• Description: The site is shown on Drawing L(63)001.The site is 5 minutes from the A92 and within easy drivingdistance of Central Scotland.The site is within Lochgelly Public Park.

The site is within Lochgelly Public Park. The area will require tohave a perimeter identified around the several operations,securely maintained throughout the duration of the works andwith appropriate protection and signage as the park will remain open to the public throughout the works.The area of the site willrequire to be safely and securely cordoned off.

The site is located adjacent to retained tree and shrub areaswhich will need to be protected during the Works to ensure absolutely no damage is caused to thetrees and shrubs. Permission to remove any shall be required bythe Contract Administrator in advance of such action.

The precise location and extent of existing services within andadjacent to the Site are not fully known. Whilst the ContractAdministrator will furnish available reports/drawings and other information to the Contractor to assist in locating services, it willbe the responsibility of the Contractor to ascertain the locationand extent of existing services within and adjacent to the Site, tocarry out investigations as appropriate by locating the preciseroutes of known services prior to works, to ensure that risks fromforeseeable health and safety hazards are minimised or eliminated.It will also be the Contractor's responsibility to protect all suchservices that are to remain in position throughout the duration of the Works.Most information is known, however due to the age of the sitethere remains a risk that services may exist unmapped.No guarantee can be given as to the accuracy of the servicesinformation.

The Contractor shall allow for all costs associated withalterations to and/or relocation of any utilities made necessary bythe Works whether specifically identified, or not, unlessprohibited by Legislation or inconsistent with Good IndustryPractise.

If any damage to existing utilities results from the execution of the Works, the Contractor shall immediately:

" notify the utility provider and the Authority'srepresentative and

" make arrangements for the work to be made goodwithout delay to the satisfaction of the relevant utility provider and the Authority's representative .

170A SITE INVESTIGATION• Reports for the site in general: Available upon request via the

Public Contracts Scotland web portal for the project. Refer toClause A11/180 for further details.Contractor to carry out own site investigation for the modular building facility, to use in the design of the foundations etc. andbare all costs.

200 ACCESS TO THE SITE

• Description: Access to the site will be via busy public roads fromThe Avenue.

• Limitations:Access must be maintained to the surrounding houses at alltimes.The Contractor will be required to liaise with the RoadsDepartment of Fife Council Transportation and the Police andtheir own CDM Co-ordinator/support in order to fully ascertain allrestrictions that will apply to the movement of traffic in the vicinityof the areas of the Site.

The Contractor will also take account of all working restrictions(see Section A35).It is specifically drawn to the Contractor's attention that thepedestrian routes around the perimeter and in the vicinity of theSite will continue to be used by the public throughout theduration of the Works. The Contractor will be responsible for allhealth and safety measures/precautions considered necessaryto allow the execution of the Works whilst maintaining the safetyof the public generally at all times.Following approval of the Contractor's proposed accessarrangements to the Site the Contractor must ensure that sucharrangements are strictly adhered to.Notwithstanding the foregoing, the Contractor's detailed accessarrangements will be the subject of discussion and agreementbetween the Contractor, Fife Council Transportation and theContract Administrator prior to commencement of the Works.

A site visit is recommended to ascertain any further limitations.

205 TRAFFIC MANAGEMENT PLANDescription: [The Contractor will be required to prepare a Traffic ManagementPlan, fully taking into account all of the requirements of theRoads Department, the Police and theIE CDM Co-ordinator,which will include details of the Contractor's proposed arrangements for gaining access to and from the Site duringeach part of the Works.

The proposed Traffic Management Plan must be submitted indraft form with the Tender and the Contractor will then berequired to further develop the Traffic Management Planfollowing appointment for review and approval by the ContractAdministrator prior to commencement of the Works].Limitations: [The traffic management plan shall include, but not be limited to:

" the maintenance of existing traffic routes;

" the separation of plant and vehicles from pedestrians;

" the control of reversing or slewing operations, the use of high visibility clothing; and

" the arrangements for deliveries by large vehicles to allow safe access and egress.

The Contractor shall ensure that operatives vehicles and sitetraffic park within the site area.

