What an incredible part of the world Queensland is. 3 weeks ago our biggest concern was bushfires and how little rain we had, and now we are seeing total devastation due to rain and flooding. Our hearts go out to those who have lost so much.

A: No GST is payable on the purchase of a residential property.

Q: “I moved into my new acreage property and have been told there is an easement on my property, when the searches were done I was not made aware of the easement. What can I do?” Ron Wearmouth, Pacific Pines.

A: The vendor is liable to disclose all title encumbrances on the contract. If there is an easement you may have had a right to terminate the contract but you would have had to exercise that right prior to settlement. You may still be entitled to damages. You may also have a cause of action against the lawyer who represented you in the purchase. I would seek their explanation as a starting point.
