Michael Daugherty, Founder, President and CEO of LabMD Michael J. Daugherty, is Founder, President, and CEO of LabMD, a cancer detection laboratory based in Atlanta, Georgia, as well as the author of the book The Devil Inside the Beltway. Because of his work, Mike has testified before the House of Representatives House Oversight Committee and regularly keynotes in front of healthcare, law, business and technology audience educating them on what to expect when the Federal Government investigates you. He holds a BA in Economics from University of Michigan-Ann Arbor, regularly blogs at MichaelDaughtry.com, is Senior Writer for CyberDefense Magazine, and sits

on the board of Snoopwall, a privacy company based in Nashua, New Hampshire.

The LabMD case, not overturned in the appeals process, will have major impact on all of healthcare. Data that the FTC considers exposed or vulnerable will be considered in violation of Section 5 of the FTC act...without a hack, breach or victim. Michael will expose the powers and behaviors of the Federal Trade Commission via his riveting story about his going battle with the FTC. The FTC has finally placed their cards on the table. Their verdict: If you have data that is exposed or vulnerable, but not hacked or breached, and without a single victim, you are violating the FTC Act. Mike will illustrate how far the FTC will go when challenged. Now landing at the US Court of Appeals, this landmark case is destined for the Supreme Court and will impact organizations large and small

Pepper Crutcher, Balch & Bingham R. Pepper Crutcher, Jr. is the leader of Balch & Bingham’s Affordable Care Act compliance practice (see www.acareview.com), the ACA Strategists, and is based in the firm’s Jackson, Mississippi office. Mr. Crutcher has helped develop ACA compliance software, has negotiated ACA compliance terms of union contracts and regularly speaks and writes about employer, broker and insurer ACA compliance. His litigation docket normally includes labor arbitrations, administrative proceedings and discrimination, retaliation, compensation and employment contract suits. Mr. Crutcher also has defended consolidated, multi-district FLSA litigation and

Sarbanes-Oxley and False Claims Act whistleblower investigations and suits. Pepper has more than 30 years of experience navigating complex labor and employment issues and regularly advises employers, employer organizations and allied interests regarding their ACA obligations.

Tony Maida, McDermott Will & Emery LLP Tony Maida is a partner in the law firm of McDermott Will & Emery LLP and is based in the Firm’s New York office. Tony has extensive experience in health care fraud and abuse and compliance issues, including the federal Anti-Kickback and Physician Self-Referral/Stark laws, false claims and overpayments, and government investigations. Tony previously served as a senior official in the Office of Counsel to the Inspector General at the United States Department of Health and Human Services, where he worked for nine years. As Deputy Chief of the Administrative and Civil Remedies Branch, Tony led a team of attorneys representing

the agency on False Claims Act and Civil Monetary Penalty Law cases, including conducting investigations and negotiating settlements and Corporate Integrity Agreements in some of the largest settlements obtained by the United States. He participated in defending the OIG in numerous exclusion appeals, including appeals pursued by high-level corporate executives. Additionally, Tony was the principal author of the OIG's current Self-Disclosure Protocol and the 2009 Open Letter, and was the principal author of the Notice of Proposed Rulemaking for the OIG's civil monetary penalty authorities. He has also advised at the Centers for Medicare and Medicaid Services on policy issues, including the Medicare and Medicaid Overpayment Rule, and has lectured on health care fraud and abuse issues.

CONTINUING EDUCATION CREDIT:

Attorneys - A total of 12.5 MCLEs, the total number of hours needed by attorneys for the end of the year, has been approved for continuing education by the Louisiana State Bar Association for complete attendance of the program, which includes ethics and professionalism.

Nursing - 12.5 contact hours will be awarded for this offering by the Louisiana Hospital Association for complete attendance of the program. The Louisiana Hospital Association is approved by the Louisiana State Board of Nursing Continuing Education (CE) Provider #39.

Other participants will receive, upon completion of the workshop, a certificate documenting the completed continuing education/clock hours.

REGISTRATION INFORMATION: This seminar will be conducted at the LHA Conference Center located at 2334 Weymouth Drive in Baton Rouge. The fee for members of the society or hospital member employees/per person is $350, and $450 for non-members. Seminar includes printed materials, lunch and refreshment breaks. You may elect to attend one day only for a fee of $200 for members and $300 for non-members. Lunch is provided each day. If you wish to participate in only the professionalism or ethics session, the fee is $100 per session.

A member is qualified as an individual employed by a hospital that is a current dues-paying member of the LHA or the Louisiana Society of Hospital Attorneys; a non-member would be any other individuals. Registrations may be mailed or faxed directly to the LHA. Registrations that are mailed must include payment by check or credit card. All major credit cards are accepted. You may also fax your registration form to (225) 923-1004, with a Visa, MasterCard, Discover or American Express number. Registrations by fax will be accepted if method of payment is indicated on registration form (check being mailed, etc.). All information is handled through a confidential fax and blotted out before it is forwarded to the registrar. Registration forms must be received into the LHA office by 5:00 p.m. one week prior to the scheduled event date. This applies to registrations that are received by mail or fax. An email confirmation will be forwarded to all registrants who list an accurate email address. Registrations may be confirmed by phone. It is recommended that a copy of your registration form be faxed to LHA prior to submitting it to your facility’s accounting department in order to reserve your seat in the symposium.

CANCELLATION/REFUND POLICY: We realize that problems can occur that may necessitate registration cancellations. Cancellations received in writing up to one week prior to a scheduled event will be charged a cancellation fee of $75. This fee covers some of the administrative costs associated with processing refunds, and printing costs for handout materials. Cancellations received less than one week prior to the scheduled event or those who fail to attend are non-refundable. Registrants who are unable to attend are permitted to, and encouraged to, send a substitute without incurring a cancellation fee. Please send written notice of any substitutions prior to the scheduled event. TRANSFER POLICY: If you are unable to attend the program for which you have registered and choose not to send a substitute, you may transfer your registration to another program. The LHA will hold your credit for a period of one year following the start date of the program for which you were originally registered. Transfers must be made in writing prior to the scheduled event, and a $40 transfer fee will be charged. Conference Center Directions: The Louisiana Hospital Association Conference Center is located just across the street from the LHA Headquarters Building at 2334 Weymouth Drive. From I-12, exit Airline Highway North, go to the 2nd red light – Old Hammond Highway and turn left. Turn Left at the next light onto Drusilla Lane. At the 2nd street, Brookline Avenue, turn left. The first block on the left is Weymouth Drive. Turn left onto Weymouth Drive and the Conference center is the second driveway on the left.
