There are few things more important than how we care for the elderly, vulnerable and infirm. At Lodders, we’re experts in helping our clients and their carers to manage the legal issues that affect them. We also understand that planning for the future means preparing for the unexpected.

From our Care & Capacity hub in Henley in Arden, Lodders’ dedicated team provides advice and support to clients on a variety of complex matters. We prepare Lasting Powers of Attorney for elderly clients, trustees, and business owners, and advise on applications to the Court of Protection for the appointment of Deputies, or for statutory wills or gifts to be authorised.

We help clients understand the types of long term care and funding options available, and challenge fee decisions made by the NHS and local authorities. We also look after the finances of vulnerable clients who need extra support.

Enduring Powers of Attorney (EPAs) and Lasting Powers of Attorney (LPAs)Should you need to rely on someone to assist with your finances in the future, Lodders can help.

It can be a complicated and highly specialised procedure, with three separate areas to deal with: EPAs, Personal Welfare LPAs, and Property and Affairs LPAs. It is vital that professional advice about these documents is sought before they are prepared or registered. In this way, we help you to make sure that procedural requirements are followed, and that all duties and responsibilities are understood.

Court of ProtectionIf an individual loses the capacity to deal with their affairs before they’ve prepared an EPA or LPA, it is necessary to apply to the Court of Protection to appoint a deputy. This can be a family member, friend or professional advisor. For the first time, a person can now apply to be a ‘health and welfare’ deputy as well. At Lodders, we understand that the procedure involved in appointing a deputy is complicated. We will make this as straightforward as possible, while providing advice to attorneys and deputies preparing accounts, making gifts and applying for statutory wills.

Nursing and care homesNot only is choosing a long-term care or nursing home a very important decision, the worries about funding this choice can be daunting. Lodders’ team will help you to understand the choice of homes available and how you can fund them. This includes researching your eligibility for fully-funded NHS care, for which many clients have been told, incorrectly, that they do not qualify. We can help you to challenge these decisions if you feel you have been wrongly assessed.

The service we have received from Lodders has been very efficient, kind and understanding.