The Contractor shall ensure that all his car parking areas andmain access routes are surfaced with appropriate material to asuitable depth and adequately maintained

210 PARKING• Restrictions on parking of the Contractor's and employees'

vehicles:Traffic must be planned in advance to ensure it can access thearea of the site compound.Traffic Regulation Orders may be required for craneage and siteset up.Disruption to the adjacent access roads and access openingsduring the Works must be kept to a minimum.The Contractor will be required to develop a traffic managementand access strategy for the integration into the Works.

Parking of the Contractor's and employees' vehicles will be thesubject of discussion and agreement between the Contractor and the Contract Administrator prior tocommencement of the Works, but will generally be restricted tothe area of the Contractor's Site Compound.

If the Contractor chooses to create an area for operative parkingwithin the site, then any costs associated with the formation of a safe temporary car park (including returning this area to itsformer condition) shall be borne by the Contractor and includedwithin their tender.

The use of public car parking areas for the purpose of parkingContractor's and employee's vehicles will not be permitted.Reference should be made to Clause A12:200 above, regardingthe requirement for a Traffic Management Plan to be preparedby the Contractor, which will includedetails of the Contractor's proposed parking arrangements.The parking of the Contractor's and employees' vehicles will notbe permitted to cause obstruction on any public highways or thoroughfares or to obstruct access to any of thefacilities/properties that are located adjacent to or in the vicinityof the works at any time.

220 USE OF THE SITE• General: Do not use the site for any purpose other than carrying

out the Works.• Limitations: Do not display or permit advertisements without

consent of the Contract Administrator.

Permits/Approvals/Etc.: It will be entirely the responsibility of theContractor to assess/establish the requirement for allpermits/approvals/etc. necessary to allowthe execution of the Works (via any Local Authority or other regulatory body).It will be the responsibility of the Contractor to ensure that allapplications required for permits/approvals/etc. are lodged withthe relevant Authority personnelat the appropriate times so as not to affect the programme andprogress of the Works.The cost of all such requirements will be deemed to be includedwithin the Tender Amount.

Reinstatement: The Contractor may construct necessarytemporary access roads or hardstandings as required to carryout the Works. All areas affected by the carryingout of the Works will require to be fully reinstated on completion.The Contractor will also completely reinstate all damaged areasof paving, surfacing, finishes, landscaping etc arising from theexecution of the Works, including within the area of the SiteCompound and any temporary car parking and access roadnetwork, all to the original condition. The cost of all such worksshall be borne by the Contractor and included within the Tender Amount.

Cleanliness: The Site (including the area of the Site Compoundand any temporary car parking) and access road network, mustbe kept reasonably clean at all times.Footways, carriageways, public areas adjacent to the site, aswell as all visible aspects of the site activities such as hoardings, scaffolding and warning lights, are to be kept clean and in goodorder. Dust, smoke or other emissions are to be kept to aminimum. Mud and spillage are to be cleaned off pavements,roads and public areas as soon as practicable and where arisingfrom ongoing site operations, at frequent intervals.The following condition will likely be included within any detailedplanning consent - "Adequate wheel cleaning facilities approvedby Development Services in consultation with the Head of Transportation Services being provided and maintainedthroughout the construction works so that no mud, debris or other deleterious material is carried by vehicles on to the publicroads", and the Contractor will be deemed to have taken accountof this within his submission

Completion: Upon completion of all the Works, the Contractor shall leave the Site (including the area of the Site Compound andany temporary car parking) and access road network thoroughlyclean and shall brush / wash out all areas all to the satisfaction of the Contract Administrator.

Carriage of materials etc: The Contractor shall perform, at hisown cost, all carriage of materials for the Works, and shallconvey from the Site all surplus materials andrubbish rising therefrom and shall carry away from the Site thewhole of such rubbish etc to a place of deposit where he can obtain leave to lay it down (unless wherealternative arrangements are specifically described within the billof quantities).

Disposal: The Contractor must not use gullies or drains todispose of any materials including paint, turpentine, oils, etc.

The Contractor shall form a Site Compound at a suitable locationwithin the boundary of the Site. The Contractor must submit details of the proposed location together with the proposedlayout of the Site Compound along with the Tender.The Contractor's detailed proposals will be the subject of review and approval by the Contract Administrator prior tocommencement of the Works.

230 SURROUNDING LAND/ BUILDING USES

• General: Adjacent or nearby uses or activities are as follows:- Cognisance should be taken of the close proximity of existingbuildings which may be occupied during the Works.The Contractor must give due consideration to persons living inthe surrounding properties relative to the control of dust andnoise and for persons moving safely around the Site boundaries.The Contractor should also recognise and make due allowancefor potential security risks, including trespass, theft andvandalism.

240 HEALTH AND SAFETY HAZARDS• General: The nature and condition of the site/ building cannot be

fully and certainly ascertained before it is opened up. However the following hazards are or may be present:- Refer also to the Pre-construction health & Safety DocumentSafety hazardsBoundaries and access, including temporary access

Adjacent land usesLocation of existing services – water, electricity, gas etc includingoverhead power cables

Ground conditionsAny restrictions on deliveries or waste collection or storage .

• Information: The accuracy and sufficiency of this information isnot guaranteed by the Employer or the Employer'srepresentative. Ascertain if any additional information is requiredto ensure the safety of all persons and the Works.

250 SITE VISIT• Assessment: Ascertain the nature of the site, access thereto and

all local conditions and restrictions likely to affect the executionof the Works.

• Arrangements for visit: NoneTenderers will be deemed to have made a personal inspection of the Site of the proposed Works and to have fully acquaintedthemselves as to local conditions; accessibility of the Site; the fullextent and character of the operations; the risk of damage,disturbance or injury to property and/or facilities adjacent to theSite or to the occupiers and use of such property and/or facilities;the conditions under which the work will have to be carried out;the facilities for obtaining the materials or goods specified; andthe supply and conditions affecting labour and the execution of the contract generally.No extra will be allowed on account of any omission or error arising from a lack of such knowledge, nor shall any extras beallowed for multiple handling of materials within the Site or resulting from the means of access to the Site.

A13 DESCRIPTION OF THE WORK

120 THE WORKS

• Description:The works comprise the preperation, excavating, backfilling andformation of a skatepark basin in concrete with railing featuresand a dedicated floodlighting installation

Landscaping works, generally.Landscaping works will include:- removal and replanting or trees as quantified- amenity turf for areas around the concrete skatepark basin.

The Works means the whole of the works referred to anddescribed in the tender drawings/documents, including thedesign, construction, fitting out, equipping, and testing,commissioning and making good of all defects in relation to theproject as defined above.

The Contractor will be responsible for complying with Planning,Development and Building Control requirements and will obtainall necessary statutory approvals and consents prior tocommencing work on the site, includingBuilding Warrant and Planning Permission.The Works will require Planning Permission.The Works will require a Building Warrant.* The Tenderer MUST include in their tender for any costsincurred in the submission and any subsequentrevision/resubmission of Building Warrant, Planning Permissionand any other permissions required *

The construction work will be carried out by the Contractor in atechnically proper manner and to generally be in accordancewith all current British Standards.All structural work has to be in strict accordance with themanufacturer's structural drawings & specifications.No manufacture/construction work shall be carried out by theContractor until Planning Approval and Building Warrant hasbeen obtained and Fife Council agreement is issued.All drawings are given for the manufacturer's general guidanceand he is to satisfy for himself all internal dimensions of theproposed building.All work to be carried out by a person skilled in this type of operation.The manufacturer is to verify all site dimensions before returningtender.The manufacturer to verify all dimensions before constructioncan begin.

The Contractor is responsible for preparing/submitting/completing following documentation will berequired within 4 weeks of appointment:- Complete planning and building warrant drawings.

165 EVALUATION OF TENDERIn evaluating the Tenders, the client shall determine eachsubmission on the basis of Value for Money and not necessarilylowest cost.The award process shall provide a fair, transparent andaccountable method for evaluating each Tender Submission onthe basis of balancing Quality with Price.The percentage split of Quality to Price will be stated in theevaluation documentation.The Quality aspect will be measured by analysing theinformation submitted by the tenderer against the weightings asset out in the evaluation documentation, but Tenderers mustensure that the selection information requested is complete andincluded with the returned Tender Document to progress to theassessment of the Quality aspect in the Evaluation Process.Only subsequent to this will the prices then be evaluated againstthe weightings as set out in evaluation documentation.

