WHEREAS

A. llUM is an established university which strives to enhance andstrengthen its academic excellence and has taken variousinitiatives to complement its educational excellence. llUM hasentered into various collaborative arrangements with otherparties to intensify its research excellence.

B. UMY is established higher learning institutional whichincorporates modern sciences and knowledge with lslamicShariah. The Parties are desirous of enter;ng into thisMemorandum of Agreement to declare their respective intentionand to establish a basis for cooperation and collaborationbetween the Parties upon the term as contained herein.

STUDENT EXCHANGE

Student exchange shall be on a one-to-one basis. The normalperiod shall be in one semester. ln principle, each university maysend up to 3 (three) students for that determined periodconsecutively.

Every effort shall be made to keep the exchange in balance eachyear. The absence of exchange during any academic year ispossible and does not nullify this agreement.Students may sit in any course offered by the host institutions forwhich they have the pre-requisite preparation, subject toavailability of space in the course requested.Each participant in the exchange shall be treated accordingly as

the students of the host institutions and will be expected to abideby rules and regulations of the host university.

The host university may allow and facilitate the participants in

taking part in any students'cultural and educational activities.The host university may provide accommodation and otherfacilities for the participants during the program.

CTAUSE 2

DURATION

This agreement shall operate from the date of signing for 5 years

and may be subjected to revision or modification by mutualagreement.

This agreement shall is automatically renewable on the sameterms and conditions every 5 years unless written notification is

given by either institution at least three (3) months prior to thedetermination date.

Notwithstanding the above, either institution may terminate theAgreement by giving written notice of no less than 6 months.

CLAUSE 3

SELECTION CRITERIA

The exchange program is open to qualified undergraduatestudents who have completed at least one year of undergraduatestudy. ln the special cases, application from graduate studentsmay be considered within the term of this agreement.Participating students normally shall be selected by the homeinstitution on the basis of academic merit and suitabilityundertaking its normal admission procedures.

lf the receiving institution rejects any application, the sendinginstitution may nominate additional application for considered.

STUDENT OBLIGATIONS

The obligations of the participant students shall be jointly

determined by the institutions, consistent with the following

princjples:

Exchange students are responsible to pay any related expenses to

their home institution.

Exchange students are responsible for their own transportation to

the host institution.

3. Exchange students are responsible for their own financial support

which includes living a4{ personal expenses. The host institution

bears no responsibility for providing funds to an exchange student

expect for accommodation and other facilities.

4. Exchange students shall abide by the laws of host country.

Each institution shall provide exchange students with a contact

person who will .be responsible for assisting students with the

arrangement of the program and other welfare issues.

A pre-departure information package shall be sent to all incoming

exchange students, which may include advice on the transfer from

the nearest major airport to campus and other information to

facilities a student's arrival on campus.

The obligation of each institution under this agreement are

limited to the exchange participant only and do not extend to

spouses or dependents.

.1. To the extent appropriate in the institution's judgment, and to theextent consistent with the institution's policies and procedure andapplicable laws, each institution may use reasonable efforts toassist its participa nts.

CTAUSE 6

ACADEMIC COOPERATION

It is the intention of both institutions to promote and encourage a

broad range of academic cooperation outside the student exchange

arrangements specified in this agreement. The scope of these

activities may include:

of mutual interest

2. Allowing publication of articles or research reports written by

staff of each party to this Agreement in its Academic Journal

reciprocally.

3. Sharing of experience in innovative teaching, development of an

international curriculum and course design.

4. Exchange academic materials, which are made available by bothpa rties.

5. Exchange of staff (faculty) and scholars.

6. Sponsoring cooperative seminars, workshops and otheracademic meetings on matters of mutual interest6.1,The term under which these cooperative endeavors shall be

conducted and shall be determined by mutual consultationas need and opportunities arise

6.2. Proposals for collaborative work may be submitted throughliaison officers specified by institutions. lt is intended that

details of approved projects may be included as Addenda tothis Memorandum of Agreement.

6.3.The final approval of any project is subject to the writtenapproval of both institutions and shall be dependent, in part,

upon the availability ofguaranteed support funds.

CLAUSE 7

NO AGENCY

Nothing contained herein is to be constituted a joint venturepartnership or formal business organization any kind between theParties or so to constitute either Party as the agent of the other.

CLAUSE 8

SUSPENSIION

Each Party reserves the right for reason of national security, nationalinterest, public order or public health to suspend temporarily, either inwhole or in part, the implementation of this Memorandum ofUnderstanding which suspension shall take effect immediately afternotification has been given to the other Party through diplomaticchannel.

through mutual consultation and/or negotiations between the parties,without reference to any third party or internationaltribunal.

CLAUSE 10

CONFIDENTIATITY

1. Each Party will undertake to observe the confidentiality andsecrecy of document, information and other data received fromof supplied to, the other party during the period of theimplementation of this Memorandum of Agreement or any otheragreement made pursuant to this Memorandum of Agreement.

2. ln accordance to paragraph L above, the documents, informationand data herein should not be disclosed by a party (the Disclosingparty) to the other Party (the receiving party) prior to, or after,the execution of the Memorandum of Agreement. The document,information and data relating to technical, business, marketing,policy, know-how, planning, project management and otherdocuments, information, data and/or solutions in any form,information or data which is written as confidential or by itsnature intended to be for the knowledge of the Receiving party orif disseminated orally it is considered in confidentiality.

3. Both Parties agree that the provisions of this article will continueto be binding between the parties notwithstanding thetermination of this Memorandum of Agreement.

PROTECTION OF INTELECTUAT PROPERTY RIGHTS

of the Parties and with other international agreement signed byboth Parties.

The use of the name, logo andlor official emblem of any of theParties on any publication, document and/or paper is prohibitedwithout the prior written approval of either party.

Notwithstanding anything in paragraph j. above, the intellectualproperty rights in respect of any technological development, andany products and services development, carried ouUi. Jointly by the parties or research result obtained through

the joint activity effort of the parties, shall be jointly ownedby the Parties in accordance with the term to be manuallyagreed upon; a nd;

ii. Solely and separately by the party or the research resultobtained through the sole and separate effort of the party,

shall be solely owned by the party concerned.

CLAUSE 12

NOTICE

Any communication under this Memorandum of Agreement shall be inwriting in the English and delivered by registered mail to the address orsent to electronic mail address or facsimile number of INTERNATIONAL

ISIAMiC UNIVERSITY MALAYSTA or the UNtVERStTAs MUHAMMADIYAHYOGYAKARTA, INDONESIA, as the case may be, shown below or to suchother address or electronic mail address or facsimile number as eitherparty may have notified the sender and shall, unless otherwiseprovided herein, be deemed to be duly given or made when deliveredto the recipient at such address or electronic mail address or facsimilenu mber which is duly acknowledged:
