Methods of Payment

Goods purchased will not be

released until we have received full

payment.

Cash

Cash payments can be made at the

accounts desk during or after a sale.

Cheque

Cheques should be made payable to

Lyon and Turnbull Ltd. We reserve

the right to wait until cheques have

been cleared by our bankers before

releasing bought goods. Cheques

can be cleared prior to sale on

request. Cheques drawn by third

parties cannot be accepted. If paying

by post please include the slip from

your invoice.

Switch or Credit Cards

Payment can be made by Switch,

Mastercard or Visa cards. There is a

surcharge on credit card payments.

Collection

It is the buyer’s responsibility to

ascertain collection procedures,

particularly if the sale is not being

held at our main saleroom.

Electrical Goods

Lots that were once operated by

mains electricity are bought entirely

at the buyer’s risk. They are offered

for sale for display or historical

purposes and may not comply with

current regulations.

Bidding

At the Sale

To bid at the sale all potential

buyers must be registered with us

on or before the day of sale. We will

need proof of identification and

residence, and may require a bank

reference. Potential buyers must

collect a bidding number before the

sale begins, and show that number

if successful in purchasing a lot.

Please ensure that the auctioneer

repeats the number correctly when

confirming the sale. If there is any

doubt at this stage as to the

hammer price or buyer it must be

brought to the auctioneer’s attention

immediately. All lots will be invoiced

to the name and address given on

your registration form, which is non-

transferable. If you have purchased

a lot you may take your bidding

number to the accounts department

and receive an invoice immediately.

If you have not been successful

please leave the number at the

Registration or Reception desks.

In writing

Bid forms are available at the sale

and at the back of the catalogue.

These should be submitted in

person, by post, or by fax as soon as

possible prior to the sale and we will

bid on your behalf up to the limit

indicated. In the event of receiving

two identical bids the first one

received will take precedence. They

must be received at the very latest

at least an hour before the sale. We

will do our utmost to execute these

bids but we offer this service entirely

at the bidder’s risk.

Under this legislation, we are

required to collect a royalty payment

for all qualifying works of art, where

the artist is still living. This royalty

will be charged to the buyer on the

hammer price and in addition to the

buyers premium. It will not apply to

works where the hammer price is

less than €1,000 (euros). The charge

for works of art sold at and above

€1,000 (euros) and below €50,000

(euros) is 4%. For items selling

above €50,000 (euros), charges are

calculated on a sliding scale.

All royalty charges are paid to the

Design and Artists Copyright Society

(‘DACS’) and no handling costs or

additional fees are retained by the

auctioneer. Resale royalties are not

subject to VAT.

Please note that the royalty payment

is calculated on the rate of exchange

at the European Central Bank on the

date of the sale.

Order of Sale

David Lloyd-Jones spent his early childhood in India.His father was an officer in the pre-independenceIndian Army. At thirteen he was sent to Blundell'sSchool, Tiverton, Devon, where he became Head ofSchool and subsequently won a scholarship to St.John's College, Cambridge, where he read History.His subsequent doctorate was 'Charles Fourier'sconception of social science'. He became an assistantat Glasgow University and then lecturer in politics andsenior lecturer in 1968. Amongst his many studentsover his long teaching career was Charles Kennedy,later to become the leader of the Liberal Democrats.His former students speak very fondly of him, onesaying '...his lectures on Rousseau were aninspiration'. This solicitous role made him an idealadviser of studies. Glasgow was to be his home untilhis death last year.

Wherever he lived David created an extraordinary andunique series of interiors, first in his flat in Glasgow'swest end and latterly in the Edwardian red sandstonehouse in Whittingehame Drive. This capacious spacewith its high ceilings and parquet floors, acts as aback drop for his amazing mise-en-scènes whichhave featured in so many books and magazines overthe past few decades. 'Celtic Living' an early book ofinteriors, published by Thames and Hudson, was thefirst to feature the house anonymously. David wasalways a welcoming and charming host for manyvisitors over the years. Many generations ofdecorative art students at the University of Glasgowwere welcomed through the door of 3 WhittingehameDrive. Art Fund members, Glasgow Art Clubmembers and only quite recently members of theDecorative Art Society were all welcomed by David.

