BID DOCUMENT FOR IMPLEMENTATION OFPRADHAN MANTRI FASAL SIMA YOJANA (PMFSY) IN ODISHA DURING RABI-2017-18

(Invitation of bids for selection of Insurance Companies as Implementing Agencies (IA) for"Pradhan Mantri Fasal Sima Yojana (PMFSY)" for Odisha State for Rabi 2017-18 season)

1. Two stage offers/bids (Technical & Financial) are invited from all Insurance Companiesdesignated / empanelled by DAC&FW, Government of India for submission of their Technicalbid (Annexure-I) and financial bid (Annexure-II) for carrying out implementation of "PradhanMantri Fasal Sima Yojana (PMFSY)" in Odisha state during Rabi 2017-18 season.

2. NO EARNEST MONEY IS REQUIRED.

3. The Operational Guidelines (OGs) issued by Government of India would be the finalguidelines for implementation of this scheme and shall prevail in case of any conflict betweenthe clauses in bid document & the OGs.

4. During Rabi 2017-18- season, the PMFBY will be implemented in 30 no of districts (in 6Clusters- Annexure-III) of Odisha State in selected areas for Paddy, Groundnut, Mustard,Black gram, Green gram, Sunflower, Sugarcane, Potato & Onion.

5. Detailed list of notified areas, District wise crop wise sum insured/scale of finance andindemnity levels and ten years yield data (notified area wise) etc. can be downloaded fromwww.odisha.gov.in/all tenders and http://agrisnetodisha.ori.nic.in .

6. Indemnity Level -70% for all crops.

7. Coverage and Exclusions:

a) Coverage of Risks

FOllowing stages of the crop and risks leading to crop loss are covered under the scheme.

i. Prevented Sowing/ Planting Risk: Insured area is prevented from sowing/planting due to deficit rainfall or adverse seasonal conditions.

ii. Standing Crop (Sowing to Harvesting) - Comprehensive risk insurance is providedto cover yield losses due to non-preventable risks viz. Drought, dry spells, flood,inundation, pests and diseases, landslides, natural fire and lightening, storm,hailstorm, cyclone, typhoon, tempest, hurricane and tornado.

iii. Post-Harvest Losses - Coverage is available only up to a maximum period of twoweeks from the harvesting for those crops which are allowed to dry in cut and spreadcondition in the field after harvesting against specific perils of cyclone, cyclonic rainsand unseasonal rains. (last date by which harvesting should have been done ismentioned in seasonality discipline)

iv. Localized Calamities - Loss/damage resulting from occurrence of identifiedlocalized risks of hailstorm, landslide and inundation affecting isolated farms in thenotified area.

v. General exclusions:- Losses arising out of war and nuclear ris s. ~a ous damaqrand other preventable risks (refer para IV.2 of OGs of PMFBY)

b) Coverage of Farmersi. Compulsory component:- All non- defaulting farmers availing Seasonal

Operation (SAO) loans from financial institutions (i.e. loanee farmers) forcrop/s are to be covered compulsorily.

ii. Voluntary component:- The scheme is optional for non-Ioanee farmers. All farmers whohave not availed any crop loan and are willing to get covered under PMFBY canpurchase insurance through Banks/ Insurance Companies / their designated agents.

8. Selection of Insurance Company as Implementing Agency (IA): The final selection of IAfrom the bidders shall be done based on the lowest weighted premium quoted by thecompany for all notified crops within the cluster of districts (refer para XXII1.9 of OperationalGuide(OG) lines of PMFBY). In case any company does not quote for one or more notifiedcrops in various districts within the cluster the bid will be rejected for that cluster. Selection ofImplementing Agency will be made by adopting the cluster approaches as envisaged in OGs.The insurance company quoting Lowest weighted premium rate in the cluster would bedeclared as L-1 (refer para XXII1.9 of OGs of PMFBY for evaluation process) and willimplement PMFBY for both loanee and non-Ioanee farmers. If any company declines afterbeing declared L1, the company may be barred for the coming season and the L2 may begiven the cluster for implementing the crop insurance scheme at L1 district-crop combinationrates and so on to L3, L4 bidder as per the consent of insurance company.

9. Premium rate and subsidy: All farmers (Ioanee or non-loa nee) enrolled under PMFBY wouldbe entitled for subsidy on the premium. Farmers will have to pay maximum 1.5% of the suminsured or actuarial premium rate, whichever is lower, for food crops (all Cereals & Pulses)and oil seeds and maximum 5% of sum insured or actuarial premium rate, whichever is lower,for annual commercial/annual horticulture crops. The difference between the actuarialpremium rate and farmer share would be equally borne by the State Government and CentralGovernment in the ratio of 50:50. Based on the fair estimates of coverage, State Governmentwill ensure to make an advance payment of 50% of subsidy liability to insurance companiesand will settle the balance subsidy payment on submission of final figures by insurancecompanies.

10. Claim liability: Insurers shall be responsible to settle all the admissible claims to be ariseddue to the conditions/eventualities as detailed in paras X1.10, XII, XIV & XV of operationalguidelines of PMFBY. Insurers shall be responsible for payment of claims upto the ceiling asstated in para VillA of Operational guidelines of PMFBY.

11. Bank Services Charges: Bank and other financial institutions etc. shall be paid servicecharges @ 4% of the premium collected from farmers. Rural agents engaged in providinginsurance related services to farmers may be paid appropriate commission as decided by theinsurance company, subject to cap prescribed under IRDAI regulations. Banks may submittheir Invoice in the format prescribed as Annexure-IV.