450 CONTRACT SUM ANALYSIS:Content of the Analysis: A breakdown of the Contract Sum intoat least the following categories:-A breakdown of the Contract Sum must be provided by theTenderers identifying itemised costs for each of the elementswithin the contract. Item costs may be used for simple and predictable variations, therefore it is required that they arecompleted, and carried forward to the Summary provided. - Prominent signage at the rear of the vehicle to warn cyclists of the dangers of passing the vehicle on the inside.

140 CLIMATIC CONDITIONS

210A PROGRAMME the Contractor is required to plan in detail theexecution of the Works; in accordance with the requirements of the working arrangements as detailed elsewhere within thetender documents, to meet the programme for the execution of the whole of the Works covered by the Contract, using approvedmethods and within the time required to suit progress andcompletion of the whole of the Works as stated in the ContractParticulars and taking into account any requirement for sequencing the works if noted within the Tender Drawings.

The programme is to cover all activities for which the Contractor and his Subcontractors are responsible and those for which theContract Administrator and Consultants are responsible to theContractor e.g. issue of Working Drawings, approvals and theissue of instructions regarding the expenditure of ProvisionalSums.

Additionally, the Contractor must allow and build in to hisprogramme reasonable times for all associated works to becarried out by Utility Companies (e.g. Electricity, Gas, Water,Telephones, etc.) and for works to be carried out by personsemployed direct by the Employer within the overall ContractPeriod for the Works (refer to A50/110).

Submission: The Contractor must submit to the ContractAdministrator, for approval, his detailed programme showing allactivities with duration times arranged to meet the completiontime for the Works within two weeks of the acceptance of theTender and in advance of the commencement of any part of theWorks.

Approval: Approval of the programme by the ContractAdministrator is not to be regarded as indicating that theEmployer or the Contract Administrator accepts that theContractor will be in a position to carry out the Works inaccordance with the detailed programme.

Draft Programme: Submit a draft copy of the Master Programme with the Tender.

Review: During the progress of the Works, the completeprogramme is to be reviewed every week and compared withactual progress. The Contractor shall provide, to the ContractAdministrator, detailed weekly trade-by-trade progress reportsand site labour records. The Contract Administrator shall haveaccess to the Contractor's/Sub Contractors' labour wage sheets.If it is shown by reviews of the programme that the execution of the work is not in accordance with the programme and the Workswill not be completed by the Date for Completion, the Contract Administrator shall have the power to instruct the Contractor toprovide additional labour or plant, increase working hours or toimplement whatever means are deemed necessary to completethe Works by the Date for Completion. Additional costs incurredin complying with the Contract Administrator's instructions in thisregard shall be borne by the Contractor.

260A SITE MEETINGS• General: Site meetings will be held to review progress and other

matters arising from administration of the Contract.The Contractor shall ensure that representatives of the Councilare afforded an opportunity to attend (and the Authority shalladhere to all health and safety rules/ requirements) all sitemeetings relating to the Works and that agendas for suchmeetings are received by the Authority a minimum of 2 businessdays prior to the meetings and (whether or not suchrepresentatives have attended) that a copy of the minutes of sitemeetings is supplied promptly to the Authority.

• Frequency: Every two weeks.

• Location: Within the Contractor's accommodation on the Site.

• Accommodation: Ensure availability at the time of suchmeetings.

• Attendees: Attend meetings and inform subcontractors andsuppliers when their presence is required.

• Chairperson (who will also take and distribute minutes): ContractAdministrator.

Information to be submitted at meeting: Contractors ProgressReportSubmit a progress report at the site meeting.Content: Notwithstanding the Contractor's obligations under theContract the report must include: -- A progress statement by reference to the master programmefor the Works.

- Details of any matters materially affecting the regular progressof the Works.

- Subcontractors' and suppliers' progress reports.- Any requirements for further drawings or details or instructions.

- Health and Safety report.- a dated digital photographic record of the progress internallyand externally with particular attention to works executed inthe preceding month. Two copies of the photographic recordshall be provided to the Authority on separate CDs in a formatto be agreed by the parties.