A glimpse through the door of the porch gives a clueto the many visual treats in store. The sheer numberof items, one placed carefully on top of another, intottering piles, is overwhelming. For David the chaseof the object was exciting and his regular visits to thefamous Glasgow Barras yielded many of the earlytreasures. From the hall with its three Arts & Crafts

lights and the walls lined with book laden cabinetssurmounted by massed arrangements of art glassand pottery, passing the Edwardian portrait of ayoung girl (to will be offered in our Fine PaintingsSale in June) we are led into the large drawing roomwith its bowed window embellished with stained andleaded glass. This room is predominantly Art Nouveauin character with the stylish cabinet, retailed by alocal Glasgow firm and the inlaid Shapland & Petterdesk at the side window. Comfortable sofas andarmchairs sit amidst tables laden with pots, glassand metal wares. The crowning feature of this room isthe south west wall, entirely given over to books ofthe Art Nouveau period, with their covers facing outrather than the spines. This most imaginative wallpaper is testament to the inventiveness of this periodof book design.

The dining room on the right of the hall is furnishedin the Aesthetic manner with its large ebonised deskand associated furniture, strongly influenced byJapan. The room is dominated by an oil painting bySir D.Y. Cameron (also included in the June sale)which hangs above the fireplace. Books of a slightlyearlier date predominate here and a solid Edwardianextending dining table sits in the centre of the room,much of its top decorated with Aesthetic tiles.

The kitchen beyond moves forward to the 1920s and1930s, and contains ceramic works by some of thewell known potters. Prints from the 1950s line thewalls here. Finally the narrow and steep stairwell,lined with etchings and Japanese prints, leads to thebedrooms, furnished appropriately with Arts & Craftsbedroom furniture.

Now the house is to be sold and the contentsdispersed, let us hope that the objects that gaveDavid so much pleasure will fall into equallyenthusiastic hands and that these in turn will remindus of a much loved friend.

Liberty's was founded by Arthur Lasenby Liberty in1875. Originally employed as a shop assistant atFarmer & Rogers India Shawl Warehouse, he usedthe ten years of experience he had gained there toopen his own store on Regent Street. Utilising hisinterest and knowledge in Asian and Near andFar Eastern cultures, he sold ornaments, fabricsand curios from Japan and the East. The businesswas a success from the beginning and quicklyexpanded.

Liberty soon realised the quality of the items he wassourcing from Japan and the East was deterioratingand decided and with demand outstipping supply

for quality fabric he commissioned his own fromEnglish dyers and manufacturers and had themimport and hand block fabrics. The high qualitywhich were achieved became known as 'Liberty ArtFabrics' and were used in for clothing andfurnishings.

Liberty's costume department opened in 1884 underthe directorship of the architect and designer E.W.Godwin. Godwin's aim was to challenge the creationsof Parisian fashion houses and create a home grownstyle - early clientele included artists of the Pre-Raphaelite movement and their circle including EllenTerry and Oscar Wilde.

Liberty & Co also promoted the designs of keymembers of the Arts & Crafts and Art NouveauMovements including Archibald Knox. The promotionof these styles by Liberty's and other avant gardeoutlets helped them to achieve internationalrecognition.

Throughout the 20th century, Liberty has continued topromote the work of many designers includingLucienne Day, Arne Jacobsen and Gio Ponti. Libertyfabrics have been used by designers such as YvesSaint Laurent, Bill Gibb, Jean Muir and Mary Quantand the shop today continues to promote and sellfashion and design of the highest quality.

