    The Sawn Lake Program7 . Penn West o l d s a number of i n e r a l l e a s e s i n and around t h e Sawn and Haig Lakes r e a

    of Northern A l b e r t a , and has d e v e l o p e d a program t o develop t h o s e m i n e r a l l e a s e s ,c o n s i s t i n g of c o o r d i n a t e d and s e q u e n t i a l development s t e p s on v a r i o u s l o c a t i o n s ,i n c l u d i n g w e l l s i t e c o n s t r u c t i o n , d r i l l i n g , and c o m p l e t i o n s t h e Sawn Lake Program ).

    8 . The Lubicon Cree have c l a i m e d a b o r i g i n a l t i t l e i n and around t h e Sawn and Haig Lakea r e a s and c l a i m t o have t r a d i t i o n a l u s e a r e a s i n t h e l a n d s making up t h e Haig LakeProgram and many of h e r o a d s t h a t a c c e s s t h e Sawn Lake Program. Some of h e l a n d smaking up t h e Sawn Lake Program a r e i n c l u d e d w i t h i n t h e a r e a f o r a proposed r e s e r v ef o r t h e Lubicon C r e e . No agreement a s been r e a c h e d between h e Lubicon Cree and t h ep r o v i n c i a l and e d e r a l governments i t h r e s p e c t t o t h e s e l a n d s .

    Consultation9 . Penn West a s f u l f i l l e d i t s o b l i g a t i o n s t h a t have been d e l e g a t e d by t h e Crown o c o n s u l t

    and accommodate w i t h t h e Lubicon Cree w i t h r e s p e c t t o t h e Sawn Lake Program.

    1 0 . I n 2011 and 2012, Penn West o n s u l t e d w i t h t h e LLN and Ominayak i n r e s p e c t of h eSawn Lake P r o j e c t , i n c l u d i n g f o r t h e a p p r o v a l of L i c e n s e s of Occupation f o r a c c e s sr o a d s , s u r f a c e l i c e n s e s f o r d r i l l i n g and c o n s t r u c t i o n a c t i v i t i e s and w e l l l i c e n c e s . As a r a si s known o Penn West, Omi nayak was h e Chief of h e LLN n t i l February 1 5 , 2013.

    1 1 . On r about February 25, 2013, and a t l l t i m e s s u b s e q u e n t , t h e Government of l b e r t ahas i n s t r u c t e d Penn West o d i r e c t l l a c t i v e and ongoing c o n s u l t a t i o n w i t h t h e LubiconCree o Chief i l l y Joe Laboucan Chief Laboucan ) and h i s c o n s u l t a t i o n c o n t a c t , a s t h eGovernment of l b e r t a and Canada r e c o g n i z e d Chief Laboucan a s t h e e l e c t e d Chief oft h e Lubicon Cree under l e c t i o n s h e l d on February 1 5 , 2013.

    1 2 . S i n c e February 25, 2013, Penn West has communicated w i t h Chief Laboucan and t h ed e s i g n a t e d c o n s u l t a t i o n a g e n t of h e LL n r e l a t i o n t o t h e Sawn Lake Program.

    1 3 , On ovember 21, 2013 Ominayak and t h e C o u n c i l l o r Defendants n o t i f i e d Penn West ofan Order and C o u n c i l R e s o l u t i o n which o b j e c t e d t o Penn West's c t i v i t i e s i n t h e Sawnand Haig Lake a r e a s , and a s s e r t e d t h a t t h e s t r i c t e s t enforcement of h e Lubicon LakeNation laws i l l be p p l i e d ,

    Roadblock

    1 4 , On o r about November 26, 2013, a p p r o x i m a t e l y 18 i n d i v i d u a l s , i n c l u d i n g t h eDefendants, blockaded a p o r t i o n of h e Penn West c c e s s r o a d s on l a n d s d e s c r i b e d a s 3 -25-91-136 i n Northern S u n r i s e Country ( t h e Roadblock ). The Roadblock i s on ana c c e s s r o a d p u r s u a n t t o Licence of Occupation LOC 110648 i s s u e d t o Penn West byA l b e r t a S u s t a i n a b l e Resource Development on A p r i l 4, 2011. The purpose of t h eRoadblock s t o impede and p r o h i b i t Penn W e s t ' s l a w f u l o p e r a t i o n s i n t h e Sawn and HaigLake a r e a s , t o which t h e Defendants o b j e c t . Penn W e s t ' s a c t i v i t i e s i n c l u d e , among o t h e rt h i n g s , c o n s t r u c t i o n of a w e l l pad s i t e f o r d r i l l i n g of w e l l s ( t h e 3-25 Wells )a p p r o x i m a t e l y one i l o m e t r e s o u t h of h e Roadblock.

    1 5 . The Roadblock was i n i t i a t e d by, o r i n t h e a l t e r n a t i v e e r e c t e d a t t h e d i r e c t i o n o f ,Ominayak and h e C o u n c i l l o r D e f e n d a n t s .

    1 6 . The Roadblock h a s c o n t i n u e d and remains i n p l a c e a s a t t h e d a t e of h i s S t a t e m e n t ofClaim. The Defendants have p l a c e d v e h i c l e s and s t r u c t u r e s a c r o s s t h e roadway,p r e v e n t i n g t h e p a s s a g e of e h i c l e s , p e r s o n n e l and equipment o t h e Penn West i t e f o r t h e3-25 W e l l s .