270 EXTENSIONS OF TIMENotice: When a notice of the cause of any delay or likely delay inthe progress of the Works is given under the conditions of contract, written notice must also be given of all other causeswhich apply concurrently. Details: As soon as possible submit: -- Relevant particulars of the expected effects, if appropriate,related to the concurrent causes.

- An estimate of the extent, if any, of the expected delay in thecompletion of the Works beyond the date for completion.

415 WORKS IN CONNECTION WITH NEW SERVICESWork Beyond the Boundary of the SiteWhere work is being executed beyond the boundary of the Siteor in the public highway, the Contractor shall be responsible for the provision of all watching, lighting, traffic signalling, temporarybarricades, walking platforms and warning notices required toensure the safety of all persons. The Contractor will also beresponsible for removing the same on completion, giving allnotices to the relevant authorities, paying relevant fees andcharges and carrying out the work to the satisfaction of suchauthorities

560 TESTS AND INSPECTIONS• Timing: Agree and record dates and times of tests and

inspections to enable all affected parties to be represented.• Confirmation: One working day prior to each such test or

inspection. If sample or test is not ready, agree a new date andtime.

610 DEFECTIVE PRODUCTS/ EXECUTIONS

• Proposals: Immediately any work or product is known, or appears, to be not in accordance with the Contract, submitproposals for opening up, inspection, testing, making good,adjustment of the Contract Sum, or removal and re-execution.

• Acceptability: Such proposals may be unacceptable and contraryinstructions may be issued.

620 EMERGENCY REMEDIAL WORKThroughout the duration of the Contract, including the DefectsLiability Period, the Contract Administrator or his representativemay, whenever he considers it necessary so to do, issueinstructions including verbal instructions, requiring any defect,shrinkage, frost damage or other fault, which he may deem anemergency, to be made good and the Contractor shall forthwithcomply with the same and (unless the Contract Administrator shall otherwise instruct, in which case the Contract Sum shall beadjusted accordingly) entirely at his own cost.If within four hours after receipt of an instruction issued under Emergency Remedial Work the Contractor does not comply therewith, then the Employer may employ and pay other personsto execute the emergency repair and all costs incurred inconnection with such employment may be deducted by him fromany monies due or to become due to the Contractor under thisContract or may be recoverable from the Contractor by theEmployer as a debt.In order to comply with any instructions issued under Emergency Remedial Work The Contractor shall maintain a guaranteed emergency repair service which shall be available twenty-four hours per day and seven days per week.The Contractor shall state the names and telephone numbers of his representatives to whom instructions issued under Emergency Remedial Work may be given. The Contractor shall be responsible for the observance of thisCondition by Sub Contractors employed in the carrying out of theWorks.

710 PRACTICAL COMPLETION AND HANDOVER

The Contractor must comply with the following handover procedure at the completion of the work: -

- Stage 1 – The Contractor must conduct the snagging and thenbring this work forward at a stage where the items have beenreduced sufficiently to be acceptable for inspection by theContract Administrator. The number of items which theContract Administrator is prepared to accept is ten; if there aremore than ten items the Contract Administrator will deem theWorks not acceptable for design team snagging.NB – The term snagging shall mean incomplete, outstanding and unsatisfactory Works.

- Stage 2 – On the Contractor's request, the ContractAdministrator will inspect the areas concerned, and completeand issue snagging lists.

- Stage 3 – When the Contract Administrator and theContractor's Site Representatives are satisfied that virtually allthe items on these lists have been made good, aPENULTIMATE inspection will be held. This inspection is themain technical inspection attended by the Contractors, theContract Administrator, Employer's Representatives, etc. If atthis meeting the Contract Administrator finds the Worksacceptable for handover, then it will be followed a few dayslater by Stage 4

- Stage 4 – The Final Handover attended by the Contractor, theEmployer, Contract Administrator, etc. If Stage 3 above hasbeen effectively carried out, this final stage should only entailthe clearing of a minimal number of items followed by the finalstage cleaning/clearing up. The inspection itself should thenbe reduced to a rapid walk over the areas concerned, i.e. itshould be a very much shorter process than the penultimateinspection. The key to speed and the smoothness in thisprocedure lies in Stage 1.