Furniture from the Tudor ShopThe following collection of Arts & Crafts furniture wasall made in the early 1920s for Liberty & Co'smagnificent Tudor building in Great MarlboroughStreet. The building was completed in 1924 and wasbuilt so that trading could continue while renovationswere being completed on their adjacent premises inRegent Street. It was designed by Edwin Thomas Halland his son Edwin Stanley Hall at the height of the1920s fashion for the Tudor revival and constructedfrom the timbers of two 19th century men-of-warbattleships: HMS Impregnable and HMS Hindustan.After the First World War a more reactionary attitudetowards architecture and design was understandableand the Liberty board recognized the marketingadvantage and reassurance to their customers ofbuilding in the sixteenth century manner. The newbuilding would demonstrate craft of the highestquality and attention to detail and would be areflection of the Arts & Crafts values of “truth tomaterial” which had played such an important part inthe foundation of the company and the goods that itsold.

The shop was engineered around three galleried lightwells that formed the main focus of the building andemulated the great atrium spaces of Bon Marché andPrintemps in Paris. Sir Arthur Liberty, who foundedLiberty & Co. in 1875, wanted to create the feelingthat you were walking around your own home sosurrounding these wells were more intimate roomswhich reflected the warren of rooms found in theoriginal shop in Regent Street. Liberty's ownworkshops in Highgate made the wood panelling and

a team of twenty carvers worked for eighteen monthson the woodwork alone.

Under the supervision of the architects a collection offurniture was made for the rooms and galleries todisplay the textiles, clothes and luxury goods the shopwas so famous for. It is represented by a series of

tables, chests and display cabinets, all made in thesixteenth century style, with pegged construction anddecorative details complementing the design detailsin the building. The finish is either a dark fumed,natural or limed finish, also a characteristic of thewood finish of the rooms in which they once stood.The first group is designed in a Tudor style, withsubstantial oak planked tops above pegged supportspieced with decorative panel, also seen on panelingand staircases in the main shop (figure 2). Thesecond group also displays a 16th century aesthetic,with identical planked tops raised above cross framedsupports. The chests of drawers and the magnificenthexagonal centre table have distinctive hand wroughtiron handles and linenfold panelling, found in other

furniture still in situ. All the furniture was made in thefirm's workshops in Highgate and demonstrates thesame high levels of craftsmanship and attention todetail as the building itself. A photograph of theworkshop in the 1920s (figure 3) shows a chest ofdrawers and a display cabinet being produced.

Liberty & Co. has retained a core of pieces for itscollection; however, a substantial selection of thishistoric furniture, now unsuitable for contemporaryretailing, is offered here. Lyon & Turnbull will presentthe remaining pieces, designed by Sir Robert Lorimer,as part of their sale of Scottish Design on June 15th.

The illustration opposite showsthe new café at Liberty & Co’sTudor building in 1924 open forbusiness. The café, which nolonger exists, was located in thebasement and had as its focalfeature a large stone fireplacewith distinctive conical canopy.Shown in the picture are a groupof small oak tables around whichsat shoppers in need ofrefreshment. These tables weremade for the shop and theirdesign reflects the archedbuttresses and roof pendants inthe main atriums. The chairs, alsoin oak, were designed by RichardRiemerschmid, who had started tosupply designs to Liberty ’s in the1900s. The tea wares were madeby Moorcroft, a regular supplier ofwares to the shop, and wereglazed in powder blue.

From the Aesthetic and Arts & Crafts Movements, through theCeltic Revival, Art Nouveau and the Glasgow Style to thepresent, Scotland has a rich heritage of excellence in craft anddesign. This heritage arguably reached its zenith at the turn ofthe 19th century when Charles Rennie Mackintosh and hiscircle became the foremost exponents of Art Nouveau inBritain, going on to influence the course of design historyinternationally. It is also remarkable however to reflect on theother great names produced by this small country. Gothic

giants Bruce Talbert and Richard Norman Shaw; the Aestheticdesigners Daniel Cottier and Christopher Dresser; and theGlasgow designers George Walton and Jessie M. King are just ahandful of the many Scottish designers who went on to achieveinternational recognition.

