Section 1. Section 62-1 of Chapter 62 of the Code of the City of Albany shall be amendedto read as follows:

and the failre to move into the City! shall be deemed a volntary resignation. The City may

re"ire annal proof of residency from affected employees.

. %oard of esidency. There is hereby created by this section a %oard of esidency. This %oard

shall consist of five members and shall consist of the 4ayor of the City of Albany or the4ayor5s appointee! the Corporation Consel of the City of Albany or a representative of the

Corporation Consel and three Concil members. All members of this %oard shall be City of

Albany residents. The %oard shall have the following powers and obligations:

17 The %oard shall meet within 8+ days pon receipt of a written re"est of the 4ayor or 

independently elected or appointed official heading an office! to ma&e a determinationgranting or denying a one year waiver of the residency re"irement for prospective

employees. The granting of the waiver e#empts said employee from the provisions of this

section for a one year period. This determination shall be based pon one or more of the

following criteria: a7 the degree of speciali'ation and professionalism re"ired in any

given field of employment( b7 the e#istence of hardship sch as may be determined bythe %oard( and c7 the lac& of "alified candidates residing within the City. A re"est for

an e#tension of the waiver may be made and determined in the same manner providedherein for the initial re"est.