- It should be noted that it is a pre-requisite of the issue of aCertificate of Practical Completion and all Operational andMaintenance Manuals and Maintenance and CleaningInstructions required to be provided for the Works are handedover prior to Practical Completion, failing which the Certificateof Practical Completion will be withheld.

- Stage 5a – Eleven months after practical completion, theContract Administrator will carry out a detailed inspection of the externals to determine the Extent of the Works requiringattention under the terms of the Contract.

- Stage 5b – Following this a meeting attended by the Contract,Contract Administrator and the Employer's Representative willbe held to finalise the Schedule of Defects. This Schedule willbe delivered formally to the Contractor within fourteen days of

- Stage 5c – The Contractor is then required to carry out theWorks within a reasonable period of time from the date of receipt of the Schedule of Defects. Upon its completion theContract Administrator will inspect these Works and if, in hisopinion, these have been satisfactorily completed, then aCertificate of Making Good Defects will be issued.

720 SECURITY AT COMPLETION

• General: Leave the Works secure with, where appropriate, allaccesses closed and locked.

• Keys: Account for and adequately label all keys and hand over toEmployer with itemized schedule, retaining duplicate schedulesigned by Employer as a receipt.

730 MAKING GOOD DEFECTS

• Remedial work: Arrange access with Contract Administrator.• Rectification: Give reasonable notice for access to the various

parts of the Works.• Completion: Notify when remedial works have been completed.

735 SHRINKAGEAll defects and cracks caused by shrinkage of the Works(including materials in accordance with the Contract) will beconsidered to the Contractor's defects and will be made good,including all associated redecoration, by the Contractor at hisown expense, as required by the Contract Administrator.

150 SECURITY• Protection: Safeguard the site, the Works, products, materials,

and any existing buildings affected by the Works from damageand theft.

• Access: Take all reasonable precautions to prevent unauthorizedaccess to the site, the Works and adjoining property.

• Special requirements: Security must be maintained at the Siteand consequently the undernoted instructions, where applicable,must be strictly enforced: -- The Works must be kept as secure as possible at all times andparticularly at the close of each day's work. This requirement willinclude the protection of any openings in external walls or groundworks with suitably boarding.- The Contractor will be entirely responsible for the security of the Site and the Site Compound. As a minimum the Contractor will provide Heras, or equivalent, temporary fencing to the perimeter of the Site Compound.- Adequate temporary hoardings shall be erected and maintainedas necessary to prevent unauthorised persons from gainingaccess to the Works- Precautions must be taken with any external scaffolding tomake it as secure as possible against unauthorised access.- Where appropriate, lighting should be left on at night and floodlighting used to illuminate open areas of the Site and scaffolding.The Contractor shall meet all costs associated with themaintenance of the permanent lighting installations in andaround the site, including all temporary power supplyrequirements particularly during periods of interruption to themains power supply- All ladders, welding equipment, workmen's tools, machineryand vehicles, must be removed from the Site or securely lockedaway at the end of the day and NOT left unprotected on the Sitewhere they could be of use to criminals.Precautions should also be taken with valuable materials, suchas electrical equipment, which could be stolen or damaged.- The Contractor must appoint a senior member of staff to be incharge of late/ overtime working. This person will be heldresponsible for making the site secure at the close of eachday's/night's work, which will include closing and securing allgates.- The Contractor shall post all necessary signage notices as arerequired by Legislation, Approved Codes of Practice or GuidanceNotes to warn persons of the Works in progress and to indicateareas where entry is prohibited. .

210 EMPLOYER'S REPRESENTATIVES SITE VISITS• Safety: Submit details in advance, to the Employer or the person

identified in clause A10/140, of safety provisions and procedures(including those relating to materials, which may be deleterious),which will require their compliance when visiting the site.

• Protective clothing and/ or equipment: Provide and maintain onsite for the Employer and the person stated in clause A10/140and other visitors to the site.