To celebrate this ongoing legacy Lyon & Turnbull will hold anew auction for summer 2011: Scottish Design from 1860 tothe present day. The sale will encompass decorative arts anddesign from these diverse periods in the country's history andwill reflect the skill and variety of manufacture across a widerange of materials, including ceramics, glass, jewellery,textiles, metalwork, drawings, prints, posters, books,manuscripts, furniture and pottery.

One of the items consigned for the sale is this oak writingtable, designed by Charles Rennie Mackintosh and made forMiss Cranston's Ingram Street tearooms in 1909. MissCranston, who owned and ran a number of Glasgow tea rooms,was Mackintosh's most supportive patron. Tea rooms played animportant role in Glasgow society at the turn of the 20thcentury, unique places where people of different classes couldmeet and relax, and Miss Cranston was particularly successful.Mackintosh's first commission for Miss Cranston was to createa stencil for her Buchanan Street tea rooms in 1896. A fewshort years later he had been given sole responsibility for theinteriors and furniture in her Argyle [1899], Ingram [1900] andWillow tea rooms [1903].

The complicated latticework between the legs is distinctive ofMackintosh's style and creates an elegant spatial constructionbeneath the working surface of the desk. The top of this deskwould have originally held an arrangement of dividers, allowingit to be used by several ladies at a time. The current ownerbought the table in the 1960s from Cooper & Co who owned theIngram Street tea room. It has only recently been identified andincluded in Roger Billcliffe's catalogue raisonné. It will beoffered in the sale in June with an estimate of £10,000-15,000.

STANDARD TERMS &CONDITIONS OF SALE

Lyon & Turnbull carries on business withbidders, buyers and all those present inthe auction room prior to, or inconnection, with a sale on the followingGeneral Conditions and on such otherterms, conditions and notices as may bereferred to herein.

1. DEFINITIONS

In these Conditions:

(a) “Auctioneer” means the firm of Lyon &Turnbull or its authorised auctioneer, asappropriate;

(b) “deliberate forgery” means animitation made with the intention ofdeceiving as to authorship, origin, date,age, period, culture or source but which isunequivocally described in the catalogueas being the work of a particular creatorand which, at the date of the sale, had avalue materially less than it would havehad if it had been in accordance with thedescription;

(c) “hammer price” means the level ofbidding reached (at or above any reserve)when the auctioneer brings down thehammer;

(d) “terms of consignment” means thestipulated terms and rates of commissionon which Lyon & Turnbull acceptsinstructions from sellers or their agents;

(e) “total amount due” means thehammer price in respect of the lot soldtogether with any premium, Value AddedTax chargeable and any additional chargespayable by a defaulting buyer under theseConditions;

(f) “sale proceeds” means the net amountdue to the seller, being the hammer priceof the lot sold less commission at thestated rate, Value Added Tax chargeableand any other amounts due to us by theseller in whatever capacity and howeverarising;

(g) “You”, “Your”, etc. refer to the buyer asidentified in Condition 2.

(h) The singular includes the plural andvice versa as appropriate.

2. BIDDING PROCEDURES AND THEBUYER

(a) Bidders are required to register theirparticulars before bidding and to satisfyany security arrangements before enteringthe auction room to view or bid;

(b) the maker of the highest bid acceptedby the auctioneer conducting the saleshall be the buyer at the hammer priceand any dispute about a bid, which mustbe raised before the next lot is offered,shall be settled at the auctioneer’sabsolute discretion.

(c) Bidders shall be deemed to act asprincipals.

(d) Once made, no bid may be withdrawn.

(e) Our right to bid on behalf of the selleris expressly reserved up to the amount ofany reserve and the right to refuse any bidis also reserved.

3. INCREMENTS

Bidding increments shall be at theauctioneer’s sole discretion.

4. THE PURCHASE PRICE

The buyer shall pay the hammer pricetogether with a premium thereon.Antiques, Jewellery & Silver and Pictures(Not Fine Sales)17.5%.

All other sales (Fine/Special/Collections)25% up to £25,000 / 20% thereafter.VAT will be charged on the premium at therate imposed by law.