    I n t e r f e r e n c e with Penn West Economic n t e r e s t s and Contractual e l a t i o n s

    1 7 . On r about December 9, 2013, t h e Defendants f o r m a l l y r e q u e s t e d T r i n i d a d D r i l l i n g( T r i n i d a d ) , Penn W e s t ' s d r i l l i n g c o n t r a c t o r a t t h e s i t e of a w e l l i n t h e Sawn LakeProgram and l o c a t e d a t 14-25 -091-13W5M a p p r o x i m a t e l y 1 km rom t h e l o c a t i o n of h eRoadblock, o immediately c e a s e l l d r i l l i n g o p e r a t i o n s . The Defendants were aware ofPenn W e s t ' s c o n t r a c t w i t h T r i n i d a d f o r d r i l l i n g a t t h e s i t e of t h e 3-25 Wells and t h e

    D e f e n d a n t s ' conduct was i n t e n d e d t o c a u s e , o r t o w i l l f u l l y i n d u c e , T r i n i d a d t o b r e a c h i t sc o n t r a c t w i t h Penn West.

    1 8 . At l l t i m e s , Penn W e s t ' s a c t i v i t i e s have been l a w f u l l y conducted i n a c c o r d a n c e w i t h l ln e c e s s a r y p e r m i t s and l i c e n s e s i s s u e d by a p p l i c a b l e a u t h o r i t i e s .

    1 9 . I n d i r e c t i n g , e r e c t i n g and m a i n t a i n i n g t h e Roadblock a s d e s c r i b e d , t h e Defendants havei n t e r f e r e d w i t h Penn W e s t 's l a w f u l r i g h t t o use and occupy i t s a c c e s s road o n l a n d sd e s c r i b e d a s 3 - 2 5 - 9 1 - 1 3 ( t h e Access Road ), and have i n t e r f e r e d w i t h Penn W e s t ' s r i g h to f use a s g r a n t e d by L i c e n s e o f Occupation No. LOC 10648, mong t h e r t h i n g s , t h eD e f e n d a n t s ' i n t e r f e r e n c e has p r e v e n t e d t h e f r e e a c c e s s t o , o r p a s s a g e o n and o v e r , o r t h eu s e o f t h e Access R o a d by a u t h o r i z e d Penn West c o n t r a c t o r s , c a u s i n g c o s t , d e l a y , an dh a r d s h i p t o Penn West.

    20. The D e f e n d a n t s ' a c t i o n s w i t h r e s p e c t t o t h e Roadblock amount t o an u n l a w f u li n t e r f e r e n c e w i t h Penn W e s t ' s economic i n t e r e s t s , and w i t h t h e r i g h t s g r a n t e d t o PennWest under LOC 110648, a s w e l l a s Mineral S u r f a c e Lease MSL 110673 and WellL i c e n c e s 0454377 and 0454404, s s u e d t o Penn West n J a n u a r y 2013.

    21. As a r e s u l t of Ominayak and t h e C o u n c i l l o r Defendants' d i r e c t i o n s and o t h e r D e f e n d a n t s 't r e s p a s s and i n t e r f e r e n c e w i t h Penn West and i t s employees, a g e n t s , and c o n t r a c t o r s 'r i g h t s o f p a s s a g e o n t h e Access Road, Penn West has s u f f e r e d damage i n c l u d i n g l o s s o fb u s i n e s s and g o o d w i l l and w i l l c o n t i n u e t o s u f f e r i r r e p a r a b l e damage and harm a s m o rec o m p l e t e l y d e s c r i b e d below.

    Injunction

    22. The c o n t i n u i n g Roadblo ck and a h a l t i n o p e r a t i o n s a t t h e Sawn Lake P r o j e c t w i l l c a u s ei r r e p a r a b l e harm and damages which cannot be r e a d i l y c a l c u l a t e d and compensated f o r i ndamages, I f Penn West i s u n a b l e t o complete i t s d r i l l i n g o p e r a t i o n s due t o t h eRoadblock, t h e n i t w i l l e x p e r i e n c e an i n d e f i n i t e d e l a y i n p r o d u c t i o n and revenues f r o mt h e 3-25 W e l l s . F u r t h e r , because o f t h e c o o r d i n a t i o n and s e q u e n t i a l development o f

    23. The u n l a w f u l a c t i o n s of h e Defendants w i l l have n e g a t i v e consequences f o r Penn Westi n t h e i n v e s t m e n t m a r k e t , and c a u s e f i n a n c i a l l o s s t o Penn West which i s d i f f i c u l t t oq u a n t i f y .

Penn West s e e k s s h o r t term and long term o r d e r s under t h e P u b l i c Lands A c t , o r i n t h ea l t e r n a t i v e , an i n t e r i m and permanent i n j u n c t i o n a g a i n s t t h e D e f e n d a n t s , r e s t r a i n i n g andp r o h i b i t i n g t h e c o n t i n u a t i o n of any r o a d b l o c k s u n l a w f u l l y e s t a b l i s h e d on a l l roadways i nand around t h e Sawn Lake a r e a , and i n p a r t i c u l a r t h e Access Road c o n s t r u c t e d on p u b l i cl a n d s p u r s u a n t t o LOC 10648, and from i n t e r f e r i n g w i t h Penn W e s t s o p e r a t i o n s i n andaround t h e Sawn and Haig Lake a r e a s .
