trusteeship over the islands,

allowing them to seek member­ship in international organiza­tions as full-fledged nations.

Council President Jbse Ayala of Ecuador welcomed the two Pacific nations after the council votes, saying their admission will “help foster peace and or­derly international coexistence.”

“The universality of our orga­nization is steadily becoming a reality and gaining in signifi­cance as more and more of the states which make up the world community are admitted to membership," he said.

Admission of the two states, he said, “will make an outstand­ing contribution to the United Nations by bringing to it an in­novative approach and a fresh perspective on world affairs, in order to promote changes in es­tablished practices, many of which are in need of renewal.”

Council action on the two states was delayed for a day be­cause the Soviet Parliament was discussing the issue and the So­viet U. N. delegation did not have authorization to vote.

U.N. membership requires a recommendation from the 15 nation Security Council and a two-thirds vote in the General Assembly.

Marilyn Jones, a staff of the Department of Planning and Budget was recently named as this year’s departmentEmployee of the Year.

Marilyn will be one of 21 civil servants who is vying for the recognition of Employee of the Year.

Although Jones has worked in the office for the past three years, she has 18 years of experience as a civil servant in the Finance office to her credit. Everyday, she has surrounded herself with numbers.

“When I was in Finance, I was spending the money. Now, I am on the planning and saving side,” she said.

Marilyn is currently assigned to plan the budget for the Public Health and Governor’s Office. The two department’s provide her a “wish list” after which she analyzes and determines what the two agency’s most urgent needs are. She then delivers the budget package to the Legisla­ture.

Jone’s work may sound all routine, but, for her, there is more

to job than numbers. She says that the hardest part was con­vincing people to cut back and cut down their budget as much as possible.

“Everybody wants exactly what they ask for. Wecan’tgive them all that they ask for. We have to look at available re­sources,” she said.

By all accounts, she does her

knowledgeable, organized, effi­cient, helpful and cheerful.

Although she is so successful in her career, Marilyn has one regret and that is to watch her four children ages 21,20,15 and 6 grow. “I still want the chance to see the little one grow up,” she said. “If not, I guess I will wait for grandchildren and I’ll retire and beagrandma,” she said while

job exceptionally well. She has been credited by her supervisors as someone who willingly as­sists co-workers and other agencies.

Marilyn consistently volun­teers to work overtime and is

thinking of the future.Jones has plans of retiring

within two years. During her interview, she joked, “I always said I will give this job 20 years and a day.” ··> >̂