5. VALUE ADDED TAX

Value Added Tax on the hammer price isimposed by law on all items affixed withan asterisk (*) or dagger (†). Value AddedTax is charged at the appropriate rateprevailing by law at the date of sale and ispayable by buyers of relevant lots.

6. PAYMENT

(1) Immediately a lot is sold you will:

(a) pay to us the total amount due in cashor in such other way as is agreed by us.We accept cash, bank transfer (details onrequest), Switch or Debit Cards and Visaor MasterCard (please note there is asurcharge of 1.5% (VAT included) whenusing credit cards). We do not acceptAmerican Express.

(2) any payments by you to us may beapplied by us towards any sums owingfrom you to us on any account whateverwithout regard to any directions of you oryour agent, whether express or implied.

7. TITLE AND COLLECTION OFPURCHASES

(1) The ownership of any lots purchasedshall not pass to you until you have madepayment in full to us of the total amountdue.

(2) You shall at your own risk and expensetake away any lots that you havepurchased and paid for not later than fourworking days following the day of theauction or upon the clearance of anycheque used for payment after which youshall be responsible for any removal,storage and other associated charges.

(3) No purchase can be claimed orremoved until it has been paid for.

(4) It is the buyer’s responsibility toascertain collection procedures,particularly if the sale is not being held atour main saleroom and the potentialstorage charges for lots not collected bythe appropriate time.

8. REMEDIES FOR NON-PAYMENT ORFAILURE TO COLLECT PURCHASES

(1) If any lot is not paid for in full and takenaway in accordance with these Conditionsor if there is any other breach of theseConditions, we, as agent for the seller andon their behalf, shall at our absolutediscretion and without prejudice to anyother rights we may have, be entitled toexercise one or more of the followingrights and remedies:

(a) to proceed against you for damages forbreach of contract;

(b) to rescind the sale of that lot and/orany other lots sold by us to you;

(c) to resell the lot (by auction or privatetreaty) in which case you shall beresponsible for any resulting deficiency inthe total amount due (after crediting anypart payment and adding any resale costs).Any surplus so arising shall belong to theseller;

(d) to remove, store and insure the lot atyour expense and, in the case of storage,either at our premises or elsewhere;

(e) to charge interest at a rate of 1.5% permonth above the current base rate on thetotal amount due, to the extent it remainsunpaid for more than four working daysafter the sale;

(f) to retain that or any other lot sold toyou until you pay the total amount due;

(g) to reject or ignore bids from you oryour agent at future auctions or to imposeconditions before any such bids shall beaccepted;

(h) to apply any proceeds of sale of otherlots due or in future becoming due to youtowards the settlement of the total amountdue and to exercise a lien (that is a right to

retain possession of) any of your propertyin our possession for any purpose until thedebt due is satisfied.

(2) We shall, as agent for the seller andon their behalf pursue these rights andremedies only as far as is reasonable tomake appropriate recovery in respect ofbreach of these Conditions

9. THIRD PARTY LIABILITY

All members of the public on ourpremises are there at their own risk andmust note the lay-out of theaccommodation and securityarrangements. Accordingly neither theauctioneer nor our employees or agentsshall incur liability for death or personalinjury (except as required by law by reasonof our negligence) or similarly for thesafety of the property of persons visitingprior to or at a sale.

10. COMMISSION BIDS

While prospective buyers are stronglyadvised to attend the auction and arealways responsible for any decision to bidfor a particular lot and shall be assumedto have carefully inspected and satisfiedthemselves as to its condition we shall ifso instructed clearly and in writing executebids on their behalf. Neither theauctioneer or our employees or agentsshall be responsible for any failure to doso. Where two or more commission bidsat the same level are recorded we reservethe right in our absolute discretion toprefer the first bid so made.

11. WARRANTY OF TITLE ANDAVAILABILITY

The seller warrants to the auctioneer andto you that the seller is the true owner ofthe property consigned or is properlyauthorised by the true owner to consign itfor sale and is able to transfer good andmarketable title to the property free fromany third party claims.