12. Notification of crops and area: The scheme will operate on the principle of "Area Approach"in the defined areas called Insurance Unit (IU). The scheme in the state will operate onGrampanchayat unit area level for paddy crop. For all other notified crops, Block shall be theinsurance unit. (list of notified crops along with notified village/village panchayat is availableat http://agrisnetodisha.ori.nic.in .

13. Notification of Automatic Weather Stations (AWS) : The list of weather stations shall be asper the State's Notification.

16. Roles & Responsibilities of Insurance CompanyI. Ensuring payment of bank service charges to banks @4% of the premium collected from

banks.II. Providing monthly progress returns/ statistics/ information to State and Central Government.

III. Endeavoring for 100% coverage of the loanee farmers through Banks/Financial Institution,etc.

IV. Facilitate the bank branches/ intermediaries/ agents to upload the details of insured farmersand beneficiaries with all requisite details on Crop Insurance portal within 15 days after cut-off date for collection of premium from farmers.

V. Redressal of all Public Grievances within the time fixed by IRDAI. Provide and adequatelypublicize "Toll Free Number" where farmers can approach for redressal of grievance,intimate claims in case of localized calamity, seek information on coverage, etc.

VI. The coverage of loanee farmers should be carried out by insurance companies themselves.Use of agents / brokers is not allowed.

VII. Marketing and publicity of Scheme, Insurance company will ensure the marketing andpublicity of the scheme and submit a report with photographs to State and CentralGovernment.

VIII. Distribution of Declaration form/proposal form to bank/financial institution branch/soIX. Providing Monthly Progress Reports/ Statistics/ information demanded by the Govt.,(both

State and Central Government).X. Settlement of claims:

a. Localised Calamities: The IA would dispose the claim, if payable, within 30 days ofsurvey of loss.

b. Post Harvest loss: The IA would dispose the claim, if payable within 30 days ofreceipt of loss survey report.

c. In all other cases; IA should settle the claims (if any) within 3 weeks after receipt ofyield data from State Government, as mentioned in the seasonality discipline atpara 15 of this bid document.

XI. Awareness and Publicity - Extensive efforts to generate publicity and create awarenessof PMFBY at grass-root levels / locations including bank branches. Also coordinate withthe States and other agencies for awareness and publicity of the scheme.

XII. Other roles & responsibilities as detailed in para XXIV.3 and XXV of OGs of PMFBY.

17. Roles and Responsibilities of State GovernmentI. Take suitable action for adoption of new technology for early loss assessment and

better administration of scheme. Implementing CCE using handheld devices, recordingcoordinates photographs, etc.

II. Issuance of necessary instructions to Regional Meteorological Centres of IMD and othergovernment! quasi government agencies for supplying weather data on real-time basisto insurance company on actual cost basis.

III. To undertake extensive awareness and publicity campaigns of Scheme amongstfarming community through agriculture and extension Departments to maximizecoverage of the farmers specially non-loa nee farmers.

IV. To develop appropriate mechanism for triangulation of Yield data with Satellite Imagery,NDVI, NDWI etc. along with third part audit through independent empanelled agencies.

V. Submission of yield data for all notified crops and insurance units to insurancecompanies in standard format within stipulated date.

VI. To furnish to the insurance companies the insurance unit wise area sown of insuredcrops within two months from the sowing period.

VII. Assist insurance companies for assessment of crop loss of individual insured farmerscaused by localized perils and also assist in post harvest losses.

VIII. To undertake requisite number of CCE in the notified area following single series, andprovide the yield data to the insurance company within the prescribed cut-off date, alongwith results of individual CCEs.

IX. Allow insurance companies to co-observe and witness CCEs, and permit them toaccess various records including Form-8 at grass root / district / state level used forrecording data of CCEs by States. State shall strengthen audit process of conductingCCE with necessary checks and balances. AudioNideo recording of CCEs shall beimplemented besides other process to ensure accuracy of CCE.

X. State Government will submit CCE's results of all notified crops for notified area instandard format within stipulated date to respective IA.

XI. Other role & responsibilities as detailed in para XXIV.2 of OGs of PMBFY.

18. Dispute Redressal:The Bidding Process, the Tender Documents and the Bids shall be governed by,

and construed in accordance with the laws of India and the competent courts atBhubaneswar shall have exclusive jurisdiction over all disputes arising under, and pursuantto and/or in connection with the Bidding Process. Any dispute relating to bid document andbidding process will be resolved by the SL TC on crop insurance.

Any dispute related to claims of PMFBY will be addressed by District Level MonitoringCommittee of the concerned district.

19. Conditions:i. The selected IA should have a State level office.ii. The Selected Implementing Agencies(IA) should have /will open an office in the

District Head Quarter with regular land line phone apart from mobile phone. One

staff capable to handle the calls should be available in the office. The company is tsubmit details of the office, officer, phone no. etc before getting the work order.

iii. All other conditions mentioned in the Operational Guidelines issued by theDepartment of Agriculture, Cooperation & Farmer Welfare, Ministry of Agriculture &Farmer Welfare, Govt. of India, New Delhi are to be implemented in letter & spirit.

iv. The Director, Agriculture & Food Production-cum-Chairman, SL TC, Odisha reservesthe right to reject any or all tenders without assigning any reasons thereof.

20. Power of exemption:

Observation of above instructions on the part of the tender is strictly obligatory.However, the State Level Technical Committee on crop insurance may in any exceptionalcases exempt a particular tenderer from observing one or more of the instructions / ofstipulations on the recommendations of the Committee.