230 SAFETY AND WELFARE REQUIREMENTS

Requirements: The Contractor shall ensure that all safety andwelfare measures required under or by virtue of the provisions of any enactment or regulations, or the working rules of anyindustry are strictly complied with.The Contractor shall provide and maintain on the Site allnecessary facilities for his own employees, for those employedby nominated and other Sub Contractors and for Contractors andothers employed direct.All Contractor's employees must wear suitable and clean safetyclothing and equipment as required for the trade and worksbeing undertaken and in accordance with British Standardsrequirements. Clean protective clothing must also be worn whenworking on the Employer's premises. The Contractor shall, prior to commencement of the Works, bebound to consult with the Contract Administrator and/or CDM Co-ordinator, to ensure that the current national/local Safety, Healthand Welfare Regulations will be complied with during thecarrying out of the Works.In accordance with Chapter 37, Part 1, Section 2, Clause 3 of theHealth and Safety at Work Act the Contractor shall maintain awritten statement, updated and revised as appropriate, of his general policy with respect to the health and safety at work of hisemployees and the organisation and arrangements for the timebeing in force for carrying out that policy. The statement must beexhibited to the Architect/ContractAdministrator and/or CDM Co-ordinator when so requested.The Architect/Contract Administrator and CDM Co-ordinator shall, at all reasonable times, have access to the Works and tothe workshops or other places where work is being prepared for this Contract.The Architect/Contract Administrator may issue instructionsrequiring compliance with the said Regulations.

330A NOISE AND VIBRATIONStandard: Comply with the recommendations of BS 5228-1, inparticular clause 7.3, to minimize noise levels during theexecution of the Works.Equipment: Fit compressors, percussion tools and vehicles witheffective silencers of a type recommended by manufacturers of the compressors, tools or vehicles.Restrictions: Do not use:- Pneumatic drills and other noisy appliances: Contractor to giveprior notice to the CA and limit noise as reasonably practical.

- Radios or other audio equipment or permit employees to usein ways or at times that may cause nuisance.

Generally: The Contractor will be required to discuss andagree the time of any work that is considered likely to cause adisturbance. Such discussions must be held with the ContractAdministrator well in advance of the intended dates for carrying out the Works.

340 POLLUTION• Prevention: Protect the site, the Works and the general

environment including the atmosphere, land, streams andwaterways against pollution.

• Contamination: If pollution occurs inform immediately, includingto the appropriate Authorities and provide relevant information.

350 PESTICIDES

• Use: Not permitted.

360A NUISANCE

• Duty: Prevent nuisance from smoke, dust, rubbish, vermin andother causes.

• Surface water: Prevent hazardous build-up on site, inexcavations and to surrounding areas and roads.The Contractor shall adequately maintain approaches to the siteand keep such free from mud and debris. All vehicles must becleaned, with any mud or loose debris removed, prior to thevehicles leaving the site. The Contractor shall, as necessary,provide facilities for washing down site vehicles before leavingthe site, to avoid contamination of the surrounding roads. Anycontamination of surrounding roads by site traffic shall beremoved immediately by the Contractor. Planning restrictionsmay also apply and, if incompatible with the foregoing, theplanning restrictions will prevail.

370A ASBESTOS CONTAINING MATERIALSDuty: Report immediately any suspected materials discoveredduring execution of the Works.- stop all work in the area- evacuate and exclude everyone from the area- close, seal or lock off the area, where practical- do not remove any equipment or materials- Do not disturb.- Agree methods for safe removal or encapsulation.

All operatives who in the execution of instructed work, discover or uncover working material which may contain asbestos mustnot proceed with the work and report to their supervisor whoshall inform Fife Council property Services immediately for further instruction.

The CA will arrange for sampling and analysis to be taken byan organisation which can demonstrate conformance withEN45001, by accreditation with a recognised accreditationbody. In the event of an analysis providing proof of asbestosthe CA/Architect will instruct the contractor to arrange for theremoval by a specialist sub-contractor's compliance with allthe relevant regulations, and to the entire satisfaction of theHealth and Safety Executive and the EnvironmentDepartment.

Incoming Supply

The new installation will provide a supply to the new feeder pillar/dedicated sub-distribution board.

The Contractor is to provide background and supports for meter and control equipment, cost to be included within billed items.The contractor is to provide a pillar, complete with associatedfoundations, cost to be included within billed item for same.The contractor is responsible for making good existingpavements/roadways /hard/soft landscaping to match existingand temporary road closures, and must bear said costs and beincluded against this Clause].