12. AGENCY

The auctioneer normally acts as agentonly and disclaims any responsibility fordefault by sellers or buyers.

13. TERMS OF SALE

The seller acknowledges that lots are soldsubject to the stipulations of theseConditions in their entirety and on theTerms of Consignment as notified to theconsignor at the time of the entry of thelot.

14. STANDARD VENDOR FEES ANDCHARGES (Subject to VAT)

(1) Commission: 15% of the first £3000 and10% thereafter is charged on the sellingprice of each lot (subject to a minimumcharge of £30). Loss and damagewarranty: 1.5% on value of lots sold.Photography: max £40 mono per lot, max£250 colour. Internet Marketing Service:£10 per lot.

(2) If a vendor wishes to withdraw a lotconsigned for sale, a withdrawal fee willapply; this will be charged at 15% of themid estimate with any photographycharges incurred and all subject to VAT atthe current rate.

15. DESCRIPTIONS AND CONDITION

(1) While we seek to describe lotsaccurately, it may be impractical for us tocarry out exhaustive due diligence on eachlot. Prospective buyers are given ampleopportunities to view and inspect beforeany sale and they (and any independentexperts on their behalf) must satisfythemselves as to the accuracy of anydescription applied to a lot. Prospectivebuyers also bid on the understanding that,inevitably, representations or statementsby us as to authorship, genuineness,

origin, date, age, provenance, condition orestimated selling price involve matters ofopinion. We undertake that any suchopinion shall be honestly and reasonablyheld and accept liability for opinions givennegligently or fraudulently. Subject to theforegoing neither we the auctioneer or ouremployees or agents or the seller acceptliability for the correctness of suchopinions and all conditions andwarranties, whether relating todescription, condition or quality of lots,express, implied or statutory, are herebyexcluded. This Condition is subject to thenext following Condition concerningdeliberate forgeries and applies save asprovided for in paragraph 6 “information tobuyers”.

(2) Private treaty sales made under theseConditions are deemed to be sales byauction for purposes of consumerlegislation.

16. FORGERIES

Notwithstanding the preceding Condition,any Lot which proves to be a deliberateforgery (as defined) may be returned to usby you within 21 days of the auctionprovided it is in the same condition aswhen bought, and is accompanied byparticulars identifying it from the relevantcatalogue description and a writtenstatement of defects. If we are satisfiedfrom the evidence presented that the lot isa deliberate forgery we shall refund themoney paid by you for the lot including anybuyer’s premium provided that (1) if thecatalogue description reflected theaccepted view of scholars and experts asat the date of sale or (2) you personally arenot able to transfer a good and marketabletitle to us, you shall have no rights underthis condition.

The right of return provided by thisCondition is additional to any right orremedy provided by law or by theseConditions of Sale.

GENERAL

17. We shall have the right at ourdiscretion, to refuse admission to ourpremises or attendance at our auctions byany person.

18 (1) Any right to compensation for lossesliabilities and expenses incurred in respectof and as a result of any breach of theseConditions and any exclusions provided bythem shall be available to the sellerand/or the auctioneer as appropriate.

(2). Such rights and exclusions shallextend to and be deemed to be for thebenefit of employees and agents of theseller and/or the auctioneer who maythemselves enforce them.

19. Any notice to any buyer, seller, bidderor viewer may be given by first class mailin which case it shall be deemed to havebeen received by the addressee 48 hoursafter posting.

20. Special terms may be used incatalogue descriptions of particularclasses of items (Books, Jewellery,paintings, guns, firearms etc) in whichcase the descriptions must be interpretedin accordance with any glossary orguidance notes appearing in thecatalogue. These notices and terms willalso form part of our terms and conditionsof sales.

21. Any indulgence extended to biddersbuyers or sellers by us notwithstandingthe strict terms of these Conditions or ofthe Terms of Consignment shall affect theposition at the relevant time only and inrespect of that particular concession only;in all other respects these Conditionsshall be construed as having full force andeffect.

22. Scottish law applies to theinterpretation of these Conditions.
